PURPOSE: The purpose of this item is to solicit any additional comments or questions on land

development items so staff may prepare a response for the Public Hearing.

BACKGROUND: The November 15, 2017, Board of Supervisors (Board) Public Hearing

includes two (2) Agricultural and Forestal District applications and eight (8) land development

applications.

1. Interim additions to the New Lovettsville, New Catoctin South, New Upperville and

Beaverdam Valley Agricultural and Forestal Districts – Requests in the Catoctin and Blue

Ridge Election Districts to add parcels to above-mentioned Districts. The Agricultural District

Advisory Committee (ADAC) (4-0-2: Courtney and Higgins absent) and Planning

Commission (Commission) (9-0) recommend adding seven additional properties totaling 141

acres to the above-mentioned Districts. The Transportation and Land Use Committee (TLUC)

(9-0) recommends approval of the additions. Staff supports approval.

2. Request for Withdrawal of Land Belonging to Travellers Rest LLC from the New

Mountville Agricultural and Forestal District - A request in the Blue Ridge Election District

to withdraw 50 acres from the New Mountville Agricultural and Forestal District. The ADAC

(4-0-2: Courtney and Higgins absent) and Commission (9-0) support approval of the

withdrawal. The TLUC (9-0) on October 13, 2017, recommended approval. Staff supports

approval.

3. ZMOD-2017-0004/Chick-Fil-A Dulles 20 Center Comprehensive Sign Package - A Sign

Plan (filed as a Zoning Modification (ZMOD) under the 1972 Zoning Ordinance) in the Broad

Run Election District for a Chick-Fil-A restaurant in the Dulles 28 retail center on Pacific

Boulevard. The Commission (9-0) and staff support approval of the plan.

4. ZCPA-2016-0016 & ZMOD-2016-0021/Woodland Road Industrial Park, Section 1, Lot 8

- A Zoning Concept Plan Amendment (ZCPA) and ZMOD in the Sterling Election District to

reduce the width and amount of planting associated with proffered buffer yards for a parcel in

the Woodland Road Industrial Park. The Commission (9-0) and staff support approval of the

changes.

5. ZCPA-2016-0015, ZMOD-2017-0009 & SIDP-2017-0001/Lansdowne Town Center

Fringe - A ZCPA, ZMOD, and Sign Development Plan (SIDP) in the Ashburn Election

District to reduce the amount of office space, add retail and restaurant space, without changing

the previously approved total floor area, and modify a previously approved sign plan at the

Lansdowne Town Center. Zoning modifications reduce buffer width and building setbacks

from Belmont Ridge Road, change required internal block arrangements and how much civic

space is to be included in the Town Center. The discussion at the Commission focused on safe

access to the fringe sites through existing parking areas. The Commission (9-0) and staff

support approval.

6. SPMI-2017-0014/One Loudoun Sign Plan Amendment - A Minor Special Exception

(SPMI) in the Broad Run Election District to modify a previously approved sign plan in One

Loudoun. The new sign plan reflects three new zoning districts and changes to zoning district

boundaries made since the original sign plan was approved. The Commission does not review

SPMI applications. Staff supports approval of the changes.

7. SPEX-2016-0066/James River Petroleum - A Special Exception (SPEX) in the Broad Run

Election District to permit bulk fuel storage in the Planned Development – General Industry

(PD-GI) zoning district. The site is on the east side of Executive Drive at its terminus. The

application is under the 1972 Zoning Ordinance and is not reviewed by the Commission. Staff

supports approval.

8. ZMAP-2016-0020 & ZMOD-2016-0018/Evergreen Commerce Center - A rezoning

(ZMAP) and ZMOD from Planned Development – General Industry (PD-GI) and Planned

Development Commercial Center – Regional Center (PD-CC-RC) to PD-CC-RC in the Blue

Ridge Election District to permit retail commercial uses at the Evergreen Commerce Center at

the intersection of Loudoun County Parkway and Evergreen Mills Road. Modifications

propose to reduce the required yards for buildings and parking from adjoining roads and

property lines. The Commission (9-0) and staff support approval.

9. ZMAP-2016-0017, SPEX-2016-0053, SPEX-2016-0054, & ZMOD-2017-

0015/Commonwealth Center – Requests in the Broad Run Election District at

Commonwealth Center to allow commercial retail uses including a convenience store with gas

pumps and an automobile service station adjacent to Loudoun County Parkway. The site is

zoned Planned Development – Industrial Park (PD-IP) and the proposed zoning is Planned

Development – Commercial Center – Small Regional Center (PD-CC-SC). Modifications

propose reducing or eliminating various yards and setbacks and allowing two points of access

to Loudoun County Parkway. The Commission supports (9-0) approval after considering

additional details about design and use mix. Staff has reservations about the Revised General

Plan (Plan) policy, which does not support the conversion of employment property to retail use

in the Route 28 Business Area and does not support multiple access points from Loudoun

County Parkway.

