Water & Sewer Oversight Experience

• Responsible for creating, forecasting, and monitoring the City's water & sewer budget, working with both DWSD and the Macomb County Public Works office.

• Established and modernized the City's water & sewer rate structure to include tiered rates, a summer discount, and a fixed component resulting in the City having one of the lowest water & sewer rates of any DWSD community.

Macomb County Executive appoints Brian Baker to Great Lakes Water Authority

Macomb County Executive Mark A. Hackel is confirming his appointment for the Great Lakes Water Authority (GLWA) as Brian Baker, finance and budget director for Sterling Heights. Since 1991, Brian has been directing the city budget and since 2001, additionally directing the city's financing and debt management. He was quickly identified from the local government leaders in Macomb County as their choice for representation on the new authority.

"Brian was a clear leader and insightful tactician from the onset of working with our locals on the new Great Lakes Water Authority," said County Executive Hackel.

The GL WA board will consist of two members from Detroit, one appointee each from Wayne, Oakland and Macomb counties, plus one appointee from the governor's office.

Brian has been serving on the Detroit Water and Sewer (DWSD) Oversight project. Further, he has modernized Sterling Heights own water and sewer rate structure resulting in the lowest rates of any DWSD community. Of patticular interest, is his success at implementing a perfonnance-based budget, labor negotiating experience, management ofthe city's pension board and extensive experience with the bond rating agencies.

"Making sure our locals are represented by their choice is my top priority," said County Executive Hackel.

The County Executive office will now be submitting Brian to the Macomb County Board of Commissioners for confirmation.

Legislative Session Schedule – The 97th Michigan Legislature returned following the November 4th election for one day on Thursday, November 6th for regular session and voting for leadership races. The legislature will return for the week of November 10th and then recess until the first week of December. There are twelve session days scheduled between now and the end of the year, as the “Lame-Duck Session” of the 2013-2014 legislative session is officially underway.

Transportation Infrastructure Funding

In early May, the House passed a package of bills that would yield around $500 million dollars annually to be spent on transportation infrastructure. The bills include several pieces including the repeal of both the 19 cents per gallon on unleaded gas and 15 cents per gallon on diesel gas and replacing both with a 6 cents per gallon wholesale tax. Furthermore, there would be a dedication of 1% of the 6% use tax to roads moving forward, an increase in fees on overweight trucks, and applying sales tax collected on gas to roads.

The House passed House Bills 5492 and 5459 the week of May 6th. HB 5492 earmarks 1 percent of the use tax for the State Trunkline Fund, dollars that have traditionally went into the General Fund. The bill redirects $239.2 million in the 2014-15 fiscal year. These funds would need to be appropriated annually. HB 5459 redirects sales tax revenue from the sales tax on fuel purchases not currently earmarked for schools or local government going to the State Trunkline Fund. The bill would redirect about $130 million in fiscal year 2014-15.

The Speaker has made clear on a number of occasions that this $500 million package was only the first step towards the goal of around $1.5 billion in annual road funding.

During the final weeks before summer recess the Senate debated and considered these bills. In addition, the Senate considered the inclusion of a phased-in increase to the 6% wholesale tax proposed by the House by 1.5% each year for 5 years, eventually yielding over $1.5 billion in annual revenue. Despite the leadership of Senate Majority Leader Randy Richardville and Governor Snyder, the bill failed in several attempts at passage by narrow margins. The House package of bills, and any revenue enhancement that the Senate hoped to achieve will now be under consideration on Thursday, November 13th.

The Governor’s office is working closely with Senate Leadership to achieve the three votes that they fell short before the summer recess.

SB 922 (Sen. Brandenburg) – It is now Public Act 297 of 2014

• The bill was introduced by Sen. Jack Brandenburg with the intent to extend for one year the Dec. 31, 2014 sunset on a law that passed in 2012 amending the Revised Municipal Finance Act, which allowed local governments to borrow money to cover unfunded employee pension liabilities, which is allowed if the local has closed its traditional “defined benefit” pension system to new employees. This includes Macomb County. GCSI worked closely with the bill sponsor to ensure its passage. It is now Public Act 297 of 2014.

