POLYCHLORINATED TERPHENYLS

PART 1

Objective, Scope, Basis, Definitions and General Principles

Objective

Article 1 - The purpose of this Regulation is to establish the administrative and technical

procedures and principles for the definitive disposal of used polychlorinated biphenyls (PCB)

and polychlorinated biphenyl-containing materials and equipment without endangering

human health and harming the environment.

Scope

Article 2 - (1) This Regulation shall cover

• preparation of the inventory,

• temporary storage,

• transportation,

• decontamination,

• disposal

of polychlorinated biphenyls (PCB) and polychlorinated biphenyl-containing materials and

equipment as well as

• limitations and obligations concerning the import and export,

• measures to be taken,

• inspections to be made,

• related legal and criminal responsibilities

for PCB and PCB-containing materials and equipment.

Legal Basis

Article 3 - (1) This Regulation has been issued (Text: prepared) under subparagraph (g) of

the first paragraph of Article 3, Articles of 8, 11, and 12 of the Law on Environment dated 9

August 1983 No: 2872, and under the provisions of subparagraphs (p) and (s) of the first

paragraph of Article 9 of the Law on the Organization and Duties of the Ministry of

Environment and Forestry dated 1 May 2003 and No: 4856.

Definitions

Article 4 - (1) For the purposes of this Regulation,

a) “Decontamination” means all operations, which enable the recycling, reuse or disposal of

PCB contaminated fluids, equipment and all kinds of materials under safe conditions and the

replacement of fluids in PCB-containing equipment whit non-PCB containing fluids.

b) “The Ministry” means the Ministry of Environment and Forestry

c) “Disposal” means operations to make PCB harmless, by using one or several of the

methods of disposal D 8, D 9, D 10, D 12 and D 15 listed in Annex 6 of this Regulation.

ç) “Holder” means the natural or legal person who is in possession of used polychlorinated

biphenyl (PCB) and polychlorinated biphenyl-containing materials and equipment.

d) “Used PCB” means any PCB which has become waste.

e) Polychlorinated biphenyl (PCB) means:

-1) polychlorinated terphenyls (PCT),

-2) Monomethyl-tetrachlorodiphenyl methane, monomethyl-dichloro-diphenyl methane or

monomethyl-dibromo-diphenyl methane,

-3) any mixture containing more than 50 ppm of polychlorinated biphenyl (PCB),

polychlorinated terphenyls (PCT), monomethyl-tetrachlorodiphenyl methane,

monomethyl-dichloro-diphenyl methane or monomethyl-dibromo-diphenyl methane.

f) “Equipment containing PCB” means any equipment containing PCB or having contained

PCB, which has not been decontaminated as listed in Annex 4; as well as any equipment

which may contain PCB, if not proved otherwise.

General Principles

Article 5 - (1) The principles regarding PCB management are listed below:

a) Holders of used PCB and PCB-containing materials and equipment shall take the necessary

measures to ensure the protection of environment and human health.

b) The import of used PCB, PCB and equipment containing PCBs is not allowed. The

Provisions of the “The Regulation on Control of Hazardous Waste” published in the Official

Gazette dated 14 March 2005 No: 25755 shall apply for the export procedures of used PCBs,

PCBs, and equipment containing PCBs.

c) The manufacture and import of PCBs is not allowed. However, their use as reference

standard in scientific experiments, laboratory analysis and measurements are the exceptions of

the mentioned prohibition.

ç) The materials and equipment, which are subject of Article 12 of this Regulation, must be

decontaminated and/or disposed of by 2025 at the latest.

d) It is prohibited to recover PCB from any material for the purposes of its reuse.

e) Equipment containing PCB which is not subject of the inventory in accordance with Article

12 of this Regulation, or parts with PCB in other equipment, shall be disposed of in licensed

hazardous waste disposal plants.

f) Incineration of PCBs on ships is prohibited (D11).

g) Manufacturers of materials and equipment listed in Annex-4 are obliged to include the

remark “No PCB” in the product description.

