TENDER NOTICE FOR PROVIDING HOUSE KEEPING & FACILITY MANAGEMENT SERVICES AT BANK OF BARODA’S OFFICE PREMISES AT VIJAYA TOWERS,M G ROAD, BANGALORE -560001. Bank of Baroda invites tender for above mentioned work from reputed Facility management companies for manning and maintaining various services by engaging manpower as per requirement mentioned in tender document. Tender can be downloaded from Bank’s website:www.bankofbaroda.com(tender section) from 20.02.2020 to 12.03.2020. Application fee- Rs 5000.00 ( Non –refundable) can be paid in form of demand draft drawn in favor of Bank of Baroda. Last date of submission of tender is: 12.03.2020 up to 3.00 pm. Opening of technical bid – 4 pm, 12.03.2020. Bidders are advised to visit the Bank’s office premises at MG Road, Bangalore and acquaint themselves with the site and recent condition of building and fitting, etc. before submission of tender. The time of opening of price bid will be conveyed after scrutiny of technical bids. Bidders need to ensure that all documents sought in the tender are properly attached. Bank will not call for any not submitted documents and reject the application if the missing document is must for qualification. Pre bid meeting – at 3 pm, 28 th February 2020 at 5th floor, Vijaya Towers, MG Road, Bangalore. Any queries related to the Tender shall be sent by fax/mail to GAD ([email protected]) at least 2 days in advance. All bidders are invited to attend the Pre bid meeting. Deviation to any of the terms will not be permitted after freezing of the same at the Pre bid meeting. EMD of Rs.1,00,000.00 (Rs One Lac only) must be submitted along with bids failing which the bidder will be disqualified. (Exemption as per Govt of India Guidelines and with submission of sufficient proof). Withdrawal of tender will entail forfeit of EMD. The period of contract will be initially for 1 year which will be renewed further for 2nd year subject to satisfactory service and at Bank’s own discretion. PRE-QUALIFICATION CRITERIA FOR TENDER

1. The service provider should be duly registered under Shops & Establishments Act. 2. Continuous experience of at least 5 years in the immediate past in carrying out

Housekeeping and Facility Management Services with at least one work of minimum of 1,00,000 sq. ft. Built Up Area in Public Sector Banks /Offices of Public Sector Undertakings, Government/Semi-Government offices.

3. The service provider should have well-equipped office based in Bangalore. 4. The track record of the service provider should be clean and it should not have any

involvement in illegal activities or frauds. 5. Should have proper licenses from labour authorities as per the labour laws, and other

required licenses/permission and documents to carry out the job.

6. The service provider should have GST registration. 7. Must have filed Income Tax returns for last 3 (three) years. 8. Must have Average Annual Turnover for minimum of Rs.26.00 lakhs Per annum during last

three years, ending 31st March 2019 for House Keeping & Facility Management Services. 9. Should have enough trained/experienced/well groomed personnel and manpower to carry

out Housekeeping and Facility Management Services. 10. The service provider should comply with all Central / State statutory laws relating to labour,

legislation including a) Code on wages, 2019 b) Submission of profile of employees engaged by him as per his tender along with

photo copies of appointment letters, certificate of educational qualifications, experience certificates, address proof, duly verified photographs, caste certificates (in case of SC/ST/OBC/Minority), Police Verification Reports etc.

c) Employees Liability Act, including Employees Provident Act,1952 and other miscellaneous Provisions Act 1952, Payment of Gratuity Act, 1972 and Employee State Insurance Act, 1948 and applicable acts, time to time.

d) Contract Labour (Regulation & Abolition) Act. e) Any other Act or Enactment relating thereto and rules framed from there under

from time to time. 11. The service provider shall keep the Bank safe, saved, harmless and indemnified against

claims of any of the workmen and all costs and expenses as may be incurred by the Bank in connection with any such claim that may be made by any workmen or on their behalf. The service provider should indemnify the Bank against the damage/deluges caused by their workmen during the course of executing the contract. The Service Provider shall keep the Bank indemnified from all damages whatsoever arising out of any illegal or immoral activities of the personnel employed by the Service Provider.

