Introduction

This Annual Report is presented in adifferent format from previous years. In thefirst quarter of 2003, we published anAnnual Review illustrating the impact ofArts Council support for the arts on acounty by county basis and we reported onthe implementation of each of the sixobjectives of the Arts Plan 2002-2006.Individual grant decisions were reported asthey were made in our newsletter ArtMatters in the course of the year 2002.

This Annual Report contains the auditedaccounts, which were signed off in the lastquarter of 2003, and a listing of eachindividual grant made. It also provides theopportunity to report on significant changein the Council’s organisation, made at thevery end of 2002.

In the second half of the year, the Councilreceived the necessary approval fromGovernment to reorganise and enlarge itsstaff structures, in line with the submissionreported on last year.

The effect of the change in structure will bequite radical. Instead of multi-functionalofficers carrying responsibility for both policydevelopment and grant administration overa number of different portfolios, there willbe dedicated groups of staff responsible forgrants and awards management on the onehand, and arts staff and specialists recruitedto provide policy advice and expert adviceon the other. To deal with the opportunitiesand challenges posed by increased funding,heightened public accountability andtransparency standards and the provision ofe-services to the public, new roles incommunications and information will alsobe created.

The process of recruiting the staff andconsulting specialists to fill these rolesbegan at the end of the year.

Sa chéad ráithe den bhliain2003, d’fhoilsíomar AthbhreithniúBliantúil, a léirigh an tionchar a bhí agtacaíocht na Comhairle Ealaíon ar nahealaíona, contae ar chontae, agus a thugtuairisc ar chur i bhfeidhm gach ceann dechuspóirí Plean na n-Ealaíon 2002-2006.Tugtar eolas ar chinntí deontais aonair mar adhéantar iad sa nuachtlitir againn, ArtMatters, i rith na bliana.

Sa Tuarascáil Bhliantúil seo tá na cuntaisiniúchta, a síníodh sa cheathrú dheiridh de2003, agus liosta ar gach aon deontas abronnadh. Tá deis inti freisin cur síos athabhairt ar athrú suntasach in eagraíochtna Comhairle, a tharla ag deireadh 2002.

Bursaries, awards and schemesSparánachtaí, dámhachainí agus scéimeanna

The Arts Council expresses its support to theindividual artist in a variety of ways, throughgrant aid to organisations, events andproduction companies and more explicitlythrough bursaries, awards and schemes, wherethe Council provides direct financial support toartists. The Council also provides the cnuas toeligible members of Aosdána where theyrequire this to devote time to artistic work.

In addition to bursaries to individual artists, theCouncil provides support through a range ofone-off awards and schemes to assist in thecreation of new work. A projects award isopen to both individuals and organisationsfrom any art form or combination of artforms.Project awards may be offered for either thedevelopment stage of a project or theproduction, performance or exhibition stage.Commissions foster the creation of new workand help to build relationships between artistsand their audience.

Residencies aim to offer an artist theopportunity to work on a specific project orprogramme and /or develop their own practicein a new environment or specific locationoutside of their normal work place.

The Council also part funds the arts officersalaries and artistic programming costs of mostlocal authorities.

What follows from pages six to 19 is a detailedlisting of amounts paid to individuals andorganisations in 2002 excluding revenue andmajor capital grants. This figure is detailed asAwards and Development in the statutoryaccounts as per note three on page 38.

Tá dámhachtainíTionscadail oscailte do dhaoine aonair agusd’eagraíochtaí ó fhoirm ealaíne ar bith nó ómheascán d’fhoirmeacha ealaíne. D’fhéadfaídámhachtainí Tionscadail a bhronnadh don staidforbartha de thionscnamh nó don staid léirithe,oirfidigh nó taispeántais. Déanann Coimisiúincruthú saothair nua a chothú agus cabhraíonn siadgaolta a thógáil idir ealaíontóirí agus an luchtféachana.

An aidhm atá le Cónaitheachtaí ná deis a sholáthaird’ealaíontóirí obair a dhéanamh ar thogra nó archlár faoi leith agus/nó a gcleachtas féin a fhorbairti dtimpeallacht nua nó i suíomh faoi leith atálasmuigh den a ngnáth-láthair oibre.

Grants to not-for-profit arts organisationsare offered to cover their operating costs(revenue funding) or to assist with thecreation and maintenance of a fixed asset,through once-off investments (capitalfunding) and programme specific funding.Grants are normally offered on an annualbasis, though some 73 organisationsreceived funding in 2002 under the termsof a multi annual funding agreement.

The Arts Council classifies arts organisationsunder the following broad headings:Resource and Service Organisations(including artist facilities, membership-basedorganisations and information serviceproviders); Arts Venues (including galleries,theatres and multi-disciplinary centres); ArtsProduction Companies (includingperforming arts companies and a range ofarts publishers) and Festivals and Events(including major multi-disciplinary festivals,specialist and local community events).

This year we refined and improved oursupports for individual artists, making xxxawards out of a total of x,000 applicationsreceived. Through these awards, we helpartists to build their body of work, which isthe basis on which their careers rest.

To bridge an acknowledged gap for mid-career artists, we introduced new awards forprofessional training and development. Thisflexible and responsive scheme allows artiststo apply on a year-round basis for shortcourses, seminars and conferences. This newscheme was one of the first outcomes of anextensive evaluation of artists’ programmes,carried out over a couple of years by anexternal analyst, Belinda Mollar.

The practical effect of professional trainingfor artists is to help them to build viablecareers in the arts. A critical step for manyartists is public celebration of their talent ortheir promise. Tom Vaughn Lawlor, an actingstudent who has received three successiveacting training awards from the Council,won the prestigious Laurence Olivier Bursary,one of the most important awards foremerging actors in Britain - the first timethis has been won by an Irish student actor.

Through detailed negotiation of fundingsupports with a number of key serviceorganisations, including the Association ofProfessional Dancers in Ireland, Shawbrook /LD Dance Trust and the Institute ofChoreography and Dance, we supported thedance sector in a number of measures toimprove the sustainability of dance artists’careers, including training and productiondevelopment opportunities and internationalnetworking. A feasibility grant to the

emerging Theatre Forum established thebasis for an independent engine ofprofessional and sectoral developmentwithin the wider performing arts sector.

Financial support for more than half ofAosdána’s members is provided by thecnuas (annuity). This offers stability to manyartists to open up an extended range ofeconomic opportunities. Paula Meehan, arecently-elected member of Aosdána andwinner of the Denis Devlin Award in 2001,gives an illustration of the impact on hercareer of the support provided by the cnuas.She had her first original work for radio,Janey Mack is Going to Die broadcast byRTÉ Radio 1 in 2002. “Membership ofAosdána and the receipt of the cnuas hasgiven me the time to work on biggerprojects, and longer work” says the poet,who has gone on to develop other work forradio, to produce a number of plays (all ofwhich have had professional productions)and to start working in fiction for the firsttime.

Consistent direct support for Ríonach NíNéill through a series of awards in earlieryears and a recent residency grant enabledthis dance artist to produce Seandálaíocht–a performance work exploring language andidentity. The richness of the work rested onthe sustained interaction with people inGaeltacht areas provided for in theresidency. The work premiered in theConnemara Gaeltacht in 2002 and touredwith great success during the year to theEaragail Arts Festival in Gweedore, and alsoto Inis Oírr, Baile Bhúirne and Glencolumcille.

I have audited the financial statements onpages 31 to 46 under Section 6 of the ArtsAct, 1951.

Respective Responsibilities of theCouncil and the Comptroller andAuditor GeneralThe accounting responsibilities of theCouncil are set out in the Statement ofResponsibilities of the Council on page 31. It is my responsibility, based on my audit, toform an independent opinion on thefinancial statements presented to me by theCouncil and to report on them.I review whether the statement on thesystem of Internal Financial Control on page31 reflects the Council’s compliance withapplicable guidance on corporategovernance and report any material instancewhere it does not do so, or if the statementis misleading or inconsistent with otherinformation of which I am aware from myaudit of the financial statements.

