ARRESTS AND CITATIONS

1. PURPOSE

The purpose of this policy is to establish uniform procedures for the making andreporting of arrests and citations as provided in Section 24209 Business and ProfessionsCode, and Sections 740, 806, 835.9, 853.6, 853.7, 853.8, 949, 959.1 and 13020 of thePenal Code.

2. THE SUSPECT

A. Confirming Identity

Whenever a person is arrested or cited by an ABC investigator, every effort shouldbe made to confirm the person's identity through any of the following means:

• View the suspect's actual driver's license or identification card

• Interviews or statements from other suspects/witnesses

• Run the suspect through the Department of Motor Vehicles (DMV) or theCalifornia Law Enforcement Telecommunications System (CLETS)

If you are unable to satisfactorily identify the suspect, the person should bebooked into the county jail (Section 853.6(i)(5) Penal Code). See P 103.5regarding juveniles.

B. Searching for False Identification

Investigators should make every attempt, whenever possible, to locate false I.D.'s.Refer to the California Peace Officers Legal Sourceboolc, Chapter 3, Section Iff(D),for the latest case law regarding stop and searches.

C. Checking for Warrants

Whenever possible, the Investigator should run all suspects--whether adult orjuvenile--through CLETS' wanted persons system (WPS) to check for anyoutstanding warrants.

D. Miranda Warnings

• Investigators will follow the most recent case law in regard to Miranda warnings.Refer to the California Peace Officers Legal Sourcebook, Chapter 7.

3. NOTICE TO APPEAR (CITATION)

A. Form to be Used

Form ABC-303, Notice to Appear, shall be the official citation form used by ABC(Illustration No. 1).

1. Releasing licensees and their employees on a citation is mandatory forviolation of the Business & Professions Code, Division 9, when they arewilling to sign the citation. If they refuse to sign, they shall be booked underSection 853.6 Penal Code. (Section 24209 Business & Professions Codeand Section 853.6(i)(8) Penal Code)

2. Juveniles will be cited to the Juvenile Probation Department. JuvenileProbation will further notify them and their parents or guardian when toappear.

B. Preparing the Citation

All information entered shall be printed, with pen (blue or black ink), using a firmwriting foundation and sufficient pressure to make clear and legible copies.

Complete items as shown. If the investigator feels that additional information isneeded, it shall be written on the reverse side of the original under the "Notes" ,section. For example, for citations issued for Section 25658.1 B&P Code, MinorAttempting to Purchase, write in the type of alcoholic beverage.

• Thumb Print -- The defendant's right thumbprint should be placed on theNotice to Appear in situations in which there is a question as to the trueidentity of the suspect. The court has the option of comparing thumbprints inthose cases where the defendant alleges that another person has committed thecited offense. (Section 853.6(d) Penal Code)

• Court Appearance Date-- The court appearance date will be determinedby the local jurisdiction. Check with the criminal court clerk for appearancedates.

• "Booking Required" Box -- Whenever the violation is a "recordable"offense, as determined by the Department of Justice, the "Booking Required"box on the Notice to Appear should be checked. See Illustration No. 2.

By checking the Booking Required box, the court is notified that the arrest is to berecorded on the defendant's CI&I criminal history record ("rap sheet"). The courtthen may order the defendant to be booked in order to have the ABC arrest (citation)recorded on their CI&I record.

Most local courts should refer the defendant to a local law enforcement agency tocomplete the booking required process. Although ABC is a criminal justice agency,it is also a public service agency, and is not designed to perform booking services.ABC will not perform booking services for its arrests. Therefore, if a local court orlocal prosecutor's office contacts a District or Branch office about booking servicesor refers a defendant to ABC for booking, the District Administrator or Supervising

Investigator should inform them that ABC cannot perform booking services. Thedefendant should be referred back to the local court.

C. Distributing the Citation

1. Citations shall be distributed as follows:

• Original (pink) -- Send to the Court or Juvenile Probation Department

• Second (white copy) -- Stays with the original Investigation Report

• Third (green copy) -- Give to the person cited

• Fourth (yellow copy) -- Retained by the investigator or disposed of. Ifdisposed of, shred to prevent unlawful use of personal information.

D. Voiding or Dismissing Citations

Whenever a citation is voided by the issuing investigator (e.g., errors in enteringdata), the original and all copies shall be marked "VOID" in large, block letters.The reason for voiding shall be entered in the space marked "violation"; e.g.,"Subject gave wrong name," "Cited into wrong court," etc. The voided citationwill be initialed by the Supervisor or District Administrator. Voided citations shallbe kept in the book.

Once a citation is issued to a suspect, it must be filed with the local prosecutor. It isa misdemeanor not to do so (Section 853.6(j) Penal Code). If the DistrictAdministrator or District Supervisor believes a citation should be dismissed in theinterest of justice, refer to Section 853.60) of the Penal Code.

E. Issuing Cite Books

The Supervisor will maintain a list of citation books issued to each investigator.No Form ABC-64, Receipt for State Owned Equipment, is needed for the issuance \ofa citation book to an investigator.

4. SPECIAL SITUATIONS

A. Juveniles

1. Contacting a Parent or Other Responsible Adult

At the time of citation, the Investigator should make a reasonable effort tocontact a parent of any juvenile who is being cited or taken into temporarycustody. For notification purposes, Investigators should attempt to contact thefollowing, in this order:

(a) Parent or legal guardian

(b) Responsible adultfamily member

(c) Responsible adult other than a relative; e.g., fatally friend or neighbor

2. Releasing a Juvenile

Except as provided in Paragraph 3 below, Investigators should make everyreasonable effort to release the cited juvanile to the parent or other responsibleadult. If the parent or other adult requests that the juvenile be detained until theadult is able to take custody of the juvenile, the Investigator should agree to theparent or other adult's request. If the minor resides nearby, the Investigatormay opt to transport the juvenile back home and into the custody of the parentor guardian.

ff the investigator is unable to notify a parent or guardian at the time of citation,the investigator shall release the juvenile on the Notice to Appear in accordancewith Section 853.6(i) Penal Code. However, the investigator shall make areasonable effort to contact a parent or guardian later that same shift. Theperson contacted shall be noted in the investigation report.

Investigators should take into consideration other options than just releasing ajuvenile on a notice to appear. For example, if the juvenile has been consumingalcoholic beverages, but is not intoxicated, and a parent cannot be immediatelynotified, the Investigator should consider any other means available to providefor the safety of the cited juvenile.

3. Non-Release of a Juvenile

(a) A juvenile should not be released on a Notice to Appear if:

One of the provisions of Section 853.6(i) occurs, for example:

The juvenile was so intoxicated that he or she could have been a danger tohimself or herself or to others (however, having consumed an alcoholicbeverage is not necessarily intoxication and is not a reason, in and of itself,to take a juvenile into custody); (b) The juvenile had outstanding warrants;or (c) The juvenile could not provide satisfactory evidence of personalidentification. In addition, a juvenile should not be released if he or shefalls under Section 300(a) Welfare and Institutions Code (i.e., person under14 years of age).

B. Misdemeanor Arrest Without A Warrant (Section 836 Penal Code)

On the Notice to Appear, Form ABC-303, is a box with the wording:"Violation(s) not committed in my presence, declared on information andbelief.' I declare under the penalty of perjury under the laws of the State ofCalifornia that the forgoing is trne and correct."

Use of this box allows investigators to issue a Notice to Appear for violations thatdid not occur in the investigator's "physical proximity." Before checking using thisbox, the following elements should be present:

1. The Investigator should observe the suspect(s) either still at or in the processof leaving the scene of the crime; and

2. In addition to the Investigator's observations, the Investigator should haveother independent and admissible evidence, such as:

a. An admissible confession or admission from a suspect about the crime

b. A positive identification from one of the suspect(s)

The following chart provides examples of when to check the box, "Violation NotCommitted in My Presence." When in doubt, do not check the box.

C. Warrant Service by Notice to Appear

Often, local courts specify on misdemeanor arrest warrants that service shall bedone by issuance of a citation in lieu of physical arrest (Section 827.1 Penal Code).Although this procedure reduces jail overcrowding and overhead costs, it canbecome a problem for state law enforcement agencies that do not staff full-timewarrant clerks to process the required paperwork.

1. Whenever an Investigator locates a suspect with an outstanding arrest warrantthat specifies service shall be done by issuance of a citation, the Investigatorshould detain the suspect and summon a local law enforcement agency forprocessing. If a local law enforcement agency is not available, the followingprocedure is required:

• After a suspect has been lawfully detained, request the CHPCommunications Center to conduct a warrant check through DOJ'sCLETS Wanted Person System (WPS). If an outstanding arrestwarrant is discovered, request the CHP Communications Center tocontact the agency holding the warrant to confirm that the warrant is stilloutstanding. Investigators should never arrest any person for anywarrant based solely on an entry in the Wanted Persons System. Thewarrant may have already been served and was never removed fromCLETS. Always confirm.

• If a warrant is confirmed, verify if the agency holding the warrant willextradite (pick-up) or if the warrant is "citeable."

• If the outstanding warrant is citeable, request the warrant be abstractedto the nearest CLETS terminal where the Investigator can retrieve theteletype abstract.

• Issue the suspect a Notice to Appear, Form ABC-303. In the violationsection, indicate the following information:

-Name of the issuing court (not necessarily the same as the local court)-The charge(s)-The court's docket number and bail-The appropriate court for appearance with the date and time

• The suspect may be released on the outstanding arrest warranton theirsigned promise to appear. Provide the suspect with their copy of theNotice to Appear.

After releasing the suspect:

• Advise CHP Communications to send a CLETS teletype to the agencyholding the warrant that the warrant has been served by citation.

• Proceed to the CLETS terminal that received the teletype abstract fromthe agency holding the warrant. The Investigator must obtain theteletype abstract before the end of their shift. A faxed copy of theteletype abstract is not acceptable.

• Attach a photocopy of the teletype abstract to the citation and forward tothe appropriate court.

• The Investigator is to prepare a brief investigation report to documentthe probable cause of the arrest. Include with the report the originalteletype abstract. (Refer to P 104.)

5. JAIL BOOKING FEES

There have been instances where jail personnel have asked ABC investigators about jailbooking fees after booking a suspect into a county jail for either an on-view arrest or foran outstanding arrest warrant. In doing so, jail personnel mistakenly thought ABC wassubject to jail booking fees. Investigators should be aware that ABC is excluded fromGovernment Code Section 29550, which lists agencies that can be charged a booking fee.Investigators should never agree to any booking fee.

6. MONTHLY ARREST AND CITATION REPORTING

A. Background and Purpose

Each year, DOJ's Criminal Justice Statistics Center prepares an annual report ofarrests made and citations issued by California law enforcement officers. Thereport is divided into Part I and Part II offenses. The annual report is forwarded tothe public, academia, the Judiciary, the Legislature, the Governor's Office, theOffice of Emergency Services, the Legislative Analyst's Office, and theCommission of Peace Officer Standards and Training (POST). The annual reportaffects future public policy making decisions and funding.

The Department of Justice (DO J) has requested that ABC participate in DOJ'sUniformed Crime Reporting System. ABC will use DOJ's guidelines entitled,Standards for Monthly Arrest and Citation Register Reporting, in complying withthe statute. (Section 13020 Penal Code)

B. Form to be Used

District andBranch Offices andSpecialized Units will use DOJ Form JUS 750,Monthly Arrest and Citation Register, to record each arrest made or citation issuedby ABC. DOJ has authorized ABC to create and use its own electronic (computer)version of Form JUS 750 (Illustration No. 3).

Form JUS 750 can be found in the Guest Access Server and will be completedmonthly, using the DOJ guidelines.

One Form JUS 750 shall be used for recording adult arrests and a separate one forjuvenile arrests.

C. Completing Form JUS 750:

1. ABC Report Number

In the column titled ABC Report Number, use ABC's Uniform ReportingNumbering System (e.g., 02-50-001). (Refer to P 104.)

• If a citation is issued and an investigation report is not necessary, suchas for a minor attempting to purchase an alcoholic beverage, in violationof Section 25658.5, B&P Code (an infraction), a report number shouldstill be used. An ABC Report Number should still be obtained from theABC Report Log, form ABC-325, for logging the ABC citation. (Referto P 104.)

2. Arresting Agency

In the column titled Arresting Agency, the last name and badge number of thearresting Investigator will be used. Example: Smith #123. Only oneInvestigator's name should be listed.

3. Agency name and NCIC Number

Each District and/or Specialized Unit shall use the information listed onIllustration No. 4 to properly identify the agency name and National CrimeInformation Center (NCIC) Number.

For example: The Sacramento District Office should use the agency name of:"CASD ABC SACRAMENTO" and the NCIC number of CA0343000.(CASD means C,-difornia State Department.) Only upper case lettering shouldbe used.

