Govt Plans Financial Relief for Australian Broadcasters In a one-off measure, the govt will not collect 2016-17 financial year license fees for free-to-air TV and radio broadcasters. ▪ Community TV broadcasters in Adelaide, Melbourne, and Perth will get six additional

months to vacate terrestrial spectrum and make the transition to online streaming. Impact Analysis: Australian broadcasters have had a difficult time adjusting to

competition from online streaming services such as Netflix.

1,700 fixed wireless towers to serve 180,000 customers. Impact Analysis: Customers in rural and regional Australia can now buy plans of more

than 100GB a month of peak data. They have long expressed their frustration to govt about improving Sky Muster stability and inability to meet data needs of bush consumers.

Govt Opens Consultation on NBN Migration Assurance Framework The framework will lay down roles and responsibilities of all parties involved in helping customers migrate to a new NBN service. ▪ Submissions are due by 28 Jul. ▪ NBN Co has lodged a revised Special Access Undertaking (SAU) with the ACCC to

accommodate multi-technology service offerings. Submissions will be accepted until 4 Aug.

▪ ACCC has also released a consultation paper on the NBN’s Services in Operation Record Keeping Rules (SIO RKR). Submissions are due by 28 Jul.

Impact Analysis: The goal is for all NBN customers to have a positive migration experience with minimal or no disruption to their broadband services.

ICT POLICY AND PREFERENCES 4G Licensing Guidelines Open for Comments The BTRC has published draft 4G mobile licensing guidelines for industry comment. The guidelines include a proposal that 4G licensees be required to float shares on the local stock market. 4G licensees would also be subject to rollout obligations covering all divisional capitals within the first nine months of licensing, and all district headquarters within 18 months, with nationwide services expected in three years. Licensees would be liable to share 5.5% of revenues from 4G services with the BTRC, pay 1% of revenues to the Social Obligation Fund and a controversial conversion fee for technology neutrality. ▪ A similar local listing requirement was previously proposed for 2G licence renewal. ▪ Cellco Grameenphone is the only operator listed on the Dhaka Stock Exchange with an

IPO of 10% equity in 2009. ▪ The BTRC also seems keen on a new player entering the market through spectrum

acquisition after the shutting of CityCell the M&A of Airtel Bangladesh and Robi Axiata. ▪ The market is dominated by Grameenphone, Robi and Banglalink who together control

97.3% of the market. The remaining 2.7% market share is held by Teletalk. Public Consultation on National Numbering Plan 2017 The BTRC had opened a public consultation on the draft National Numbering Plan 2017 to update the 2005 version currently in place, which was formulated in a less competitive telecom market environment. As new services (e.g. M2M, ENUM) and market players have emerged, BTRC wants to have a plan which is able to serve the market in the next 15 years. ▪ The consultation was conducted between 3-10 Jul. Spectrum Guidelines 2017 Published The BTRC published its latest guidelines on spectrum assignment to cellcos in the 2100MHz, 1800MHz and E-GSM (900MHz) bands. The guidelines set USD25m as base price for each MHz of airwave. There is no provision for direct sale of the spectrum in IMT band without auction. ▪ The BTRC rejected Banglalink’s request for direct assignment of 5MHz spectrum in

2100MHz band.

PRIVACY AND SECURITY Govt Will Finalise Digital Security Act in Aug The govt is planning to finalise the Digital Security (DS) Act in Aug. The current Information Communication and Technology (ICT) Act 2006 will remain in force until then. The ICT Act is controversial due to Section 57, which limits freedom of expression, speech and the press in an online environment. ▪ The govt is still deliberating of Section 57 will be scrapped or a similar provision will be

added to the DS Act. ▪ 21 journalists have been sued under Section 57 since 1 Mar.

ICT POLICY AND PREFERENCES Cambodian Students Undergo ICT Training in China Under Seeds for the Future, a Huawei-sponsored programme, 10 Cambodian students will receive ICT training from its headquarters. ▪ This is the second batch of students who have participated in Huawei’s programme.

▪ The programme has actively contributed to the development of human resources in the ICT area in Cambodia.

▪ Huawei signed a cooperation agreement (CA) with the Union of Youth Federations of Cambodia in Nov 2016 to carry out the programme.