10. ZMAP-2017-0003, ZMOD-2017-0011 & SPMI-2017-0020/True North Data - Requests to

permit a data center complex on 106 acres in the Catoctin Election District. The site abuts the

north side of Sycolin Road and west side of Goose Creek and is zoned Transitional Residential

– 10 (TR-10). The proposed zoning is Planned Development – Office Park (PD-OP).

Modifications propose to change how tree canopy is calculated, reduce the required sidewalk,

and modify the type of plants used in certain buffers. The Commission debated policy issues

as well as visual and environmental impacts of the project and based on design commitments

and additional data from the applicant, recommends (6-3: Barnes, Scheel, and Lloyd opposed)

approval. Staff cannot support approval because the proposal conflicts with the Plan land use

and environmental policies.

Staff will update the Board on November 8, 2017, and solicit any Supervisor questions or

comments concerning these items so staff can respond at the hearing. Attachment 1 provides an

additional description of each application. Attachment 2 outlines potential applications for

upcoming Board Public Hearings.

2. Nonprofit Organizations’ Requests for Property Tax Exemption by Designation

On September 12, 2017, the FGOEDC voted separately whether certain organizations

should be considered for an ordinance granting the requested property tax exemption. At

the October 3, 2017, Board Business Meeting, Supervisor Letourneau moved the

recommendation of the Finance/Government Operations and Economic Development

Committee that the Board of Supervisors forward the exemption applications for Hero

Homes, Inc. and Makersmiths, Inc., to a Board of Supervisors Public Hearing. (Seconded

by Vice Chairman Buona.) This item presents, Hero Homes, Inc. and Makersmiths, Inc.

applications for exemption from real estate taxes, personal property taxes, or both,

effective January 1, 2018.

3. Proposed Conveyance of County Property – Grant of Easement to Zayo Group, LCC –PIN

#089-36-7079-000 (Broad Run)

Election District: Broad Run

Request to grant Zayo Group, LLC (Zayo), on behalf of Digital Realty Trust (DRT), a

fiber easement on County-Owned land referred to as Land Bay ‘O’ located at the

intersection of Shellhorn Road and Loudoun County Parkway. The requested easement is

proposed as a 10-ft wide and approximately 265.6-ft long, with an area of approximately

2,656 square feet. Zayo has been working with DRT to provide a fiber connection between

DRT’s existing and a new data center that is being constructed nearby.

4. Interim Additions to Agricultural and Forestal Districts

Election District: Blue Ridge & Catoctin

Section 15.2-4309 of the Virginia State Code provides a mechanism for property owners to

add land (Interim Addition applications) to Agricultural and Forestal Districts (AFD) on or

before June 1 of each year. Seven Interim Addition applications have been received that

would add 141.08 acres to four AFDs – New Lovettsville, New Catoctin South,

Beaverdam Valley, and New Upperville AFDs. Once applications to add parcels to AFDs

were received, staff sent notifications by first-class mail to the owners of the properties

adjacent to each parcel (on June 15, 2017), and adjacent property owners had until July 15,

2017, to submit an application to join the other Interim Additions. No additional requests

were received.

At the October 13, 2017 Transportation and Land Use Committee (TLUC) meeting, TLUC

recommended (9-0) that the Board approve the 7 Interim Addition applications, based on

the finding that all parcels recommended for addition to AFDs contain agriculturally and

forestally significant land. At the Planning Commission’s (Commission) September 26,

2017 public hearing, the Commission recommended (9-0) that the Board approve the

Interim Addition applications. At the August 10, 2017 public meeting, the Agricultural

District Advisory Committee (ADAC) recommended (3-0-2: Higgins, Courtney absent)

that the Board approve the Interim Addition applications. Staff supports Board approval of

the 2017 Interim Addition applications to include 7 parcels.

5. Request for Withdrawal of Land Belonging to Travellers Rest LLC from the New

Mountville Agricultural and Forestal District

Election District: Blue Ridge

Travellers Rest LLC of Middleburg,

Virginia, has submitted an application

to withdraw a 50-acre parcel from the

New Mountville Agricultural and

Forestal District (AFD). The applicant

has undertaken a Chapter 11

bankruptcy reorganization and wishes

to remove the property from the New

Mountville AFD to allow the applicant

to pursue entering into a conservation

easement and other use options.

The parcel is located on the east side of

Sam Fred Road (Route 748), south of

Featherbed Farm Road, west of Carters

Farm Lane (Route 627), and north of

John Mosby Highway (Route 50). The

New Mountville AFD currently has a

4-year period that will expire on

January 2, 2021, and is subject to a lot

subdivision minimum of 50 acres.

