The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.

(a) Definitions. As used in this provision --

"Economically disadvantaged women-owned small business (EDWOSB) Concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service- (1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner. Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except-- (1) PSC 5510, Lumber and Related Basic Wood Materials; (2) Product or Service Group (PSG) 87, Agricultural Supplies; (3) PSG 88, Live Animals; (4) PSG 89, Subsistence; (5) PSC 9410, Crude Grades of Plant Materials; (6) PSC 9430, Miscellaneous Crude Animal Products, Inedible; (7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products; (8) PSC 9610, Ores; (9) PSC 9620, Minerals, Natural and Synthetic; and (10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology-- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically-- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that-- (1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by-- (i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and (ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and (2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned-- (1) Directly by a parent corporation; or (2) Through another subsidiary of a parent corporation.

Veteran-owned small business concern means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

"Women-owned small business concern" means a small business concern--

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or

(2) Whose management and daily business operations are controlled by one or more women.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)", means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

(b) (1) Annual Representations and Certifications. Any changes provided by the offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications posted electronically on the SAM website.

(2) The offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov. After reviewing the SAM database information, the offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications--Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs ___ .

(b)(4) TECHNICAL QUOTE SUBMISSION REQUIREMENTS.

A technical quote shall be submitted by the offeror in sufficient detail to evaluate

compliance with the requirements of the solicitation and must address the requirements

defined in the Vehicle Specifications Document (Attachment 1). This may include

product literature, or other documents, if necessary. The technical quote is limited to 10

pages. Offerors are also required to complete the Vendor’s Comment section on

Attachment 1 with either a “yes” or “no” in response to whether the proposed vehicles

meet each individual specification.

Offerors shall submit one (1) electronic technical quote in .pdf, or Microsoft Office (e.g.

Word, Excel, etc.) format by e-mail on or before the closing date and time to Ms. Krayn

Chandler, Contract Specialist, email at [email protected]. Offerors are

required to ensure that all attachments are virus free.

Offerors may submit any other information deemed relevant to this offer. Other relevant

information is limited to 10 pages in addition to the 10 pages allowed in the technical

quote.

The electronic copy of the complete quote and any supporting documentation shall be

submitted in .pdf, or Microsoft Office (e.g. Word, Excel, etc.), as applicable by e-mail. If

the electronic copy cannot be retrieved through e-mail, the Contracting Officer will notify

the offeror and a replacement electronic copy shall be provided by the offeror within 1

working day after notification.

Quote Changes – Offerors shall submit quote revisions as required in response to

government initiated evaluation notices or changes as a result of the discussions

negotiations process. Regardless of the number of quote revisions submitted, the integrity

and clarity of each quote must be maintained. All quote updates must meet the following

criteria.

(1) Be submitted in the same number of copies as the original quote.

(2) Changes to quote data shall be submitted as a complete page change for each page on

which a change occurs. A solid black line in the right hand margin shall be used to

identify the lines of text, data or graphics changed.

(3) Each change page shall contain a revision number and date located in the upper right

hand corner of each affected page beneath the offeror’s name and original quote date.

Revisions shall be numbered sequentially, beginning with Revision 1. When a change

requires the removal of an entire page, a blank page shall be submitted and labeled “This

Page Intentionally Left Blank”.

(4) Quote changes shall not exceed the page limitations specified herein.

PRICE QUOTE SUBMISSION REQUIREMENTS.

a. Offerors shall submit all price quotes on the solicitation. Offerors shall include a memo with

the price quote acknowledging the number of amendments to the solicitation that was received.