ğ) Refilling of transformers having a low insulating fluid level with insulating materials

containing PCB is not allowed. Liquids, which shall be added or replaced, shall comply with

the specifications as defined in subparagraph (b) of the first paragraph of Article 15 of this

Regulation.

h) On the condition that the transformers are in good working order and do not leak, the

maintenance of them can be continued in order to fulfill the technical requirements or the

specifications pertaining to the dielectric quality until the transformers are decontaminated,

taken out of service and / or disposed in accordance with this Regulation. However,

transformers with PCB containing internal components which are damaged shall not be

repaired, they shall be disposed directly.

ı) Expenses for indemnification / compensation of any environmental damage caused by the

management of PCBs shall be paid by natural or legal persons responsible for the pollution

according to the principle “polluter pays”. Expenditures made by public authorities and

institutions due to the lack of the measures to be taken by those responsible to stop,

compensate or reduce environmental damages or due to the measures to be taken directly by

related authorities shall be collected from those responsible under the Law on Collection of

Public Claims No: 6183.

PART 2

Duties, Authorities and Responsibilities

Duties, Authorities and Responsibilities of the Ministry

Article 6 - (1) The Ministry is authorized and responsible in order

a) to provide national and international cooperation and coordination with regard to

implementation of new systems and technologies for the execution of this Regulation,

b) to monitor changes of registered used PCB and PCB containing materials and equipment

by composing the PCB inventory and to update inventories,

c) to make reduction plans and programs in conformity with respective institutions for the

decontamination or disposal of used PCB, materials and equipment containing PCB by the

end of 2025 at the latest,

ç) to issue decontamination and / or disposal licenses.

Duties and Authorities of the Provincial Directorates of Environment and Forestry

Article 7 - (1) The Provincial Directorates of Environmental and Forestry are responsible and

authorized in order

a) to identify holders of used PCB, materials and equipment containing PCB and to ensure

notification of these holders to the Ministry with the PCB Inventory Form given in Annex 3 in

accordance with the provision of Article 12 of the this Regulation,

b) to ensure that holders of used PCB and PCB-containing materials and equipment make

labelling in accordance with Article 11 of this Regulation,

c) to issue transportation licenses in accordance with the provisions of Article 13 of this

Regulation,

ç) to ensure that temporary storage areas shall be established in accordance with the

provisions of Article 14 of this Regulation and to monitor these areas, and

d) to control plants with decontamination or disposal license.

Obligations of PCB holders

Article 8 - (1) PCB holders and holders of materials and equipments containing PCB shall

fulfill following obligations:

a) to notify the Ministry in accordance with the provisions of Article 12 of this Regulation,

and to obtain inventory registration number from the Ministry,

b) to notify the Ministry of any changes in the inventory information with the PCB Inventory

Form in Annex -3 after the decontamination and / or disposal operation,

c) to have PCB analysis performed in accordance with the provisions of Article 10,

ç) to perform labelling operations in accordance with the provisions of Article 11 of this

Directive or to have them performed accordingly,

d) to apply Article 14 with regard to temporary storage areas,

e) to perform transportation operations in accordance with the provisions of Article 13,

f) to take necessary measures in areas containing PCB in accordance with the provisions of

Articles 20, 21 and 22, and

g) to perform decontamination and / or disposal operations or have them performed in

accordance with Articles 15 and 16 or have them performed accordingly.

Obligations of undertakings carrying out the disposal and/or decontamination

Article 9 - (1) Undertakings carrying out decontamination and disposal operations are obliged

a) to obtain the respective license from the Ministry in accordance with the provisions of

Articles 17 and/or 18,

b) to establish the ISO 14001 or an equivalent Environmental Management System within one

year after obtaining the license and to furnish the Ministry with related proof / certificate,

c) to perform PCB analysis in accordance with Article 10,

ç) to apply Articles 20, 21, and 22 in environments with PCB,

d) to perform transportation operations in licensed vehicles,

e) to dispose wastes resulting from the decontamination operations in compliance with the

provisions of Article 16 of this Regulation or have them disposed accordingly,

f) to notify the Ministry regularly of decontaminated or disposed materials and equipment.

PART 3

PCB Analysis, Labelling and Inventory Preparation

PCB analysis

Article 10 - (1) Preliminary detection of PCB content in equipment and insulating fluids shall

be performed. If the result of preliminary detection is 50 ppm and more, quantitative analysis

shall be performed

‒ in laboratories accredited in compliance with the provisions of TS EN 61619 for

insulating fluids;

‒ in laboratories accredited in compliance with the provisions of TS EN 12766 - 1, TS EN

12766 - 2 and TS EN 12766 - 3 for petroleum products and waste oils,

‒ in laboratories authorized by the Ministry.

