IMPORT CONTROL INVOERBEHEER I, Owen Pieter Faure Horwood, in my capacity as

Minister of Economic Affairs and acting by virtue of the powers vested in me by the Import and. Export Control Act, 1963 (Act 45 of 1963), do hereby prescribe the following regarding import pennits for 1975.

Ek, Owen Pieter Faure Horwood, in my hoedanigheid van Minister van Ekonomiese Sake en handelende kragtens die bevoegdheid my verleen by die Wet op In- en Uitvoerbeheer, 1963 (Wet 45 van 1963). skryf hierby die volgende voor met betrekking tot invoerpermitte vir 1975.

Paragraph 1.-The goods mentioned in this paragraph in column (1) below. and provided for in the respective customs tariff items, as shown in column (2), are hereby exempted from the provisions of Government Notice 1918, dated 6 December 1957, and may be imported into the Republic of South Africa, from any country, without an import permit.

portable power tools and spares therefor, other than those specified in paragraph 4 of this notice;

(ix) ships, boats and all other types of vessels and spares therefor;

(x) Pharmaceutical products and requisites in the finished form, other than those specified in paragraph 4 of this notice;

(xi) fungicides, pesticides and insecticides in the finished form, other than those specified in paragraph 4 of this notice;

(xii) textile piece goods imported by merchants, other than those specified in paragraph 4 of this notice;

(xiii) paper and board imported by merchants.

Note !.-Permits issued for a particular class or kind of goods in terms of this paragraph will not be interchangeable for any other class or kind of goods specified in this paragraph.

Note 2.-Import permits issued in terms of this paragraph will not be valid for the importation of the goods specified in paragraphs 3 and 4 of this notice.

Note 3.-Applications for import permits for the classes and kinds of goods specified in this paragraph must be submitted on the existing prescribed forms or by letter where no form is prescribed.

Paragraph 3.-Permits for the importation of the classes and kinds of goods specified in this paragraph will be granted to individual importers in accordance with quotas determined from time to time.

(i) Wines, all types, including champagne, liqueurs, cordials, mixed potable spirits and. other potable spirits, containing more than 3 per cent of proof spirits; malt liquors;

(ii) all classes and kinds of goods not specified elsewhere in this notice.

Note 1.-Import pern1its issued for ''all classes and kinds of goods not specified elsewhere in this notice" appearing under item (ii) of this paragraph, shall have the same meaning as the meaning previously assigned to "General Merchandise" import permits.

Note 2.-fermits issued for goods under item (ii) of this paragraph will not be valid for goods mentioned under item (i) of this. par~graph, but.will be yalid for the i~portation (?f goods appeanng in paragraph 2, with the exception of agncultural tractors, machinery and spares therefor [paragraph 2, item (iii)] and. components and subassemblies for passenger motor vehicles [paragraph 2, item (v)J.

(ii) uitrusting, masjinerie; toerusting en reserwedele daarvoor, uitgesonderd die wat in paragrnaf 4 van hierdie kennisgewing gespesifiseer is;

(iii) landboutrekkers, -masjinerie en reserwedele daarvoor, uitgesonderd die wat in paragraaf 4 van hierdie kennisgewing gespesifiseer is;

(iv) handelsmotorvoertuie en reserwedele daarvoor; (v) komponente en subsamestelle vir passasiersmotor

voertuie gedek deur 'n asdan geldige vervaardigingsprogram wat deur of namens die Minister van Ekonomiese Sake goedgekeur is;

(vi) vliegtuie en sweefvliegtuie en reserwedele daarvoor; (vii) professionele elektroniese toerusting en reserwe

dele daarvoor; {viii) handgereedskap vir ambagsmanne en werktuig

kundiges, met inbegrip van draagbare kragaangedrewe gereedskap en reserwedele daarvoor, uitgesonderd die wat in paragraaf 4 van hierdie kennisgewing gespesifiseer is;

(ix) skepe, bote en alle ander soorte vaartuie en reserwedele daarvoor;

(x) farmaseutiese produkte en benodigdhede in die finale vorm, uitgesonderd die wat in paragraaf 4 van hierdie kennisgewing gespesifiseer is;

(xi) swamdoders, plaagdoders en insektedoders in die finale vorm, uitgesonderd die wat in paragraaf 4 van hierdie kennisgewing gespesifiseer is;

(xii) tekstielstukgoedere deur handelaars ingevoer, uitgesonderd die wat in paragraaf 4 van hierdie kennisgewing gespesifiseer is;

(xiii) papier en karton deur handelaars ingevoer. 0 pmerking 1.-Permitte wat vir 'n bepaalde klas of soort

goeder.e ingevolge hierdie paragraaf uitgereik is, sal nie uitruilbaar wees vir enige ander klas of soort goedere wat in hierdie paragraaf gespesifiseer is nie.

