Welcome to An Evening at Highgrove with The Prince’s Trust

On behalf of The Prince’s Trust I am delighted to welcome you to this very special evening at such a wonderful venue here at Highgrove.

I would like to thank our sponsors and supporters Coutts, The Roper Family Trust and Stuff Advertising. As a result of their generous contributions all of the money raised from this event will go towards changing the lives of young people across the South West.

Our headline act for the evening is renowned saxophonist, twice Grammy-nominated and winner of Classical Brit Award, Amy Dickson. We are also delighted to be joined by our host this evening, British presenter and broadcaster, Moira Stuart OBE and by Welsh television presenter, Arfon Haines-Davies, who will be leading the Live Auction.

Throughout the evening there will also be an opportunity to bid on a range of carefully selected artworks and exclusive experiences so do use the technology available in the room or visit www.princestrustathighgrove.co.uk to bid generously. The collection of art has been generously collected and curated by Bridget Sterling of Axle Arts and includes artwork by Cornish landscape painter, David Griffi ths, whose previous commissions have included His Royal Highness the Prince of Wales.

The need from young people is growing every day and The Prince’s Trust must continue to be a dynamic lifeline. We work hard to create brighter futures for young people aged 11 to 30, empowering them to live, learn and earn. The funds raised truly make a difference to the lives of young people in need here in the South West and tonight marks a pivotal moment towards their futures.

Finally, I am extremely grateful to the Highgrove Event Committee who have supported this event, with special thanks to Jenny Bower, Richard Neville, Brady George, Bridget Sterling and Jane Day. Your tireless dedication has enabled The Prince’s Trust to hold this special event; thank you.

“My Dad passed away when I was 15 which was really hard to deal with, and a few years later I was sexually assaulted which left me feeling vulnerable and I ended up having to leave home for my safety.

During my first year of university my boyfriend was murdered and despite persevering and staying on to graduate, eventually the reality of everything caught up with me and I turned to alcohol to cope.

A few years later I approached The Prince’s Trust with an idea to set up my own corporate massage business.

I really believe in the benefits of holistic services and my business, WorkSpa, brings a variety of well-being services to the workplace to reduce employee stress and improve productivity.

In my role as a Young Ambassador, I have shared my story at numerous events to help promote the work of The Trust and raise money for the charity. I am also a member of the UK2030 Taskforce which is aiming to ensure young people have a stake in society.”

Moira Stuart OBE, Host

Moira Stuart’s career in radio and television spans more than three decades. She started her BBC career as a production assistant in BBC Radio’s Talks and Documentaries department in the 1970s, before moving on to becoming a BBC Radio 4 announcer, newsreader and programme presenter. In 1981, Moira moved to television news becoming the first female African-Caribbean national newsreader to appear on British television. During her tenure at the BBC, Moira presented every type of news bulletin before her departure was announced in 2007.

In February 2019, Moira joined Classic FM to be the station’s early morning news presenter. From July 2019 she will present her own Saturday afternoon show, Moira Stuart’s Hall of Fame Concert and a further series will commence in Autumn 2019.

Arfon Haines Davies, Auctioneer

Arfon Haines Davies was for over thirty five years one of the main presenters on HTV Wales, he also presented numerous series on the Welsh language channel S4C.

Arfon has been a member of the Welsh committee of the Institute of Fundraising for ten years. He is also proud of his association with Wales’ leading auctioneers Rogers Jones & Co and is delighted to help with this evening’s auction.

Amy Dickson, Classical Saxophonist

Twice nominated for a Grammy™ award, British-Australian Amy Dickson made history by becoming the first saxophonist to win a Classic BRIT Award, for Breakthrough Artist of the Year. In 2016 she was named the UK’s Young Australian of the Year and was invited to judge the final of BBC Young Musician. Recognised for her remarkable, distinctive tone and exceptional musicality, Amy has since been acknowledged by BBC Music Magazine as one of the world’s six best classical saxophonists ever.