12. The bidder should have completed either of the following facility management service contract as under during 7 years (i.e. prior to 31/12/2019): a. One similar work of value not less than Rs 52 Lacs. b. Two similar works of value not less than Rs 32.5 Lacs each. c. Three similar works of value not less than Rs 26 Lacs each.

Document proof: Copies of Work orders & Completion Certificates (self attested) issued from the respective Organizations to be submitted related to the similar works executed during the relative period stated above. Note : Similar work means construction of building, repairs & rehabilitation of buildings etc

IMPORTANT NOTES TO TENDERERS

1. The intending bidders should note the Pre-Qualification Criteria for tender and those who full-fill the criteria only shall submit their tenders.

2. The bidder shall carefully study all the conditions mentioned here under as well as other

General conditions before submitting the bids.

3. Intending tenderers shall visit Vijaya Towers and make themselves thoroughly acquainted with local site conditions, nature and requirement of work, present conditions of premises / fittings / fixtures, etc., and make assessment of labour and material, etc. required before quoting for the tender.

A Brief on the building is given below :- The building has 2 basements, Ground, Mezzanine-1, Mezzanine-2 and 10 upper floors with total built up area of 1,67,500 sq.ft.. The present staff strength in the building is around 600. The construction of the building was completed and occupied by the Bank since 1987. The Building has been provided with State of the Art Mechanical, Electrical & Electronic Equipments.

4. Scope of Work – Bank of Baroda intends to avail services for Housekeeping & maintenance of its premises at Vijaya Towers, M G Road, Bangalore. The service provider is required to provide qualified and experienced personnel to discharge following functions:-

5. Working Days: All Sundays and National Holidays will be non working days. In addition to that, Holi, Diwali, Eid, Chrismas, Dussehra and Ambedkar Jayanti will be treated as Holidays. All other days will be working days even if the same is non-working day for the Bank.

6. Period of contract - The contract will be for a period of 12 months commencing from the date of award of contract, which may be further extended at the sole discretion of the Bank for another one year. However, Bank reserves its right to review and terminate the same even before completion of the said period by giving one month's notice. However, the service provider undertakes to continue to discharge his duties and

obligations until the Bank engages a new service provider. The rate quoted shall be valid for period of two years without any increase in Wages act. salary/wages, costs and service charges.(no increment in contract value if 2nd year contract is awarded)

7. Raw Materials - All cleaning materials such as phenyl, disinfectants, deodorants,

odonil, room fresheners , insecticides like Finit, Hit, Air-Fresheners Stick, Air-freshener round, Dettol Hand wash, Dettol Liquid soap, Sani Cubes, Squeeze, Vim powder, naphthalene balls, necessary tools for cleaning materials and maintenance shall be provided and arranged by the service provider at his own cost. The quality of these materials should be of superior standard, with prior approval of the Bank. If the same are not found up to the desired quality, the service provider will be required to replace it on the instructions of the Bank. If due to such material any damage occurs to Bank's property, the service provider will be liable to pay for its repairs/replacement.

8. Equipments - The service provider shall also arrange all cleaning materials as indicated below :-

(if any new fitting or item that will be provided by Bank)

9. Demand Draft for Rs.1,00,000/- (Rs. One Lakh only) issued by Public Sector Bank or any Scheduled Commercial Bank on Bank of Baroda payable at Bangalore towards Earnest Money Deposit.

10. Commercial Bid (CB)

The Commercial Bid (CB) will give all relevant price information and will quote prices only in Indian Rupees. The Commercial bid should not contradict the Technical bid in any manner. The CB should comprise of wages of employees as per the provisions under Code of wages, 2019 and the directives of Govt. of India, Ministry of Labour and other statutory provisions. The cost of materials and the equipments hired, if any by them related to scope of work. The CB should be submitted in a separate sealed cover duly super-scribed "Commercial Bid for House Keeping & Facility Management Services" as mentioned above.

The successful bidder (L-1) after opening of commercial bid has to undertake the work within a notice of 1 week after receipt of work order.

• Conditional Tender - Conditional tender are liable to be rejected.

• Incomplete Tender - Incomplete tender shall be summarily rejected.

• Transfer of Tender Documents - Tender documents are not transferable.

