The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.
While the law in contractor’s regulation is black and white, how those words are interpreted has always been a ‘gray’ area where expert advice is often advised. Can a Sole Proprietor keep some parts of his license active while also qualifying someone else? Maybe, maybe not as we all learn from his question…
Q: I frequently read your articles and often times you refer to certain trades being “incidental and supplemental” to the classification that a contractor holds. How does the CSLB define incidental and supplemental? It seems that contractors could use these terms broadly to perform work out of the scope of their license.
A: Board Rule 831 states “for purposes of Section 7059, work in other classifications is ‘incidental and supplemental’ to the work for which a specialty contractor is licensed if that work is essential to accomplish the work in which the contractor is classified. A specialty contractor may use subcontractors to complete the incidental and supplemental work, or he may use his own employees to do so.”
Q: I have a CA Contractor’s License with 3 classifications: “C-8”(Concrete), “C-27” (Landscaping), and a “C-29” (Masonry). It is now a Sole Proprietor license. I want to be
a Responsible Managing Employee (RME) for a new corporation but the company only needs the “C-27”. I know that since I’m an RME I am going to have de-activate the “C-27” classification on my individual license, but is there a way to still keep the other two classifications active?
A: There are limited circumstances in which a RME can qualify two active licenses at the same time however the situation you described doesn’t appear to fall under those circumstances. There is no way to inactivate particular classifications on a license while keeping the others active. That being said, you will be required to inactivate your Sole Owner license in order to act as an RME for a new corporation.
Q: We have made some structural changes to our corporation that involves adding several Officers. We have already updated the Secretary of State with the changes. We plan to file the changes with the CSLB to update our license as well, but it is my understanding that each of the new Officers will be required to get fingerprinted, so the process of adding them to the license could take several weeks. In the interim, are those individuals permitted to sign contracts?
A: To the best of my knowledge, your company ultimately decides who has the
authority to sign contracts. I am not aware of any CSLB law or rule that regulates who can and cannot sign contracts on behalf of the company. With that said, as long as your corporation approves of the new Officers signing contracts, have them sign away!

Enforce All Provisions of the Diesel Off-Road Regulation
All BIllS ON GOvERNOR’S DESKWell, the streets of Sacramento are safe once again until January – the Legislature is out! So, what’s done is done on the part of the 120 members of the California State Legislature. “The ball has now been passed” onto the governor so to speak who now has until October 12th to act on the 610 bills that have been sent to him. Following are some interesting statistics.
In the first box is the number of bills that were introduced in each house of the Legislature this year, followed by the number of bills in each house that I tracked on your behalf (called mine).
The following box below shows the number of bills that have been signed (Chaptered) by the governor thus far this year, followed by the total
number of officially “dead bills” which you will
note is only 4 (and even those 4 could be “revived if necessary”). Next shows that 610 bills are enrolled (have been sent to the governor who now has until October 12th to act on each of them). “Other” means that 1440 bills are two-year bills, meaning that they carry over until next year. And, thus far the governor has only vetoed 5 bills this year! You will also note that 83 of the bills that I worked on this year are before the governor.
In my annual year-end legislative report, I will discuss the final outcome of ALL bills that have an effect on YOUR business that the governor is currently considering. Stay tuned!

By the way, the governor is still deliberating on our SB 399 (Wright) which would require all state agencies to pay interest of 10% above prime on all invoices not paid within 45 days.
So, now that all bills are on the governor’s desk, I am busily crafting letters either urging the governor to sign or veto measures before him. Over the next few weeks I’ll include some of my letters to give you a “flavor” of what I’ve been dealing with; and, for those that I’ve requested a veto, what you hope will not ultimately affect you! Dear Governor Brown:On behalf of the Engineering Contractors’ Association, California Fence Contractors’ Association, California Chapter of the American Fence Association, Marin Builders Association, the Flasher Barricade, I respectfully request a vETO of AB 1336 (Frazier).
AB 1336 is intended to stop the unlawful practice among a limited number of construction employers of failing to pay construction workers all wages due on the designated pay date. My contractors strongly support efforts to stop such illegal practices, as unscrupulous construction employers are both harmful to the employee and place our contractors, who pay on time and in full, at a competitive disadvantage.
Unfortunately, AB 1336 does little to stop unscrupulous contractors and unfairly punishes companies that play by the rules and pay their workers all of the wages that they are owed in a timely manner. AB 1336 unjustly triples the time frame within which the Labor Commissioner may make a determination on wage violations from 180 days upon notice of completion of a project to 18 months upon notice of completion or 18 months from the acceptance of work, whichever is later. This bill does little to ensure an aggrieved employee will be fairly paid in a timely manner. By extending the time frame for the DLSE to make a determination by 600%, AB 1336 causes harm to both the employee and to the legitimate contractor.
The provisions in AB 1336 deleting the requirement that the action commence not later than 180 days after acceptance of the public work, or the filing of a valid notice of completion, whichever is later, is unnecessary and would create an imbalance with other enforcement provisions in the prevailing wage statutes that require the Division of Labor Standards Enforcement to issue a civil wage and penalty assessment within 180 days of
the events described above. The Division regularly and routinely issues such assessments within the proscribed 180-day period, and there is no basis for creating or need for a different period of time for JLMC.
Moreover, the 18 month time period is inconsistent with California’s statutes affording rights to unpaid workers to bring an action against the public works payment bond for the project on which they worked. Under Civil Code Section 9558, an action on a payment bond can be brought no later than six months after the period in which a stop payment notice can be given, which typically would require such an action to be brought within six months plus 30 days after a notice of completion is recorded.Further, extending the time frame to 18 months for JLMC to commence civil actions would conflict with the underlying purposes of the existing statutes of limitations under the Labor Code, namely that wage claimants with good causes of actions should pursue them with reasonable diligence. It is unfair and inappropriate to require companies to defend themselves years after the fact against charges that involve the misconduct of a subcontractor, at a time when they no longer have access to witnesses or other evidence to disprove a claim made by employees of that subcontractor.
For these reasons, I urge your VETO on this dangerous measure.

