DRAFT MINUTES OF THE EXECUTIVE COMMITTEE MEETING

Thursday, September 7, 2017

At the Berkshire Regional Planning Commission Office 1 Fenn Street, Suite 201, Pittsfield, MA 01201

I. Call to Order

A. The meeting is called to order at: 4:00 p.m.

Chair Kyle Hanlon started the meeting by reading a statement regarding the open meeting law. BRPC records all meetings. Others may record the meeting after informing the chair. Any documents presented must be left with the chair of the meeting.

II. Approval of Minutes of Executive Committee Meeting of August 3, 2017 Chuck Ogden moved to approve; seconded by Sam Haupt. Unanimously approved.

III. Financial Reports

A. August Expenditure Report Everyone reviewed the completed expenditure list for August.

Jamie Mullen moved to approve the August Expenditures as presented; seconded by Chuck Ogden. Unanimously approved

B. Accounts Receivable Report

Staff is continuing to follow up on aged receivables over 90 days. None of the aged receivables are at risk.

C. Status of Receipt of Community Assessments for FY 2018 Marianne reported we sent out reminders at the end of August. We are starting to see payments coming in from that reminder. We have 6 communities that have not paid, Adams, Alford, Clarksburg, Hancock, Otis and Sandisfield.

D. Status of Discussions by Regional Planning Agencies and State Retirement Board

Tom recapped as we reported before seven other RPA’s have received large bills for their portion to the retirement system. BRPC has not received any bills because we entered via special legislation. The RPAs have been meeting with the State Retirement Board and the Executive Office for Administration and Finance. It looks like we will be dragged into this at some point in the future but not for any past liability. Tom explained the Vo-tech Schools and Educational Collaboratives have agreed to pay 5.5% of total payroll for their employer portion to the State Retirement Board. BRPC did a calculation to estimate of 5.5% of our payroll would result in about a $60,000 bill that would increase our overhead by 10%. The seven RPA’s would like not to pay past or future money and get special legislation. If the seven RPA’s had to pay the past liability they would go out of business. The feeling is the Executive Office for Administration and Finance is looking for a negotiation and not legislation to resolve the issue. There is a MARPA Directors meeting on September 15th to discuss a proposal to present for negotiation. The idea would be a percentage of payroll going forward and not paying any past liability for the seven RPA’s. This cannot linger on because there is an audit finding for bills not being done since 1972. The retirement board has indicated that BRPC and FRCOG would be pulled in for the future employer’s portion of retirement. For BRPC and FRCOG to be involved legislation would have to be changed. MAPC is currently not involved. The thought of involving MAPC in a legislation change would give the RPA’s additional clout to not involve the RPA’s at all. Marianne commented the RPA’s stressed at the meeting she attended the RPA’s financial constraints. Assessments are capped at 2.5% increase and MassDOT’s cap on overhead is 155%. We will keep the committee posted on the continuing discussions.

E. Other – Due to Grantors on the Balance Sheet Reduction for FY17 and FY18

Marianne reported the difference between MassDOT’s approved rate from the prior years audited financials and the actual overhead rate causes BRPC to owe MassDOT or MassDOT owing BRPC. BRPC sent MassDOT a letter requesting the disposal of one project’s records from 2006. MassDOT approved the disposal, per our accountant BRPC reduced the Due to Grantor amount for the one project. In FY2018, BRPC will request to dispose of the records for all projects older than 7 years old. The potential improvement in BRPC’s balance sheet could be approximately $74,000.

IV. Environmental Review – Notice of Project Change: Daley Development (Lee)

We are reviewing a Notice of Project Change for the Daley Development in Lee. This is a solid waste transfer station on Rte. 102 that we originally reviewed in August 2011. Staff gathered information and drafted a comment letter.

There will be an Environmental Review Committee meeting on Monday September 11th. A site visit is not needed. The comments are due to MEPA no later than September 12th.

Roger Bolton moved to allow the Environmental Review Committee to finalize the comment letter and submit it to the Secretary of Executive Office of Energy and Environmental Affairs; Sheila Irvin seconded. Unanimously approved

V. Delegate and Alternate Issues – None VI. Items Requiring Action

A. Approval to Submit Grant Application to Department of Protection for MS4 (Stormwater) Grant The Executive Committee is requested to authorize the Executive Director to submit a grant application to the Department of Environmental Protection to provide assistance to our municipalities who must comply with the new MS4 municipal stormwater permitting requirements and to sign any resulting agreements and contracts. No BRPC match is required. Tom explained this is a new program to work with communities effected to provide mapping of the infrastructure. We are requesting about $50,000. Sam Haupt moved to approve the Executive Director to submit a grant application to Department of Environmental Protection for MS4 (Stormwater) on behalf of the Commission; seconded by Chuck Ogden. Unanimously approved.