• No Erasures or Alterations - Technical as well as Commercial details must be completely filled up. The corrections or alterations, if any should be authenticated by the person signing the tender forms with office rubber stamp. In the case the corrections or alterations are not authenticated properly, bid will be rejected.

• In the first stage of tender opening process, only Technical Bid will be opened on

11/03/2020 at 4.00 pm at the address mentioned in the Tender Notice in presence of available tenderers or their authorized representatives who may choose to be present at the time of opening. After scrutiny of the bids, the bidders satisfying the technical and other requirements as determined by the bank and accepting the terms and conditions of these documents shall be shortlisted. The Bank may inspect the site under facility management of short listed bidders and may also obtain client certificate / opinion from client to judge the quality of work of the bidder concerned before short listing any bidders. The decision of the Bank as regard quality of work will be final and binding on all the bidders.

• Under the second stage of process, the Commercial Bid of only those bidders which have

been short listed earlier in first stage will be opened. Short listed service providers will be notified by e-mail / post and may remain present or send authorized representatives to be present at the time of opening of the Commercial Bid, if they choose.

• The Bank shall be under no obligation to accept the lowest or any other offer received in

response to this notice and shall be entitled to reject any or all tenders without assigning a reason whatsoever. The decision of bank will be Final in all matters/conditions/instructions/clauses and their interpretations.

• The Commercial bid should remain valid for a period of 90 days from the date of opening

of Technical Bid.

• The successful tenderer shall execute the agreement in the prescribed form as provided by the Bank.

• All disputes/ settlements arising out of this contract, if any shall come under the

jurisdiction of Courts located at Bangalore City.

• The successful tenderers should open an account in any of the branches of Bank of Baroda in Bangalore suitable according to their convenience.

GENERAL CONDITIONS

1. The Service Provider will carry out the cleaning and other connected operations at

Daily/weekly/monthly frequencies as enumerated in IMPORTANT NOTES TO TENDERER" by using high standard cleaning materials of approved quality and make.

2. Subletting the Work - The Service Provider shall not 'directly or indirectly sublet the work to other party without prior written permission of the Bank. However, he may be required to depute specialized agencies for a particular work, approval of which may be sought from the Bank before appointing. It shall be entirely service provider's responsibility to pay such agencies in time without any implication on the work.

3. Third Party Damages - The Service Provider shall be responsible for all injury /

damage to persons, animals, building, building structure, equipments, furniture & fixtures, property etc. and any damage to road, streets, footpaths and shall compensate/rectify it at its own cost.

4. Insurance Cover - The contractor is required to obtain the third party insurance for

each incident as follows:- (A) Personal injury - Rs.2.00 lacs (B) Property Damage - Rs.10.00 lacs The service provider shall also be required to obtain Group Personal Accident Insurance Policy of at least Rs. 5 Lac per employee and covering all the staff during the contract period deployed at the site.

5. Compliant with all Statutory Requirements –

a) The service provider shall be responsible for assigning duties to personnel deployed, Code on wages, 2019, ESI, Provident Fund, Bonus, Group Linked Insurance Scheme etc. as per relevant laws of the land and the compensation Act or any other benefits to the staff employed by the service provider. Bank shall not be responsible for non payment of any of the amounts to the staff of the House Keeping Agency on account of Statutory Provisions applicable.

b) The service provider shall comply with all the statutory requirements as may be

applicable now and as amended from time to time which includes compliance with the Employees State Insurance Act 1948, Employees Provident Fund Act 1952, Payment of Gratuity Act & Code on wages, 2019, and as per notification. Bank will conduct Periodical inspection to ensure compliance of various statutory requirement .As and when it is required by the Law enforcement authority they should produce all relevant documents for Inspection & Audit Purpose. Any variation in the minimum wages including any revision in the dearness allowances payable from time to time as announced by the Government shall be absorbed in the quote rates by the service provider. The service provider shall maintain register/records as required under the aforesaid statutes and produce the same as and when required to do so by the Bank.

c) The Service Provider shall comply with all applicable laws, ordinance, rules and regulations in respect of this contract and the employment of the workers by the agency shall pay its own cost all the charges in connection therewith.