Impact Analysis: This is a good initiative on two fronts: 1) to strengthen Cambodia’s ICT sector through knowledge gained from the programme; and 2) to foster a deepening of relationship and networks between Cambodia and China.

CLOUD Apple to Build First China Data Centre The US consumer electronics producer will invest USD1bn the data centre, which will be located in Guian New Area, Guiyang, in Guizhou province, and will be operated by the provincial govt-owned Guizhou-Cloud Big Data Industry. ▪ Guizhou-Cloud Big Data Industry will be the sole Chinese operating partner of Apple’s

iCloud service. This is the first time Apple has partnered a local company for its cloud services.

▪ The new data centre facility will store Apple’s Chinese users’ information, which have previously been stored overseas, was established in part to adhere with new requirements brought forth by China’s Cybersecurity Law, for citizen data to be stored locally.

▪ Apple has reassured stakeholders that it will retain encryption keys, amid fears that the local data centre will open user content to greater govt surveillance.

ICT POLICY AND PREFERENCES Bike-sharing Standards Released The Ministry of Transport has published standards on the production, operation and maintenance of shared bikes. ▪ Complaints over the four months from Jan to Apr 2017 have risen nine-fold y-o-y to

2,600 . ▪ The new regulations specify requirements for shared bikes to have a service life of

three years and companies to hire one maintenance employee for every 200 bikes, in addition to regulating deposits, compensation complaint management.

▪ Regulations will take effect on 1 Oct. MIIT Denies Issuing Notice to Ban Personal VPNs Bloomberg reported that MIIT issued a notice state-run operators to block subscribers to access virtual private network (VPN) apps on their network by 1 Feb 2018. ▪ However, the MIIT has denied this, and told state-run thepaper.cn that it had issued no

such notice. ▪ In Jan, the MIIT made it mandatory for China-based companies offering VPNs to first

receive govt approval, and has clamped down on widely-used VPN services in a 14-month nationwide campaign against unauthorised Internet connections, including VPN. However, overseas-based services have remained out of reach.

Impact Analysis: Nonetheless, if the purported ban were to be executed and enforced, all mobile users will be unable to access govt-blocked websites including social networks such as Facebook and Twitter, and international news sites. Users have been able to take advantage of loopholes in China’s “Great Firewall”, by using VPNs for example, to access censored or blocked content. Businesses that have obtained approval from the govt and registered their usage will be able to continue accessing VPNs, although it’s not clear what the approval criteria or probability is. However, start-ups, entrepreneurs and freelancers that rely on overseas websites for information and/ or communication stand to be the hardest hit by such a ban.

and efficiency. Nokia Supports Chinese Firms Going Global, Launches Nokia Shanghai Bell Nokia plans to launch a special unit to support Chinese firms’ international expansion. Focus areas include data centres, cloud, IP routing, transport and services. ▪ Nokia will lend expertise in new technologies including cloud, AI and machine learning. ▪ Nokia has also officially launched Nokia Shanghai Bell JV after completing its

transaction with state-owned China Huaxin Post & Telecommunication Economy Development Centre. Nokia’s China business and the former Alcatel-Lucent Shanghai Bell have been operating as one since Jan 2016. Nokia owns 50% of the Nokia Shanghai Bell JV.

Baidu Announces Partners for Autonomous Car Platform Baidu claims to have established one of the world’s largest open autonomous driving alliances with more than 50 partners to accelerate the commercialisation of its AI technology. Partners include international automotive and tech companies, as well as five Chinese vehicle makers. ▪ Project Apollo, the company’s open-source AI platform for self-driving cars which was

announced in Apr, is expected to help Baidu increase returns from its investments in AI, and the company has already established subsidiaries in Singapore and the US to support this.

▪ Baidu’s autonomous car strategy could face setbacks in the form of sanctions from local authorities after

Stripe Partners Alipay, WeChat on Payments Businesses that use the San Francisco-based start-up’s e-payments software will be able to accept Alipay and WeChat as payment methods. The partnership is also expected to Chinese consumers’ demand for cross-border e-commerce.