VII. Committee Reports

A. Regional Issues Committee

Jamie reported the next meeting will be October 4th. The topic is Short-Term Housing Rentals and we expect to generate language for municipalities on regulations and land use impacts. Sheila commented on taxes on AirBnB and Bed & Breakfast is also part of the discussion. Jamie invited others to the meeting.

B. Other - none VIII. Executive Director’s Report

A. Report on New Contracts/Agreements Attached is a list of new contracts and agreements entered into and two which were not approved since the August 3rd Executive Committee meeting.

B. Hiring of New Senior Land Use Planner We are very pleased to report that we have hired a new Senior Land Use Planner, Christopher Gruba. Chris will be joining us in mid-September and comes from Michigan. He has about eleven years of land use planning experience in Michigan, Florida and Nevada. We expect he will be able to fill the void we have had since Brian Domina left in not having a planner devoted primarily to land use regulations and planning. A copy of Chris’s resume is attached. Tom explained Chris will be working on zoning and bylaws.

C. Status of Filling Other Open Positions

Tom and Marianne reported the following new staff to be hired and a Subcontractor:

Margaret McDonough – Planner will start September 11th. Heather DeMarsico – Community Development Program Associate will start September 18th. The Transportation Planner position is in its final stages of interviews and an offer will be done tomorrow. Elizabeth Maschmeyer – has been hired as a Public Health Nurse Contractor

D. Workshop on Recreational Marijuana for Municipal Officials – August 31st, Lenox

Town Hall

E. Implementing Best Practices: A Statewide Conference for Municipal Officials and Staff – September 18th, College of the Holy Cross, Worcester

The annual statewide conference on municipal best practices and regionalization is scheduled for Monday, September 18th at the College of the Holy Cross in Worcester. We have not yet seen a final program but it appears to be packed with helpful sessions based on the draft we have seen.

F. 2017 Moving Together Conference – September 28th, Boston Park Plaza Hotel

Attached is the program MassDOT’s Moving Together Conference scheduled for Thursday, September 28th at the Boston Park Plaza Hotel. Further conference information is available at: http://www.umasstransportationcenter.org/assnfe/ev.asp?ID=2778.

G. BRPC Annual Meeting – Thursday, October 19th, Pittsfield Country Club

Tom reported save the date emails have gone out. Kyle reported he was unable to secure Thomas Krens as speaker. After a discussion, the second choice was a presentation about current mill redevelopment efforts ongoing across the county. The following could be on a panel:

• Sal Perry – Greylock Works – North Adams • Steve Sears – Former Crane Stationary Mill - Dalton • Jeff Cohen – Eagle Mill – Lee

Each would be asked to present for 10 – 12 minutes about their project with the intent to show that re-development and moving forward is in fact happening. There was a request to have plans, graphics available for review before the meeting. If none of these folks are willing, then Mayor Linda Tyer would be asked to present about the Pittsfield “Renaissance”

IX. Old Business

A. Committee Membership for FY 2018

We appear to be getting to closure on committee membership for this year (Committee membership list attached). We could use at least one additional member on the Commission Development Committee. We think it would also be advisable to try to actively

recruit new committee members from amongst the delegates and alternates for any of the committees.

B. September 28th BRPC Meeting & Orientation for New Delegates and Alternates

We have ten new delegates or alternates and have polled them to determine if they would prefer to meet for 45 minutes before the Commission meeting with some light “dinner” (wraps/salad) or have some orientation as an initial part of the 7 p.m. meeting. Hopefully we will get some feel for their preference in the next few days . The Orientation will be at 6pm before the Commission meeting. Anyone who would like to attend the training are welcome to share their insights with new members. A presentation and discussion of the data developed for the Massachusetts Rural Policy Advisory Commission and probably their 2017 Annual Report which is waiting on final approval to be released can be presented. We have routine business to approve the Chair’s appointments of Committee Chairs and At-Large Executive Committee members for FY 2018. The executive committee agreed Nat should present the Rural Policy Annual Report. Tom suggested the Community Compacts. This is the 3rd year for this program and Nat and Tom believed the Best Practices (attached) would be good to review with the commission members. All agreed this should be a topic at the September 28th meeting. We could invite Rep. Pignatelli to discuss the study of a new interchange on the MassPike between Lee and Westfield which he successfully had included in the FY 2018 State budget. After a discussion, all agreed not to discuss this at the Commission meeting.

C. Scheduling Executive Director’s Annual Performance Review Nat’s annual performance review will be part of the Executive Committee’s October 5th meeting. A short self-evaluation beforehand will be provided beforehand.

D. Status of Search for New Executive Director

Sheila reported they have a search committee, job description and a budget. Sheila will be setting up a meeting.