Withdrawal of the subject parcel will

not reduce the size of the district to

under 200 acres nor will it affect the ability of other parcels to meet geographic

requirements. Withdrawal of property from AFDs is permissible under Section 15.2-4314

of the Code of Virginia of 1950 (Virginia Code) “for good and reasonable cause.”

The TLUC recommended (5-0) approval of the application at a TLUC meeting on October

13, 2017. The Commission recommended (9-0) approval of the application following a

public hearing on September 26, 2017. The ADAC recommended (4-0-2: Courtney,

2017. Staff supports approval of the applicant’s request. The critical action date is at the

pleasure of the Board.

6. ZMOD-2017-0004/Chick-Fil-A Dulles 20 Center Comprehensive Sign Package

Election District: Broad Run

The applicant proposes to increase

the maximum number of signs,

increase the total aggregate sign

area for business signs, and affirm

the sign area of existing menu

signs. To do so, the applicant

requests to modify the applicable

provisions of Section 523 of the

1972 Zoning Ordinance. The

overall sign package is similar to

recent approvals for the franchise.

The existing restaurant occupies

1.04 acres within Dulles 28 Center,

on the east side of Pacific

Boulevard (Route 1036), north of Waxpool Road (Route 625), and west of Sully Road

(Route 28). The Revised General Plan designates this area for Route 28 Core employment

uses.

The Commission held a public hearing on September 26, 2017. There was no public

comment. The Commission forwarded (9-0) the application to the Board with a

recommendation of approval. Staff supports Board approval of the application subject to

Conditions of Approval (Conditions). The critical action date is March 28, 2018.

7. ZCPA-2016-0016 & ZMOD-2016-0021/Woodland Road Industrial Park, Section 1, Lot 8

Election District: Sterling

A application to reduce a previously proffered 50-foot perimeter buffer in the southeast

corner of the subject property and to modify the required side and rear buffer yards.

The subject property is located on the east side of Blackwood Court, north of Woodland

Road in the Woodland Road Industrial Park. The subject property is also located in the PD-

GI (Planned Development – General Industry) zoning district under the 1972 Zoning

Ordinance and the Route 28 Taxing District. The area is governed by the policies of the

Revised General Plan, which designate this area for Route 28 Business.

overall development of retail

space to 55,063 square feet and

decrease the overall office

space to 16,508 square feet with

no change in the overall total

floor area. The applicant is also

requesting to modify the

original sign plan. Lastly, the

applicant is requesting seven

Zoning Modifications (ZMOD)

of the PD-TC (Planned

Development – Town Center)

zoning district standards to

accommodate the proposed

concept plan amendments.

The site, known as Land Bay E1 of the Lansdowne Village Greens, is situated in the

northeast quadrant of the Route 7 and Belmont Ridge Road intersection and does not have

direct access from Route 7. The area is governed by the policies of the Revised General

Plan (Suburban Policy Area (Ashburn Community), which designate this area for Keynote

Employment.

The Commission held a public hearing on July 25, 2017. There were seven public speakers

who voiced the following concerns: introducing two fast food restaurants to the area,

traffic impacts, pedestrian safety, and vehicular congestion within and around the town

center parking lots. The Commission held a Work Session on September 14, 2017. During

the discussion, the applicant presented revised exhibits that showed design changes that

modified the building footprints and locations as well as parking space reconfigurations,

extended Front Street to Ruby Drive, and redesigned head-in parking spaces to angled

parking spaces along Ruby Drive. At a subsequent worksession on September 26, 2017,

the Commission forwarded (9-0) the application to the Board of Supervisors (Board) with

a recommendation of approval. Staff supports Board approval. The applications are ready

for action. The critical action date is November 21, 2017.

9. SPMI-2017-0014/One Loudoun Sign Plan Amendment

Election District: Broad Run

The purpose of this item is to consider amendments to the approved sign development plan

that will incorporate three new zoning districts that have been added to the original

application area for One Loudoun. The proposal will also add signage specifications for

specific tenants who were not known at the time of the original sign development plan.

The property is 83.7 acres in size

and located generally in the

southwestern quadrant of the Harry

Byrd Highway (Route 7) and

Loudoun County Parkway (Route

607) interchange. The Revised

General Plan designates this area for

Keynote Employment.

Requests for SPMIs are not subject

to Planning Commission review and

proceed directly to the Board. Staff

supports Board approval of the

application subject to Conditions.

The critical action date is November

20, 2017.

10. SPEX-2016-0066/James River Petroleum

Election District: Broad Run

The purpose of this item is to consider permitting a petroleum storage and distribution

facility on a 2.07-acre site within the PD-GI (Planned Development – General Industry)

zoning district under the 1972 Zoning Ordinance.