ACCESS NETWORKS China Unicom to Acquire Spectrum from SARFT China Unicom is reportedly negotiating a deal to acquire the agency’s 700MHz spectrum in exchange for shares. ▪ SARFT has been holding onto unutilised 700MHz spectrum with the aim of launching

LTE, but never deployed the network. China Telecom Expands International IoT Partnerships The operator has entered into partnerships with: 1) Hong Kong Telecom (HKT), on the development of a common IoT platform covering mainland China and Hong Kong; 2) Telenor, for China Telecom’s subscribers to access Telenor Connexion’s IoT networks in Europe and Asia; and 3) Orange Business Services, for both companies’ subscribers to access each other’s footprint, as well as to collaboratively enhance existing IoT capabilities, develop new IoT service models, and apply emerging technologies. China Mobile, ZTE to Collaborate on 5G Energy Efficiency

The companies have agreed to promote the adoption of energy-saving 5G network architecture and technical solutions. ▪ ZTE is developing a solution that can enable and disable wireless resources according

ICT POLICY AND PREFERENCES President Xi inaugurates Carrie Lam as New Chief Executive On 1 Jul, in commemoration of the handover of Hong Kong back to Chinese sovereignty, President Xi flew to Hong Kong to inaugurate Ms Carrie Lam Yuet-ngor as Hong Kong’s new Chief Executive. ▪ Ms Lam has been quick to open social media accounts on Facebook and Twitter. Impact Analysis: Likely to be more proactive in driving innovation, for example, the

smart city concept, but also more proactive in driving changes in the schools’ curriculum and national security laws which would be opposed by democrat activists. The biggest challenge therefore will be to find a more conciliatory approach which chimes with the aspirations of Hong Kong people.

Smart City Blueprint Launched The OGCIO released the “Report of Consultancy Study on Smart City Blueprint for Hong Kong” by PwC. ▪ The 232-page report itemizes potential smart city projects under six headings: smart

mobility, living, environment, people, govt and economy, while section 7.2 “Smart City Pilot Proposals” outlines the means to bring them to fruition.

▪ A key feature proposed is to create a Smart City Steering Committee, a Smart City Programme Office, and a series of project Teams to create cross-govt leadership and agency co-ordination.

Impact Analysis: With the new Hong Kong govt in place from 1 July 2017, it remains to be seen how urgently and effectively these proposals will be adopted, but Hong Kong’s new CEO, Ms Carrie Lam Yuet-ngor, was responsible in her previous post for creating the Innovation & Technology Department (ITB) that could well be the lead agency for smart city projects.

Uber Illegal According to ITB In a radio interview, Innovation and Technology Bureau (ITB) head, Nicholas Yang, said it is not Uber's format that is problematic but its legality. ▪ In Jun, the ITB published a Facebook post which strongly criticized Uber, arguing it was

intentionally violating the law.

APPS , NEXT -GEN DEVICES AND SERVICES Cross-border Electronic bill payments The HKMA and the Guangzhou branch of the People's Bank of China launched a cross-boundary electronic bill payment service between the SAR and Guangdong. ▪ The scheme aims to provide a channel for customers in Hong Kong to make bill

payments denominated in yuan to merchants in Guangdong through internet or mobile banking platforms.

ACCESS NETWORKS HKT and China Telecom Enter IoT Partnership China Telecom and HKT have entered an agreement to develop services based on an IoT open platform.

ICT POLICY AND PREFERENCES DoT Pilots Central Equipment Identity Register DoT has launched a six-month pilot of the Central Equipment Identity Register (CEIR). Under CEIR, mobile operators will share data on lost or stolen phones to prevent such phones from getting activated again even if using a new SIM card. The project aims to protect consumer interest, curtail counterfeit mobile phone market, discourage mobile phone theft, detect cloning of phones and allow lawful interception. ▪ CEIR will use the International Mobile Equipment Identity (IMEI) number to identify

phones. ▪ The DoT is to make tampering of IMEI number a punishable offence with up to three

years of imprisonment. ▪ Cellcos are not allowed to provide service to any mobile phone with fake IMEI number,

but find identifying handsets with duplicate IMEI number difficult. GST to Impact Telecom Industry TRAI requested for reduction in GST rate from 18% to 5% claiming that the telecom sector is a core infrastructure industry and a key enabler of the digitisation of the economy. ▪ The govt imposed a 10% basic customs duty (BCD) on imported smartphones under the

GST regime in line with boosting local manufacturing as part of the Make in India programme.