E. Other – None

X. New Business

A. Nominations Received for 2017 Charles Kusik Award

Tom handed out another nomination. After a discussion, a motion was made. Chuck Ogden moved to nominate Bobbi Orsi for the 2017 Kusik Award; seconded by Jamie Mullen. Unanimously approved.

B. Surplus Equipment Offered to Towns and Cities Per our established policy, we have offered the attached list of computers and office furniture which is no longer of use to our towns and cities. The folding tables and chairs had been stored in a vacant office in the building which the new building owners are going to use and we don’t have storage space for them, plus we haven’t used them in quite some time.

C. Status of Receipt of Community Assessments for FY 2018

We are pleased to report that all community assessments for FY 2018 have been received. VI. Items Requiring Action

A. Approval to Submit Planning Assistance Grant Application to the Executive Office of Energy and Environmental Affairs to implement age friendly zoning practices in up to three municipalities

The Executive Committee is requested to authorize the Executive Director to submit a grant application to the Executive Office of Energy and Environmental Affairs to implement age friendly zoning practices in up to three municipalities and to sign any resulting contracts. As an implementation issue, updating municipal land use practices to more easily allow multiple options for housing for seniors to remain in their communities is an important one to tackle. This will be a regional application which will develop desired bylaws which then can be adapted for other communities. There is a 25% match required which will be provided through District Local Technical Assistance funds or the Tufts Foundation Age-Friendly grant.

B. Approval to Potentially Submit Other Planning Assistance Grant Applications to the Executive Office

of Energy and Environmental Affairs The Executive Committee is also requested to authorize the Executive Director to submit other Planning Assistance grant applications to the Executive Office of Energy and Environmental Affairs and to sign any resulting contracts. There are several other potential zoning projects which are under consideration in several communities which may be eligible for this new program. We are in discussion with the communities to determine interest and the easiest path forward to obtain this grant funding. Community funds or DLTA funds may be used to provide the 25% match required.

VIII. Executive Director’s Report

A. Report on New Contracts/Agreements

Attached is a list of seven new contracts and agreements entered into and one which was not approved since the September 7th Executive Committee meeting.

B. Hiring of Four New Staff

As was reported at the last Executive Committee meeting, Chris Gruba has joined us as Senior Planner, focusing on land use and community planning. Justin Gilmore joined us as Transportation Planner. Since the last meeting, we have also had Rebecca Haight join us as the Community & Economic Development Program Associate, primarily providing ongoing support to the CDBG program. A copy of Rebecca’s resume is attached. Due to a sudden influx of new work, we have also added Planner William Sikula who will be assisting with the CDBG program and taking on Hazard Mitigation planning activities working with the Environmental and Energy Program. A copy of Bill’s resume is also attached. Also attached is an up-to-date Organizational Chart.

C. Status of Senior Economic Development Planner Position

We are in the process of refilling the Senior Planner focusing on economic development activities both for individual municipalities and for regional programs and projects. Bill Compton resigned last week and we have advertised the position and are receiving applications and begun interviewing promising candidates.

D. BRPC Annual Meeting with Thomas Krens as Guest Speaker – Thursday, October 19th, Country Club of Pittsfield

The Annual Meeting of the Berkshire Regional Planning Commission will be held on the evening of Thursday, October 19th and will be held at the Country Club of Pittsfield. Our guest speaker will be Thomas Krens, Director Emeritus at The Solomon R. Guggenheim Foundation and President of EMRCA, Inc. He will be speaking about The Extreme Model Railroad and Contemporary Architecture Museum proposed in North Adams and the North Adams Cultural Development Plan which has the potential to dramatically further the transition of the northern Berkshire economy and communities. We will also be presenting this year’s Charles Kusik Award for Significant Contributions to Planning in Berkshire County. D. Workforce Skills Planning Facilitated Discussions – Wednesday, October 18th and Thursday, October

19th

Attached is an announcement regarding three opportunities for Berkshire employers to participate in a facilitated discussion to identify regional workforce gaps and to develop strategies and solutions to meet industry needs. A copy of the flyer is attached. Sessions will be held on Wednesday, October 18th from 9:30-11:00 a.m. at BCREB’s office at 66 Allen Street and Thursday, October 19th from 9:00 to 10:30 a.m. at the Red Lion Inn and from 1:00-2:30 p.m. at the Porches in North Adams. Registration is limited to 20 people at each discussion so register early by emailing [email protected].