CARB Receives US EPA Authorization to Enforce All Provisions of the Diesel Off-Road Regulation
If you haven’t heard, our Construction Industry Air Quality Coalition (CIAQ) has informed us that On Friday, September 13, 2013 the US EPA granted CARB authorization to enforce all provisions of the In-Use Off-Road Diesel Vehicle Regulation (Off-Road Regulation). With EPA authorization, CARB will begin to enforce the restrictions for adding certain tier vehicles to a fleet beginning January 1, 2014 and the emission performance standards for large fleets July 1, 2014. Please find on pages 12-13 the CARB Regulatory Advisory describing the schedule it will follow to enforce these provisions of the regulation and other relevant information.

ENFORCEMENT OF THE IN-USE OFF-ROAD VEHICLE REGULATION On September 13, 2013, the U.S. Environmental Protection Agency (U.S. EPA) granted authorization to the California Air Resources Board (ARB or Board) to enforce all provisions of the In-Use Off-Road Diesel Vehicle Regulation (Off-Road Regulation). The Off-Road Regulation was originally approved by the Board in May 2007, and amended in January 2009, July 2009, and December 2010. ARB has been enforcing the reporting, labeling, sales disclosure, and idle limitation requirements, and this advisory informs owners and operators of off-road vehicles operating in California as to how ARB staff will proceed with enforcement of the adding vehicles and emission performance requirements. In order to provide fleets adequate time to ensure compliance, ARB will phase in enforcement of various elements of the rule beginning January 1, 2014, as described below. Adding Vehicles Requirements ARB will begin to enforce the off-road regulation’s restrictions on fleets adding vehicles with older tier engines on January 1, 2014. As described in Section 2449(d)(6) of the Off-Road Regulation, fleets are prohibited from adding older tier vehicles as follows: Tier 0s – As soon as enforcement commences, a fleet may not add a vehicle with a Tier 0 engine to
its fleet. Tier 1s for Large and Medium Fleets (fleets with over 2,500 hp) – As soon as enforcement
commences, a large or medium fleet may not add a vehicle with a Tier 1 engine to its fleet. The engine tier must be Tier 2 or higher.
Tier 1s for Small Fleets (fleets with up to 2,500 hp) – As soon as enforcement commences, a small fleet may add a vehicle with a Tier 1 engine if and only if the vehicle either had an equipment identification number (EIN) assigned by ARB to the vehicle prior to January 1, 2012 or entered the State of California for the first time after January 1, 2012. Effective January 1, 2016, a small fleet may not add any vehicle with a Tier 1 engine. The engine tier must be Tier 2 or higher.
Tier 2s – Beginning January 1, 2018, for large and medium fleets, and January 1, 2023, for small fleets, a fleet may not add a vehicle with a Tier 2 engine to its fleet. The engine tier must be Tier 3 or higher.
The chart below shows the minimum tier engine that may be added by a fleet beginning January 1 of a given calendar year. For example, if a medium or large fleet wanted to purchase a vehicle on January 1, 2015, the vehicle’s engine would have to be a Tier 2 or cleaner engine. Fleets are allowed to continue operating lower Tier vehicles that they already own, but must comply with the adding vehicle requirements when considering purchases of new or used vehicles.

* Registered Tier 1 engines are those that had an equipment identification number (EIN) assigned to the vehicle by ARB prior to January 1, 2012, and can only be added to a fleet if both the fleet selling and the fleet purchasing the vehicle reported to ARB by January 1, 2012, or had entered the State of California for the first time after January 1, 2012. Emissions Performance Requirements ARB will begin to enforce the emissions performance requirements for large fleets on July 1, 2014 and then annually each January 1 thereafter. The emission performance and compliance dates for medium and small fleets will be enforced upon their effective dates as shown below: January 1, 2017, for medium fleets; and January 1, 2019, for small fleets. The emission performance requirements continue annually until 2023 for large and medium fleets and 2028 for small fleets. To meet annual emissions performance requirements, fleets must either (1) meet the fleet-average emissions targets, or (2) meet the Best Available Control Technology (BACT) requirements. In general, if a fleet does not meet the fleet-average emissions targets, then it must apply BACT each year on a certain portion of its fleet until it does meet those targets. In order to meet BACT requirements, fleets can either: (1) turn over to newer, cleaner engines or vehicles, or (2) install ARB-verified exhaust retrofits. “Turn over” means retiring (selling) a vehicle, designating a vehicle as a permanent low-use vehicle, repowering a vehicle with a higher tier engine, or rebuilding the engine to a more stringent emissions configuration. Penalties Fleets that fail to comply with the Off-Road Regulation will be subject to enforcement action, including potential fines. Cal-West Rentals is in search of a technician to work within our service department at our yard in Petaluma. They will be responsible for repairing and maintaining all types of equipment including small engines, heavy construction equipment, and delivery trucks.
The work is mostly in the shop, but also includes field service calls and deliveries of equipment. It is a full-time position, M-F, with full benefits. This person will be reporting to our service manager. Must possess knowledge and experience in the mechanical and construction field.

done as needed, on time, and to specifications• Assure job site inspections are occurring• Coordinate job payment schedule with Accounting

MINIMUM QUAlIFICATIONS• 5 years experience in concrete construction estimating
and project management• 5 years construction field experience• College or other coursework in construction
management or estimating• Strong organizational, interpersonal skills• Proficient on MS Office • Clean DMV, drug free
