    11235. Theprop0sedMosque/CommunityCenterisbeingbuiltinplaceofasinglefamilyhomepreviously

    occupiedby

    an

    elderly

    couple.

    Once

    completed,

    it

    will

    be

    able

    to

    accommodate

    up

    to

    1,500

    people

    daily,

    yet

    notasingleparkingspothasbeenallocatedforitsuse. Thisfacilityisbeingconstructedwithoutanyregard

    totheimpactonthesurroundingcommunity. Religionmustnotbeanexcuseforzoningviolationsandinappropriatedevelopment. Asresidentsofthecommunity,wedemandthatourrightsbeprotectedaswell.

    AttachedpleasefindBayPeoplesreportNo:2,detailingtheproblemwiththecurrentzoningregulations,

    whichinsteadofprotectingthecommunity,createdloopholesthatarebeingexploitedbythisandsimilar

    constructionprojects. Theseprojectswillcreatenuisanceandwilldestroythequalityoflifeoftheresidents.

    Currentzoningregulationsareindireneedofrevision. Theneighborhoodresidentsobjecttotheautomatic

    asofrightstatusthisconstructionreceivedfromthecity. Theprop0sedMosque/CommunityCenteris

    beingbuiltinplaceofasinglefamilyhomepreviouslyoccupiedbyanelderlycouple.Oncecompleteditwill

    beabletoaccommodateupto1,500peopledaily,yetnotasingleparkingspothasbeenallocated. This

    facilityisbeingconstructedwithoutanyregardtotheimpactonthesurroundingcommunity.AllowingsuchconstructionstobesitedinthecurrentlocationjeopardizesthefundamentalpurposeoftheZRto"promote

    andprotectpublichealth,safetyandgeneralwelfare."AssetforthintheZR,"thezoningdistrictsestablished

    inthisResolution...aredesignedtoguidethefutureuseoftheCity'slandbyencouragingthedevelopment

    ofdesirableresidential,commercialandmanufacturingareaswithappropriategroupingsofcompatibleandrelatedusesandthustopromoteandtoprotectpublichealth,safetyandgeneralwelfare."

    life,yetDepartmentofBuildings(DOB)ignoredallofitwhenitsignedoffonthisproject.DOBhasthepower

    andauthoritytorejectapplications,BoardofStandardsandAppeal(BSA)hasthepowerandauthorityto

    affirmsuchrejectionsinordertopreventabusesthatwouldgoagainstthepurposeoftheZR.

    buildingorganization,dedicatedtoenhancingthequalityoflifeforallNewYorkersandmakingourcitysafer

    Board

    is

    empowered

    by

    the

    City

    ChartertointerpretthemeaningorapplicabilityoftheZoningResolution,BuildingandFireCodes,Multiple

    DwellingLaw,andLaborLaw.Thispowerincludestheabilitytovaryincertaininstancestheprovisionsof

    theseregulations.

    TheCourtofAppealshasmadeclearthattheinterpretationoftheZRbyBSAandDOBmustbe"givengreat

    weightandjudicialdeference,"ithasalsomadeclearthatsuchdeferenceisonlyafforded"solongasthe

    interpretationisneitherirrational,unreasonable,norinconsistentwiththegoverningstatute."Appelbaum,66

    N.Y.2dat97778.

    BSAignored

    the

    evidence

    as

    well

    as

    the

    intent

    of

    the

    ZR

    and

    related

    regulations

    in

    order

    to

    affirm

    DOB's

    approvalofthisMosque/Communitycenter. BSA'sdeterminationisirrational,unreasonable.Thus,BSA's

    decisionisarbitraryandcapriciousandaffectedbyanerroroflawandshouldbeannulled.

    InFischerv.Taub,127Misc.2d518,52526(1stDept1984),theFirstDepartmentstatedthattheplainmeaningoftherelevanttermsmadeclearthat:facilityisthesumofitspartsandnotamanifestationofany

    oneofthem. Accordingly,theMosque/CommunityCentershouldbelookedatasumofallpartsandnotany

    singleonetakenseparately. Thefacilityat2812VoorhiesAvenuehasbeenadvertisingitselfasacommunity

    centerandaspartofthecommunityfacility,theyareplanningtoprovideprayerspace,knownasaMosque,

    butthefacilityitselfisnotaMosque. IfisaCommunityCenter,henceitshouldbetreatedlikeoneand

    parkingshouldbecalculatedbasedonrequirementsapplicabletoaCommunityCenter,notahouseof

    worship. ThebuildershavespecificallyrefrainedfromidentifyingthefacilityasaMosque.Infact,theonly

    documentslistingthisfacilityasahouseofworshiparethedocumentsfiledwiththeDOB,whichwere

    intendedtocircumventtheparkingrequirements.Theparkingrequirementsforahouseofworshiprequire

    onespotper15people,whiletherequirementsforaCommunityCenterareonespotper10people. The

    facilityisclearlymotivatedtofilepaperworkasahouseofworshiptotakeadvantageofthelowerrequired

    numberofparkingspots.However,onlytworoomsonfloors1and2arelistedastheprayerfacility.