▪ The govt imposed a 10% BCD on imported fully built base stations for the above reason.

Online Education Rules in the Making As part of the Digital India initiative, the Ministry of Human Resource Development is planning to draft an online education policy for the University Grants Commission and deliberate how best to integrate it with the mainstream. ▪ The govt has been encouraging top Indian institutions to develop MOOCs. ▪ Aadhaar will be used for authentication of students and to link them to a national

academic depository.

IPR Intellectual Property Exchange to Be Launched India is to set up an Intellectual Property (IP) Exchange for both domestic and foreign individuals and businesses, where users will be able to buy and sell intellectual property rights across various sectors. ▪ The IP Exchange is to be developed under the Ministry of Science and Technology

through the National Research Development Corporation and launched in 8-9 months. ▪ India has 200,000 patents every year that have potential for commercialisation.

PRIVACY AND SECURITY CERT-Fin to Aid Cybersecurity of Financial Industry The govt is planning to set up the Computer Emergency Response Team in Financial Sector (CERT-Fin) to ensure a comprehensive cybersecurity framework for the financial sector. CERT-Fin will operate a 24x7 help desk, analyse cybersecurity incidents and give inputs for cybersecurity policy making.

DoT Insists on GPS in Mobile Phones The DoT has mandated that mobile phones sold in India from 1 Jan 2018 be equipped with GPS to locate subscribers in emergency situations. ▪ The request of the Indian Cellular Association to use alternative technology in low-cost

smartphones has been rejected. ▪ Adding GPS might push up the production costs of handset manufacturers, and

increase phone prices by over 50%. Digital Payments Industry Continues to Grow The National Payments Corporation of India (NPCI) gave permission to WhatsApp to enter into a partnership with multiple banks to allow users to make in-app payments and money transfers using UPI. ▪ Google completed testing of its digital payments service for India and waiting for RBI

approval (expected within 2-3 months). ▪ Uber is expected to go live through integration with the BHIM app in Jul. ▪ Amazon is testing a pay button for UPI on its portal. ▪ The govt mandated linking Aadhaar numbers with the PAN of taxpayers from 1 Jul. ▪ Central Board of Direct has launched an app called Aaykar Setu to help users

understand the various nuances of direct taxes, file income tax, apply for PAN, check tax deducted at source (TDS) statement, and share grievances with govt authorities.

ACCESS NETWORKS BharatNet to Get More Funding DoT is considering giving viability gap funding (VGF) to the BharatNet project to meet the Dec 2018 deadline of provide broadband connectivity to 250,000 villages. ▪ Project cost has swelled by almost 70% from the initial approved INR201bn

(USD3.1bn). ▪ Private sector involvement is being fostered, especially in providing last mile

connectivity. DoT Allows Infrastructure Consolidation Across Circles The DoT amended the terms of the Unified Licence Agreement (UL) to allow telcos to optimise the location of switching and network infrastructure to meet capacity requirements. Previously, providers had to restrict deployment to each of their licensed service areas (circles), now consolidation across circles is allowed. ▪ The amendment might signify a move towards a single licence for India as opposed to

having a separate one for each of the country’s 22 service areas. Telecom Market Consolidation Continues

enterprise and international cable businesses. TRAI Issues Draft Design of Public Wi-Fi System TRAI issued the draft design of the Public Wi-Fi system. The technical document provides detailed technology specifications for various providers to ensure full Wi-Fi system interoperability. ▪ Any entity with a valid Permanent Account Number (PAN) can set up a public Wi-Fi

hotspot. ▪ TRAI has invited proposals from all entities willing to be part of the public Wi-Fi pilot by

DICT Re-introduces Pipol Konek Free Public Wi-Fi “Pipol Konek” or Free Wi-Fi access in Public Places will serve 105,000 concurrent users with 256Kbps each, the minimum speed requirement of a broadband service. ▪ According to ICT Undersecretary for Special Concerns Eliseo Rio, as of 19 Jun, there

were 381 “live” project sites, and 904,588 devices had access to the free public Wi-Fi. ▪ The project will cover 1,634 total localities, including 13,024 public places, 1,489

municipalities and 145 cities with 18 points of presence across the Philippines. ▪ Among the public places to be covered are 4,568 schools, 3,173 parks and plazas, 2,277

govt hospitals, 677 libraries, 1,557 national govt offices, 682 state universities and colleges and 90 seaports, airports and train depots.

