Preface
Annual Report, as stipulated under Section 12(6) of Jharkhand
Lokayukta Act 2001 for the year 2011-12 is being presented. This is fourth
Annual Report of this office.
Jharkhand Lokayukta Act was enacted in the year 2001. The office of
Lokayukta Jharkhand became functional on 4th of December 2004 after a
former Judge of Jharkahnd High Court, Justice Laxman Oraon was appointed
as the first Lokayukta of Jharkhand. After his superannuation as Lokayukta on
4th of December, 2009, I was appointed as Lokayukta Jharkhand. I assumed
office on 3rd January, 2011.
The objective for setting up the Lokayukta organization was to
effectively deal with the cases of the acts of misconduct, abuse of power and
corruption on the part of the public servants so that governance in the State
improves. A corrupt public servant is menace to the society because he brings
the governance into dispute, shakes the faith of the people in the rule of law,
deprives the common man to get benefits which he would otherwise have got
by expenditure of massive public fund and makes him face serious problems
in the pursuit of the daily activities.
During last one year of tenure I have felt that the office of Lokayukta Jharkhand is not that effective as other states like Madhya Pradesh, Karnatka, Maharashtra, Andhra Pradesh, Keral and Bihar. If the state Government really intends to curb on corruption and maladministration then it should seriously think to take immediate steps towards the following.
(i) Amendment should be made in the Act and provision should be made to tag one investigation Agency totally under the Lokayukta so that independent and fair enquiry can be made by the Lokayukta without any unnecessary delay.
(ii) Lokayukta should be given power to conduct raid, search and seizure, to attach the property acquired illegally by the corrupt public servants.
(iii) In order to curb corruption prevailing in the State Government officials, the institution of Lokayukta has to be made powerful like the State of Madhya Pradesh, Uttarakhand, Karnatka and Bihar.
Though the office of Lokayukta is functional in the State of Jharkhand
since December 2004 but the fact remains that the general public of the State
of Jharkhand do not know much about the existence of post of Lokayukta as
well as the objective for which has been created. They should also know the
powers and functions which are exercisable by the Lokayukta. Therefore it is
most important to make the general public aware about the existence of the
office of Lokayukta and to make them aware as to how they can utilize this
office for redressal of their grievance and complaint regarding inaction,
maladministration, abuse of power and corruption against the State
Government machinery. General public must know as to how they can avail
the facilities offered by the institution of Lokayukta.
And for this purpose website of the office was launched on 27th of
August, 2011. It was inaugurated by Hon’ble Sri Arjun Munda, Chief Minister
of Jharkhand. Apart from that the Lokayukta Act bearing all the relevant facts
& provision of the Lokayukta Act has been published by this office with the
help of Jharkhand Legal Services Authority through leaflet in the F.A.Q. form.
One another leaflet containing the activities of the Lokayukta office has also
been published and distributed in order to make awareness among the
people. These leaflets were distributed among the public, through
workshop/Seminar and Mobile legal awareness camps. The Mobile legal
awareness van was flagged of on 2nd December, 2011 with the slogan of
“Fight against Corruption”. Two audio CDs describing the activities and
functioning of this office were also launched. Consequently filings of cases
are increasing day by day. Photograph of all these activities has given under
the head Achievement & Activities.
During my tenure of one year and three months all together 855
complaints/ petitions have been filed and 455 cases have been disposed of.
Brief summary of the important cases and the action taken by the government
against the public servants on the recommendation of this office are described
in the chapter IV of this report.
During the financial year 2011-12 interview for appointment of sixteen
employees of fourth grade has been held. Result is awaited. Similarly six
employees of third grade have been recruited whereas processes of
recruitment for another four employees of third grade are in progress. Written
Test and Skill test for Computer operation has already been held. Interview is
awaited.
Besides all this efforts, we are facing paucity of adequate office space
and infrastructure. In the absence of independent building the office of the
Lokayukta is presently running in an old building in the campus of Audrey
House in which several other offices e.g. Vigilance Bureau, Hajj Committee,
Commercial Taxes Tribunal etc. are functioning. Even no separate court room
for hearing of cases, visitors rooms Library Hall, have been provided. The
litigants and the office staff are suffering for want of proper accommodation
and lavatory etc.
Apart from that in the absence of investigating agency the office of the
Lokayukta is feeling handicapped. We have to depend on the other agency
like State Police, Vigilance Bureau, and C.I.D. who are themselves
overburdened with their own work causing unnecessary delay in the disposal
of the cases. Though several letters and reminders (As mentioned in
Appendix IV) have been sent for providing the investigating agency for smooth
functioning of this office but to no effect. Similarly request letter has also been
sent to create the permanent post of Data entry Operators and Drivers but
nothing has been heard. This is within the knowledge of our state
administration that in several states including the State of Bihar there is
separate office building with sufficient accommodation and independent
investigating agency of the Lokayukta.
At the end, I would like to say that this Institution is performing its duties
as effectively as possible with the limited resources available. I earnestly
believe that the government will give due consideration to the difficulties and
problems pointed out in this report and will take appropriate action to resolve
them in order to make the office of Lokayukta to be more effective in curbing
corruption from the Government machinery.

01. Case No. 01/Lok(Revenue)08/2006Re- Recommendation for legal action against ADM (Law & Order) for
appointment of Principal of College with malafide intention. Shri Jitendra Pradad, Professor, Coal field College Bhaga, Jharia
Dhanbad lodged a complaint on 29.-03-2006, making a grievance that Sri Raj
Mohan Tiwari, ADM(Law & Order) Dhanbad, in the capacity of the Secretary of
the Governing Body of Coal field College, Bhaga Dhanbad is violating the order
of Dy.Commissioner Dhanbad and disregarding the instructions of Vinoba
Bhave University and also in violation of the High Court's order by misusing his
power, passed an order for removal of the complainant from the post of
Principal and reappointed Sri S N Vaidya, the retired Principal, again as the
Principal of said college.
The matter was enquired in detail and the report was called for from
Dy.Commissioner, Dhanbad, Vinoba Bhave University and C.I.D. of the state
govt. On the basis and facts of the enquiry report submitted by the above
authorities, it was found that Sri Raj Mohan Tiwari, the then ADM(Law&Order)
Dhanbad had illegally reappointed Sri S N Vaidya (Retired Principal) as the
Principal of Coal Field College, Bhaga Dhanbad and committed several
financial irregularities .
Accordingly, recommendation to the State Govt. take legal action by
lodging FIR and also by initiating departmental action against Sri Raj Mohan
Tiwari was passed.
02. Case No. 02/Lok(Edu)04/2011

Re - Recommendation for legal action against Block Education Extension Officer for corrupt practices in operation of Mid-Day-Meal scheme.A complaint petition was filed by Ramesh Kumar Chourasia, Pakur
alleging therein that Smt. Ahilya Devi, Block Education Extension Officer, Pakur
is involved in corrupt practices of Mid Day Meal scheme.
An enquiry report was called form the D.C. Pakur, who submitted his
report on the basis of enquiry made by D.S.E., Pakur where the allegations
made in the complaint were found to be true. On account of this, notice, u/s
10(i)(ka) was issued against the accused public servant Smt. Ahiliya Devi.
Meanwhile action taken report was called from D.C., Pakur who submitted that
the Secretary, H.R.D. was requested to take action against the concerned
public servant. The case was fixed for hearing. Public Servant Smt. Ahilya Devi
has submitted her case through her counsel. After conclusion of hearing of both
the sides Lokayukta has been pleased to pass final order on 16.12.2011. It was
held by Lokayukta that Public Servant Sri Ahilya Devi the then Block Education
Extension Officer has committed fraud and irregularities in the distribution of
rice under the Mid Day Meal Scheme of Government. Smt. Ahilya Devi has
failed to submit any evidence of her innocence and consequently Lokayukta
recommended to the State Govt. u/s 12(3) of the Jharkhand Lokayukta Act to
lodge an FIR and initiate the departmental proceeding against her.
03 Case No. 01/Lok (Police) 04/2008
Re - Action taken against 3 Police officials for torturing attitude & lodging of false case against an innocent person.
Complainant Gurmeet Singh has filed a complaint stating therein that he
is an office bearer of Grudwara Parbhandhak Committee and BJP unit, Katras
Mandal. Being a social worker he used to visit police station and raised the
finger against the wrong doings of police officials. Therefore police had
grievances against him.
On 17.11.2007 he was called at police station and misbehaved by officer
in- charge Sri Dev Upadhaya and inspector Sri Rama Kant Ram. The said
police officials have also arrested the complainant by lodging a false case
against him.

A report was called for from I.G., Bokaro, Range. It was reported by Sri
K.S. Meena the then Inspector General, Bokaro, Range that during the enquiry
it was found that a false case was lodged by the police against the complainant.
Therefore departmental proceedings have been initiated against both the police
officials and the investigating officer. The IG has also ordered for re-
investigation of the criminal case lodged against the complainant.
Again it was reported by the complainant that he was threatened by the
concerned police officials to withdraw the case. He has also appeared in person
and further submitted by his letter that after reinvestigation it was found that a
false police case was lodged against him. Therefore he prayed for strong action
against the police officials. Again a report was called for. Thus by the
intervention of the Lokayukta all the three police officials involved in this case
were punished by reversion/demotion to their rank. A separate criminal
proceeding have also been initiated against the erring officers u/s 211/183 IPC.
04. Case No.01/Lok(Kara)01/2011
Re - Complaint by prisoners of Chaibasa Jail for not providing proper facilities as per jail manual and other irregularities
In the instant case thirty four prisioners of Chaibasa Jail lodged a
complaint alleging therein that fooding and other facilities are not provided to
the prisoners according to the provision of the jail manual. Secondly about one
thousand prisoners have been lodged in a room having capacity of 290
prisoners only.
Report from the District and Sessions Judge as well as Superintendent
of Police was called for, who submitted their separate reports. It was reported
that a new extension building of jail has been constructed but it was in
occupation of C.R.P.F. personnel. Condition of the Library was also not good
and books were not properly kept in the library. Condition of hospital was also
very bad. Then on the direction of Lokayukta immediate effective steps was
taken to remove all the short comings in the liberary, and in the jail hospital and
to get the new extension building vacated by the C.R.P.F. I so that the prisoners
may be shifted in the new building. In compliance thereof the I.G., Prison
submitted the action taken report wherein it was reported that appropriate steps
have been taken regarding Jail Library and Hospital. So far as the adequate

accommodation for the prisoners is concerned it was stated that a request has
been made to the Deputy Commissioner, Chaibasa for vacating the extension
part of the jail building which is presently under the occupation of C.R.P.F.
Personnel.
In this view of the facts that effective measures have already been taken
in the mater the case was closed.
05. Case No. 02/Lok(vividh)01/2011Re - Suo Muto action on the basis of TV News regarding corruption in
implementing the drinking water scheme in Deogahr. This case was initiated on the basis of news broadcasting on the Aryan
News Chanel on 9th May, 2011 about 6 p.m. It was reported by the said news
that about 206.2315 lakhs rupees has been allotted by the Government during
the financial year 2003-04 to 2010-11 under Swajaldhara Yojna to provide
drinking water to the villagers of District Deoghar. It was also reported that only
water pipe has been installed in some of the blocks under the scheme and it
was shown on paper that project has been completed whereas a drop of water
could not provide to the villagers.
After seeing the said news of the TV Chancel the Lokayukta has taken
suo motu action and the news report was directed to be registered as
complaint. An enquiry committee headed by the Secretary to the Lokayukta and
Private Secretary of Loakyukta was made. The committee has visited the site of
all the projects of District Deoghar under the scheme and submitted its report
along with copy of the CD containing photographs and video clipping of the site.
It was found by the inquiry committee that not a single project was completed
under the scheme. Only water tank has been constructed or water pipe line has
been attached with submersible but water not supplied to the villagers.Then the
Deputy Commissioner, Deoghar was directed to submit his comment after
making a detail and thorough enquiry relating to all twenty three projects
mentioned in the said report. It was reported that effective steps have been
taken by the Deputy Commissioner, Deoghar to complete all the pending
projects within a month. The Executive Engineer has been directed by the
Deputy Commissioner, Deoghar to recover unutilized money. The then
Executive Engineer Sri B.P. Singh was held responsible for non completion of
project and it was held that Form A be issued against him. The concerned