    Basementfloorandthethirdfloorarelistedasaccessoryspace,andwillbeusedforthecommunitycenter

    purposes.Thereisnothingpreventingthefacilityfromallowingcommunitycenterusageonfloors1and2.Alternatively,thereisnothingpreventingthefacilityfromopeningupallspaceforprayerandattractinga

    muchlargerthanprojectednumberofworshippers,whichwouldalsorequiremanymoreparkingspotsthan

    currentlyallotted.

    CITYOFFICIALS/ELECTEDPOLITICIANS

    Despitehavingcontactedthelocalpoliticianswithourconcernsabouttheeffectsoftheproposed

    constructiononthecommunity,BayPeoplehavebeenrepeatedlyignored. BayPeopleareappalledbythe

    lackofconcernfortheproblemsoftheneighborhood,andsuspectthatthepoliticiansareafraidand

    unwillingto

    be

    perceived

    as

    opposing

    areligious

    group,

    when

    in

    fact

    they

    are

    being

    asked

    to

    address

    aquality

    oflifeproblem. Thecityofficialsareturningablindeyeonthesituation. BayPeopleacknowledgetheright

    ofareligiousgrouptobuildahouseofworshipandsupportthisright,howeverBayPeoplealsosupportthe

    rightoftheneighborhoodresidentstoenjoytheirpropertyandmaintainacertainqualityoflife. Therightsof

    theneighborhoodresidentsarenolessimportantthantherightsoftheworshipersandmustbetakeninto

    accountwhendeterminingthesizeandeffectsoftheproposedfacility.Whowillprotecttheirrightstoenjoy

    propertyandrightstocontinuedqualityoflife,safety?

    BayPeoplewouldliketoinvitecityofficialsandelectedpoliticianstotakealookattheactualbuildingin

    questionandthesurroundingarea,andtoseeforthemselveshowthisfacilityovershadowsthewholeblock

    andwill,oncecompleted,destroythequalityoflifeintheneighborhood.Seeingthewallsofthestructure

    almostcomplete,

    its

    size

    became

    that

    much

    real

    for

    everyone

    living

    nearby.

    Bay

    People

    stand

    even

    more

    convincedthattheMosque/CommunityCenterwillcreateparking,traffic,noiseandpollutionproblemsthat

    thecommunityistryingtoprevent.

    Thezoninglawaswrittenallowshousesofworshiptogetaroundtheoccupancythresholdwhichwould

    otherwiserequirethemtoprovideparkingspaces. BoroughpresidentMartyMarkowitzagreedwithBay

    Peoplesassessmentthatthelawispoorlywrittenandinsteadofprotectingtherightsoftheneighborhood

    residentsendedupallowingthecreationofthisoversizedstructure.

    BSA'sdeterminationwasaffectedbyanerroroflaw,wasarbitraryandcapriciousandwasanabuseof

    discretion. Therefore,DOB'sapprovalsandissuedpermitsshouldberevoked.

    Allcongregantswillcometothehouseofworshipatthesametimeforthesamepurpose.Thetotalnumberwill

    292asLamisDeek(builderslawyer)statedduringBSAhearing.Theyallfillthemainroomandasecondaryarea

    Themainroomisassignedformenandthesecondroomisassignedforwomen.Duetothissegregationofmen

    andwomenonlynumberofoccupants(men)ofthemainroomwentintocalculationfortheparking.Thewomen

    congregateswerenotaccounted. Thusthenumberoftheoccupantsthatcometothehouseofworshipatthe

    sametimeforthesamepurpose(maximumsimultaneousoccupancy)issignificantlyreduced. Itisalsopossible

    thatthecongregantswillgatherinthecellarandnotonlyonthefirstandsecondfloors. APAapplicationwasfile

    forthecellartobeusedasagatheringroomfor89people,whichcanbehappeningatthesametimeasthe

    services

    on

    the

    first

    and

    second

    floor.