d) The Service Provider shall be governed by the provisions of the Contract Labour

(Regulation and Abolition) Act 1970 and shall obtain the Contract Labour License as

required from the Commissioner’s Office within 15 days from the date of issue of work order.

e) The Service Provider shall renew the Contract Labour License from time to time and

inform the officer concerned i.e. Chief Manager, Office Administration Department of the Bank accordingly. In the event of the service provider not securing the Contract Labour License 15 days from the date of issue of work order or in the event of the service provider not renewing the license , it shall be open to the Bank to 'terminate the agreement forthwith, without being required to give any advance notice of such termination. The Service Providers shall also be responsible for payment of penalty, if any imposed in this regard by the Labour Authorities.

6. Protection of material and work - The Service Provider shall be responsible for storing

and watching his own material and protecting the work at his own cost. The Service Provider and his workers will be allowed to use lift after office hours. However, no paint / drums or heavy bag of cement/ paint will be allowed to be taken into the lift. Any damage/ spoiling of lift/floor caused during such act will have to be made good by the service provider at his own expenditure.

7. Cleaning during the work - Cleaning work should commence at 8.00 A.M and it should be completed by 10.00 AM on working days or otherwise instructed. After cleaning / moping etc. work is completed the site should be neat and tidy. No cleaning material should be left in and around the floor.

8. Keeping of cleaning material/brooms etc. - The material required for keeping

cleaning material should be kept in stores provided by the Bank. The material in any case should not lie on the floor/ room/ toilets/ or electrical panel switchboards on each floor or otherwise strict action will be initiated.

9. Quality of work - All work shall be carried out in a professional manner to the entire

satisfaction of the Bank. If at any point of time , it is observed that the service provider is not progressing the work with due diligence, care and lagging much behind the schedule and/or services provided are not satisfactory, the Bank reserves the right to terminate contract with 30 days notice. In case of such termination the security deposit held by the Bank will be forfeited.

10. Supervision - Supervisor staff should be at least graduate with minimum 5 years

experience in similar works and he should be well versed with operation of fire fighting equipments. Supervisor staff should be available daily at the site at least during the working hours of the Bank and shall be responsible for the entire work in the building as per the scope of work. He should maintain a register on every floor and confirm in writing in the said register that work has been done upto satisfaction. The register will be checked by the officials of the Bank and if the register is found incomplete the Bank may impose suitable penalty on the service provider, as it may deem fit. He will be responsible for the conduct of his workers to receive and act on such instructions issued by the Bank. He should be provided with a cell phone he should be accessible to Bank for 24 hours.

11. Safety - The service provider shall carry out the entire work in a workman like manner

having full regard for the safety of the men working at the site. All safe practices shall be strictly adhered to by the workman of the service provider like wearing helmets, safety belts, when working at heights, gloves when handling sharp objects and reinforcement etc. The service provider shall protect sides of opening in floor slabs, edges of slab, stair, stairwells etc. with barricade, warning signs/lights and educate all workman regarding following Safe working practices. He shall provide first aid boxes at site. In spite of following all safety measure, in case of any unfortunate accident, the service provider shall indemnify the employer against any expenses or claims towards treatment or Compensation.

12. Payment for service provided - The service provider will be paid on monthly basis for

services during the preceding month for which he shall submit the bill for the agreed amount latest by 7th of the following month and it will be settled by the Bank within 15 working days after deducting TDS, taxes, retention money etc.

13. Manpower/Staff –

a) The service provider shall always employ a minimum strength of experienced staff at the site .Necessary training should be given to them before posting the staff at site. He shall also comply with the provisions of all labour legislations in force which interalia includes payment to its staff as per code on wages, 2019. Receipt of any complaint on this ground shall be viewed seriously. No additional payment will be made if service provider keeps more staff at site for completing the pending work or if the minimum staff strength is not able to perform satisfactory as per contract provision.

b) The workers shall wear colour code uniforms along with company ID, shirt, shoes,

cap, gloves, safety shoes and safety belt where ever it is required for male and suit/saris, aprons, cap, safety gloves etc. for lady staff. Any indecent behaviour / suspicious activities of the Staff employed shall be viewed seriously and suitable action or penalty shall be levied on the Service provider. The service provider has to submit the list of workers with photo ID, education qualification, address proof etc. before deputing the He is also submit police verification report of the staff members.