Basis of Audit OptionIn the exercise of my function asComptroller and Auditor General, Iconducted my audit of the financialstatements in accordance with auditingstandards issued by the Auditing PracticesBoard and by reference to the specialconsiderations which attach to state bodiesin relation to their management andoperation.

An audit includes an examination, on a testbasis, of evidence relevant to the amounts

and disclosures in the financial statements.It also includes an assessment of thesignificant estimates and judgements madein the preparation of the financialstatements and of whether the accountingpolicies are appropriate to the Council’scircumstances, consistently applied andadequately disclosed.

I planned and performed my audit so as toobtain all the information and explanationsthat I considered necessary to provide mewith sufficient evidence to give reasonableassurance that the financial statements arefree from material misstatement whethercaused by fraud or other irregularity or error.In forming my opinion I also evaluated theoverall adequacy of the presentation ofinformation in the financial statements.

OpinionIn my opinion, proper books of accounthave been kept by the Council and thefinancial statements, which are inagreement with them, give a true and fairview of the state of affairs of AnChomhairle Ealaíon at 31 December 2002and of its income and expenditure and cashflow for the year ended.

Statement of Responsibilities of the Council

Section 6 (1) of the Arts Act, 1951, requiresthe Council to keep accounts in such form asmay be approved by the Minister for Finance.In keeping such accounts and preparingfinancial statements, the Council is required:

- To select suitable accounting policies andthen apply them consistently,

- To make judgements and estimates thatare reasonable and prudent,

- To prepare the financial statements on thegoing concern basis unless it isinappropriate to presume that AnChomhairle Ealaíon should continue inoperation,

- To state whether applicable accountingstandards have been followed subject toany material departures disclosed andexplained in the financial statements.

The Council is responsible for keeping properbooks of account which disclose withreasonable accuracy at any time, the financialposition of An Chomhairle Ealaíon and whichenable it to ensure that the financialstatements comply with Section 6 (1) of theAct. The Council also is responsible forsafeguarding the assets of An ChomhairleEalaíon and for taking reasonable steps for theprevention and detection of fraud and otherirregularities.

Statement of Internal Financial Control

On behalf of the Arts Council of Ireland, Iacknowledge our responsibility for ensuringthat an effective system of internal financialcontrols is maintained and operated by theCouncil.

The system can only provide reasonable andnot absolute assurance that assets aresafeguarded, transactions authorised andproperly recorded, and that material errors orirregularities are either prevented or would bedetected in a timely period.

The Council has taken steps to ensure anappropriate control environment is in place by: - Clearly defining and documenting

management responsibilities and powers, - Developing a strong culture of

accountability across all levels of theorganisation,

- Communicating the importance of strictadherence to controls to all staff.

The Council has also established processes toidentify and evaluate business risks. This isachieved in a number of ways including:

- Working closely with the Government,sectoral interests and clients to ensurethere is a clear understanding of the ArtsPlan,

- Carrying out regular reviews of the currentArts Plan, both short term and long termand evaluating the risks to bringing thePlan to fruition,

- Setting annual and longer term targets forthe four main areas of funding.

(support, development, awards andcommunication) followed by regularreporting on the results achieved, bothfinancial and cultural,

- Establishing and enforcing extensivestandard procedures and provisions underwhich financial assistance may be madeavailable to projects, individuals andorganisations.

The system of internal controls is based on a framework of regular managementinformation, administrative proceduresincluding segregation of duties and a systemof delegation and accountability. Inparticular it includes:

- A comprehensive budgeting system withan annual budget which is reviewed andagreed by Council,

- Regular reviews by the Council and theFinance and Audit committee and annual financial reports which indicatefinancial results versus previous years,

- Setting targets to measure financial andother performances.

