Accessing the UK Market The exact rules that will apply at the end of the transition period will depend on the details of any agreement between the EU and the UK concerning their future trading relationship or if no deal is agreed. Free Trade agreement negotiations commenced in March 2020. The envisaged future partnership between the UK and the EU should contain regulatory cooperation in terms of technical regulation for placing construction products on the EU market and in the UK. The UK Government has confirmed plans to introduce import controls on EU goods at the border after the transition period ends on 31 December 2020. This will mean traders will have to submit customs declarations and be liable to goods checks. Prepare for border controls by making sure you have an Economic Operator Registration and Identification (EORI) number and also look into how you will make declarations, including using a cus- toms agent. Products during the Transition Period During the transition period EU law, including the Construction Products Regulation, will continue to apply in the UK. You can continue to use a UK notified body for conformity assessment tasks.

However, you should begin to prepare for the end of the transition period:

• Ask your UK notified body if it is making arrangements move to an EU-27 Member State. • If they have no plans to move you will need to find another EU-27 notified body (see EU NANDO website).

All construction products certified by a UK notified body must be placed on the EU market before the end of the transition period.

Do you import Construction Products from the UK?If you are currently a distributor of construction products from the UK you will continue to be a distributor during the transition period.

If you currently source products from UK suppliers, at the end of the transition period you will become an importer. You will take on additional responsibilities under article 13 of the Construction Products Regulation and you should become familiar with these as soon as possible.

Look at your supply chain.

• Find out the additional responsibilities you will be taking on• Engage with the manufacturers of the products you import • Ensure that you will be able to get the information and assurances you need • Ensure that your details will be included in packaging and product information leaflets

Agrément CertificationNSAI Agrément assesses, specifies testing, and where appropri-ate, issues Agrément certificates confirming that new building products, materials, techniques and equipment are safe and fit for purpose in accordance with the Irish Building Regulations and with the terms of the certificate. Such Agrément certificates may be in addition to, but not conflict with, CE marking and will not be be affected by the outcome of Brexit.

Similarly, the status of British Board of Agrément (BBA) certificates for use in the UK, will not be affected by the outcomes of Brexit.

What Must I Do Now?

If I rely on a UK Notified Body…

• Ask your UK notified body if it is making arrangements to establish in an EU-27 Member State.• If yes, engage with your UK notified body to see what you need to do to transfer certification to their new EU-27 notified body.• If no, check the EU Nando website to find another EU notified body to certify your product. The details of all EU notified bodies are available on the EU Nando website.

Where a manufacturer has transferred from an UK notified body to a new EU-27 notified body, products produced after the transfer must bear the new EU-27 notified body identification number.

• Arrange to have all products CE marked by a UK notified body placed onto the EU market before the end of the transition period.