c) The service provider shall be solely responsible for the credentials/acts of his staff workers, if any of the service provider’s staff found misbehaving with employees of the Bank, other staff of Service Provider, visitor or any person, the service provider shall terminate the services of such persons immediately.

d) The service provider is required to submit daily labour report duly signed by the

officer (GAD / FACILITY MANAGEMENT DEPARTMENT) of the Bank.

e) The service provider is required to make timely payment to his staff including various statutory authorities. The Bank reserves a right to check the same.

f) All persons engaged by the service provider for carrying out the work would be

deemed to be service provider’s employees for all purpose and he shall make regular and full payment to his employees. No liability / responsibility whatsoever on account of persons engaged by the service provider is attributable to the Bank.

g) The service provider shall give an undertaking that they have necessary license and

registrations under the Labour Welfare Legislation and they duly and promptly are complying with the provision pertaining to Employees Provident Fund Act, Employees State Insurance Act, Code on wages, 2019 and such other legislation.

h) The Bank shall not be responsible for injury or loss of life occurring during the

performance of duties in the premises to any personnel deployed by the service provider. Any compensation or expenditure towards treatment for such injury or loss of life shall be borne by the service provider. Service provider indemnity the Bank on this respect.

i) The service provider and his personnel shall co-operate with the security agencies

deployed in the campus and shall be thoroughly checked every time they leave the premises by the security personnel at the main gate.

j) The service provider shall not engage any person who is below 18 years of age.

k) The employees should be available to carry out work as mentioned in Annex – B

including Lunch break of one hour and on Sunday and Bank holidays as and when required.

l) The staff of Service Provider shall be liable for security search during the course of

work and at the time of leaving the premises.

m) All employees should be provided Identity Card by the service provider.

14. Stationery: The contractor has to bear the cost of all the stationery, telephone etc. required for proper execution and maintenance of record for the work. If found using Bank’s materials, Bank may recover an appropriate amount from the contractor’s bills.

15. Compensation towards non-attentiveness / delay -Service Provider shall maintain proper Record Register indicating reasons for not attending to any particular complaint within time schedule, failing which appropriate compensation shall be recoverable. The expected period of completion of the various items of work and the amount of deduction beyond that period for pending complaints will be as under:-

It is, therefore, essential that Service Provider should maintain a sufficient stock of frequently used materials at site and keep proper inventory / records. Levy of compensation as above shall not absolve the contractor from his responsibilities. Further, a sum of Rs.200/-(minimum) per incidence shall also be charged as compensation towards non completion of the routine activities indicated in the scope of work. Deputy General Manager (GAD / FACILITY MANAGEMENT DEPARTMENT) shall be the final authority for decision in such matters which can not be challenged. In absence of Deputyt General Manager (GAD / FACILITY MANAGEMENT DEPARTMENT), next higher authority shall be the final authority for such decision.

16. Emergency Work - It shall be Service Provider's responsibility to attend to emergency works in time.

17. Rates, Taxes and Duties All the rates furnished in the tender shall be inclusive of all lab our and material including all duties, royalties, etc. GST will be paid separately.

18. Cost of Replacement –

a) Contractor shall follow the prescribed formats / procedures for receiving complaints, receiving the work slips duly sanctioned and preparation of bills etc., as stipulated by the Bank from time to time.

b) The cost of replacement, wherever applicable shall be paid for only on sanctioned work slips issued by the Bank to the Contractor. If any replacement is done without proper sanction, the same will not be considered for payment.

c) Under no circumstances, charges for scaffolding, centering, shuttering jhulla and curing will be paid extra for any works related to maintenance / repair / replacement.

19. The Bank further reserve right to delete or reduce any item or sanction of the bills before

effecting payment in case any complaints regarding quality of services/inefficient services, non-adherence to agreed quality of material or services have been received or notified by the Bank without assigning any reason whatsoever and no claim will be entertained in this regard.