E. Citizen Planner Training Collaborative Berkshire Workshops – Thursday, November 2nd (Roles and

Responsibilities for Planning & Zoning Boards, Part 2) and Thursday November 9th (Municipal Vulnerability and Resilience Planning), BRPC

Attached is the program of the 2017 fall workshops sponsored by the Citizen Planner Training Collaborative across the state. BRPC will host two workshops, the first on Thursday, November 2nd from 6-8 p.m. on Roles and Responsibilities for Planning & Zoning Boards. The second will be on Thursday, November 9th from 6-8 p.m. on Municipal Vulnerability and Resilience Planning (this second workshop qualifies for AICP credits for the professional planners in the region). G. MassDOT Working Group on Pittsfield to New York City Seasonal Passenger Rail Service

MassDOT has established the working group to begin study of the feasibility of seasonal passenger rail service between Pittsfield and New York City. This study was initiated through the state budget by Senator Hinds and is based on the successful Cape Cod Flyer service. The working group represents a broad set of stakeholders. BRPC is represented by Executive Director Nat Karns with Transportation Program Manager Clete Kus as his alternate. Very preliminary discussions have focused on utilizing CSX-owned track into New York State and the Hudson River line currently utilized by Amtrak and, south of Poughkeepsie, MetroNorth. H. Community Compact Applications for 2018

Applications for FY 2018 Community Compacts may now be submitted. All Berkshire communities are eligible for new Compacts this year, except Lanesborough and Windsor who were approved last year. The list of eligible Best Practices is very extensive and every community should be able to find two items for which they would like assistance. I. Planning Assistance Grant Opportunity from Executive Office of Energy & Environmental Affairs – application deadline October 23, 2017

The Executive Office of Energy & Environmental Affairs has issued a Request for Responses for the 2018 Planning Assistance Grants. This is a great opportunity to obtain funding to update zoning bylaws and for other local planning projects. Responses must be received at EOEEA no later than October 23, 2017. J. Efficiency and Regionalization Grant Opportunity from Division of Local Services – application deadline November 16, 2017

The Division of Local Services has issued a Request for Responses to the FY 2018 Efficiency and Regionalization Grant Program which provides financial support to governmental entities interested in implementing regionalization and other efficiency initiatives that allow for long-term local government sustainability. This has been a valuable source of assistance for projects in the region, particularly ones that were municipal/state commitments under the Community Compact program. The application period opens on October 16th and closes on November 16th. K. Municipal ADA Compliance Grant Opportunity from Massachusetts Office on Disability – application deadline November 17, 2017

The Massachusetts Office on Disability has issued a request for applications to the FY 2018 Municipal Americans with Disabilities (ADA) Improvement Grant Program. This is a great opportunity to get funds to develop an ADA Transition Plan or to carry out ADA improvements. The first round (typically there is a second spring round) deadline is November 17th. L. District Local Technical Assistance Projects for 2018 It is not too soon for municipalities to be considering what assistance they might like to receive from BRPC staff under the 2018 District Local Technical Assistance Program. We are waiting on our contract from the State but expect that in the next several weeks. Priorities have not changed from prior years and focus on planning for growth and housing and on planning for collaborations between municipalities. DLTA has been used to assist communities and the state in meeting Community Compact commitments over the past two years as well. We expect to solicit potential assistance projects from our cities and towns in November and make decisions early in December. IX. Old Business

A. Committee Membership for FY 2018 We have several new committee members as a result of the orientation session and the September Commission meeting (assisted greatly by the sales pitch from our Chair, Kyle Hanlon). Attached is an up-to-date committee membership list.

B. Status of Search for New Executive Director

The Search Committee will hold its first meeting on Tuesday, October 17th at 1:30 p.m. at BRPC. Meetings are public meetings.

X. New Business

A. November 16th BRPC Meeting

Peter Taylor, President of the Berkshire Taconic Community Foundation, has agreed to present A Closer Look, the report resulting from a recent process to learn more about the pressing issues facing the four county region BTCF serves. The Commission Development Committee also has established some topics they would like on future agendas. Based on the discussion from the presentation of the Rural Policy Advisory Commission data at the September Commission meeting, it seems that having presentations by Jonathan Butler of 1Berkshires, Heather Boulger of the Berkshire County Regional Employment Board, and Ellen Kennedy from Berkshire Community College are all on the wish list so we could see if one of them is available (all three at one meeting is too much).

B. Executive Director’s Annual Performance Review

I will send out a brief self-evaluation no later than Wednesday, before the meeting.

Fall 2017 Course DescriptionsRoles and Responsibilities of Planning & Zon-ing Boards, Part 1 (MIIA)Join us if you are a new Board member or build-ing inspector. This program will launch you into your role as a local official, introduce you to the functions of the two boards, and teach you the main tools of planning and zoning.

Roles and Responsibilities of Planning & Zon-ing Boards, Part 2 (MIIA)This session is designed to discuss more ad-vanced topics for new Board members or build-ing inspectors. Part 2 will focus on the Open Meeting, Public Records, and the Conflict of In-terest Laws.