HB 5457 (Rep. Lane) - Now Public Act 309 of 2014

An Analysis Provided by The Michigan House Fiscal Agency:

• In 2009, the voters in Macomb County (population 833,493) adopted a county charter which serves as a "constitution" to describe the form and functions of their county government. Only two of Michigan's 83 counties—Macomb and Wayne—have elected to adopt county charters, although any county could do so. When a county's leaders decide to develop a charter, they follow the guidelines in a state statute known as the Michigan

Charter Counties Act. First, a broadly representative group of charter commissioners must be elected to constitute a volunteer charter commission whose members disband when the voters approve or reject the commission's proposed charter. State statute sets the size of the charter commission, and that size varies depending upon the population in a county. In Michigan's most populous counties having more than 600,000 people—Kent, Wayne, Oakland, and Macomb—a charter commission must have between 25 and 35 charter commissioners. For example, Macomb county voters elected 26 charter commissioners on November 4, 2008; the commissioners met regularly for about six months to research and write the county charter, advised by expert legal drafters. The voters adopted their proposed charter on November 3, 2009, (after the governor signed off on a draft in July 2009). The 26 temporary, volunteer Macomb County charter commissioners were elected from the same 26 geographic districts as the County's 26 longer-term county commissioners. In 2009, among the changes Macomb voters adopted in their new county charter was a reduction in the size of the Macomb county commission from 26 to 13 commissioners.

2014 General Elections

Republicans were dominant in Tuesday’s election expanding their majority in the House and Senate and retaining control of the Governor’s office, Attorney General, and Secretary of State. Governor Rick Snyder, Attorney General Bill Schuette and Secretary of State Ruth Johnson were all reelected to office for another four-year term. Republicans maintained their 5-2 majority on the Michigan Supreme Court as incumbents Brian Zahra and David Viviano won as did newcomer Democrat Richard Bernstein. However, Democratic Congressman Gary Peters was elected to the U.S. Senate in a decisive win over former Secretary of State, Terri Lynn Land. In the state House and Senate, Republicans achieved even more impressive results. For the first time since 1954, the Republicans will have 27 of the 38 Senate seats, expanding on their supermajority of 26 last term. The 27th seat will belong to Rep. Margaret Obrien who beat her colleague Rep. Sean McCann in the greater Kalamazoo area by only 60 votes. A recount of these votes is expected, as over 80,000 votes were cast in this election. In the House, Republicans picked up a total of four seats, increasing their majority from 59 seats to 63. They successfully warded off challenges to incumbents and defeated two sitting members of the House (Theresa Abed in the 71st and Collene Lamonte in the 91st). Winning candidates in these seats were Tom Barrett in the 71st and former Rep. Holly Hughes in the 91st. It should be noted that the Hughes’ winning margin over Lamonte currently stands at 58 votes and there will likely be a recount. In addition they flipped two Democrat seats (Segal in the 62nd and Terry Brown in the 84th). Winning candidates were John Bizon in the 62nd and Edward Canfield in the 84th.

AGREEMENT BETWEEN GOVERNMENTAL CONSULTANT SERVICES, INC. AND THE OFFICE OF THE MACOMB COUNTY EXECUTIVE MARK HACKEL

THIS AGREEMENT has been made and entered into this first day of January

2015 by and between Governmental Consultant Services Inc., a Michigan Corporation

with its principal office located at 120 North Washington Square, Ste. 110, Lansing,

Michigan 48933, hereinafter referred to as GCSI and the Office of the Macomb County

Executive Mark Hackel, located at 1 South Main, 81h Floor, Mt. Clemens, Michigan

48043, hereinafter referred to as OCE.

GCSI'S REPRESENTATIONS AND WARRANTIES

1.1 GCSI has been duly organized and validly exists in good standing under

the laws of the State of Michigan. GCSI has Corporate Power to enter into and carry

out this Agreement.

1.2 This Agreement has been duly executed and delivered by its appropriate

Corporate Officers and is duly authorized by its Board of Directors.

CLIENT REPRESENTATIONS

2.1 The "OCE" is the Office of the County Executive. The Home Rule Charter

of Macomb County sets forth the powers and duties of the Executive and his staff,

which constitutes the "OCE". Mark Hackel is the duly elected Executive of the County.

SERVICES

3.1 The OCE does hereby retain GCSI and GCSI does hereby agree to

provide professional lobbying services for the purposes of aiding the OCE and the

County Executive in accomplishing their objectives.

3.2 GCSI recognizes that pursuant to Macomb County's Home Rule Charter,

that the OCE is responsible for intergovernmental relations, administration, economic

development and management of County finances.

3.2 In order to fulfill its obligations under this Agreement, GCSI will:

(a) assign a principal to manage the lobbying activities.