20. In case the service provider fails to fulfill his obligations for any day or any number of days to the satisfaction of the bank for any reason whatsoever, he shall pay by way of compensation of liquidated damages as quantified by the bank for the entire number of such days and the Bank shall without prejudice to their Rights and remedies including the termination of the contract, be entitled to deduct such damages From the money, if any, payable by them to the Service Provider.

21. Indemnity: The contractor shall keep Bank indemnified against claims, if any of the

workmen and all costs and expenses as may be incurred by Bank in connection with any claim that may be made by any workmen of service provider. The Contractor shall also execute an indemnity bond in favour of Bank, in the approved format in this regard.

22. EMD & Security Deposit –

a) Earnest Money Deposit (EMD) for the work is Rs.1,00,000/- (Rupees One Lakh Only) and shall be submitted with submission of tender.

b) The successful tenderer shall pay the security deposit which shall be 10% of contract value per year. The EMD will be adjusted in security deposit and will remain with Bank and is refundable interest free security deposit and shall be returned to service provider only after adjusting dues/penalties. The security deposit should be submitted in favour of Bank within 07 days after the acceptance of tender. Tender unaccompanied by Earnest Money shall under no circumstances will be entertained and it shall be liable to be rejected.

c) The security deposit shall be forfeited in case contractor fails to perform his duties satisfactorily or any breach of terms and conditions of contract.

d) The successful bidder shall be required to execute an agreement with Bank in the Banks prescribed format in requisite stamp paper within 15 days from the date of award of work. In the event of failure to execute the agreement within the stipulated period, EMD amount will be forfeited.

23. The Bank shall have right to conduct audits by its internal/external auditors or by agents

appointed to act on its behalf and the copies of the audit report will be furnished to the Bank from time to time.

24. The Service Provider will allow the Reserve Bank of India or person/s authorized by it to access service provider’s records of transactions and other necessary information given to be stored or processed by the Service Provider within a reasonable time also payment of supervisory fees levied by RBI.. Also recognize co-operate with the Reserve Bank of India and or any other Regulatory Authority / Government Agencies having necessary jurisdiction to cause inspection to be made of service provider of the Bank and its Books and account one or more of its officers or employees or other persons.

25. The Service Provider will disclose forthwith, instances of security breaches, if any to the

Bank. 26. The Service Provider will preserve the documents and data in accordance with the

legal/regulatory obligation of the Bank in this regard. 27. Legal issues, if any, will strictly be under the jurisdiction of courts in BANGALORE only.

28. Other penalty clauses: Bank reserves the right to terminate and to impose the penalty on service provider to Rs 2000/- per offence/mistake/misconduct on the following:

(i) Any service provider found in drunken condition/ indulged in bad conduct. (ii) Improper maintenance and defacement of property. (iii) Misbehaviour with Bank’s staff and security personnel. (iv) Not following safety and security norms as may be indicated by authorised representative of Bank. (v) Any staff or service provider found without uniform ID card and found creating nuisance on duty. (vi) Staff of service provider in the premises without police verification. Non-submission of police

verification by service provider within specific period conveyed by Bank, the competent authority direct the service provider to remove the staff from service immediate effect.

(vii) Non compliance of clauses in tender document and agreement executed between the service provider and Bank.

(viii) Service provider and his employees staying at Bank’s premises after closing hours. (ix) In addition to the above, if there is repeated penalties imposed more than twice to the service

provider, an explanation will be sought from him and the same shall be replied within 7 days from the date of issuance. On non-satisfaction of reply, the Competent Authority of the Bank of Baroda will terminate the contract. Once the amount under the clause is debited, the service provider shall reimburse the security deposit to the extent of the debited amount within 15 days thereof failing which it shall be treated as breach of agreement and action shall be taken accordingly.

29. Disputes & Differences: Decision of the Bank regarding performance of contract, levy of

compensation for delay and payments for contract work of extra work done shall be final and binding on the Service Provider. Decision of the Bank will be final and binding on any matter connected with the work. However, any dispute in the matter shall be decided after mutual discussion based on the terms and conditions of the contract. However, if the matter cannot Be solved then the same shall be referred to the respected, qualified person in the field agreed to both parties, however, this is pre-course to any legal action in this regard.