Amy Dickson began her musical studies at the age of two and took her first saxophone lesson in Sydney aged six. She made her concerto debut at 16, and on her 18th birthday made her first recording as soloist with the Sydney Symphony Orchestra. That year she moved to London to study at the Royal College of Music, then at the Conservatorium van Amsterdam.

As well as receiving the James Fairfax Australian Young Artist of the Year award, she was the first ever saxophonist to win the Gold Medal at the Royal Overseas League Competition, the Symphony Australia Young Performer of the Year Competition and The Prince’s Prize.

Whilst proving to be a brilliant interpreter of contemporary music, she is devoted to the development of new repertoire for the saxophone. Having commissioned many living composers, she has already made a substantial contribution to the legacy of the instrument’s concerto, chamber and solo repertoire.

Amy’s raison d’etre is her own Take a Breath wellbeing programme. Amy conducts breathing workshops and gives schools concerts wherever she can. As well as introducing children to classical music, sometimes for the first time, Take a Breath helps equip young children with the tools to recognise stress and to build resilience to help combat it, using a simple and discreet relaxed breathing technique.

Anne Denholm, Harpist

Anne Denholm is one of Britain’s leading young harpists, and in 2015 was appointed Offi cial Harpist to HRH The Prince of Wales. Anne graduated from the Royal Academy of Music with distinction, and as the fi rst ever harpist to win the historic RAM Club Prize. As a soloist Anne has won numerous national and international awards and travels across the U.K. and abroad giving regular solo recitals. She is in demand as an interpreter of new music, and is a founding member of award-winning contemporary experimental quartet, The Hermes Experiment. She freelances with orchestras and choirs across England, including the BBC Concert Orchestra, City of Birmingham Symphony Orchestra and English National Opera.

KURT JACKSON MA (Oxon) DLitt (Hon) RWA was born is 1961 in Blandford, Dorset. He graduated from St Peter’s College, Oxford with a degree in Zoology in 1983. While there, he spent most of his time painting and attending courses at Ruskin College of Art, Oxford. On gaining his degree he travelled extensively, painting wherever he went. He travelled to the Arctic alone and hitched across Africa with his wife, Caroline. They moved to Cornwall in 1984 where they still live and work.

A dedication to and celebration of the environment is intrinsic to both his politics and his art and a holistic involvement with his subjects provides the springboard for his formal innovations. Jackson’s practice involves both plein air and studio work and embraces an extensive range of materials and techniques including mixed media, large canvases, print making and sculpture.

JACKIE PHILIP is a Scottish artist and colourist living and working in Edinburgh. Born in 1961, she graduated from Wimbledon School of Art in 1983 before going on to post graduate studies at the Royal Academy School in London, graduating in 1986. Philip lectures across the world including London, Florence and Auckland. She has won awards from the British Institute Fund, Italian Government Scholarship and Tigh Alisdair Ruaraidh Residency. She exhibits regularly at the Royal Academy in London.

Philip’s paintings are characterised by her strong use of complimentary colour, which set up a sensory vibration. Her mark making is distinguished by her use of a palette knife, her backgrounds often patchworked from small blocks of colour. Focused largely on the genres of still life and landscape, Philip brings influences from her travels in Asia and the East with her vibrant colour combinations and simplicity of composition.

CORINNA BUTTON completed her Fine Art degree at Leeds, before going on to study an MA in Printmaking in London. It was during her undergraduate studies that she discovered the German Expressionists and their work continues to influence her practice today. Button’s work can be found in many high-profile collections including the V&A Museum in London, Ashmolean Museum in Oxford, Jiangsu Art Museum in China and the BBC. She is a respected member of the Royal Society of Painter Printmakers.

Button explores themes of feminine identity, her distinct practice defined through her application of texture and patterning. Female portraits emerge through layers of paint and mixed media, with a rich yet playful sense of becoming; imprints of decorative fabric meld the language of painting and printmaking into a spontaneous and energetic exploration of movement and identity.