One-stop Online Portal to Speed up Mass Housing Projects The Housing and Urban Development Coordinating Council (HUDCC), in partnership with the DICT, is planning a one-stop online portal to help process the documents needed to approve mass housing projects. ▪ The one-stop online portal will enable applicants to circumvent a tedious

administrative process of approaching a list of agencies including the Department of Environment and Natural Resources, Department of Agriculture, Department of Agrarian Reform, etc.

▪ Focus group discussions conducted by the HUDCC found that the current system, which has a backlog of 5.5 million housing units, is prone to red tape and corruption.

A Franchise Tax for Telcos? A leader of the House of Representatives wants to lift the franchise tax exemptions granted to telecoms industry, which has become a significant sector for the country's economic growth. ▪ House Bill 5444, introduced by Deputy Speaker Sharon Garin, seeks to amend the

National Internal Revenue Code to re-impose franchise tax on telecommunications entities.

▪ Under the bill, a franchise tax at the rate of 8% would be imposed on the gross receipts of telco companies in lieu of the value-added tax (VAT) to which these entities' earnings are presently subjected.

Spectrum Dispute Between DICT, PCC Rumbles on Rodolfo Salalima, Secretary of the DICT, has again hit out at the Philippine Competition Commission (PCC) for not accepting the earlier view of the Court of Appeal (CA)’s special 12th Division that the decision of the NTC to award the spectrum of the San Miguel Corp. (SMC) to PLDT and Globe was in the public interest. ▪ The PCC, through the Office of the Solicitor General (OSG) last April, filed a petition

seeking to dissolve the writ of preliminary injunction issued by the CA. The PCC clarified that the petition only pertains to PLDT since the CA 6th Division has denied Globe’s petition to stop the review of the transaction. But the CA has approved Globe’s motion to consolidate its petition with that of PLDT.

▪ PLDT and Globe contend that the deal is already “deemed approved” based on the interim rules governing the PCC at that time. Under the PCC’s transitory rules, the commission only needed to be notified about the PHP70bn (USD1.4bn) deal.

Basis and All-Vehicle Detection System (Catch-All)”. ▪ DLSU partnered with the DOST’s Philippine Council for Industry, Energy, and Emerging

Globe Introduces Separate Data Allowance for Video Streaming Globe has introduced a mobile video content add-on called ‘GoWatch' which allots a separate data allocation for streaming on various platforms, including Netflix, YouTube. Tribe, HOOQ, NBA, Cartoon Network, and Disney Channel Apps. ▪ GoWatch is available on prepaid and postpaid with 2GB streamed video for PHP29 per

day (USD0.50) add-on; 2.5GB for three days for PHP99 (USD2); and 10GB for 30 days for PHP399 (USD8).

Globe Caught in Cell Site Dispute Globe Telecom has filed a lawsuit against a resident of Dasmariñas Village in Makati City for preventing the construction of cell sites that was supposed to improve mobile services in the area. ▪ Globe's suit comes after the Secretary of the DICT threatened to penalize residents and

associations that "obstruct" the erection of cell towers in villages. But an association of residents from Dasmarinas Village claims that because the Secretary was previously chief legal counsel and senior advisor of Globe, there is a conflict of interest.

▪ Globe has reached several agreements with other residential associations to install cell sites in the area, but in this case the resident suggested danger from radiation.

Impact Analysis: The strength and weakness of the Philippines is the possibility of litigation, and residents need reassurance about levels of signal strengths and positioning of cells.