Opmerking 2.-Invoerpermitte wat kragtcns hierdie paragraaf uitgereik is, sal nie gcldig wees vir die invocr van goedere wat in paragrawe 3 en 4 van hierdie kennisgewing gespesifiseer is nie.

Note 1.-The classes and kinds of goods specified in this paragraph, including maintenance spares and components therefor, may be imported into th.e Republic of South Africa only if the goods are specifically described in the relevant import permit.

Note 2.-Import permits issued in terms of this paragraph will not be valid for any of the classes and kinds of goods specified in paragraphs 2 and 3 of this notice.

Note 3.-Wh.ere applicable, the meaning to be assigned to any description of articles in this paragraph shall be the meaning assigned to similarly numbered items in the First Schedule to the Customs and Excise Act, No. 91 of 1964.

Paragraph 5.-Nothing in this notice absolves an importer from the obligation of also complying w:th the provisions of other legislation relating to the importation of goods into the Republic of South Africa.

Paragraph 6.-The importation of goods mentioned in paragraphs 1, 2. 3 and 4 of this notice is prohibited unless the goods are calibrated to conform with S.I. practice or unless a specific permit for goods which do not conform exclusively with S.I. practice, is obtained.

EXPLANATORY NOTES 1. The attention of importers is directed to the fact that

this notice becomes operative on the date of publication, but its contents are not applicable to 1974 import permits. The expiry date of 1974 import permits is 31 March 1975.

2. Importers are reminded of the following:

(i) Goods should not be shipped unless the importer is in possession of an appropriate valid import permit. Goods which arrive at ports in the Republic of South Africa and for which the importer cannot produce a valid import permit will be deemed to have been imported in contravention of the Import Control Regulations.

(ii) Import permits may not be negotiated, sold or used to the benefit of any firm not named in the import permit, without the prior written approval and consent of the Director of Imports and Exports. Any import permit which appears to have been used in this manner will be cancelled and withdrawn forthwith.

Pamgraaf 5.-Niks in hierdie kennisgewing stel 'n invoerder vry van die verpligting om ook die vereistes van ander wetgewing wat op die invoer van goedere in die Republiek van Suid-Afrika betrekking het, na te kom nie.

Paragraaf 6.---Die invoer van goedere in paragrawe I, 2, 3 en 4 van hierdic kennisgewing vermeld, word verbied, tensy die goedere in ooreenstemming met S.1.-praktyk gekalibreer is of tensy 'n spesifieke permit verkry is vir goedere wat nie uitsluitlik in ooreenstemming met S.I.praktyk gekalibreer is nie.

VERDUIDELIKENDE OPMERKINGS I. Die aandag van invoerders word gevestig op die feit

<lat hierdie kennisgewing in werking tree op die datum van publikasie, maar dat die inhoud daarvan nie van toepassing is op 1974 invoerpermitte nie. Die vervaldatum van 1974 permitte is 31 Maart 1975.

2. Invoerders word aan die volgende herinner: (i) Goedere mag nie verskeep word nie, tensy die

invoerder in besit van 'n toepaslike geldige invoerpermit is. Goedern wat by hawens in die Republiek van SuidAfrika aankom en waarvoor die invoerder geen geldige invoerpermit kan toon nie, sal geag word strydig met die Invoerbeheerregulasies ingevoer te wees.

(ii) Invoerpermitte mag nie verhandel, verkoop of gebruik word ten voordele van enige firma wat nie in die invoerpermit genoem is nie, tensy die skriftelike goedkeuring en toestemming van die Direkteur van Invoer en Uitvoer vooraf verkry is. As dit blyk dat enige invoerpermit op hierdie manier gebruik is, sal dit gekansellcer en onmiddellik ingetrek word.