MICK MORGAN studied ceramics at Cardiff College of Art, graduating in 1974. He set up his first studio in Wenvoe during his last year at college and in 1975 established his current studio in Talog, Carmarthen where he has lived and worked ever since. He lectures locally at the Camarthen School of Art and exhibits locally and through Axle Arts in Bath.

Morgan has developed an astute and sophisticated understanding of his materials and of clay firing processes. He skilfully merges form and function to create wonderfully tactile objects, some finished with beautifully soft Raku glazes and others peppered with tactile soda glazes. His interest in figurative work has led him to work on pieces related to the human form, with large hand built, stoneware pots moving towards abstract vessels with tactile surfaces.

DEREK BALMER was born in 1934 in London and graduated from the West of England College of Art in 1952. As part of the vibrant Bristol art scene of the Sixties, Balmer pursued a successful practice in Fine Art as well as developing a career as an art critic and photographer, writing regularly for the Western Daily Press and official photographer for the Bristol Old Old Vic from 1961 until 1989. In 2001 Balmer became the RWA’s eighteenth president and remained so until 2010. He exhibits regularly with Catto Gallery in London and Axle Arts in Bath.

Balmer’s bold and wonderfully exuberant compositions portray landscapes, cities and ancient architecture in a celebration of history and personal experience. Balmer’s vibrant colour palette exudes the warmth, light and energy of the Mediterranean, focusing largely on bright yellows, oranges and reds, and punctuates with a strong use of blue, green, brown and white.

Born in Columbia in 1965, ALICE MUMFORD’S parents returned to England in 1970 and settled in Great Missenden before moving on to Norway. Mumford graduated from Camberwell School of Art in 1984, where she came under the influence of tutors such as Sargy Mann, Frances Hoyland and Ben Levine. She has lived and worked in West Cornwall for the past 30 years, teaching at the St Ives School of Painting. She was elected an Academician of the Royal West of England in 2010 and exhibits across the UK.

Mumford is a colourist, painting still life and interior studies directly from life with a typically soft and restricted palette. Mumford says, ‘Sometimes I ask myself what would I lose or miss if I didn’t paint directly from life? I am excited by and wonder at what is revealed by the simple act of looking. The shapes between things and beats of tone seem to affect me.’

KEN WHITE was apprenticed as a teen to the Great Western Railway yards at Swindon as a rivet hotter. He very quickly managed to be re-apprenticed as a sign-writer, eventually graduating from Swindon Art College. Better known as a muralist, White has been commissioned to paint over 100 murals worldwide. Notable commissions include the 60-foot-high faux Georgian town house on the Royal Opera House by Jacob Rothschild in 1982. He was contracted to Richard Branson for 25 years as his personal artist, during which time he designed the iconic Scarlet Lady for Virgin Airlines.

White’s paintings focus largely on local heritage and family history. Some of his work has a ghostly air; perspectives distort as buildings and figures slant off centre. This distortion of reality is comforted by the gentle humour of social interaction and we are reassured by White’s observant eye, which captures the familiarity of the everyday.

DAVID GRIFFITHS was born in Liverpool and brought up in north Wales. His artistic inheritance came from his Grandfather, also a portrait painter, whose portrait of Prime Minister W. E. Gladstone hung in Liverpool’s Walker Art Gallery in 1889. Griffiths trained at The Slade School of Fine Art, University College, London, under the direction of Sir William Coldstream, Sir Ernst Gombrich and Sir Anthony Blunt. After graduating at The Slade, he soon established himself as one of the nation’s foremost portrait painters. He has painted portraits of many of the most eminent figures in contemporary society. His subjects include royalty, ambassadors, archbishops and distinguished members of the government, industry, commerce, medicine and academic and legal professions. It was his portrait of Prince Charles on the occasion of Charles’ investiture as Prince of Wales in 1969 which brought him to general notice.

Lot 10His Royal Highness The Prince of WalesWensleydale lithograph on paper (AP)48 x 61cm (with frame)

Wensleydale is a watercolour painted by HRH whilst on a brief visit to the area. Whilst out for a walk during his stay, he commented that he could not resist painting this dramatic vista. The Prince’s masterful handling of light and shade falling on valleys and hills draws attention to how rapidly human perceptions of the world can alter, according to the powerful changes affected by natural conditions.

One of 25 artist’s proofs, this beautiful lithograph has been numbered and framed and is accompanied by a Certificate of Authenticity from HRH The Prince of Wales. The edition was printed at Curwen Chilford Prints by Stanley Jones on watermarked Somerset paper in 13 colours, supervised by The Prince of Wales who has numbered each copy. On completion of the printing all the plates have been cancelled.

LYNNE CARTLIDGE was raised in Cornwall before completing her formal education at Cardiff Art College, graduating in 1987 with a degree in Fine Art. That same year she was selected for the prestigious Whitworth Young Contemporaries. More recently she was awarded funding from the Arts Council of Wales to study with the Cornish painter, Alice Mumford in 2014. She has also studied with Rose Hilton at the Newlyn School of Art. She has lived and worked in Wales since 1987 and was elected a member of the Royal Cambrian Academy of Arts (RCA) in 2017.

Cartlidge paints gentle and almost lyrical still life and flower studies with soft translucent colour. Influenced by Chinese brush paintings and calligraphy, her brush marks are sensitive, painterly and gently abstracted with often blurred and irregular line.

Born in Sri Lanka in 1956, SUMI PERERA graduated from Camberwell College of Arts with an MA in Bookart in 2004. Prior to pursuing fine art, Perera graduated from the University of Colombo in Sri Lanka in 1983 as a doctor and completed postgraduate studies at the London School of Hygiene and Tropical Medicine in 1994 and 1996. Her printmaking has won a number of prestigious international awards and her work is held in a number of public collections including Tate Britain, Victoria & Albert Museum, Ashmolean Museum, British Library, Yale Centre for British Art, USA and Guanlan Museum, China. Perera is a member of the Royal Society of Painter Printmakers.

Perera’s career background working as a doctor and a scientist feeds into her artistic practice and is reminiscent of the Renaissance’s idiosyncratic integration of the Arts and Sciences; the resulting work is a studious examination of the visual world, emanating an experimental, research-like quality with an exacting eye for detail.

JEANNETTE HAYES studied Fine Art and Painting at Kingston University, graduating in 1985. She has served as Vice President and Publicity Secretary for The Pastel Society UK prior to being elected President in 2016. She has received numerous prizes and awards for her work, gaining recognition from the Pastel Society and from the Chelsea Art Society, and has exhibited extensively across the UK and also in France.

Hayes’ atmospheric and energetic patchwork compositions are inspired by emotional responses to the landscape. A heightened sense of geological vigour and vitality is brought to life as Hayes immerses one in vibrant patches of colour, calming bases of earthy, olive tones and lively mark making.

Scottish born, MOIRA HUNTLY studied at Harrow School of Art and later at Hornsey College of Art in London. She is an elected member of four prestigious federations, including Past President of the Pastel Society. She is a published author of a number of books about drawing and painting and has attained numerous prizes for her work. She exhibits widely, and her work is held in many private and public collections, including the National Museum of Wales.

Huntly’s still life studies are meticulously designed, two-dimensional constructs with carefully considered balance between positive and negative space. Pattern often decorates her work with shape referencing the smooth, fluid modernity of the 1960s as well as elements of abstracted, early art-deco design. Energetic and confident mark making distracts the eye from the careful balance of form, her deeply saturated pastel colour often underpinned by a deeper hue of acrylic or gouache.

Born in 1968, abstract and figurative artist VANNI MACCHIAGODENA’S practice encompasses both painting and sculpture. His bold, abstract environments engage with archaic themes. The passing of time, the enormity of the landscape, even the tale of Saint Martin, who as a Roman soldier cut his cloak in half to keep a beggar warm, help to forge the power of his images. From uninhabitable ridges to ploughed fields, Macchiagodena expresses a direct, physical engagement with the world around him and the forces of nature at play. His work creates space for contemplation; the fragility of nature and the interconnectivity of life and organic matter seem to reverberate within each piece.