(b) provide weekly updates to Assistant County Executive Melissa Roy

and/or such other person or persons as may be designated by the Executive to receive

such weekly updates on its activities as well as those of the state legislature, state

agencies and the Governor's office that may affect the County.

(c) provide quarterly written reports to the OCE on its activities as well

as those of the state legislature, state agencies and the Governor's office that may

affect the County.

(d) Assist the OCE in positioning, provide advice and lobbying efforts

on behalf of Macomb County for economic development, business retention and

business attraction programs in the County by influencing state policy and

appropriations.

(e) provide information on real or potential challenges to County

finances, administration or its functions.

(f) maintain good standing as a registered lobbyist and that it will

comply with all laws, regulations and reporting required of lobbyists.

(g) monitor and report to the OCE any legislation that is proposed that

would impact county governments and/or the duties, responsibilities and authorities of

countyelected officials.

3.4 GCSI will provide quarterly written reports to the Board of Commissioners,

and appear before the Government Operations Committee, or a committee of the

whole, quarterly- to provide a report with: updates on its activities as well as those of

the state legislature, state agencies and the Governor's office that may affect the

county, and also including trends related to state policy regarding funding and

appropriations, pending legislation, as well as information on emerging issues of interest

to commissioners.

3.5 It is understood and agreed that GCSI's operations hereunder are those of

an independent contractor, and that GCSI has the authority to control and direct the

performance of the details of the services to be rendered and performed. It is further

agreed that GCSI's officers and employees are not employees of the OCE, the

Executive or the County of Macomb and that GCSI is not, except as herein provided,

subject to control by the OCE or the County Executive.

COUNTY POLICIES

4.1 GCSI agrees to abide by all the County policies which GCSI has received

and which were contained in the Request for Proposals which include:

COMPENSATION

5.1 For and in consideration for such services, the OCE agrees to pay GCSI

and GCSI agrees to accept during the term of this Agreement, the sum of $4,500 per

month. Payment for such services shall be made on the first day of each month after

said services are rendered.

COSTS AND EXPENSES

6.1 It is understood and agreed that the compensation recited in Paragraph

5.1 includes usual and ordinary costs and expenses. If it develops that GCSI shall be

exposed to extraordinary costs and expenses, then in that event, the OCE shall assume

and pay those costs providing the nature and circumstances thereof are disclosed to

and approved by the OCE prior to the time the same are incurred.

TERM

7.1 The term of this Agreement shall be for 24 months. This Agreement may

be renewed after each 24 month period provided that 45 days prior to the end of the 24

month term of the Agreement both parties agree to an extension under the same terms

and conditions as existed in the then current Agreement. Either party may terminate

this Agreement with 30 days written notice to the other regardless of any other

provisions contained herein.

transferable or assignable by operation of law or otherwise.

A Proclamation Commending Center Line Reserve Police Unit Captain Gary Watts

For 34 Years of Service

Commissioner Marvin Sauger, On Behalf of the Board of Commissioners,

Offers the Following Proclamation:

Whereas, the Macomb County Board of Commissioners would like to commend Center Line Reserve Police Captain Gary Watts on 34 years of volunteer service with his local police department; and

Whereas, Captain Gary Watts first joined the Center Line Police Reserve Unit on September 3, 1981, where he served as an officer for 12 years, until being promoted to Reserve Squad Leader in 1993. Gary Watts continued to rise through the ranks in the reserve unit; he was promoted to Reserve Sergeant on August 22, 1996, Reserve Lieutenant on May 30, 2000, and Reserve Captain on May 1, 2006; and

Whereas, at least one Sunday a month for the past 34 years, Captain Gary Watts was

dedicated to the residents of Center Line, showing his true commitment to the city and public safety.

Whereas, Captain Gary Watts has been commended for his service as member of the Center Line Police Reserve Unit because of his dedication to public safety through the American Red Cross; and

Whereas, volunteer efforts for Captain Gary Watts have extended beyond just the Center Line community. He has been involved in numerous special details, including assisting the Detroit Police Department the North American International Auto Show and the Major League Baseball All Star Game. Captain Gary Watts all participated in the 10 year 9/11 remembrance ceremony at Comerica Park; and

Whereas, on January 17, 2015 Captain Gary Watts will retire from the Center Line Police

Reserve Unit, but his commitment to the mission of public safety will surely not retire with him; and

Now Therefore, Be It Proclaimed By The Board Of Commissioners, Speaking For And On Behalf Of All County Residents As Follows:
