Definitions:

The following definitions apply across all resource consents:

Resource Consents Means Discharge Consents ATH-?.00, ATH-?.00 and ATH-?.00.

Business hours 0800 hours to 1700 hours on a Monday to Friday (inclusive) excluding weekends and public holidays during daylight saving periods and 0800 to 1500 during other periods.

Activities Means the Activities authorised by the Resource Consents

Treated Wastewater Means secondary treated wastewater derived from the Consent Holder’s Levin wastewater treatment plant.

Land Treatment Area Means the land identified on Figure A8b-P Dated (7 June 2018) to which Treated Wastewater will be applied.

Land Treatment System Means the system used to discharge Treated Wastewater by irrigation onto or into the Land Treatment Area.

Pond Infiltration Means the discharge of wastewater through the base of the storage pond.

Regulatory Manager Means the Regulatory Manager of the Manawatu-Wanganui Regional Council.

Planning Manager Means the Planning Manager of Horowhenua District Council.

1 Except as otherwise required by any other condition of the Resource Consents, the Activities must be carried out in general accordance with the following information provided by the applicant (collectively referred to as ‘the Application’):

a. Levin Wastewater Discharge - Resource Consent Application and AEE, dated June 2018 including Appendices A to G

2 Where there are inconsistencies between the Application and the further information provided by the Applicant, the most recent information applies. In addition, where there are inconsistencies between information provided by the applicant and conditions of the resource consent, the conditions of the Resource Consents apply.

Advice Note: Any variance from the location, design concepts and parameters, implementation and / or operation may require a new resource consent or a change of consent conditions pursuant to section 127 of the Resource Management Act 1991.

3 The Consent Holder is responsible for all contracted operations related to the exercise of the Resource Consents, and must ensure contractors are made aware of the conditions of the Resource Consents and ensure compliance with those conditions.

4 A copy of the Resource Consents must be kept onsite at all times and must be produced without unreasonable delay upon request from a servant or agent of the Manawatu-Wanganui Regional Council and/or Horowhenua District Council.

Monitoring, Inspections, and Complaints

5 In respect of monitoring required by the Resource Consents, the following apply:

a. All monitoring and sampling techniques employed in respect of the conditions of the Resource Consents must be carried out by suitably experienced and qualified persons;

b. All analytical testing other than on-site measurements, undertaken in connection with these Resource Consents must be performed by a laboratory that is IANZ accredited for the analytical tests or any other method approved in advance in writing by the Regulatory Manager;

c. All soil and water sample analyses must be undertaken in accordance with the methods detailed in the "Standard Methods For The Examination Of Water And Wastewater, 2017" 23rd edition by A.W.W.A., A.P.H.A. and W.E.F., or any other method approved in advance in writing by the Regulatory Manager; and

d. If any monitoring sites are identified as unsuitable, alternative monitoring sites must be identified by the Consent Holder and developed within a reasonable time after written certification from the Regulatory Manager.

6 The Consent Holder must ensure that the above ground physical infrastructure of the Land Treatment System and the Land Treatment Area is inspected weekly when operational, and that relevant parts of the systems are also inspected whenever any alarms associated with the systems are activated.

7 If any significant failures, blockages and/or breaks that are likely to cause an adverse environmental effect are identified in the course of an inspection under Condition 6 or otherwise, the parts of the system affected must cease operation and not recommence until the failure, blockage and/or break is remedied. The Consent Holder must notify Regulatory Manager and Planning Manager within 48 hours of identifying the failure, blockage and/or break and once the failure, blockage or break is fixed.

8 The Consent Holder must maintain for the duration of the Resource Consent, a legible sign visible at the entrance gateway on Hokio Sand Road clearly advising the public of the presence of the Treated Wastewater discharge and the public health hazard it poses.

8 The Consent Holder must maintain and make available to Regulatory Manager and the Planning Manager on request, a record of complaints which lists all complaints received alleging adverse effects attributable to the Activities. The record must include but not be limited to the following:

a. Name, address and contact details of the complainant (if given);

b. The nature and duration of the effect;

c. The date and time the effect was detected;

d. The location where the effect was detected;

e. The prevailing weather conditions e.g. wind speed and direction;

f. Description of the Activities occurring at the time of the complaint;

g. Description of investigations carried out and their outcomes;

h. The likely cause of the effect detected; and

i. Any measures taken to avoid and mitigate the alleged effect.

9 The Consent Holder must notify the Regulatory Manager and Planning Manager of any complaints alleging adverse effects attributable to or associated with the Activities covered by these consents within 24 hours of the complaint being received.

10 The Consent Holder must, within 24 hours notify the Regulatory Manager and Planning Manager, and keep a record of, any spillage of material that causes any damage to soil and or vegetation in the Land Treatment Area or creates any noxious, dangerous, offensive or objectionable odour beyond the property boundary.

Management Plans

11 The Consent Holder must prepare and submit to the Regulatory Manager and Planning Manager for technical certification, within the timeframes stated, the management and monitoring plans listed in Table 1 below. The plans:

a. Must give effect to the relevant requirements outlined in the conditions ?/?/?, ATH-?.00, ATH-?.00 AND ATH-?.00; and

b. Each plan shall detail which consent conditions the plan is giving effect to in achieving the stated objectives for the plan found within these conditions.

13 The plans listed in Schedule 1: Condition 11 Table 1 must be submitted within their respective timeframes to the Regulatory Manager and the Planning Manager, for written technical certification:

a. Should certification of the plan be withheld, the reasons for this will be provided to the Consent Holder within 15 working days of receipt of the plan by the managers. The Consent Holder must submit a revised plan to the Managers for technical certification within 20 working days of the reasons being provided. Should certification of the revised manual or plan be withheld then the Consent Holder must within 10 working days engage a suitably qualified mutually acceptable independent person for resolution of the matters of dispute and his or her decision on those matters must be final. The costs of dispute resolution must be met by the Consent Holder;

b. A plan may be varied by the Consent Holder. The certification process for a variation of a plan must follow the process outlined in Conditions 13(a); and

c. The Consent Holder must exercise the Resource Consents in accordance with, and comply with, the provisions of any certified manual or plan (including any certified variation) at all times.

14 After the OMP is certified under Condition 13 The Consent Holder must review the Operation and Management Plan by 31 October of every following year, to incorporate any proposed changes to the management of the Activities. Following each review, the Operation and Management Plan, including any proposed changes must be submitted to the Regulatory Manager and Planning Manager for technical re-certification using the process in Condition 13 before 30 November of the same year.

Advice Note: Where no changes are proposed to the management of the Activities, a statement to this effect will suffice to comply with this condition.

16 The Consent Holder must prepare an Operation and Management Plan (OMP). The OMP must include (but not be limited to) the following:

a. A description of the Levin Treated Wastewater storage and Land Treatment System (including a site map indicating the locations of discharge infrastructure), the Irrigation area (including the size), and monitoring sites;

b. Intended operation and maintenance procedures for the Levin Treated Wastewater storage and the Land Treatment System, including the pipelines to the land discharge points (irrigation risers) and how the systems will be operated and maintained to comply with these General Conditions and the Conditions of Discharge Consents ATH-?.00, ATH-?.00 and ATH-?.00 (to land from pond infiltration, to air, and to land by irrigation);

c. Defined responsibilities for the Consent Holder and the Land Treatment Operator, regarding the operation, maintenance, monitoring and reporting of the Land Treatment System activities;

d. Management of the Land Treatment System operation including record keeping;

e. The measures to be implemented to control, regulate and record irrigation application, including application depths and nutrient loading and details about how the Land Treatment Area will be managed;

f. The measures to be implemented to control, regulate and record the Treated Wastewater storage pond volumes and the appropriate irrigation discharge protocol for varying pond levels and seasons;

g. Measures to ensure the Treated Wastewater irrigated remains aerobic;

h. Key operational matters, including daily, weekly and monthly maintenance checks, inspections after heavy rain, and the keeping of a maintenance register to record the details of all maintenance events or any system malfunctions;

i. Monitoring and reporting procedures required to demonstrate compliance with these General Conditions and the Conditions of Discharge Consent ATH-?, ATH-?.00 and ATH-?.00 (to land from pond infiltration, to air and to land by irrigation);

j. A risk assessment plan and contingency plan, including a trouble shooting guide, in the event of Levin Land Treatment System malfunctions or breakdowns;

k. Procedures for receiving, recording and responding to all complaints in accordance with General Conditions 8 and 9;

l. Procedures and processes for the management of odour from the Land Treatment Area;

m. Mitigation and contingency measures for controlling odour, aerosols, ponding and surface run-off within and from the Land Treatment Area;

n. Monitoring, risk management, and contingency plans, including a trouble shooting guide for system malfunctions and breakdowns;

o. Measures to ensure that the Activities do not result in any erosion or destabilisation of the Land Treatment Area’s soils;

p. Procedures for managing hydrophobic conditions of soils within the Land Treatment Area;

q. A protocol and programme for reviewing the effectiveness of the management plan; and

r. 5-yearly review of wastewater inflows and quality to ensure the Levin Land Treatment System are adequate.

Advice Note: The purpose of the Operation and Management Plan is to outline the operation and maintenance of the Levin wastewater discharge system to land, and to manage the discharge of Treated Wastewater to land in accordance with the Resource Consents and within the constraints of land availability, wastewater storage, soil and groundwater conditions, odour and aerosol control, and risks to human health.

Cultural Monitoring

24 The Consent Holder must invite iwi who submitted on the Resource Consents to undertake Cultural Health Index Monitoring according to their respective tikanga. If the engagement is accepted, the Consent Holder must commission iwi who submitted on the Resource Consents (as applicable) to undertake Cultural Health Index Monitoring in compliance with the Cultural Health Index Monitoring Protocol prepared in accordance with Condition 25. The Consent Holder must contribute up to $? Per year for the life of the Resource Consents to iwi who submitted on the Resource Consents (as applicable) for monitoring and reporting in accordance with the protocol. The contribution is payable on receipt of a fully itemised invoice and the monitoring report for the applicable year. On receipt of a monitoring report by iwi who submitted on the Resource Consents (as applicable) the Consent Holder must summarise the report and any responses to it in the next annual monitoring report, prepared in accordance with Condition 29, and append a full copy.

25 The Consent Holder must consult iwi who submitted on the Resource Consents on the development of a Cultural Health Index Monitoring Protocol. If iwi who submitted on the Resource Consents wish to develop a protocol, that protocol as a minimum, must:

a. describe the relationship of iwi who submitted on the Resource Consents (as applicable) to the discharge area and the sites of interest to iwi who submitted on the Resource Consents (as applicable) on the land to which these Permits apply;

b. describe the tikanga of the iwi who submitted on the Resource Consents (as applicable) relevant to the proposed cultural monitoring (including kaitiakitanga, mauri of awa, whenua, tangata, whanaungatanga and te ha tawhirimatia), the activities, and the site(s);

c. identify and map (with map references) the site(s) to be monitored;

d. set out the frequency of monitoring;

e. describe the procedures required to access the application site for the monitoring (in particular health and safety requirements);

f. identify the parameters and methods used for the monitoring; and

g. set out the matters to be included in the Cultural Health Index Monitoring Report and the frequency of the reporting obligations.

26 At least two months before the commencement of Cultural Health Index Monitoring under Condition 24, the Consent Holder must provide the Regulatory Manager and Planning Manager with the iwi who submitted on the Resource Consents (as applicable) Cultural Health Index Monitoring Protocol (if any).

27 On completion of the protocol (if any) the Consent Holder must contribute up to $? To iwi who submitted on the Resource Consents (as applicable) to assist with the development of the protocol. The contribution is payable on receipt of a fully itemised invoice and the completed protocol.

28 Every 5 year anniversary from the date of the completion of the first protocol (if any), iwi who submitted on the Resource Consents may review their protocol. If a review is to be undertaken iwi who submitted on the Resource Consents (as applicable) must inform the Consent Holder within 1 month prior to the 5 year anniversary of any recommend changes. If the Consent Holder receives recommend changes within that time, the Consent Holder must consult with iwi who submitted on the Resource Consents (as applicable) on those recommended changes. The Consent Holder may either accept or decline those recommendations and where declined must advise iwi who submitted on the Resource Consents (as applicable) of its reasons. If the protocol is amended in accordance with this condition the Consent Holder must provide a copy to the Regulatory Manager, and the Planning Manager within one month of responding to the iwi who submitted on the Resource Consents (as applicable).

29 In the event of an archaeological site, waahi tapu, or koiwi being discovered or disturbed during the Activities authorised by these resource consents, the Consent Holder must immediately cease further work in the immediate area and inform the land owner, Muaupoko Tribal Authority Inc, Ngati Raukawa, the Regulatory Manager, Heritage New Zealand, and (in the event that human remains are found) the New Zealand Police. Further work at the site must be suspended while iwi carry out their procedures for removal of taonga. The Regulatory Manager will advise the Consent Holder when work can resume.

Reporting and Mitigation Measures

30 By 1 October of each year, the Consent Holder must provide the Regulatory Manager and Planning Manager an annual monitoring report for the previous 12 month period (1 July to 30 June). The annual monitoring report must include (but is not limited to):

a. A summary and interpretation of analyses and records collected in accordance with these General Conditions and the Conditions of Discharge Consents ATH -?.00, ATH -?.00 and ATH ?-.00 (to land from pond infiltration, to air and to land by irrigation);

b. A comment on compliance with each of these General Conditions and the Conditions of Discharge ATH -?.00, ATH -?.00 and ATH ?-.00 (to land from pond infiltration, to air and to land by irrigation);

c. A summary of inspections made on the physical infrastructure in accordance with Condition 6 of these General Conditions and any other inspections as identified in plans required by Condition16;

d. In relevant years, results of soil sampling required by Condition ? of Discharge Consent ATH – ?.00 (to land) and an analysis to determine whether any material change in soil quality has occurred and actions taken to remedy any nutrient deficiency or excess;

e. Results of groundwater monitoring required by Conditions ? and ? of Discharge Consent ATH – ?.00 (to land) and Conditions 2 and 3 of Discharge Consent ATH – ?.00 (pond infiltration), including an assessment of whether there has been a decline in groundwater quality due to the Activities;

f. The daily and annual volume of discharges to land;

g. A summary of the daily water levels of Treated Wastewater storage;

h. A schedule of any complaints recorded during the year and any follow up actions undertaken; and

i. Any measures that have been undertaken, or are proposed to be undertaken in the upcoming 12 months, to maintain, optimise, or enhance the environmental performance of the wastewater treatment and discharge system.

31 The Consent Holder must for the term of the Resource Consents maintain riparian planting along the margin along the northern edge of the Waiwiri Stream as shown in Figure A6b-P.

32 The Consent Holder must for the area identified in Condition 31 within 2 years from granting of this consent plant eco-sourced native trees that will upon maturity provide shade across the stream channel.

33 Algicides shall not be used for the mitigation of algae blooms in the ‘Pot’ without prior consultation with the Regional Council, and approval as to the methods of application.

Description

The activities authorised by this Discharge Consent are restricted to the discharge of Treated

Wastewater by way of infiltration through the floor and walls of The Pot infiltration pond.

Definitions

As per the definitions in Schedule 1.

No. Wording

1 This Consent is subject to the General Conditions in Schedule 1 and the specific conditions of this Consent, which must be complied with at all times.

2 Groundwater quality and level must be monitored at the bores identified on Figure A10b-1-P dated 02/2018 attached to and forming part of this Consent. This includes P3 nested, P4 nested, P5 nested, P6, and P7.

3 The Consent Holder must undertake groundwater sampling every three (3) months, from the commencement of this Consent. Samples must be collected from the wells described in Condition 2 above and the samples must be analysed for the following:

a. Total Phosphorus (TP); b. Dissolved Reactive Phosphorus (DRP);

Electrical Conductivity (EC) (field measurements); j. Chloride; k. Static water level (field measurements); l. pH (field measurements); and m. ScBOD5.

4 The Consent Holder shall maintain a storage pond water level monitor and record its output at least once daily.

5 By 1 October each year commencing October 2019 the Consent Holder must prepare a report that summarises and assesses all of the monitoring information required under Consent Condition 3, for the preceding 12 months (1 July to 30 June) or part thereof for the duration of this Consent. The raw monitoring data must also be included within this report. This report must include (but not be limited to) the results from groundwater monitoring conditions, a compliance assessment against consent conditions, a description of any issues and how these have been and/or will be mitigated and any proposed improvements or changes.

6 By 1 October every five years from the commencement of this Consent, a 5 yearly groundwater quality report must be prepared, with the first report being due no later than 1 October 2024. This report must be submitted to the Regulatory Manager and must include a summary and analysis of the groundwater quality data from the preceding 4 years of data plus the 5th year information and analysis of the results looking for trends and effects of pond infiltration on groundwater quality since commencement of this Consent.

7 The Manawatu-Wanganui Regional Council may, under section 128 of the Resource Management Act 1991 initiate a review of these conditions every 5 years in the month of July, commencing in July 2024 for the duration of this consent. The review shall be for the purposes of avoiding, remedying or mitigating any adverse effects on the environment which may arise from the exercise of this Consent. The review shall allow for the consideration of the following matters:

a. The modification of the monitoring program, including reviewing the frequency of the monitoring or the determinants required;

b. Requiring compliance with any relevant rule of an Operative Regional Plan or any National Policy Statement; c. The deletion, amendment or addition of new Conditions as necessary to avoid, remedy or mitigate any

adverse effects on the environment, including but not limited to conditions to mitigate any adverse effects attributed to any breach of any conditions;

d. Addressing any more than minor unintended adverse effects on the environment which may arise at a later stage;

e. Review of the effectiveness of the standards in the conditions in addressing any adverse effects on the receiving environment;

f. Requiring the Consent Holder to adopt the Best Practicable Option to remove or reduce any adverse effects on the environment; and

g. Achieving an outcome that arises from a review that is initiated by the equivalent review condition in Discharge Consents ATH-?.00, or ATH-?.00.

8 The review under Condition 7 may result in any of the following outcomes to ensure that any more than minor unintended adverse effects are appropriately mitigated:

a. The deletion or amendment of any conditions of the Consent; b. The addition of new conditions requiring the Consent Holder to adopt the best practicable option; c. Achieving an outcome that arises from a review that is initiated by the equivalent review condition in Consents

ATH-?.00, or ATH-?.00.

Definitions:

No. Wording

1 This Consent is subject to the General Conditions in Schedule 1 and the specific conditions of this Consent, which must be complied with at all times.

Treated Wastewater Quality Standards and Monitoring

2 The Consent Holder must ensure that the Treated Wastewater sampled from the sampling port installed in accordance with Condition 3 and sampled while the discharge is occurring meets the following standards:

(a) The pH must not be less than 6.8 as a median of five consecutive monthly samples;

(b) The Dissolved Oxygen (DO) must not be less than 1.0 g/m3 as a median of five consecutive monthly samples;

(c) The concentration of Soluble Carbonaceous five day Biochemical Oxygen Demand (ScBOD5) must not exceed 40 g/m3 as a median of five consecutive monthly samples;

(d) The concentration of Total Suspended Solids (TSS) must not exceed 40 g/m3 as a median of five consecutive monthly samples;

(e) The concentration of Total Nitrogen must not exceed 45 g/m3 as a median of five consecutive monthly samples; and

(f) The concentration of Escherichia coli (E. coli) must not exceed 500,000 cfu/100 mL as a median of five consecutive monthly samples,

3 The Consent Holder must maintain a sampling port in the pipeline immediately prior to the Land Treatment System.

4 The Consent Holder must take samples of Treated Wastewater from the sampling port installed in accordance with Condition 3 once per month while the discharge is occurring. The samples must be analysed for:

a. Soluble Carbonaceous five day Biochemical Oxygen Demand (ScBOD5);

b. Total Suspended Solids (TSS);

c. Total Nitrogen (TN);

d. Ammoniacal-Nitrogen (NH4-N);

e. Nitrate Nitrogen (NO3-N);

f. Nitrite Nitrogen (NO2-N);

g. Total Phosphorus (TP);

h. Dissolved Reactive Phosphorus (DRP);

i. Sodium (Na);

j. Potassium (K);

k. Magnesium (Mg);

l. Calcium (Ca);

m. Escherichia coli (E. coli);

n. pH (field measurement); and

o. Dissolved oxygen (DO) (field measurement).

Flow Monitoring

5 The Consent Holder must measure and record the Treated Wastewater volumes using flow meters. The flow meters must record:

a. Inflow to The Pot storage pond; and

b. Discharge to irrigation.

6 The Treated Wastewater flow meters must be calibrated and maintained to have an accuracy of +/- 5% or better. The daily total flow records must be transferred daily to the Manawatu-Wanganui Regional Council either via a telemetry system or similar system such as File Transfer Protocol (FTP) in a format compatible with the Manawatu-Wanganui Regional Council systems.

7 The Consent Holder must maintain a record of all irrigation Activities. This record must be readily available to the Regulatory Manager and include but not be limited to the date, time, location and volume of each Treated Wastewater discharge application.

Discharge Criteria

8 The Consent Holder must ensure that at all times the discharge of Treated Wastewater is controlled so that the discharge of Treated Wastewater onto or into land does not exceed:

a) Prior to [date] (18 months following granting of consents):

i. 100 mm in any one application; and

ii. 20,000 m3/d; and

iii. 70,000 m3/wk.

b) Thereafter:

i. 50 mm in any one application; and

ii. 100 mm/wk.

9 The Consent Holder must ensure that the design of land discharge areas and the rate, frequency and method of the discharge of Treated Wastewater does not result in:

a. Run-off to surface water, surface drains or sub-surface drains; or

b. Any ponding on the soil surface; or

c. Anaerobic soil conditions; or

d. Uneven distribution as far as practicable across the entire Land Treatment area; or

e. A non-compliance with any other condition of this consent.

Advice Note: Ponding for the purposes of this condition is defined as a depth of Treated Wastewater greater than 25 mm covering a continuous area exceeding 10 m2 or a combined area greater than 20 m2 during and following irrigation, or any Treated Wastewater on the soil surface five hours after irrigation has occurred.

10 The Consent Holder must ensure that Treated Wastewater is not discharged to land within the Land Treatment Area in such a manner that would result in direct irrigation or spray drift closer than:

a. 20 m from any water body, whether flowing continuously or intermittently, including any open drain;

b. 20 m from any property boundary where there are no buildings;

c. 150 m from the existing dwelling house on Hokio Sand Road;

d. 25 m from any recognized archeological site; and

e. The outer dripline of the existing Kanuka habitat and wetland habitat identified on Figure A6b-P.

Advice Note: For the purpose of Condition 10 (e), dripline means the area defined by the outermost circumference of a tree canopy where the water drips from and falls onto the ground vertically below. For the avoidance of doubt, Condition 10(d) does not apply to discharges by way of infiltration from The Pot storage pond.

Advice Note: For the purpose of Condition 10 (e), Kanuka habitat, and for that matter any other indigenous vegetation, applies to vegetation that existed at 31 December 2017, noting that indigenous vegetation is being planted for the intended purpose of wastewater irrigation.

Monitoring

11 The Consent Holder must undertake annual composite soil samples from two (2) areas that have received Treated Wastewater during the previous 12 month period (starting 1 October of any given year and ending 30 September of the following year) for the duration of this Discharge Consent. Six 75 mm depth composite soil samples must be analysed for the following:

a. pH;

b. Exchangeable Sodium (Na);

c. Exchangeable Sodium percentage (ESP);

d. Exchangeable Potassium (K);

e. Exchangeable Magnesium (Mg);

f. Exchangeable Calcium (Ca);

g. Phosphorus (Olsen P);

h. Sulphate-S;

i. Total Nitrogen; and

j. Cation Exchange Capacity (CEC).

12 The Consent Holder must every five (5) years undertake composite soil samples from two (2) areas that have received Treated Wastewater during the previous 12 month period (starting 1 October of any given year and ending 30 September of the following year) for the duration of this Discharge Permit. A 450 to 550 mm depth composite soil sample must be analysed for the following:

(a) pH;

(b) Exchangeable Sodium (Na);

(c) Exchangeable Sodium percentage (ESP);

(d) Exchangeable Potassium (K);

(e) Exchangeable Magnesium (Mg);

(f) Exchangeable Calcium (Ca);

(g) Phosphorus (Olsen P);

(h) Sulphate-S;

(i) Total Nitrogen; and

(j) Cation Exchange Capacity.

13 Groundwater quality and level must be monitored at the bores identified on Figure A10b-1-P attached to and forming part of this Consent. This includes: P3 nested, P4 nested, P5 nested. P6 and P7.

14 Surface water quality must be monitored at the locations identified on Figure A10b-2-P attached to and forming part of this Consent. This includes: Stream #2, Stream #4 and Drain #3.

15 The Consent Holder must undertake groundwater sampling every three (3) months, and surface water sampling every six (6) months, for the period from the commencement of this consent. Samples must be collected from the locations described in Condition 13 and 14 and the samples must be analysed for the following:

a. Total Phosphorus (TP);

b. Dissolved Reactive Phosphorus (DRP);

c. Total Nitrogen (TN);

d. Nitrate Nitrogen (NO3-N);

e. Nitrite nitrogen (NO2-N);

f. Ammoniacal-Nitrogen (NH4-N);

g. Escherichia coli (E. coli);

h. Dissolved Oxygen (DO) (field measurements);

i. Electrical Conductivity (EC) (field measurements);

j. Chloride;

k. Static water level (field measurements);

16 The Consent Holder must prepare an annual Mitigation Strategy summary (for the 12 month period starting 1 October and ending 30 September) every year which must describe and report on:

a. A list of all mitigation measures undertaken in the previous 12 month period; b. All investigations undertaken to ascertain if nutrient load to surface water can be reduced; c. Survival and growth conditions of all vegetation planted for mitigation purposes; and d. plans for further mitigation in the pending 12 months to 5 years.

17 The annual Mitigation Strategy summary prepared in accordance with Condition 16 must be submitted to the Regulatory Manager by 31 October of each the mitigation is undertaken.

Reporting

18 By 1 October each year the Consent Holder must prepare a report that summarises and assesses all of the monitoring information required under Conditions ?, ?, ?, ? and ? for the preceding 12 months (1 July to 30 June) or part thereof for the duration of this Consent. The report must include a copy of the raw monitoring data from Conditions ?, ?, ? and ?. The report must assess whether compliance has been achieved with Conditions ?, ?, and ?. This report must be forwarded to the Regulatory Manager in a suitable electronic format. This report must include the following results from soil sampling conditions, groundwater monitoring conditions and irrigation records (but not be limited to):

a. inflows, outflows, volumes irrigated,

b. groundwater and surface water quality data,

c. Treated Wastewater quality data,

d. information around the daily measurements made by the operator to determine irrigation scheduling,

e. comparison against / compliance with consent conditions,

f. consideration/evaluation of the data and the relevance of it in terms of effect,

g. a description of any issues and how these have been /will be mitigated, and

h. any proposed improvements or changes.

Reviews

19 The Manawatu-Wanganui Regional Council may, under section 128 of the Resource Management Act 1991 initiate a review of these conditions every 5 years in the month of July, commencing in July 2024, for the duration of this consent. The review shall be for the purposes of avoiding, remedying or mitigating any adverse effects on the environment which may arise from the exercise of this Consent. The review shall allow for the consideration of the following matters:

a. The modification of the monitoring program, including reviewing the frequency of the monitoring or the determinants required;

b. Requiring compliance with any relevant rule of an Operative Regional Plan or any National Policy Statement;

c. The deletion, amendment or addition of new Conditions as necessary to avoid, remedy or mitigate any adverse effects on the environment, including but not limited to conditions to mitigate adverse effects attributed to any breach of any conditions;

d. Addressing any adverse effects on the environment which may arise at a later stage;

e. Review of the effectiveness of the standards in the conditions in addressing any adverse effects on the receiving environment;

f. Review of the exceptional circumstances for discharge volume and associated limits when such circumstances are regular rather than exceptional.