Creating Master Plans (MIIA)Local officials will learn why and how to prepare, adopt, and implement the master or compre-hensive plan described in MGL Chapter 41, Sec-tion D. The session will identify the sections of a master/comprehensive plan and the specific steps by which the plan will be carried out.

How to Hold A Perfect Public Hearing (MIIA)This session covers legal and procedural require-ments for conducting a public hearing. It also contains video clips to assist boards in avoiding constructive approvals, easing tension between parties over controversial projects, and calming chaotic hearings.

Introduction to the Subdivision Control Law and ANR (MIIA)Addresses the purposes of the Subdivision Con-trol Law, important procedural requirements and board responsibilities when reviewing sub-division and ANR plans; adoption of subdivision regulations; review of ANR plans; access issues; preliminary and definitive plans; Planning Board waivers; modifying, amending, and rescinding plans; enforcement; vested rights and zoning freezes. Planning With Community Support (MIIA & AICP)This course describes how to run a planning pro-cess - whether it is for a comprehensive plan or master plan - that will have the support of the community with the amendment and imple-mentation process. It will explain how to work with or without consultants to make plans that result in local action.

How to Read a Subdivision Plan (MIIA)This session explains how topography, roads, lot lines, wetlands, drainage, and utilities are delin-eated on a plan. The information presented will aid boards with the decision-making and nego-tiating process.

Site Plan Review (MIIA)The Zoning Act does not contain any provisions for the review of site plans; however, the process can be a very effective tool for a board to review the details, aesthetics, and impacts of a poten-tial project. This course explains the difference between site plan approval and special permits, the review process, the types of conditions a board may impose, reasons for disapproval, the appeal process, and the types of information a town can require to be shown on a site plan.

Special Permits and Variances (MIIA)Participants will learn the difference between special permits and variances, the issues and criteria for decision-making, timeliness, and pro-cedural requirements.

Recreational Marijuana (AICP)In November 2016, Massachusetts voters ap-proved Ballot Question 4, which legalized the use and possession of marijuana for non-med-ical (“recreational”) purposes. The General Court subsequently made significant changes to the law, which became effective on July 28, 2017 when Governor Baker signed Chapter 55 of the Acts of 2017. This workshop will cover the changes in the law and the impacts on com-munities, local regulation or prohibition of mar-ijuana establishments, optional local taxation, as well as changes to the regulation of medical marijuana. We will discuss how local communi-ties can work within the framework of the law to properly plan for recreational marijuana.

Municipal Vulnerability and Resilience Plan-ning (AICP)This course introduces planning for resiliency to extreme weather and associated vulnerabilities and hazards, including new planning resourc-es from the state (Municipal Vulnerability Pre-paredness program). Learn how to assess local vulnerabilities to weather extremes, how they interact with development, and identify actions to reduce hazard risks and increase resilience in-cluding through use of green infrastructure.

OVERVIEW AND GOALS: The Executive Office of Energy & Environmental Affairs (EEA) hereby offers Massachusetts’ municipalities technical assistance to improve their land use practices. Through this announcement, Matthew Beaton, Secretary of the Executive Office of Energy and Environmental Affairs (the Secretary), makes available grant funding to the Commonwealth’s municipalities and Regional Planning Agencies in support of their efforts to plan, regulate (zone), and act to conserve and develop land consistent with the Massachusetts’ Sustainable Development Principles.

These Planning Assistance Grants are part of an effort to encourage municipalities to implement land use regulations that are consistent with the Baker Administration’s land conservation and development objectives including reduction of land, energy, and natural resource consumption, provision of sufficient and diverse housing, and mitigation of/preparation for climate change. Funds are intended to help communities undertake the public process and retain appropriate technical expertise.

SINGLE OR MULTIPLE DEPARTMENTS MAY CONTRACT UNDER THIS RFR: ALL contracts awarded under this RFR will be utilized solely by EEA. TOTAL ANTICIPATED DURATION OF CONTRACT (S): The contract period will end June 30, 2019 for most contracts issued pursuant to this RFR, and deliverables for these contracts must be received, along with final billing, by July 31, 2019 (exceptions will be handled on a case by case basis and addressed in individual contracts). ANTICIPATED BUDGET: Up to $50,000 per proposal (or per community assisted in the case of multi-jurisdictional proposals) will be available to municipalities, though exceptions may be made at the Secretary’s discretion. Proposals are expected to vary in the amount of funding requested based on the anticipated activity. For example, a community proposing to develop a tree retention bylaw might request $5,000; while a city undertaking a comprehensive re-write of the local zoning ordinance to achieve Master Plan consistency might request the maximum of $50,000. MATCH REQUIREMENT: Respondent budget must represent a minimum non-state match of 25%. Neither District Local Technical Assistance nor Unified Planning Work Program funds are considered “state” funds under this grant, and are eligible for use as match. Respondents may also propose the use of in-kind services from planning professionals as matching funds. Note: Volunteer time will not be accepted for matching purposes. Respondents must submit letters of commitment from all organizations providing matching funds, including the amount to be provided, on the letterhead of the granting organizations. If such funds are not yet formally available, Respondents must include a notice of intent to provide matching funds from the potential funding organizations and the amount that will be provided from each. Respondents may not use any grant funding from any agency of the Commonwealth of Massachusetts as matching funds. Any funding from any non-state grant, public or private, must be accompanied by a letter from the grantor on their letterhead authorizing the use of matching funds.

Respondents may not alter RFR language or any RFR component files. Those submitting a proposal must respond in accordance to the RFR directions and complete only those sections that prompt a Respondent for a response. Modifications to the body of this RFR, specifications, terms and conditions, or which change the intent of this RFR are prohibited. Any unauthorized alterations will disqualify response.

RESPONDENT ELIGIBILITY: This RFR is open to -

Municipalities (individually or as a group with an identified lead community with whom the state will contract). Municipalities are expected, subject to EEA approval, to sub-contract with non-profits, planning consultants, and regional planning agencies to complete approved proposals.

Regional Planning Agencies (RPAs) on behalf of a community or communities for the implementation of specific task (e.g. helping a group of five communities zone for transit oriented development). Note: Applications from RPAs may be weighted on a community-by-community/task-by-task basis in order to ensure equitable scoring. RPAs may, subject to EEA approval, sub-contract with non-profits and planning consultants.

Applications from Regional Planning Agencies require a letter of endorsement from any community, which is the subject of the proposal.

PROJECT DEFINITION: EEA seeks to further implementation of the MA Sustainable Development Principles. Applications that implement techniques found in the Smart Growth Toolkit are desirable. Applicants are encouraged to review the Sustainable Development Principles (see Appendix B) and the Massachusetts Smart Growth Toolkit (see http://www.mass.gov/envir/smart_growth_toolkit/). In order to advance specific priorities $250,000 in funding will be set-aside for each of the following:

1. Zoning for sustainable housing production (e.g. Accessory Dwelling Units, 40R Smart Growth Zoning, Transit Oriented Development, or Mixed-Use zoning);

2. Actions implementing the results of a Climate Vulnerability Assessment – priorities that

were identified either through the Community Resilience Building Framework under the MA Vulnerability Preparedness Program or a similar Climate Vulnerability Assessment;

3. Zoning that results in permanent land conservation (e.g. Natural Resource Protection

Zoning or Transfer of Development Rights); and

4. Mitigation of climate change through zoning and other regulations that reduce energy use and greenhouse gas emissions via a better mix of land uses, more compact growth, enhanced design, etc.

In the event insufficient proposals are received to utilize funds set aside in each of these categories funds will be reassigned at EEA’s discretion to fund other grant proposals.

Responses can be for a project within a single municipality or for an implementation activity across a region. For example, five communities interested in passing a Village Center bylaw are encouraged to submit a regional application. Regional Responses will require the endorsement via a letter of support from any community that is to be the subject of a proposal.

Tasks suitable for funding under this RFR include but are not limited to: o Actions responsive to the four priories listed above:

­ Zoning for sustainable housing production (e.g. Accessory Dwelling Units, 40R Smart Growth Zoning, Transit Oriented Development, or Mixed-Use);

­ Actions implementing the results of a Climate Vulnerability Assessment – priorities that were identified either through the Community Resilience Building Framework under the MA Vulnerability Preparedness Program or a similar Climate Vulnerability Assessment;

­ Zoning that results in permanent land conservation (e.g. Natural Resource Protection Zoning or Transfer of Development Rights); and

○ Rezoning for consistency with a Master Plan or implementation of specific actions or recommendations from a Master Plan.

o Development of a mixed-use zoning district (e.g. mill building reuse, Village Center) o Feasibility studies, land-use analyses, and other plans necessary for successful

redevelopment of sites and buildings o Zoning for agriculture, forestry preservation, or tree retention; o Work necessary to utilize a package wastewater treatment plant to advance

development under village center or other smart growth consistent zoning;

Development of complete streets policy and plans that enable biking and walking o

instead of driving; and o Drafting a Water Conservation Plan that meets state water conservation standards

GRANT REQUIREMENTS: As a condition of funding assistance contracts executed under this RFR will include a clause noting that grant recipients agree to share the end product of the funded activities with EEA and with other communities in the Commonwealth through reports, meetings, workshops, and to highlight these activities in print, on the web or other media outlets. EEA is to be credited for project funding. All contracts resulting from this RFR will require a brief project update every quarter. For regional responses each community must be addressed. These updates will include a summary of tasks achieved and include all public outreach materials created during this period.