Labelling

Article 11 - (1) Materials and equipment, which have been identified to contain PCB of 50

ppm and more on the basis of the PCB analysis, shall be labelled in accordance with Part (A)

of Annex -1, and outdoor locations, where such equipments are placed, shall be labelled, in

accordance with Part (B) of Annex -1.

(2) The equipment, which shall be decontaminated in accordance with Article 15, shall be

marked with a label for decontaminated equipment given in Annex - 2 after each

decontamination procedure.

(3) Labels shall be designed to be easily read from at least 2 meters distance and shall be

made out of indelible materials.

Preparation of the Inventory

Article 12 - (1) Holders of materials and equipment containing 5 dm³ (L) and more PCB shall

ensure that they are recorded in the PCB inventory of the Ministry.

(2) In case of capacitor sets, the calculation of the threshold value of 5 dm³ (L) shall be found

as the sum of the volumes of each part of the capacitor containing PCB.

(3) With regard to declarations of materials and equipment which are subject of an inventory,

the PCB Inventory Form given in Annex 3 must be used.

PART 4

Transportation and Temporary Storage

Transportation

Article 13 - (1) Provisions on transportation of the “The Regulation on Control of Hazardous

Wastes” published in the Official Gazette dated 14 March 2005 No: 25755 shall apply with

regard to the transportation of used PCB and materials and equipment containing PCB. All

materials contaminated with PCB during the transportation shall be regarded as hazardous

waste and shall be disposed accordingly. Except for compulsory cases, such transports shall

be performed without discharging the fluids in the equipment. In compulsory cases,

discharged fluids shall be transported with containers located on tracks as a precaution against

shocks and blows. The vehicles shall have box-body, also tools, devices and chemicals for

PCB cleaning shall be available in the vehicles.

Temporary Storage

Article 14 - (1) Materials and equipment taken out of service can be temporarily stored in

designated areas (D15) in indoor facilities having ground impermeability and ventilation.

(2) Equipment with a risk of leaking shall be temporarily stored after discharging the fluid

part. Containers, in which the fluids are poured, shall be marked according to the sample label

as showed in Part (A) of Annex 1; and shall be promptly disposed. Information with regard to

the equipment and materials under temporary storage shall be notified to the Ministry with the

PCB Inventory Form in Annex - 3.

PART 5

Decontamination and Disposal

Decontamination

Article 15 - (1) Transformers containing PCB of 500 ppm and more shall be decontaminated

in accordance with following conditions and terms:

a) The purpose of the decontamination shall be to reduce the PCB level less than 500 ppm and

if possible less than 50 ppm.

b) Replacement fluids, which do not contain PCB and also do not present any harmful risks

for the environment and human health, should be used in transformers.

c) The replacement of the fluid in the transformers shall be performed in order to obtain a

complete decontamination (full decontamination) without the need for PCB disposal

afterwards.

ç) After the decontamination process, transformer labels shall be replaced with labels

providing the new information in accordance with the provisions of Article 11 of the second

paragraph of this Regulation.

(2) Transformers with insulation fluids containing between 50 and 500 ppm PCB shall be

decontaminated, or disposed at the end of their useful lifetime in accordance with

subparagraphs (b) and (c) of the first paragraph of Article 11 of this Regulation. Time

extension for transformers with a useful lifetime which could exceed the term defined in

subparagraph (ç) of the first paragraph of Article 5 shall be evaluated by the Ministry.

(3) Decontamination operations on equipment other than transformers shall be applied

following the approval of the Ministry.

(4) Metals, porcelains, sheet metals and other materials which have a PBC level less than 50

ppm after the decontamination procedure can be recovered except than PCB absorbent

materials like paper, wood, cardboard. Principles for the certification shall be defined in the

frame of the Decontamination License.