The Council is in the process of outsourcingits internal audit function. This is being donein combination with another similar sizednon-commercial semi-state body. A reviewwas not carried out in the year ended 31December 2002. It is proposed to reviewinternal controls and procedures in 2003and on an annual basis thereafter. It is theCouncil’s opinion that an effective system ofinternal Financial Control operates withinthe Arts Council.

1. General An Chomhairle Ealaíon is anindependent body set up pursuant to theArts Acts, 1951, 1973 and 2003 to promoteand assist the arts.

2. Basis of accounting The financialstatements are prepared under the historicalcost convention.

3. Oireachtas grant Income shown asOireachtas Grant-in-Aid of € 34,102,000(2001: € 34,180,079) is the actual cashreceived in the year from the Vote for AnChomhairle Ealaíon. Income from theNational Lottery of € 13,567,000 (2001: € 13,967,119) is also the cash received in the year.

4. Expenditure on the arts Grants arecharged to the Income and Expenditureaccount on an accruals basis in the year inwhich funded activities take place; if this isnot determinable they are charged to theyear in which the activities begin.

5. Fixed assets Fixed assets are stated atcost less accumulated depreciation which ischarged at rates calculated to write-off thecost of each asset over its expected usefullife on a straight line basis, as follows:

- Furniture and Equipment - over 5 years- Computer Equipment and Software - over

5 years - There is no depreciation charge in the year

of disposal of fixed assets. - Works of art are stated at cost and are

not depreciated.

6. Capital account The Capital Accountrepresents the unamortised amount ofincome used to acquire fixed assets. The transfer to or from the Income andExpenditure Account represents the netchange in the book value of fixed assets.

7. Superannuation The Council’scontributions to superannuation costs arecharged to the Income and ExpenditureAccount in the period to which they relateand over the length of an employee’s serviceor of membership of Aosdána.

8. Trust funds Trust fund investments arestated at cost and are held in trust by AnChomhairle Ealaíon.

NOTE 9: PREMISES

The Council occupies premises at 69 and 70 Merrion Square, Dublin 2, under leases which expire in 2016and 2014 respectively. The annualised rent at 31 December 2002 was €265,505 (2001: €223,143). This is subject to review every five years. The next reviews fall due in 2004.

NOTE 10: SUPERANNUATION SCHEMES

(a) A Staff Superannuation Scheme under the Arts Act, 1973, Section 10, is in operation. Benefits aredefined and the scheme provides for equal contributions to be made by Council and staff. The assets of theScheme comprise a combination of an insured fund and a managed fund. Irish Pensions Trust Ltd act asindependent corporate trustees and the manager is Irish Life Assurance plc.

The Arts Council operates a defined benefit pension scheme in Ireland. An actuarial valuation to determinethe value of the liabilities in accordance with FRS 17 was carried out at 31 December 2002 by a qualifiedindependent actuary. The major assumptions used by the actuary at 31 December 2002 were:

NOTE 11: TYRONE GUTHRIE CENTRE

The Tyrone Guthrie Centre at Annaghmakerrig, Co. Monaghan, is a company limited by guaranteeestablished to provide a workplace for artists. The board of the company is appointed by AnChomhairle Ealaíon and the Arts Council of Northern Ireland. During 2002 the two Councilsprovided revenue funding totalling €270,731 (2001: €267,370) to the Centre; and AnChomhairle Ealaíon provided funding totalling €39,898 (2001: €40,379) for capital purposes.

NOTE 12: COUNCIL MEMBERS’ DISCLOSURE OF INTERESTS

In the normal course of business the Board may approve financial assistance to undertakings inwhich Board Members are employed or otherwise have an interest. The Board adopted proceduresin accordance with guidelines issued by the Department of Finance in relation to the disclosure ofinterests by Board Members and these procedures have been adhered to during the year.

The Council has fulfilled the requirements of the Ethics in Public Office Act, 1995, in relation to thedisclosure of interests by Council Members and Director. During the year the aggregate amount ofgrants offered where a Council Member declared an interest amounted to €7,413,576 (2001: €7,408,209).