Macchiagodena exhibits across Europe and is represented by Axle Arts exclusively in the UK. His studio is based in the town of Tertolì in Sardinia.

Ukraine born ALINA MAKSIMENKO studied at T.G Shevchenko Art School from 1985 – 1988 before graduating from Kiev Art College in 1993. She has been a member of BG-Art union of artists since 2001, and a member of The Art Union of painters of Ukraine since 2003. She exhibits extensively across Ukraine, as well as Russia and throughout Europe, and her work is held in a number of public collections including Museum of History of Kiev, Ukraine, the Museum of Modern Art, Ukraine and the Ukrainian Ministry of Culture. Maksimenko will be exhibiting new work at Axle Arts in September 2019 as part of SAW Festival.

Alina Maksimenko creates dark spaces. Her hauntingly powerful figurative paintings encapsulate graceful female studies through exquisite observation. Moody and thoughtful, Maksimenko’s women often present themselves to the viewer with their backs turned or in silhouette with the slightest hint of tonal shift to indicate a limb or turn of the head.

PETER WILLS has been working as a successful potter since 1989. He is a member of South Wales Potters as well as The Craft Potters Association of Great Britain and his work has been widely exhibited in the UK and abroad including Japan, Europe and Dubai. Commissions have included The Princess of Wales Hospital and bowls for HM Government to be presented to visiting European Heads of State. Influences include the Sung and T’ang Dynasties, and principle 20th century European potters including Bernard Leach, Lucie Rie and Derek Davis.

Will’s work is almost exclusively one of a kind pieces, mainly bowls and vases, crafted from a blend of English and French Limoges porcelain. Most work is thrown on a potter’s wheel, raw glazed when bone dry and fired to 1280 °C. He constantly experiments with new glazes, reflected in the amazing effects and colours he achieves.

KERRY HARDING received her BA from the Ruskin School of Drawing and Fine Art at Oxford University in 1994, and her Masters from Falmouth College of Art in 2003. She exhibits throughout Cornwall, the South West and London, as well as South Africa, the USA and Australia and currently teaches at St Ives School of Painting in Cornwall.

Harding creates atmospheric spaces of deep contemplation and ephemerality. Her soft, surreal environments are inspired by the weathered Cornish landscape surrounding her studio. Each piece contains a poetic resonance, captured through atmospheric hazes, a muted silvery palette and gentle layers of texture. Figurative references, such as architectural structures or natural forms, are often used by Harding to pin and sometimes exaggerate her visual grounds. She offers us visual clues which playfully tease our perspective, and also make specific reference to motifs of the North Cornish landscape.

PAUL WADSWORTH graduated from the University College Falmouth in 1997 and is a member of the Newlyn Society of Artists. He has been commissioned to produce work for several large corporations including Marks and Spencers. He currently lives and works in Cornwall.

Wadsworth undertakes regular research trips through the Middle East and India, immersing himself in a diverse tapestry of tradition and culture. He expresses an overarching sense of joy and discovery from these explorations, an enthusiasm which spurs on his energetic and physical painterly style. His work is not constrained by geographical location, instead delving into a psychological exploration of experience and memory. Wadsworth works initially en plein air, then refines his canvases in the studio, building up layer upon layer of history, with pattern, form and colour emerging from deceptively complex and mentally absorbing compositions.

RICHARD NEVILLE is the local Managing Director of Coutts in the South West. He has been painting watercolours for many years and believes in pushing the boundaries of the medium. Richard paints mainly plein air and is a frequent visitor to Girona and the North East coastline of Spain.

Richard is a member of the Clevedon Art Club which was established more than sixty years ago. The Club runs a successful summer exhibition each year. He has been a prize winner on three occasions.

Richard has recently completed a series of New York paintings including Evening Rush in New York 2 which has been donated to the Princes Trust.

Lot 21Experience: Newlyn School of Art – Coast Landscape Painting Course

Originally opening its doors for the first time in September 2011, NEWLYN SCHOOL OF ART is a dynamic and innovative art school situated in the heart of the famous artistic colony of Newlyn in Cornwall.

This four day mixed media coastal landscape painting course is taught by respected coastal painter Imogen Bone. The course will give students the opportunity to paint in the dramatic cliff top locations for which West Cornwall is famous. Imogen will share her in depth knowledge of the local coastline and the countless techniques and applications of the broad range of waterbased media she uses in her painting. A hands-on course based mainly in the outdoors which will be hugely informative and inspiring to all, regardless of experience. Conditions of Sale for The Prince’s Trust An Evening at Highgrove on Thursday 20th June, 2019

The items offered in this Sale and listed in this catalogue (the “Property”) will be sold by Prince’s Trust Trading Limited, a company registered in England and Wales under number 3161821.

Prince’s Trust Trading Limited is a company which has covenanted to pay its net profits each year to The Prince’s Trust, a charity registered with the Charity Commission under number 1079675.

These terms govern the contract for sale (the “Contract for Sale”) of any lot by Prince’s Trust Trading Limited (the “Seller”) to the Purchaser (as defined below) in the auction on 20th June 2019 (the “Auction”).

Any questions in relation to the auction should be directed to the Seller and not to the auctioneer, who serves merely as auctioneer for the Seller in conducting the sale (the “Auctioneer”). The Sale is subject to the following terms and conditions which govern the sale of all the Property offered (as amended by any posted notices or oral announcements during the auction) (the “Conditions of Sale”):

1. a) The Seller assumes no risk, liability or responsibility for the authenticity or the authorship of any of the Property (that is, the identity of the creator or the period, culture, source or origin, as the case may be, with which the creation of any property is identified herein);

b) The Property is sold with all faults and imperfections and errors of description;

c) The Seller does not make or give and does not agree to make or give any representation of fact, un-dertaking, obligation, guarantee, contractual promise or warranty or undertake any duty of care of any kind or nature, expressed or implied, in relation to any description (which shall include inter alia physical condition, size, quality, rarity, importance, genuineness, attribution, authenticity or provenance) of any of the Property or any estimate in relation to it, nor in relation to satisfactory quality of the Property or its fitness for purpose. No statement made in the auction catalogue, notice or description, at any time before, during or after the Sale, in any Sale invoice or elsewhere, will be deemed to be such a representation of fact, undertaking, obligation, guarantee, contractual promise or warranty.

2. Any of the Property may be withdrawn by the Seller at any time before the Sale.

3. Unless otherwise announced by the Auctioneer at the time of the Sale, all bids are per lot as numbered in the catalogue.

4. The Seller reserves the right to reject a bid from any bidder. Property may be offered subject to a reserve price. In the event of any dispute between bidders, the Auctioneer will have sole and final discretion either to determine the successful bidder or to re-offer and resell the lot in dispute. If any dispute arises after the Sale, the Sale records of the Seller will be conclusive in all respects.

5. If the Auctioneer determines that any opening bid is not commensurate with the value of the Property, he may reject the same and withdraw the property from Sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject the advance.

6. The sale of any lot is complete and the Contract for Sale is made at either the fall of the Auctioneer’s hammer in the case of the live auction, or at the announced closing time of the silent auction. Thereupon, the highest bidder acknowledged by the Auctioneer for any lot is the purchaser (the “Purchaser”) of that lot (the “Lot”) and is contractually bound to:

a) assume the risk and responsibility of the Lot;

b) sign a confirmation of purchase thereof; and

c) pay the full amount of his highest bid for the Lot within three working days (the “Purchase Price”).