Disposal

Article 16 - (1) Materials and equipment listed in Annex 4 and all liquid, solid and viscous

materials, equipment and wastes as cleaning liquids, paper, wood, plastic, fabric and cloth

pieces, protective clothing and equipment, soil, construction and excavation wastes containing

50 ppm PCB and more, shall be disposed at licensed plants according to the “The Regulation

on Control of Hazardous Wastes”

(2) Provisions defined in the “Regulation on Control of Waste Oils" issued in the Official

Gazette dated January 21, 2004, Number 25353, shall be applied for the recovery and disposal

of PCB-containing oils.

(3) Technical standards laid down in the “The Regulation on Control of Hazardous Wastes”

must apply the incineration of PCB according to the D 10 method. On the condition that

biological or physical-chemical procedures meet the requirements of the safe disposal

standards and the available newest technologies, methods other than incineration (D10) can

be implemented.

PART 6

Decontamination and Disposal License

Decontamination License

Article 17 - (1) Natural or legal persons who will perform decontamination of PCB-

containing equipment are obliged to obtain a license from the Ministry. Information and

documents listed in Annex 5 shall be enclosed with the application for the license. The period

of validity of the license is three years. The license cannot be transferred. In necessary cases,

operation permission with a validity no longer than one year can be granted to facilities before

awarding the license.

(2) In case decontamination units are going to be established within maintenance, repair, and

production facilities; a separate section shall be allocated in the facility premises.

Decontamination facilities and units shall be established and operated with the following units

and provisions:

a) Indoor workplace

b) Ground impermeability

c) Temporary storage area for equipment

ç) PCB tanks

d) Fire-fighting equipment

e) Vacuum or manual fluid discharge system

f) Active carbon filter

g) Absorbent materials

ğ) Solvent washing unit for equipment

h) Tanks for washing liquid

ı) Suitable laboratory for detection of PCB

(3) The mass balance charts for quantities of recovered and / or disposed materials and wastes

after the decontamination process shall be prepared and conveyed to the Ministry.

Disposal License

Article 18 - (1) Permissions or licenses shall be granted to the plants, which are going to

perform disposal processes with the methods D10, D12 and D15 as listed in Annex – 6, in

accordance with the provisions of the “The Regulation on Control of Hazardous Wastes”.

(2) Licenses for those methods which are not included within the scope of paragraph (1) of

this Article shall be obtained from the Ministry in accordance with the provisions of this

Regulation. Complex plants, which are going to perform decontamination and disposal

operations in an integrated way, must obtain a disposal license. Plants which are certified by

an accredited organization or a scientific institution that meets the requirements set forth in

the third paragraph of Article 16 of this Directive shall apply for the license with the

documents listed in Annex 5. This license shall be valid for three years. The license cannot be

transferred. The provisions of the “The Regulation on Control of Hazardous Wastes” shall be

applied with regard to the procedure of closing the plants. If necessary, an operation

permission with a period of validity no longer than one year can be granted to plants before

awarding the license.

Cancellation of the License

Article 19

(1) If the Ministry or the Provincial Directorate of Environment and Forestry detects

unconformity with the license or permission in operating the plant, a period from two months

up to six months shall be granted to rectify the deficiency depending on the significance and

source. In case that the Ministry or its relevant Provincial Directorate of Environment and

Forestry detects the continued existence of the deficiency, the operation permission of the

plant shall be cancelled and sanctions in accordance with Article 23 shall be imposed. After

rectification of the deficiency an application in accordance with the provisions of Article 17

or 18 must be made to re-obtain the license.

PART 7

Measures to be taken against PCB

Measures at the worksite

Article 20 - (1) The following general measures shall be taken in areas containing PCB;

a) Provisions of the “Regulation on the Use of Personal Protective Equipment at the

Worksite” published in the Official Gazette dated 11 February 2004 and No: 25370 shall

apply with regard to materials and specifications of protective clothing and respiration masks

of persons dealing with PCBs.

b) Workers cannot leave the worksite with PCB contaminated clothing, and work clothing;

life-cycle of which has expired, shall be regarded as hazardous waste.

c) It shall be not allowed retaining food, eating, and smoking in areas with PCBs. Proper areas

shall be designated in the plant for such purposes.