g. Requiring the Consent Holder to adopt the Best Practicable Option to remove or reduce any adverse effects on the environment; and

h. Achieving an outcome that arises from a review that is initiated by the equivalent review condition in Discharge Consents ATH-?.00, ATH – ?.00, ATH – ?.00.

the FIDOL Factors). For the avoidance of doubt, this Condition does not apply at the property boundaries within and contiguous with the Land Treatment Area.

3 In the event that the Consent Holder becomes aware of a breach of Condition 2 the Consent Holder must notify the Regulatory Manager within two hours of first becoming aware of the breach.

4 The Consent Holder must not irrigate Treated Wastewater to land in an un-fresh/anaerobic state by ensuring that the Dissolved Oxygen is greater than 0.0 g O2/m3 at the Pot pond inlet to the Land Treatment System.

Monitoring and Complaints

5 If directed in writing by the Regulatory Manager following a review of odour complaints, or following verification of an offensive or objectionable odour that is attributable to the wastewater irrigation system, the Consent Holder must undertake the odour monitoring in accordance with Condition 6.

Advice note: Manawatu - Wanganui Regional Council staff or suitably qualified independent persons engaged by the Regional Council shall, when assessing compliance with this condition, verify the presence of any ambient odour by recording the Frequency, Intensity, Duration, Offensiveness and Location of the odour or spray drift (i.e. the FIDOL Factors). For the avoidance of doubt, this Condition does not apply at the property boundaries within and contiguous with the Land Treatment Area.

6 The monitoring required in Condition 5 must be conducted by an appropriately qualified and experienced independent person, and be in general accordance with the German VDI Standard 3940 or any similar standard certified as appropriate by the Regulatory Manager. If a recognisable wastewater odour is detected, then an upwind assessment should also be undertaken as necessary to confirm or otherwise if the odour is due to the wastewater storage or irrigation activity.

7 On completion of the monitoring required in Condition 5, the Consent Holder must submit to the Regulatory Manager a report summarising the findings of the odour monitoring and significance any of odour effects identified, together with any recommendations for changes to appropriate management plans, downwind monitoring procedures and a timeline for any required engineered or process changes that are identified. The timetable for the implementation of process or engineering changes shall be within six months of submitting the report to the Regulatory Manager unless a later date is agreed.

8 Following receipt of an odour complaint the Consent Holder must investigate the source of any odours within 24 hours of receiving the complaint during business hours or within 72 hours outside business hours and promptly take remedial action as necessary. Within 5 working days of receiving a complaint, the Consent Holder must provide a written report to the Regulatory Manager that specifies:

a. Details of the complaint; b. Weather conditions at the time of the event; c. Details of wastewater discharge events; d. Actions taken to investigate the complaint; e. Outcomes of the investigation including the cause or likely cause of the event; f. The nature and timing of any measures implemented by the Consent Holder to avoid, remedy, or mitigate

any more than minor and unintended adverse effects; and g. Actions to be taken in the future to prevent recurrence of future similar events.

Advice Note: Should there be a series of complaints related to a single incident then only one investigation and one report covering the incident and related complaints needs to be completed by the Consent Holder.

9 In the event that a report required under Condition 7 confirms significant odour effects and identifies process or engineering changes required to mitigate these, then the Consent Holder shall repeat the odour monitoring as per the procedures specified within Conditions 5 and 6 to confirm the effectiveness of revised odour management procedures and/or mitigation measures. This second round of monitoring should be completed following the implementation of the necessary changes in procedures and processes that were identified as being necessary to

mitigate the significant odour effects. The results of the further monitoring shall be submitted to the Regulatory Manager within 10 working days of the monitoring being completed.

Review