11. ZMAP-2016-0020 & ZMOD-2016-0018/Evergreen Commerce Center

Election District: Blue Ridge

The purpose of this item is to consider rezoning approximately 9.9 acres from PD-GI

(Planned Development – General Industry) and PD-CC-RC (Planned Development –

Commercial Center – Regional

Center) to PD-CC-RC under the

Revised 1993 Zoning Ordinance to

develop a retail center. The applicant

is also requesting Modifications to:

1) reduce the required yards for

buildings and parking along

Evergreen Mills Road and Liberty

Harvest Court, 2) reduce the required

yard for buildings, parking, outdoor

storage, and loading areas along the

northern property boundary, 3)

reduce the building setback along

Evergreen Mills Road, and 4) permit

fewer canopy trees in exchange for

additional understory trees for the Type 3 buffer required along Loudoun County Parkway.

The vacant, 9.9-acre subject property is located at the northwest corner of Evergreen Mills

Road and Loudoun County Parkway. Access will be provided from Liberty Harvest Court,

a future private road connecting Yardley Ridge Drive with Evergreen Mills Road. The

entire site is planned for Industrial uses with the Revised General Plan (Plan). The southern

4.72 acres were rezoned to PD-CC-RC as a part of Arcola Village – The Shops (ZMAP-

2005-0035). This request would replace the previously approved proffers and permit a

new, larger commercial area where industrial uses were planned.

The Commission held a public hearing on September 26, 2017. There was no public

comment. The Commission discussed the change from industrial to commercial land use,

the timing of improvement to extend Liberty Harvest Court to Evergreen Mills Road, and

the proposed modifications. The Commission forwarded (9-0) the application to the Board

of Supervisors (Board) with a recommendation of approval.

Staff supports Board approval of the Zoning Map Amendment subject to Proffers. The

proposal is consistent with recently approved projects adjoining the site and reflects

changing conditions in the area. Staff has reservations about the requested Zoning

Modifications and the lack of information about building and parking locations that would

clarify the need for the requested modifications. Staff recommends forwarding the

application to a Business Meeting noting that the critical action date is November 21, 2017

and an extension would be required.

12. ZMAP-2016-0017, SPEX-2016-0053, SPEX-2016-0054, & ZMOD-2017-

0015/Commonwealth Center

Election District: Broad Run

This proposal would convert 36

acres within Commonwealth Center

from PD-IP (Planned Development

– Industrial Park) to PC-CC-SC

station and/or a convenience food

store with accessory gas pumps.

The 37-acre site is located on the

south side of Route 7 and extends

south on the east side of Loudoun

County Parkway beyond Russell

Branch Parkway. The Revised

General Plan designates this area

for Route 28 Business.

The Planning Commission

(Commission) held a public hearing

on June 27, 2017. There was no

public comment. The Commission

discussed office vacancy rates in the County, along the Route 7 Corridor, and in the One

Loudoun Mixed Use Development. The Commission also discussed the applicant’s

approved site plan for ballfields in Land Bay B and the related Floodplain Alteration

(FPAL). Additional discussion included: the applicant’s lack of design detail and the

feasibility of committing to a certain amount of office space and forwarded the

applications to a Work Session for further discussion.

The Commission held worksessions on September 14, and September 26, 2017. During the

worksessions, the applicant presented language that would provide “four-sided”

architecture facing major roadways and proposed enhanced landscaping. The Commission

forwarded (9-0) the applications to the Board of Supervisors (Board) with a

recommendation of approval.

At this time, staff cannot fully support Board approval. Issues for the Board’s

consideration include: 1) the conversion of retail area to retail use in light of the Route 28

Business Area policies, and 2) Zoning Modifications that are in direct conflict with County

policy, such as the proposed access points from Loudoun County Parkway south of Russell

Branch Parkway. Staff recommends forwarding the application to a Transportation and

Land Use Committee noting that the critical action date is November 15, 2017.

The Commission held a public hearing on the applications on September 26, 2017. One

person spoke in favor of the applications, and seven spoke in opposition. Speaker concerns

respect to the Envision Loudoun process, Sycolin Road traffic impacts, potential chemical

spills, drinking water quality, visibility of the development from Sycolin Road and Goose

Creek, wildlife impacts, and adequacy of stormwater treatment. The Commission

conducted a worksession on October 12, 2017 and based on design and screening

commitments voted (5-3, Scheel, Barnes and Lloyd opposed) to recommend approval.

Staff cannot support the Board’s approval of the applications, as the proposed PD-OP

zoning district and data center land use are inconsistent with Transition Policy Area

policies. The critical action date is May 4, 2018.