The solicitation with all prices and other necessary information completed shall constitute the

price quote.

b. Offerors shall complete blocks 12, 17, and 30 of the RFQ, SF1449. By submission of its offer,

the offeror accedes to all solicitation requirements, including terms and conditions,

representations and certifications, and technical requirements, in addition to those identified as

evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation

terms and conditions and provide complete accompanying rationale.

c. Insert proposed unit and extended prices in the SF 1449 CONTINUATION SHEET for

Contract Line Item Number (CLIN) 0001. The extended amount must equal the whole Saudi

Arabian Riyal (SAR) unit price multiplied by the number of units. All unit and total SAR

amounts provided shall be rounded to the nearest SAR.

d. Complete the necessary fill-ins and certifications in provisions included in the RFQ.

e. Format for quote shall be as follows:

1. No less than 12 font.

2. Elaborate formats or color presentations are not desired or required.

Offerors shall submit one electronic price quote by e-mail in .pdf format on or before the closing

date and time to Ms. Karyn Chandler, Contract Specialist, [email protected]. Offerors are required to ensure that all attachments are virus free. The Contract Specialist is the

sole point of contact for this acquisition.

Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm until 15

August 2015.

EVALUATION PROCESS

QUOTE EVALUATION

The Government may award a contract resulting from this solicitation to a responsible offeror(s)

whose offer conforms to the solicitation, price and other factors considered. Offerors are

required to submit a price and technical quote. The following factors shall be used to evaluate

offer:

1. BASIS FOR CONTRACT AWARD This acquisition will be conducted using FAR Part 13.5,

FAR Part 12, and Appendix A of the Department of Defense (DOD) Source Selection

Procedures, Lowest Price Technically Acceptable (LPTA) Source Selection Process as a guide.

This is a best value source selection where best value is expected to result from selection of the

technically acceptable quote with the lowest evaluated price.

a. The evaluation process shall proceed as follows:

(1) Price. The price quotes will be evaluated but not rated. Offeror’s proposed prices will

be determined by multiplying the quantities identified in the Request for Quote (RFQ) by

the proposed unit price for each Contract Line Item Number (CLIN) to confirm to the

extended amounts for each CLIN. The individual CLINs will be totaled to determine the

offeror’s total proposed price. The offeror’s price quote will be evaluated to determine

completeness and reasonableness, as defined below.

(A) Completeness. The quote will be reviewed to determine the extent to which

cost elements have been addressed. The offeror’s price and other supporting

information will be evaluated to ensure continuity and traceability of prices to the

technical quote and between initial quotes and any revisions thereto. The review

will determine the adequacy of the offeror’s quote in addressing and fulfilling the

solicitation requirements.

(B) Reasonableness. The quote will be reviewed to determine price

reasonableness.

(2) Technical. Technical quotes will be evaluated at the factor level on an

acceptable/unacceptable basis, assigning ratings of Acceptable or Unacceptable as

defined below.

Acceptable – Quote clearly meets the minimum requirements of the solicitation.

Unacceptable – Quote does not clearly meet the minimum requirements of the

solicitation.

(A) Measures of merit for this factor are met when the offeror presents a solution

meeting all of the requirements specified in the Vehicle Specifications document

(See Attachment 1). Multiple Awards may result from this soliciation.

(B) Contractor Responsibility – To be eligible for award, the offeror must be

determined responsible as defined in Federal Acquisition Regulation (FAR)

9.104-1. The Government reserves the right to obtain information relative to

present and past performance on its own.

(3) General Considerations – The quote must comply in all material respects with the

requirements of law, regulation and conditions set forth in the solicitation.

(4) The government intends to award a contract without discussions; however, the

government reserves the right to hold discussions. It should be noted that there is no

obligation on the part of the government to make an award to any offeror in response to

this RFQ.

(5) A written notice of award or acceptance of an offer, mailed or otherwise furnished to

the successful offeror within the time for acceptance specified in the offer, shall result in

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.

(a) Definitions. As used in this provision --

"Economically disadvantaged women-owned small business (EDWOSB) Concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service- (1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner. Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except-- (1) PSC 5510, Lumber and Related Basic Wood Materials; (2) Product or Service Group (PSG) 87, Agricultural Supplies; (3) PSG 88, Live Animals; (4) PSG 89, Subsistence; (5) PSC 9410, Crude Grades of Plant Materials; (6) PSC 9430, Miscellaneous Crude Animal Products, Inedible; (7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products; (8) PSC 9610, Ores; (9) PSC 9620, Minerals, Natural and Synthetic; and (10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology-- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically-- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that-- (1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by-- (i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and (ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and (2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned-- (1) Directly by a parent corporation; or (2) Through another subsidiary of a parent corporation.

