About Tier 5 GAE

• The government authorised exchange category was set up in 2008 for people coming to the UK through approved schemes that aim to share knowledge, experience and best practice, and to experience the social and cultural life of the UK. 

• In contrast to Tier 2, which requires the employer to directly sponsor migrant workers, Tier 5 does not permit employers to sponsor migrants; instead the sponsor has to be an overarching body. This is where we, AIESEC UK play a vital role as we have been granted a Tier 5 license to issue Certificates of Sponsorship and are registered as an overarching body to manage this programme on behalf of UK Home Office.

What is Access Tier 5?• Access Tier 5 is a Government Authorised Exchange (GAE) programme

designed specifically to allow undergraduates and graduates from countries outside the EEA to gain experience working in the UK for a minimum of 4 weeks and maximum of 12-24 months. It gives UK employers an opportunity to hire the best and the brightest talent from overseas on key initiatives, to learn key skills they can take back to their home country.

• We hold an A rated Sponsor License which allows us to act as an "over-arching body" and to issue Certificates of Sponsorship for individuals who meet our eligibility criteria and wish to apply for a Tier 5 Visa to come and experience working, social & cultural life in the UK.

• This programme is endorsed by Department For Business, Innovation & Skills (BIS) & Office of the Immigration Services Commissioner (OISC).

Who do we work with?• We help students and recent graduates on Tier 4 switch categories in UK

to Tier 5 Government Authorised Exchange should they fulfill Home Office requirements.

• We also work with students and recent graduates outside of UK who have arranged an internship with a UK Employer and require our sponsorship services to work in the UK.

• Finally, we work either directly with Employers, or via their nominated Immigration Advisors, who require our sponsorship services to bring over non-EEA nationals for their internship programmes under Tier 5 Government Authorised Exchange.

Program Requirements1. The maximum term of placement is 12 months at a time.

2.  Minimum qualification of the intern is that of an undergraduate enrolled on a course at a NARIC listed institution.

3. The intern must have completed their last studies no more than 3 years ago.

4.  The placement position should be Supernumerary i.e outside of the regular staffing requirements of the company and must not fit into a Tier 2 (General) occupation category; thereby not affecting the UK Resident Labour Market.

5. The internship should be a full time placement (35- 48hrs/week) and the condition of employment should be in line with the National Minimum Wage Act if outside of London or £15000 pa if based in London.

Program Requirements6. The intern must be 18 years of age and above.

7. Any work that the intern undertakes must be at a skill level of NQF Level 3 or above.

8. The employer must have the financial & personnel resources to support the intern through out the placement.

9. The Employer must be a UK Registered Company, Charity or Government department.

Exceptions to the programme:

1. This program is not open to employers in the Hospitality, Care or Agriculture sector.

ProcessFor us to advise if an international  candidate would fit into our sponsorship programme, we would require their employer representative to complete the assessment form and submit it. To complete the assessment, below documents from the candidate would also need to be submitted.

ProcessUpon receiving all documents, we will confirm within 1 working day if the candidate is eligible for a Tier 5 Certificate of Sponsorship under the GAE category. Please note if the initial assessment is successful, we will automatically register the employer company on to our programme, thereby invoicing the employer for a one off Registration Fee of £600.00. Also, the above fees would only be charged should the assessment be successful as we only take on cases where we are 100% sure we can sponsor the candidate. Post successful Registration, we will ask for the Client and Migrant Care Letters to be signed and returned to complete the process of applying for a Certificate of Sponsorship.

Time Frame

Upon receiving both the Care Letters and successful payment of Registration Fee, we will issue a Certificate of Sponsorship between 1 to 5 working days.

CoS  Fees

Express Route - £100/Month of Placement - i.e £1200.00 for (Processing time - 1 working day)

OR

Standard Route for 12 Month applications only - £750.00 ( 5 working days)

Benefits of using Access Tier 5 – For Individuals

•We do not charge any fees to the students; our fees are paid by their employers.

•We are an A rated sponsor, which means we can certify maintenance of funds for the candidates, we sponsor under Tier 5 Government Authorised Exchange.

•Individuals in UK on Tier 4 can switch to Tier 5 GAE if they can find an internship that meets our and Home Office's criteria.

•We provide full support to our clients throughout the process of the application, clearly advising on every step including Entry Clearance and Visa Application.

•No cooling off period to move to a different category such as Tier 2.

•No maximum limit applied on the salaries offered.

Benefits of using Access Tier 5 – For Individuals

•When we facilitate a candidate's immigration under Tier 5 GAE, we take over all sponsorship responsibilities from the employer for the duration of the individuals placement.

•Tier 5 Government Authorised Exchange is a great route to use in order to gauge whether there is employer candidate compatibility before both sides fully commit to a more permanent position under Tier 2.

•Extremely Quick turnaround times; we can issue a Certificate of Sponsorship within 1 working day of receiving all the paperwork provided its correct.

Migrant & Employer Obligations

Upon the Migrant’s arrival to the UK the Migrant must provide AIESEC UK with:

•A copy of Migrant’s stamped visa vignette in their passport.

•Migrant’s new contact details. Any subsequent changes to their contact details must also be provided within five working days of them taking effect.

•Migrant’s employment address (if different from Employers' correspondence address). Any subsequent changes to the employment address must also be provided within five working days of them taking effect

During the internship

•Monthly payslips (if the employer is not a Tier 2 License Sponsor)

•Updated copy of “migrants contact information” if any details have changed.

Migrant & Employer Obligations

One month before the Migrant’s visa expires

•Confirmation of the migrant’s last day of employment and outbound travel details.

•Copy of migrant’s P45 (If Available)

AIESEC’S ObligationsAs a sponsor of the Access Tier 5 scheme, we must report to Home Office: if the migrant does not turn up for their first day at work;

• if the migrant is absent from work for more than 10 working days without the sponsor's permission;

• if the migrant's contract of employment (including if resigned or are dismissed) or if any registration needed to work in the UK (such as with a governing body) is ended;

• if we stop sponsoring the migrant for any other reason, for example, if the migrant moves in to an immigration category that does not need sponsorship;

•if there are any significant changes in the migrant's circumstances, for example, a change of job or salary (but not job title or annual pay rise);

•any suspicions we may have that the migrant is breaking the conditions of permission to stay.
