Myth #1 I am a salaried employee so I do
not get paid overtime.
Fact #1Salary employees can receive overtime. An employee must qualify for an exemption to be exempt.

Myth #2I work a professional job so I do not qualify for
overtime.
Fact #2People with professional titles and careers are still eligible to receive overtime An employee must qualify and meet 100% of the requirements for an exemption in order to be exempt.
Myth #3
I am a supervisor so I do not qualify for overtime.
Fact #3Supervisors can still be eligible to receive overtime. In order to be exempt a supervisor must fulfill 100% of the requirements to be exempt which include the right to hire or fire, and supervising must take up more than 50% of the supervisors time.
Myth #4I worked overtime this
week and instead of getting paid overtime I am taking
“comp" time.
Fact #4California employers are not allowed to use any “comp” time programs that take overtime hours from one week and give “time off” in another week.
Myth #5
Employees are
responsible to keep track of their own
time and attendance.
Employers are responsible for keeping accurate records of all hours worked.
Fact #5
If an employer doesn’t have detailed and accurate records available during litigation, an employees testimony of what they remember working is sufficient proof.

Myth #6
My travel time from the main office to mobile job sites doesn’t count
towards overtime hours.
Any travel time from the initial place of work to any other work site Is considered work time and eligible for overtime. This includes flight time as well as taxi rides to the airport.