ACCESS NETWORKS New Wireless Operator Receives Approval for Marawi Rollout The Regional Board of Investments (RBOI) of the Autonomous Region in Muslim Mindanao (ARMM) have approved the PHP3bn (USD60m) telecoms investment of TierOne Communications International (TierOne), a company jointly owned by Filipinos (70%) and Australians (30%). ▪ The investment was originally destined for Mararwi City, which is now subject to

fighting between Islamist rebels and the army. Instead, the pilot programme will be undertaken in Cotabato City, providing cellular services in 2G, 3G, 4G, LTE, broadband wireless Internet at 3Mbps to homes and enterprises, and Wi-Fi for public or common areas.

▪ Despite previously awarding a licence to ARMM, the NTC has only recently released the spectrum to ARMM.

DOST Set to Launch ‘CubeSats’ in 2018 The Philippine Council for Industry, Energy and Emerging Technology Research and Development (PCIEERD), one of the DOST’s three sectoral planning councils, announced plans to use cube satellites or CubeSats by 2018 to provide connectivity to remote villages. ▪ CubeSats belong to a class of nano-satellites using a standard size and form factor of

‘one unit’ or ’1U’ measuring 10x10x10 cm and is expandable to larger sizes: 1.5, 2, 3, 4, and even 12U.

▪ The Philippines has 42,036 barangays spread across 81 provinces and 1,490 municipalities, many in far-off islands and remote mountains.

Philippines Improves Mobile Browsing Speeds, Still Lags Region An assessment by Ericsson Philippines and Pacific Islands is that the Asia-Pacific region along with North America will lead the rollout of 5G. However, the Philippines already lags behind other countries with only 10% local app usage compared with a regional average of 18%. ▪ The Philippines is improving, with the availability of minimum speeds for Web

browsing having increased by 19% y-o-y. ▪ LTE subscriptions are anticipated to rise from 10% today to 70% by 2020.

National Grid, DICT Confirm Joint Planning for National Broadband The National Grid Corp. of the Philippines (NGCP) has announced plans with the DICT to open its nationwide network of fibre to help revive the national broadband project. ▪ This follows govt statements that using the network of 6,154 km would allow it to

deliver high speed internet to unserved and underserved areas without being encumbered by high capital outlays.

their impact on regulations, as well as create cross-border cooperation between the two central banks to encourage both innovation and collaboration. They are specifically targeting cross-border applications for fintech.

▪ The BOT and MAS have also updated their MoU on Banking Supervision, which had been in place since 2006. The updated MoU outlines their commitment to fostering greater information exchange and cooperation in the areas of licensing, on-site examinations, supervisory colleges, and crisis management.

ICT POLICY AND PREFERENCES NCC Publishes Draft Monopoly Law The NCC has launched a public consultation process for its draft Monopoly Control and Multiple Maintenance Law. ▪ The draft prohibits the consolidation of wireless TV, which is transmitted via spectrum

– a limited resource. ▪ The draft also prevents a single operator of radio or TV satellite broadcasting or cable

business from occupying more than one-third of the market in order to ensure that consumer choice is not limited.

▪ Consolidation which leads to companies owning more than five news and/ or financial channels, will also be rejected, considering these are the main source of information for people.

▪ As cable TV household penetration stands at 61% (i.e. the primary viewing platform), the NCC will prevent large cable TV operators – defined as operators that have a subscriber market share of 20% or more – from acquiring of merging with wireless TV, national radio, business news and financial channel or national daily newspapers.

▪ The NCC will also review Internet media, which it recognises as being an increasingly important information source, in its consideration of the growth and decline of public information sources, and may consider regulating it.

▪ The draft also considers assisting the radio and TV industry in producing content that will support the rights and interests of vulnerable groups, such as by providing govt agencies, schools and groups with equipment and technology required for content production.

▪ The NCC will aim to improve multiculturalism in the media environment and improve quality of news and other content through funding.

ACCESS NETWORKS 2G Service Termination: Operators Instructed to Improve Remote Coverage Provision of 2G services in Taiwan ceased on 30 Jun as planned, and the NCC has asked mobile operators to develop plans to enhance their 4G networks to ensure that subscribers in remote areas are adequately covered by mobile services. This has affected 60,000 Chunghwa Telecom subscribers, 20,000 Taiwan Mobile subscribers and 8,000 Far EasTone subscribers. ▪ Chunghwa Telecom plans to increase its 4G base stations by 1.4 times in 2017.