D. ABC Arrest vs. Joint Arrest:

District Offices and Specialized Units will not report Joint Arrest information onForm JUS 750. This would be double reporting the same arrest. List only arrestsor citations issued by ABC.

1. Joint Arrest:

To help compile arrest data needed for the Form ABC-19, Monthly ActivityReport, each District or Specialized Unit may use Form JUS 750 to recordtheir Joint Arrest information. However, if this occurs, a separateForm JUS 750 will be used to separate ABC's arrests and citations.

E. Routing of Form JUS 750

1. Each District Office andSpecialized Unit will maintain a copy for their ownrecords. The District Office and/or Specialized Unit will retain their copy fora minimum of four (4) years. Refer to ABC-AM, Records Storage andPreservation.

2. At the end of each month, each District Office andSpecialized Unit willforward the original Form JUS 750 to HQ Administrative Services, attachingit to Form ABC-19. Note: Make one copy for adult arrests and another forthe juvenile arrests. This should be completed and forwarded to Division bythe fifth working day of the month. Refer to ABC-AM.

• DOJ's Standards for Monthly Arrest and Citation Register Reportingrequire the JUS 750 to be completed even if no arrests or citations weremade during a particular month. The box indicating "No Adults toReport" is checked and the JUS 750 is still forwarded withForm ABC-19.

• The total number of ABC arrests on the Form JUS 750 and Form ABC-19, Monthly Activity Report, should be the same.

3. After HQ receives all the monthly reports from each District Office andSpecialized Unit, the Administrative Services Unit will forward all originalForms JUS 750 to the Department of Justice, Division of Criminal JusticeInformation Services, Criminal Justice Statistics Center in Sacramento. DOJmust receive ABC's completed Forms JUS 750 by the 12th working day ofeach month.

7. CRIMINAL OFFENDER RECORD INFORMATION PROGRAM

A. Policy

In accordance with DOJ's Criminal Offender Record Information Program, ABCwill use DOJ'sArrest and Disposition Instruction Manual for reporting arrest andsubsequent court action.

B. Form to be Used (JUS 8715)

ABC will use DOJ Form JUS 8715, Disposition of Arrest and Court Action(Illustration No. 5), to report each arrest made or citation issued. Form JUS 8715is a five-part NCR (no carbon required) form, which can be ordered from HQ Mail& Supply.

Although the completion of Form JUS 8715 will take one or two minutes for eacharrest made, it requires far less time to complete the form than it takes to later sendan investigator to the court to research the disposition for evidence disposal.

Important: District Offices will affix the District Office address stamp at thebottom of the blue copies of all Forms JUS 8715. This will ensure that dispositionsare returned to the proper District Office, and not Headquarters.

The District Office or Specialized Unit is not required to retain a copy ofForm JUS 8715.

California Penal Code

13100. The Legislature finds and declares as follows:(a) That the criminal justice agencies in this state require, for the performance of their official

duties, accurate and reasonably complete criminal offender record information.(b) That the Legislature and other governmental policy making or policy-researching bodies,

and criminal justice agency management units require greatly improved aggregate informationfor the performance of their duties.

(c) That policing agencies and courts require speedy access to information concerning allfelony and selected misdemeanor arrests and final dispositions of such cases.

(d) That criminal justice agencies may require regular access to detailed criminal historiesrelating to any felony arrest that is followed by the filing of a complaint.

(e) That, in order to achieve the above improvements, the recording, reporting, storage,analysis, and dissemination of criminal offender record information in this state must be mademore uniform and efficient, and better controlled and coordinated.

13151. The snperior or municipal court that disposes of a case for which an arrest wasrequired to be reported to the Department of Justice pursuant to Section 13150 or for whichfingerprints were taken and submitted to the Department of Justice by order of the court shallassure that a disposition report of such case containing the applicable data elements enumeratedin Section 13125, or Section 13151.1 if such disposition is one of dismissal, is furnished tothe Department of Justice within 30 days according to the procedures and on a formatprescribed by the department. The court shall also furnish a copy of such disposition report tothe law enforcement agency having primary jarisdiction to investigate the offense alleged in thecomplaint or accusation. Whenever a court shall order any action subsequent to the initialdisposition of a case, the court shall similarly report such proceedings to the department;(Emphasis added. )