ç) When leaving the worksite, workers shall clean their bodies with soap and water, and rinse

their bodies with ample amount of water.

d) Indoor worksites and storage areas shall be ventilated in an efficient manner.

e) PCB outlet points, such as covers or valves of the containers and equipment containing

used PCB, shall be closed at all times in worksites and storage areas.

f) Used PCB, materials and equipment containing PCB shall not be kept at the same premises

where flammable materials such as paint, plastic, wood, absorbent, and paper as well as

increasing and reducing chemicals are stored.

g) All equipment shall be visually inspected at least once in a week. It shall be controlled to

find out whether there is any liquid leakage or not. Control results, observations and the

relevant time shall be recorded in the control logbook.

ğ) Doors and external locations of the areas containing PCBs shall be marked according to the

provisions of Part (B) of Annex - 1.

h) Access to the operation site shall be under control.

ı) The staff shall be familiar with operations with used PCB, materials and equipment

containing PCB and shall participate in-service (on the job training) training for such

purposes.

i) An “Emergency Case Plan” shall be prepared to avoid all kinds of risks.

j) With regard to maintenance procedures and accident concurrencies, the reasons, results and

measures shall be recorded in the relevant maintenance and accidents logbook.

Measures to be taken in case of leakage and contamination

Article 21 - (1) The following measures shall be taken against leakage and contamination;

a) The defect causing the leakage shall be remedied.

b) Premises contaminated with PCBs shall be cleaned within 12 hours.

c) Contaminated premises shall be cleaned in two stages. At the first stage, the cleaning shall

be made with absorbent materials. Following the first stage, washing and rinsing operations

shall be performed. PCB shall be determined on the ground and air of the premises after the

cleaning.

ç) Spilled PCB shall be collected with appropriate methods in order to prevent their exposure

of human beings and the environment until the completion of the cleaning operation and

collected PCB and materials used for the cleaning operation shall be regarded as hazardous

waste.

d) Adequate quantity of absorbents shall be available in plants in order to avoid spreading of

spillages and leakages and absorbents shall be stored as such they can be easily accessed in

plants. Used absorbents shall be regarded as hazardous waste.

Measures against fire

Article 22 - (1) The following measures shall be taken against fire;

a) Efficient equipment for fire fighting, ventilation and lightning protection shall be available

in the plant area.

b) Fire fighting and lightning protection equipment and tools shall be available in the

immediate vicinity of equipment containing PCBs and PCB- storage areas.

c) The fire extinguishing system shall be regularly tested and the results shall be recorded in

control logbook.

ç) One person of the staff shall be assigned beforehand to make emergency notification to the

responsible authority in case of fire and the relevant notification shall be made to the said

authority.

d) Foam fire fighting systems and water tank cooling systems shall be available in the plants.

All assigned staff shall have in-service training regarding fire fighting, and shall receive

information on the risks of the gases and other waste, which may generate in such fires.

e) Fire-fighting teams shall wear masks and protective clothing.

f) With regard to the premises in which fire has occurred appropriate measures shall be taken

in order to avoid leakage of PCB, and particularly of materials which not burned totally, in

waters around the site. All ground drainages around the plant shall be blocked. Water used for

fire fighting purposes and cleaning shall be controlled and they shall be regarded as hazardous

waste.

g) Following the extinguishing the fire, the premises shall be surrounded and accesses to the

premises shall be under control. All materials contaminated with fume (including protective

clothing, fire fighting system, etc.) shall be kept in a temporary storage area or in a safe room,

and they shall be regarded as hazardous waste.

ğ) In case of fires in indoor premises, adequate ventilation shall be applied following the fire

extinguishing operation.

h) In case of any fire, fire department and the relevant local administration shall be notified.

PART 8

Miscellaneous and Last Provisions

Breach of the Regulation

Article 23 - (1) In case of breach of the Regulation, respective sanctions shall apply in

accordance with the provisions of Article 15 and subparagraphs (g), (r), (t), (u) and (v) of the

first paragraph of Article 20, and Article 23 of the Law on Environment No: 2872.

Power of Regulation

Article 24 - The Ministry shall be authorized to make all kind of regulations for the

implementation this Regulation, provided there is no contrary provision.

Enforcement

Article 25 - (1) This Regulation shall enter into force on the date of its issue.

Execution

Article 26 - (1) The provisions of this Regulation shall be executed by the Minister of

Environment and Forestry.