Veteran-owned small business concern means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

(a) Except as provided in paragraph (b) of this clause, contingent fees, as defined in the Covenant Against Contingent Fees clause of this contract, are generally an allowable cost, provided the fees are paid to--

(1) A bona fide employee of the Contractor; or

(2) A bona fide established commercial or selling agency maintained by the Contractor for the purpose of securing business.

(b) For foreign military sales, unless the contingent fees have been identified and payment approved in writing by the foreign customer before contract award, the following contingent fees are unallowable under this contract:

(1) For sales to the Government(s) of Kingdom of Saudi Arabia, contingent fees in any amount.

(2) For sales to Governments not listed in paragraph (b)(1) of this clause, contingent fees exceeding $50,000 per foreign military sale case.

(b)(4) TECHNICAL QUOTE SUBMISSION REQUIREMENTS.

A technical quote shall be submitted by the offeror in sufficient detail to evaluate

compliance with the requirements of the solicitation and must address the requirements

defined in the Vehicle Specifications Document (Attachment 1). This may include

product literature, or other documents, if necessary. The technical quote is limited to 10

pages. Offerors are also required to complete the Vendor’s Comment section on

Attachment 1 with either a “yes” or “no” in response to whether the proposed vehicles

meet each individual specification.

Offerors shall submit one (1) electronic technical quote in .pdf, or Microsoft Office (e.g.

Word, Excel, etc.) format by e-mail on or before the closing date and time to Ms. Krayn

Chandler, Contract Specialist, email at [email protected]. Offerors are

required to ensure that all attachments are virus free.

Offerors may submit any other information deemed relevant to this offer. Other relevant

information is limited to 10 pages in addition to the 10 pages allowed in the technical

quote.

The electronic copy of the complete quote and any supporting documentation shall be

submitted in .pdf, or Microsoft Office (e.g. Word, Excel, etc.), as applicable by e-mail. If

the electronic copy cannot be retrieved through e-mail, the Contracting Officer will notify

the offeror and a replacement electronic copy shall be provided by the offeror within 1

working day after notification.

Quote Changes – Offerors shall submit quote revisions as required in response to

government initiated evaluation notices or changes as a result of the discussions

negotiations process. Regardless of the number of quote revisions submitted, the integrity

and clarity of each quote must be maintained. All quote updates must meet the following

criteria.

(1) Be submitted in the same number of copies as the original quote.

(2) Changes to quote data shall be submitted as a complete page change for each page on

which a change occurs. A solid black line in the right hand margin shall be used to

identify the lines of text, data or graphics changed.

(3) Each change page shall contain a revision number and date located in the upper right

hand corner of each affected page beneath the offeror’s name and original quote date.

Revisions shall be numbered sequentially, beginning with Revision 1. When a change

requires the removal of an entire page, a blank page shall be submitted and labeled “This

Page Intentionally Left Blank”.

(4) Quote changes shall not exceed the page limitations specified herein.

PRICE QUOTE SUBMISSION REQUIREMENTS.

a. Offerors shall submit all price quotes on the solicitation. Offerors shall include a memo with

the price quote acknowledging the number of amendments to the solicitation that was received.

The solicitation with all prices and other necessary information completed shall constitute the

price quote.

b. Offerors shall complete blocks 12, 17, and 30 of the RFQ, SF1449. By submission of its offer,

the offeror accedes to all solicitation requirements, including terms and conditions,

representations and certifications, and technical requirements, in addition to those identified as

evaluation factors or subfactors. Offerors must clearly identify any exception to the solicitation

terms and conditions and provide complete accompanying rationale.

c. Insert proposed unit and extended prices in the SF 1449 CONTINUATION SHEET for

Contract Line Item Number (CLIN) 0001. The extended amount must equal the whole Saudi

Arabian Riyal (SAR) unit price multiplied by the number of units. All unit and total SAR

amounts provided shall be rounded to the nearest SAR.

d. Complete the necessary fill-ins and certifications in provisions included in the RFQ.

e. Format for quote shall be as follows:

1. No less than 12 font.

2. Elaborate formats or color presentations are not desired or required.

Offerors shall submit one electronic price quote by e-mail in .pdf format on or before the closing

date and time to Ms. Karyn Chandler, Contract Specialist, [email protected]. Offerors are required to ensure that all attachments are virus free. The Contract Specialist is the

sole point of contact for this acquisition.

Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm until 15

August 2015.

EVALUATION PROCESS

QUOTE EVALUATION

The Government may award a contract resulting from this solicitation to a responsible offeror(s)

whose offer conforms to the solicitation, price and other factors considered. Offerors are

required to submit a price and technical quote. The following factors shall be used to evaluate

offer:

1. BASIS FOR CONTRACT AWARD This acquisition will be conducted using FAR Part 13.5,

FAR Part 12, and Appendix A of the Department of Defense (DOD) Source Selection

Procedures, Lowest Price Technically Acceptable (LPTA) Source Selection Process as a guide.

This is a best value source selection where best value is expected to result from selection of the

technically acceptable quote with the lowest evaluated price.

a. The evaluation process shall proceed as follows:

(1) Price. The price quotes will be evaluated but not rated. Offeror’s proposed prices will

be determined by multiplying the quantities identified in the Request for Quote (RFQ) by

the proposed unit price for each Contract Line Item Number (CLIN) to confirm to the

extended amounts for each CLIN. The individual CLINs will be totaled to determine the

offeror’s total proposed price. The offeror’s price quote will be evaluated to determine

completeness and reasonableness, as defined below.

(A) Completeness. The quote will be reviewed to determine the extent to which

cost elements have been addressed. The offeror’s price and other supporting

information will be evaluated to ensure continuity and traceability of prices to the

technical quote and between initial quotes and any revisions thereto. The review

will determine the adequacy of the offeror’s quote in addressing and fulfilling the

solicitation requirements.

(B) Reasonableness. The quote will be reviewed to determine price

reasonableness.

(2) Technical. Technical quotes will be evaluated at the factor level on an

acceptable/unacceptable basis, assigning ratings of Acceptable or Unacceptable as

defined below.

Acceptable – Quote clearly meets the minimum requirements of the solicitation.

Unacceptable – Quote does not clearly meet the minimum requirements of the

solicitation.

(A) Measures of merit for this factor are met when the offeror presents a solution

meeting all of the requirements specified in the Vehicle Specifications document

(See Attachment 1). Multiple Awards may result from this soliciation.

(B) Contractor Responsibility – To be eligible for award, the offeror must be

determined responsible as defined in Federal Acquisition Regulation (FAR)

9.104-1. The Government reserves the right to obtain information relative to

present and past performance on its own.

(3) General Considerations – The quote must comply in all material respects with the

requirements of law, regulation and conditions set forth in the solicitation.

(4) The government intends to award a contract without discussions; however, the

government reserves the right to hold discussions. It should be noted that there is no

obligation on the part of the government to make an award to any offeror in response to

this RFQ.

(5) A written notice of award or acceptance of an offer, mailed or otherwise furnished to

the successful offeror within the time for acceptance specified in the offer, shall result in

a binding contract without further action by either party. Before the offer's specified

expiration time, the Government may accept an offer (or part of an offer), whether or not

there are negotiations after its receipt, unless a written notice of withdrawal is received

before award.

(k) Taxes. The contractor shall be responsible for the payment of the Zakat taxes, customs, or

any government fees that may become due in respect to the execution of this contract.

(o) Warranty. The standard commercial warranty period shall begin upon the acceptance date of

the vehicles.

In accordance with FAR 5.202(a)(12): "The proposed contract action is by a Defense agency and

the proposed contract action will be made and performed outside the United States and its

outlying areas, and only local sources will be solicited.” The only vendors authorized to sell and

distribute the required supplies and/or services here in the Kingdom of Saudi Arabia (KSA) are

local vendors registered in KSA. Therefore, the solicitation will be distributed locally allowing

only authorized local vendors within KSA to be eligible for award.