Grantees must seek appropriate approval for any plan or regulation produced via a grant from this Program. For example, a vote of town meeting or city council is expected for any zoning developed with grant funds (EEA recognizes that the outcome of the vote cannot be guaranteed). A final

report is also required. This final report must include a copy of the completed tasks as contracted (by-laws, site plans, etc.). An electronic and paper copy of all deliverables must be sent to EEA.

INVOICING: Grant funds will be disbursed on a reimbursement basis. Reimbursement requests should be submitted at least quarterly. Grantees must prepare a final report and invoice upon project completion that details all costs incurred and matching funds provided. Only work completed during the period of the executed contract will be eligible for reimbursement. Upon receipt of all required deliverables the community will be reimbursed for the balance of any grant funds outstanding.

SUBMISSION REQUIREMENTS: Submit an electronic copy of the proposal on appropriate media (CD or memory stick) along with ONE printed original (clearly marked as such) and FOUR printed copies. Each Proposal must clearly indicate that it is an application to the Planning Assistance Grant Program on the title page of the Proposal and on the shipping container used in delivering the Proposal. Failure to provide any of the materials listed below may result in the disqualification of the Proposal. Proposals must be submitted on or before October 23, 2017 at 5:00 PM. A postmark will NOT be accepted for verification of date of submission, though Proposals will be accepted by regular mail & courier in advance of the submission date & time. Proposals will NOT be accepted by fax machine or email.

Project proposals must include the following: A task-by-task description of each element in the project including means of

accomplishment, measures of success, the projected budget on a task-by-task basis, and timeline indicating the anticipated initiation and completion of each task, and total requested funds from EEA;

Budget summary, including anticipated spending in each state fiscal year; Explanation as to how proposed activities meet the evaluation criteria; Proposals should be organized by municipality. For proposals from a single municipality

proposing work for its own benefit, the Anticipated Scope of Work should outline each task as requested above. For proposals from a Regional Planning Agency, tasks for individual municipalities should be clustered in separate municipal groupings. (An example of the proposal format can be found in Appendix A.) Regional proposals must include a letter of endorsement from all participating communities;

A letter(s) committing to at least a 25% local match of the funds requested from EEA; A CD, memory stick, or other medium containing an electronic copy of the proposal; If proposed task is implementing a recommendation from a Master Plan or other plan,

Climate Vulnerability Assessment, or other document include a copy of relevant pages; If proposing zoning or other regulatory revision, please include a specific listing of

bylaws/ordinances or other regulations to be developed;

If selected, the Respondent will be required to submit the following forms to complete a contract: Commonwealth Standard Contract Form, filled out and signed by the Respondent Commonwealth Scope and Budget Form (available from EEA) Completed Contractor Authorized Signature Verification Form.

EVALUATION CRITERIA: Each Response will be scored using the following measures:

Advances sustainable development by directly, quickly, and significantly improving growth; o Establishes by-right zoning that expedites local permitting; o Enhances land use regulation in an area of rapid growth or high natural resource value;

Utilizes funding efficiently; o Assists a community in need (low equalized property valuation per capita); o Benefits an environmental justice neighborhood;

Implements a Master, Climate Change (mitigation or adaptation), Open Space, Housing Production, or other Plan;

Involves more than one municipality collaborating regionally on similar and related tasks; Provides a match above the required 25%; Implements a Smart Growth Toolkit technique; Advances a Community Compact Best Practice commitment; and Demonstrates consistency with the MA Sustainable Development Principles

o Provides for sustainable housing production; o Delivers a substantial energy or environmental benefit (e.g. better climate resilience,

reduced energy use, protection of critical habitats, or reduced greenhouse gas emissions);

o Facilitates walking, biking, and transit use.

NOTE: EEA reserves the option to interview some or all of those submitting a proposal for the purpose of clarifying a proposal prior to making a final award.

PROJECT TERMS: A final contract is subject to successful negotiation of a Final Scope of Services. Please note that EEA does not guarantee that any contracts may result from this RFR or that any particular funding level will be awarded. It is anticipated that projects could commence immediately upon contract execution. The awarded contract will be reviewed during its course and, upon request by the Contractor, may be extended at the sole discretion of EEA for up to one additional year. Any extension granted will not necessarily change, or increase, the monetary value of the contract.