Executive Engineer was also directed to lodge FIR against the President and
Secretaries of the Village Committees which are also responsible for dereliction
of duties.
06. Case No. 02/Lok(Revenue)07/2011Re - Cost of Rs.10,000/- imposed upon complainant for filing wrong
complainant by concealing the facts.
Shri Inderdeo Sao, the resident of Bermo, Bokaro filed a complaint on
04.04.2011 stating therein that the Circle Officer, Bermo is not supplying the
copy of measurement report of his land inspite of depositing of requisite fee for
that.
A report was called for from Sub Divisional Officer, Bermo. From the
report submitted by the SDO Bermo as well as Circle Officer Bermo. It was
reported that the land in question is "Gair Majurwa Khas land" and the same
was not mutated by the complainant nor any rent receipt has been issued in his
name. A title suit No. 22/2009 has also been filed by the complainant in the
Court of Munsif, Bermo for declaration of right title.
It was further brought to notice that the land in question was already
measured by the Circle Officer and copy of measurement report was also been
supplied to the complainant. This fact on being asked, the complainant admitted
that he has got the same.
Thus the complainant has suppressed all these facts and tried to mislead
this office. Considering the facts, the complaint case was dismissed by the
Lokayukta and a cost of Rs. 10,000/- (Rupees ten thousand only) was imposed
upon the complainant.
07. Case No. 02/Lok(Sales Tax) 02/2011Re- Issue of Sales Tax Practicner license
The petitioner Sri Janak Ram has filed the instant petition alleging
therein that after retirement he has applied for licence of Sales Tax Practioner
under the provisions of Rule 51(4) and 59(9)(d) of VAT Act. He has also paid
Rs. 500/- as prescribed fee and completed all other formalities. But inspite of
that licence was not issued in his favour. Report was called for from the Deputy

Commissioner, Commercial Taxes, Sepcial Circle, Ranchi wherein it was
reported that the licence has been issued in favour of the complainant vide
letter no. 2571 dated 12.10.2011. Thus the grievance of the complainant has
been redressed due to intervention of this office.
08. Case No. 02/Lok(Revenue)04/2008Re- Rs. 72856/- has been wrongly deducted from the final emoluments.
Shri Basant Oraon, S/o Late Dinbandhu Bhagat, resident of Gumla filed
a complaint on 27.11.2007, stating there in that an amount of Rs. 72,856/- has
been wrongly deducted from the final emoluments to be paid to the nominee of
Late Dinbandhu Bhagat a retired panchayat sewak.
A report was called for from the DC Gumla. Reminders were also issued.
Due to non submission of report by the stipulated time, the notice was issued to
all the concerned parties for hearing the case on 26.04.2011. After taking
cognizance by the Lokayukta Jharkhand, the BDO Raidih, Gumla thereof
accepted that the grievance of the complainant was genuine and wrongly
deducted amount of Rs. 72,856/- was paid to the complainant Basant Oraon,
S/o Late Dinbandhu Bhagat on 27.04.2011and in this way the poor complainant
got relief.
09. Case No. 02/Lok (Rural Development Deptt.)06/2011
Re - Issue of BPL Card and Pension under Social Pension Scheme.
The complainant Purnima Handi lodged this complaint on 28.04.2011
stating therein that her husband died on 10.08.2001 and she applied on
29.07.2002 for the benefit under National Family Benefit Scheme. But inspite of
best efforts she could not get the benefits of said scheme. Report was called. It
was reported by the Deputy Commissioner, Jamtara that since husband of the
complainant was not BPL card holder therefore she is not entitled to get
benefits under the said Scheme. However, under State Social Security Pension
Benefit Scheme an amount of Rs. 400/- as pension per month has been
sanctioned to the petitioner. Again petitioner has submitted in her comments
that BPL card may be issued in her favour. Considering the plight of the poor
lady the Circle Officer, Jamtara was directed to submit report on this issue. Due