7. Title to the Lot remains in and is retained by the Seller until the Purchase Price and all other sums payable by the Purchaser to the Seller have been paid in full, and received in cleared funds by the Seller. The Seller is entitled to withhold possession of the Lot from the Purchaser until this time. The Seller is only required to hold the Lot for 90 days from the date of the auction, after which, if the Purchaser has not collected or arranged for collection of the Lot, the Seller may, at its sole discretion, send the Lot to external storage for the account and at the risk and expense of the Purchaser. Any charges associated with the transport and storage if the Lot are to be borne by the Purchaser and will be added to the Purchase Price.

8. Risk in the Lot passes to the Purchaser at the fall of the Auctioneer’s hammer in respect of the Lot. The Seller will thereafter not be responsible for the Lot and the Purchaser will indemnify the Seller and keep the Seller fully indemnified from and against all claims, proceedings, costs, expenses and losses arising in respect of any injury, loss and damage caused to the Lot after the fall of the Auctioneer’s hammer until the Purchaser obtains full title to it.

9. All lots must be claimed within 12 months of the Sale, unless otherwise noted.

10. If the foregoing conditions and other applicable conditions are not complied with, without prejudice to any other remedies available to the Seller by law, which for the avoidance of doubt includes the right to take legal proceedings against the Purchaser for any sum due under the Contract for Sale and/or damages for breach of contract, the Seller, at its sole discretion, is entitled to exercise one or more of the following rights:

a) to terminate the Contract for Sale immediately for breach of contract;

b) to retain possession of the Lot;

c) to be paid interest on any monies due at the annual rate 5% per annum above the base rate of National Westminster Bank Plc from time to time to be calculated on a daily basis;

d) to retain as liquidated damages all payments made by the purchaser;

e) to resell the Lot by auction, private treaty or any other means to any third party, on three days’ written notice of intention to sell to the Purchaser, following which the Purchaser will be liable to Seller for payment of any shortfall between the Purchase Price and the sum of the price achieved upon resale all other charges due hereunder and any incidental damages. The Seller is under no obligation to achieve an optimum or fair market value for the Lot upon resale.

11. The Purchaser will indemnify the Seller against all legal and other costs of enforcement, all losses and other expenses and costs incurred by the Seller (whether or not court proceedings will have been issued) as a result of the Seller taking any of the steps under paragraph 10.

12. Payments for purchases must be made in pound sterling (unless otherwise noted) and in any one of the following forms: cash, cheque (backed by cheque guarantee card) or major credit cards.

13. In no circumstances will the Purchaser be able to rescind the Contract of Sale.

14. Subject to paragraph 16, in no circumstances will the Seller be required to refund any amount paid in respect of any lot to the Purchaser.

15. The Purchaser will be wholly responsible for any removal, storage, shipping, delivery costs, other charges and expenses incurred by the Seller in connection with the Lot and for complying with all import or export regulations in connection with the Lot.

16. If the Seller is prevented from performing its obligations under the Contract for Sale by circumstances beyond its control or if performance of its obligations would by reason of such circumstances give rise to a significantly increased financial cost to it, the Seller will not, for as long as such circumstances prevail, be required to perform such obligations. In such circumstances, the Seller will not be deemed to be in breach of the Contract of Sale, or be liable for failure to fulfill any of its duties there under and will only be liable to refund the Purchaser such sum that is equal to the Bid Amount (where this has been fully paid by the Purchaser) less any costs incurred by the Seller in connection with the Lot.

17. References in these Conditions of Sale to the singular will include references to the plural (and vice-versa) and reference to any one gender will include reference to other genders.

18. These Conditions of Sale, as well as the Purchaser’s and the Seller’s, respective rights and obligations hereunder, will be governed by and construed and enforced in accordance with the laws of England and Wales.

19. By bidding at an auction, whether present in person or by agent, commission bid, telephone or other means, the bidder will be deemed to have agreed to these Conditions of Sale and to have consented to the exclusive jurisdiction of Courts of England and Wales. These Conditions of Sale and the documents referred to herein constitute the entire agreement between each bidder in the Auction and the Seller.