APPENDIX B

Massachusetts Sustainable Development Principles The Commonwealth of Massachusetts shall care for the built and natural environment by promoting sustainable development through integrated energy and environment, housing and economic development, transportation, public health and safety, and other policies, programs, investments, and regulations. The Commonwealth will encourage the coordination and cooperation of all agencies; invest public funds wisely in smart growth and equitable development; and give priority to investments that will deliver good jobs and wages, transit access, housing, and open space, in accordance with the following Sustainable Development Principles. Furthermore, the Commonwealth shall seek, through incentives and assistance, to advance these Principles in partnership with regional and municipal governments, non-profit organizations, businesses, and other stakeholders. 1. Concentrate Development and Mix Uses Support the revitalization of city and town centers and neighborhoods by promoting development that is compact, conserves land, reduces infrastructure and service costs, protects historic resources, integrates uses, enables pedestrian and bicycle access, and connects to transit. Encourage remediation, restoration, and reuse of existing sites, structures, and infrastructure rather than new construction on farm, forest, or other undeveloped land. Create pedestrian and bicycle friendly districts and neighborhoods that mix commercial, civic, cultural, educational, and recreational activities with open spaces and homes. Promote the creation of vibrant public spaces that facilitate strong civic and social engagement, through deliberate planning, design, construction, and management. 2. Advance Equity Promote, through plans, regulations, and investments, equitable sharing of the benefits and burdens of development including access to housing, recreational opportunities, and transportation choices. Provide technical and strategic support for inclusive community planning and decision making to ensure social, economic, and environmental justice. Ensure that the interests of our most vulnerable populations and future generations are not compromised by today's decisions. 3. Make Efficient Decisions Make state and local regulatory, investment, and permitting processes clear, predictable, coordinated, and timely. Ensure that zoning and other development guidelines and regulations result in projects that align with the goals of smart growth, environmental stewardship, and healthy communities. Set goals and track performance to enhance consistency with these Principles. 4. Protect Land and Ecosystems Protect and restore environmentally sensitive lands, natural resources, productive forest and agricultural lands, critical habitats, wetlands and water resources, and cultural and historic landscapes. Increase the quantity, connectivity, quality and accessibility of open spaces and recreational opportunities. 5. Use Natural Resources Wisely Site, design, construct, and promote developments, buildings, and infrastructure that conserve natural resources by reducing waste and pollution through efficient use of land, energy, water, and materials. Operate fleets, facilities, and other assets in a manner that reduces greenhouse gas emissions, costs, and resource consumption. Advance the use and reuse of durable, sustainable materials considering their production, transportation, use, and disposal. Protect, enhance, and restore natural infrastructure and promote ecological design.

6. Expand Housing Opportunities Support the construction and rehabilitation of homes to meet the needs of people of all abilities, income levels, and household types. Build homes near jobs, transit, and where services are available. Encourage energy-efficient design, the use of sustainable materials, and consideration of resiliency to climate change and extreme weather. Foster the development of housing, particularly multifamily and smaller single-family homes, in a way that is compatible with the community's character and vision, while providing new housing choices for people of all means. 7. Provide Transportation Choice Maintain and expand transportation options to enhance mobility, maximize access, promote healthy and active lifestyles, reduce congestion, minimize fuel consumption, improve air quality, reduce greenhouse gas emissions, and ensure the safety of those traveling by all modes. Prioritize rail, bus, boat, rapid and surface transit, shared-vehicle and shared-ride services, bicycling, and walking in order to increase travel by these modes. Consider climate change impacts in transportation planning, project selection, and prioritization, ensuring infrastructure resilience and provision of transportation options during extreme weather events. Distribute resources equitably. Invest strategically in existing and new passenger and freight transportation infrastructure that supports sound economic development and housing construction consistent with smart growth objectives. 8. Increase Job and Business Opportunities Encourage businesses to locate near housing, infrastructure, and transportation options. Promote economic development through policies and programs intended to enhance the business climate in Massachusetts across industry sectors. Expand access to education, training, and entrepreneurial opportunities. Support the growth of local businesses, including sustainable natural resource-based businesses, such as agriculture, forestry, clean energy technology, and fisheries. Protect and enhance the basis of natural resource economies. 9. Mitigate and Adapt to Climate Change Endeavor to limit and prepare for climate change. Reduce greenhouse gas emissions from buildings, electricity generation, transportation, and other sources through decreased consumption of fossil fuels. Maximize energy efficiency and renewable energy opportunities. Support energy conservation strategies, local clean power generation, distributed generation technologies, and innovative industries. Encourage ecological siting and design before mechanical solutions. Protect against hazards in order to enhance resilience and decrease vulnerability to climate change and natural disasters in the natural and built environment. Promote redundancy of critical systems and coordinated regional, state, and local resilience planning in response to climate change and extreme weather events. 10. Plan Regionally Support the collaborative development and implementation of local, regional, state, and interstate plans that are consistent with these Principles. Foster development projects, land and water conservation, transportation and housing that have a regional or multi-community benefit. Consider the long-term ecological, economic, and social costs, benefits, and impacts to the residents and natural resources of the Commonwealth.