to intervention by the Lokayukta BPL card was also issued in favour of the
petitioner. Thus the grievance of the petitioner has been redressed by the
efforts of this office.
10. Case No. 02/Lok(Welfare)02/2007Re-Old Age Pension
The petitioner Sri Shivnarayan Bhokta, a blind pensioner has filed this
complaint stating therein that handicapped pension was granted to him till 1999.
But thereafter it was stopped without assigning any reason. A report was called
for from the Circle Officer, Kanke, Ranchi. Due to intervention by the Lokayukta
Rs. 25,200/- has been paid to the petitioner as old age pension through bank
cheque. Comment was called for from the complainant wherein he has
expressed his satisfaction regarding relief sought for.
11. Case No. 02/Lok(Excise)04/2011
Re - Retiral dues, time bound promotion and pay revision etc.The complainant Rameswar Dubey who is a retired Excise Constable,
filed this complaint making a grievance that though he retired from service on
31st December, 2003 but his retiral dues e.g. time bound promotion, pay
revision and two months pay have not been paid to him and therefore he has
made a prayer that direction be given to the concerned department to pay the
aforesaid dues.
Report was called for from the concerned department and it has been reported
that during pendency of this complaint all the retiral dues aforementioned have
been paid to the complainant.
A comment was also called for from the complainant which has been
received in this office wherein complainant has admitted that all his retiral dues
have been paid to him in the month of May 2011.
12. Case No. 02/Lok(Revenue)07/2009Re - Petitioner could not get the retiral & pensionary benefits.Shri Pramod Kumar Gupta, a retired Assistant Soil Conservation Officer,
filed a complaint on 31.05.2008, stating there in that though he was retired from

service on 31.12.2007, but he was not getting the retiral and pensionery
benefits.
A report was called for from Soil Conservation Officer, Ghatsila. After
taking cognizance by the Lokaykta Jharkhand, the SCO Ghatsila under his
letter No. 26 dated 11.03.2011 intimated that all the retiral benefits have been
paid to the complainant and pension is being paid regularly. The case was
closed under intimation to the complainant.
13. Case No. 02/Lok(Revenue)04/2011Re - Retiral & Pensionary benefits.
Shri Rajendra Prasad, retired Assistant Settlement officer, Ranchi, filed a
complaint on 04.01.-2011, stating there in that though he retired from service on
31.07.2008 and in spite that all the relevant papers for payment of retiral dues
and releasing of pension were forwarded to AG, Jharkhand by the Land &
Revenue Department, Ranchi, but still he was waiting for his retiral dues.
A report was called for from Accountant General, Jharkhand, Ranchi.
After taking cognizance by the Lokaykta Jharkhand, immediate action was
taken by the office of AG, Jharkhand and thereafter Authority letter was issued
for releasing of payment. The complainant by his letter dated 24.05.2011
informed that the Authority letter has been received. The case was closed.
14. Case No. 02/Lok(Edu)19/2008Re - Retiral dues & Pensionary benefits.
This matter relates to the grievance of the complainant Anjela Toppo
wherein she alleged that though she retired on 28.02.2007 from service from
the post of assistant teacher from Rajkiya Kanya Middle School, Gumla but
inspite of lapse of more than a year she has not been paid her retiral dues and
pensionery benefit as yet causing serious hardship to her.

Notice was sent to the Director, Secondary Education and asked as to
why the complainant has not been paid legally payable dues as yet.
Due to the action taken by Lokayukta now the complainant has got the
relief as the complainant herself has sent information in writing to this office that
she has already been paid her all retiral dues.
15. Case No. 02/Lok (Water Resources) 07/2009Re - Retiral Dues.
A retired Assistant Engineer of the Deptt. of Water Resources filed a
complaint before the Hon’ble Lokayukta on 02/06/2009 for the benefit of his
retiral dues. The office of the Lokayukta took up the matter and called for a
report from the Chief Engineer, Water Resources Deptt., Medninagar. The
Chief Engineer submitted his report wherein he has stated that since the
complainant has been died, therefore all the retiral dues have been paid to the
wife of the complainant. This assertion was also confirmed by the widow of the
complainant. Thus the grievance of the complainant was redressed as a result
of intervention by the Lokayukta and hence the file was closed.
16. Case No. 02/Lok(Industry) 02/2011Re - Retiral Dues
The complainant Sri Ashok Kumar Birua, s/o Sri Duskan Birua the then
Project Manager, District Industry Centre, Dhanbad has filed a complaint
pertaining to grievance regarding retiral dues and appointment on
compassionate ground before the Hon’ble Lokayukta on 31/12/2010. Report
was called for from the Secretary, Industry Deptt., Government of Jharkhand. It
was reported by the department that G.P.F. dues, Group Insurance, Earned
leave and sixth pay arrear had already been made. Thus the grievance of the
complainant was redressed as a result of intervention by the Lokayukta and
hence the file was closed.