    These

    people

    are

    not

    included

    in

    the

    parking

    requirements

    calculations,

    whichonlytakeintoconsiderationtheoccupantsofthemainroom.

    Theprayertimescheduledoesntlistdifferentprayertimesformenandwomen.Men,womenandchildrenwill

    prayingatthesametimetogether,5timesaday

    ThepresentwaiverwaswrittenfortheLocallyOrientedHousesofWorship. AsstatedintheZoningLawZR253

    cangetwaiverforcongregationoflessthan150people:10spotsx15carsperoneperson.DuringhearingLamis

    Deekstatedthattherewillbe292personsinthemosque. Sothe2812Voorhiesistoobigforalocalhouseof

    worship.Unreducedsimultaneousoccupancywouldrequiremorethentencarspotsallowedbywaiver.

    TheZoningResolutioninthesectionZR12wheredefinitionsoftermsarestateddoesnotgivedefinitionforthe

    roomof

    assembly.

    The

    ZR12

    refers

    to

    the

    definition

    of

    rooms

    as

    it

    given

    in

    the

    Multiple

    Dwelling

    Law.

    The

    MultipleDwellingLawrecognizestwotypesofroomslivingroomandpublicroom

    TheLivingroomasdefinedintheroomthatisusedforsleepingpurposes.Noneoftheroomsinthe2812Voorhiesavenueusedissuch

    Thesecondtypeofroomsispublicroom. Thepublicroomisdefinedasapaceusedincommonbytheoccupantsorbypersonswhoarenottenants. Therefore,theroomsthatareinincommonandthata

    usedforthesamepurposeshouldbeconsideredasonespaceoronepublicroom. Theareaofthese

    roomsshouldbecombinedandusedforthecalculationofthemaximumsimultaneousoccupancy.

    Themainpurposeoftheparkingregulationsistominimizetrafficandtrafficcongestioninthearea. Ascommun

    facilitieshavegrowninnumberandsize,oftenservingregionalpopulations,landuseconflictshavedevelopedan

    localresidents,communitygroupsandelectedofficialshavethereforeaskedthatzoningforcommunityfacilities

    residentialareasbeadjustedtomeetchangedconditions.Thechangesareintendedprimarilytolimitthesizeof

    certaincommunityfacilities,andparkingandtrafficproblems,inthecity'slowestdensityneighborhoods.3

    ThiscommunityfacilityisbeingconstructedinaR4zone. AsperCityPlanningR1R5zonesareconsideredLowe

    DensityDistrictsandtheseareasarecharacterizedbylowbuildingheights,landscapedyardsand high

    automobileownership.Somelowerdensityneighborhoodsare comprisedentirelyofsinglefamilydetache

    homesonlargelots;othershaveone andtwofamilydetachedhomesonsmallerlots.

    The1961ZoningResolutionpermittedcommunityfacilityusesinresidentialdistrictsincreasedbulkbeyondwhawasavailableforresidentialdevelopment.Communityfacilitybuildingsareallowedtohavemorefloorarea,can

    encroachonrearyards,canhavealargerbuildingenvelope.Whilethecityscommunityfacilityzoningregulatio

    haveremainedlargelyunchanged,communityfacilitieshaveproliferatedandareoftendifferenttodaythanthey

    werein1961.Thesefacilitiesaffectthequalityoflifeinmanyofthecity'sresidentialareasandtheCityhasreceiv

    complaintsregardingthelocation,size,traffic,andparkingassociatedwiththem.Asaresponsetovarious

    communityconcerns

    regarding

    the

    zoning

    regulations

    for

    community

    facilities,

    astudy

    of

    these

    issues

    was

    relea

    byCityPlanningin1993.Thestudywasfurtherrefinedfollowingthecompletionofacommunityfacilitiesparkin

    study.Inanefforttorespondtosomeoftherecommendationsfromthestudy,anapplicationforazoningtext

    amendmenttomodifythecommunityfacilitiesregulationsoftheZoningResolutionwassubmittedin1992(CEQNo.92621Y).Apositivedeclarationwasissuedfortheinitialproposal;however,anumberofissuesemergedtha

    requiredfurtherstudy.ResourcelimitationsprecludedCityPlanningfrompursuingtheapplication,anditwas

    subsequentlywithdrawn.Morerecently,inconsultationwiththeCityCouncilsLandUseCommittee,CityPlanni

    identifiedsomeofthemostcommoncommunityconcernsrelatingtoambulatoryhealthcarefacilitiesinonean

    twofamilyresidentialareas,housesofworshipthatdonotprovidesufficientparking,andcommunityfacilitiest

    obstructrearyards.CityPlanningwillcontinuetostudythebroaderrangeofissuesraisedinthe1993study.

