They moved to Gooding in 1936 to get away fromthedustbowl.AfterschoolinGooding,hewenttotheWeiserTradeSchooltolearnwelding,andfromtherewenttotheVancouvershipyards. At18,hecamehometoenlist intheUnitedStatesMarineCorps.Hewashonorablydischargedin1946.Whenhecamehome,hemetPat,andtheyweremarriedthatfall. Hewasafarmerandlandlevelertherestofhislife. Hewasprecededindeathbyhisparents;1daughter;1great-grandson;7sisters;and1brother. Legislative Update from Representative Donna Pence Wearegettingdowntothewireandbillsareflyingfastandfuriousinanefforttofin-ishbythetargetdateofnextThursdaythe24th.Therearenumberofagencybudgets,land,water,educationtaskforceandhealthcarebillsthatstillhaveonechambertopasswithfivedaysremaining.H582isabilldealingwithahypotheticalsituation of how lawmakers will managefederalland,whichinthebilltheyfeelwillbe transferred to Idaho from the federalgovernmentviatheflawed“equalfooting”conceptthatUtahlawmakerspresentedtouslastweek.Itisframedasa“justincase”situation.Ivotedagainst582incommittee,butitpassedoutonapartylinevote. InonesuccessThursdaytheHouseRe-sourceCommitteevotedtoholdincom-mitteeH586whichproposedtohavethelegislatureapproveanysaleortransferofprivatelandtothefederalgovernment.Thisprovedtoomuchofaprivatepropertyrightinfringementforamajorityofthecommitteetostomach. ThursdaywealsopassedoutS1338thatgivesCountyCommissionerstheopportu-nitytodeclareapublicnuisanceiftheyfeelFederallandsarebeingmismanagedandde-mandthemanagingagencytocomeupwithaplantoeliminateit30daysormoreafternotification.ItisawaytopoketheFederalGovernmentbuthasnopunitivepowerstoactuallycarrythroughthedemand.IfearitwillemboldensomeCommissionerstoactu-allygoinandstartworkonfederallandsorbringsuitontheFedsbothofwhichareun-constitutional.Eitherwouldgenerateasuitwewilllose.Todaythebillwasfasttrackedandwedebatedandpasseditoninapartylinevote.ItnowgoestotheGovernor.

Thereisalittlemovementonthehealth-carefront.AMedicaidExpansionlikebillwillappearMonday.Therehasbeenasignifi-cantrampingupofpressuretodosomethingthissessionfromthepublic.ThebillwillseekawaiverfromthefederalgovernmenttouseanIdahospecifictypeofplanforthoseupto100%ofpoverty.Theunfortunatethingaboutthisbillisimplementationisabout18monthsaway.ItisalsolikelythatthoseinthegapwillseemoneysavedasaresultofObamaCarehelppayforadditionalcareatHealthclinics.Theseserviceswillbeavail-ableforthis18mo.period.WewillstillneedtheCATFundandCountyIndigentFundstohelpwithseveremedicalproblemsinthisgroupofworkingpoor. AnotherbillputtorestwasonethatwouldaskforaConstitutionalAmendmentdoingawaywiththeState’sConstitutionalbanonanytaxdollarsbeingusedtofundprivateorChurchsupportedschools.Itwouldbeamajorstepincreatingvouchersforeachstudenttouseatanyschooltheywantedtoattend,whichistheultimategoaloftheschoolchoicemovement.SomethingIbe-lievewouldbedifficultinmanyofoursmalltowns.Itwillbecomingbacknextsession. S1342thatexpresslyallowstheBibletobeusedasareferenceinIdahoschoolspassedoutoftheHouseonanearpartylinevote.Wecurrentlycanusereligioustextsforrefer-encematerials,butduetotheIdahoCon-stitution’sverystrictandnarrowinterpreta-tionfocus,absolutelynoreligiousdoctrineorinstructionwouldbeallowed.AnattorneyGeneral’sopinionindicatedaswrittenthisbillwouldviolatetheConstitution. S1378givesa $5millionboosttoourexistingOpportunityScholarshipmoney

whichequatesto1,700moreoftheschol-arshipsbeinggivenouttoIdahohighschoolgraduateswhohaveaBorbetteraveragethisnextyear. S1404makingitillegaltosellfetaltissueof“prebornchildren”,wassenttothe14thorderintheSenateforamending.Ithasanumberofflawstobefixedbutmaymakeittousbeforeadjournment. H581whichdealswithfinallygettingad-ditionalinternetsalestaxrevenuewaspulledbacktotheHouseStateAffairsCommitteetoinsertsomeoftheincometaxfeaturesandtheincreaseofthegrocerytaxrefundthatwaskilledintheSenateTaxCommittee.Whatgamesweplayuphere! The last thing we passed today in theHousewasS1389 thatallowsconcealedcarryofgunsinCitieswherebeforetheyonlywereallowedoutsidecities.Therearecertainlegalreasonsnottoissuepermitslistedandyouthyoungerthan21andover18willhavetotakeaspecialtrainingbeforetheycangetapermit. SuperintendentYbarra’sRuralEducationCentersRSwasprintedandsenttothe2ndreadingcalendartoday.Theyhaveinplaceaproposaltorunapilotprojectinnorth-ernIdahocosting$300,000peryearfortwoyears.JFACrefusedtobudgetitsofar,sowewillseewhathappens.