    ThepresentrulesintheZoningResolutiondetermineoffstreetparkingrequirementsbasedonthelargestroom

    ofassembly.Usingthelargestroomruledoesnotcontrolthemultiusecommunityfacilitiesandtheirsecondary

    uses.Theparkingshouldbecalculatedbasedonthetotalpublicassemblyoccupancyofthebuilding.Thiswillso

    multiplepublicassembliesinmultiplerooms. Currentlytherearenorulesforthecommunityfacilitytoprovide

    parkingforitsownvehicles(vans,buses)oritsemployees,sotheytakeupstreetparking.

    PotentialImpactsoftheProposedAction:

    NeighborhoodCharacter Thecharacterofaneighborhoodisestablishedbynumerousfactors,includinglandusepatterns,thescaleofitsdevelopment,thedesignofbuildings,thepresenceofnotablelandmarks,andavari

    ofotherfeatures.Thereisapotentialforneighborhoodcharacterimpactsasaresultoftheproposedaction.

    Infrastructure Theproposedtextamendmentcouldresultindevelopmentthatwouldaffectthedemandfor

    waterand/orsanitarysewageandstormwaterdisposal.Thereisapotentialforaninfrastructureimpactasaresu

    oftheproposedaction.

    SolidWasteandSanitationServices Theproposedactionmayaffectdemandforsolidwasteandsanitationservices.Thereisapotentialforasolidwasteandsanitationservicesimpactasaresultoftheproposedaction.

    Trafficand

    Parking

    The

    proposed

    text

    amendment

    to

    community

    facilities

    zoning

    regulations

    might

    result

    inanincreaseinvehiculartrafficintheaffectedareasandincreaseddemandsforparking. Thereisapotentialfora

    trafficandparkingimpactasaresultoftheproposedaction.

    TransitandPedestrians Becausethesechangescouldaffecttransitandpedestrianconditions,thereisapotentialforatransitandpedestriansimpactasaresultoftheproposedaction.

    AirQuality Anairqualityanalysisdeterminesaproposedactionseffectsonambientairquality,oreffectsontheprojectbecauseofambientairquality.Ambientairquality,orthequalityofthesurroundingair,canbeaffect

    byairpollutantsproducedbymotorvehicles(mobilesources);andbyfixedfacilities(stationarysources).The

    changescouldaffectmobilesourceandstationarysourceairquality. Thereisapotentialforanairqualityimpac

    asaresult

    of

    the

    proposed

    action

    July28, 2004 TheCityPlanningCommission(CPC)todayunanimouslyvotedtoapprovezoningreformto

    betterregulatecommunityfacilitiessuchasmedicalofficesandhousesofworshipand reducetheirundesir

    effectsonlowdensityresidentialneighborhoods.

    Itchangesparkingrequirementsfor housesofworshipthathavebecomeincreasinglymoreregionalbut ha

    notprovidedadequateparking,burdeninglowerdensityneighborhoods.

    "Weare delightedtopartnerwiththeCouncilonthiszoningtextchangetoprotectthe characterofour

    neighborhoodsbyreducinglanduse conflictsfromcommunityfacilitiessuchashealthcareofficesand hou

    ofworship.Asthenatureandsizeofhealthcarepracticeshas changed,sotoomustthezoningadaptto

    accommodateneededfacilitiesinwaysthatare lessproblematicforresidentialcommunities.Itisimportan

    toprotectourlowestdensityresidentialneighborhoodsfromfacilitiesthathaveexpandedtoregional

    proportions,"saidMs. Burden,ChairofthePlanningCommission."Inputreceivedduringthe publicreview

    processhas helpedusimprovetheproposal,whichisanimportantfirststepinsolvingthe conflictsbetwee

    suchfacilities

    and

    their

    surrounding

    communities."

    CityCouncilLandUse CommitteeChairMelindaKatz,said,"Thisisagreatstepinprovidingmuchneeded

    relieftoourcommunities.Iamproudoftheexchangebetweenthe council,theadministrationand thepub

    inordertogenerateasolidsolutionthatbenefitssomanyofourneighborhoods.Adaptingzoningchanges

    ensurethestabilityofourcity'severchangingcommunitiesis, and mustcontinuetobe, acitypriority."

    Thekeychangesinthecitywidecommunityfacilitiesregulationsinclude:

    Increasingoffstreetparkingrequirementsforhousesofworship,distinguishingbetweenthosethatserve

    localvs.regionalaudienceand addingflexibilityforhousesofworshiptomeetthesenewrequirements;

    Eliminatingorreducingpermissionfor certaincommunityfacilitiestoobstructrearyards;

    Thechangesareintendedprimarilytolimitthe sizeofcertaincommunityfacilities,andtheirrelatedparkin

    andtrafficimpacts,inthecity'slowestdensityresidentialneighborhoodswhilecontinuingtoallowthem

    ampleopportunitiestolocatewherelanduse conflictswouldbeminimized.

    HousesofWorship Theparkingproblemsoftenassociatedwithhousesofworshipinlowdensity

    neighborhoodswouldbealleviatedunderthenewrules,resultinginabettermatchbetweenthe demanda

    facilitycreatesfor offstreetparking,and the amountofparkingprovided.Inlowerdensityresidence(R1

    throughR5) districts. Yet thesefacilitiesoftenattractlargenumbersofpeoplewhotravelbycar fromwell

    beyondtheneighborhood,creatingtrafficand parkingproblems.

    RearYardConstruction Inordertobetterpreservelightand air toadjoiningresidencesand rearyardview

    aswellaspreserveneighborhoodcharacter,the proposalwouldextendthecurrentprohibitionson

    communityfacilitiesbuildinginarequiredrearyardinthe lowestdensitydistrictsto. Certaintypesof

    communityfacilities

    in

    higher

    density

    residence

    districts

    would

    also

    be

    subject

    to

    greater

    restrictions

    on

    rea

    yearobstructions.

    CONCLUSION:Surroundingresidentsmustbeabletoevaluateandcommentontheconstructionofthisentity.

    BayPeopledontthinkanycommunityfacilityshouldbebuiltatthatlocation. Thefutureoccupantofthisfacility

    couldhavefoundamoresuitablelocationwhichhasenoughroomforabuildingandparking. Thereareplentyo

    availablelotswithinthecommunity;somearenexttopublictransportationvscurrentlocationwhichis12blocks

    awayfromtheB/Qtrainandblocksawayfrombusstops.

    BayPeople,Inc.collectedmorethanathousandofsignaturesfromneighborhoodresidentswhooppose

    constructionunderitscurrentdesignandlocation. ThisMosque/CommunityCentercreatesanobjectionable

    influencein

    aresidential

    area.

    This

    construction

    arouses

    disapproval

    of

    local

    residents

    because

    of

    increased

    traff

    tothearea,lackofparking,loweringofpropertyvalues,increasednoisebyautoandpedestriantrafficandan

    amplifiedcalltoprayer5timesperday.Theplan,design,size,andscopeofthisprojectisdrasticallydifferenttha

    surroundingresidentialhomes.Residentsvoicetheirobjectionstounreasonableinterferencewithenjoymentan

    useoftheirpropertiesbycontactingcityofficialandalloftheseattemptswereignored.Wedemandan

    investigationintothesituationandprotectourrightsandsafety.Wehavearighttoknowwhyaprojectthatis

    clearlyunsafeandunsuitablefortheareaisallowedtocontinuewithnooversight.Thewelfareofthe

    neighborhoodresidentsisbeingignoredundertheguiseofpoliticalcorrectness,wheninfactallweareaskingis

    attentiontoaqualityoflifeproblemandourpropertyrightsarebeingtrampleduponwithnoresponsefrom

    electedofficials.Thousandsoftheneighborhoodresidentsviewthisconstructionforwhatitis:aDOBassisted

    manipulationof

    zoning

    laws

    and

    building

    codes

    by

    the

    developer

    who

    is

    trying

    to

    squeeze

    an

    enormous

    structure

    aquietresidentialblock.Membersofthecommunity,includingBayPeople,havebeenaccusedofIslamophobia,

    bigotry,racialintolerance,whileallwearetryingtodoistodefendourrights.Wearenotopposedtoanyone

    exercisingtheirrighttofreelypracticetheirreligion.Weare,however,opposedtoaconstructionprojectthatis

    puttingourlivesandthelivesofourchildrenindanger.Thisisanillconceivedstructurethatisbeingbuiltinthe

    wrongplace,aplacethatistoosmalltoaccommodatethegrandioseplansofthedevelopers.VoorhiesAvenueis

    small,twolanestreet,thatcannothandletheincreaseintrafficandhasnospaceforparkingofalltheadditional
