Amendment Notice

This amendment is made pursuant to section 59 of the Environmental Protection Act 1986 (EP Act) to amend the Licence issued under the EP Act for a prescribed premises as set out below. This notice of amendment is given under section 59B (9) of the EP Act.

This notice is limited only to an amendment for including Category 12. No changes to the aspects of the original Licence relating to Category 37, 62, 63 or 67A have been requested by the Licence Holder.

Amendment description

Vancouver Waste Services Pty Ltd (the Licensee) operates the Mindijup Road Multiple Use Facility (the Premises) under licence L7344/1998/10 by undertaking the following prescribed activities: inert landfilling of tyres (category 63); solid waste storage depot (category 62, primarily for inert waste and green waste); composting facility (category 67A); and a trial char production facility (category 37).

On 16 June 2017, the Licensee submitted a licence amendment application to include category 12, screening of material, on the existing Licence (L7344/1998/10). The Licensee proposes to extract, wash and screen up to 400,000 tonnes of silica sand per annual period at Lot 102 Mindijup Road, Palmdale for export. This capacity is determined by considering operating hours, trucking movements and port curfews.

The sand resource at the premises has potential for high quality glass as its purity is in excess of 98.7% silicon dioxide/silica (SiO2+) and lacks clays attached to the grain surface or within the matrix. The sand requires minor intervention to improve its purity and particle size distribution and will require the construction of a wash plant and associated wet screening facility.

The sand washing and screening plant will be located adjacent to the current mining void north-east of the deposit within the premises as shown in Figure 1. The mining voids currently within the premises are a result of extractive industries licensed by the City of Albany for construction sand.

The Licensee proposes to install a wet screening plant operated by a diesel generator, located approximately 1.5m below ground level. The screening plant presented in the application is a BWS150/200 Dual Pass Sand Twin Product mounted on skids, although a similar type of equipment from a different manufacturer may be acquired.

The proposal also includes construction of a holding and settlement dam for storage of ‘slimes’ discharged during the washing process. Water for the operation will be sourced from surface water collection and a soak located on the property. More than 98% of water used in the washing process will be recycled through the plant consequently a storage dam will be required and sized to achieve a capacity of 21,000kL. The dam will be constructed using in situ clays that will be compacted to a permeability of 10-5 to 10-6 m/s. The clay ‘slimes’ produced during the washing process will line the dam and further prevent leaks.

The sands will be washed and screened through the wash plant and stockpiled for out loading and transport.

The washing of material will be carried out at the Sand Screening Plant located within the processing area shown in Figure 1. The process is outlined below;

The sand will be passed over an initial screen which removes any material larger than 2.36mm (i.e. plant roots and large sand particles);

The remaining material will be slurried with water, screened into 2 sizes fractions (-0.8mm and +0.8mm) then excess water will be removed from each size fraction via cyclones and conveyed into separate stockpiles via elevators. The “dirty” water will be allowed to run from the plant and captured in the holding dam;

The holding dam will be approximately 21,000kL and divided into compartments. The “dirty” water will enter the smaller compartment where solids will be allowed to settle out before overflowing into the larger section from which the water will be pumped back into the plant for further washing.

After the sand is washed and screened it will be stockpiled for out loading and transport. It is anticipated that the stockpile will be onsite for two to three days and be approximately 5000 to 6000 tonnes. Stockpiles are not expected to exceed 5m in height.

Given the purity of the material the applicant anticipates approximately 1.5% ‘waste’ from the plant in the form of clay and sand fines. These fines will be recovered from the settlement dam and used in rehabilitation due to the suitability of the nutrient and water holding capacity.

Location and receptors

Table 5 below lists the relevant sensitive land uses in the vicinity of the premises which may be relevant to the proposed amendment. The Delegated Officer considers receptors beyond 500m are unlikely to be impacted by noise and dust associated with the proposed screening activities.

Site geology The resource is presumed to have been deposited by Aeolian process during the Holocence period as evidence by the trend of the deposit perpendicular to the prevailing wind patterns. The soil is well graded, moderately to well rounded, sand consisting of greater than 98.7% quarts (extract from application).

Meteorology

The wind roses below represent the various percentages of occurrence of winds from specific direction observed from Albany weather station. Prevailing winds are not aligned to the direction of the nearest residence, and therefore noise and dust emissions will not likely cause an impact.

It is important to note that these wind roses show historical wind speed and wind direction data for the Albany weather station and should not be used to predict future data.

Risk assessment

Tables 9 and 10 below describe the Risk Events associated with the amendment consistent with the Guidance Statement: Risk Assessments. Both tables identify whether the emissions present a material risk to public health or the environment, requiring regulatory controls.

Decision

The Delegated Officer has considered the environmental risk of including Category 12 screening and washing of material to the existing Licence. During the assessment of the amendment application, the risk criteria in Appendix 2 has been applied. The map in Schedule 1 shows the location of the proposed washing and screening facility, holding and settlement dam and the mining area. A copy of the Development Approval has been included as Attachment 4.

The Delegated Officer considers the overall risk of the proposed works is acceptable. The overall risk of contaminated storm water impacting the quality of groundwater and/or surrounding ecosystems during operations is low. The Delegated Officer has determined that existing licence conditions are adequate for storm water management with the addition of hydrocarbon controls. The risk of dust and leachate from the storage of sand stockpiles is also low. Compliance with dust management guidelines will further reduce the likelihood of dust impacts. Risks associated to the holding and settlement dam are considered low. Considerations have been made for two risk events including overtopping from a storm event and seepage to groundwater, these risks can be adequately managed by conditioning the construction of the dam.

The Delegated Officer has amended the Licence definitions and made administrative changes in line with changes implemented within DWER.

The Delegated Officer has determined that the amendments assessed will not result in emissions from the premises which are unacceptable to public health or the environment and therefore has granted the Licence amendment.

Licence Holder’s comments

The Licence Holder was provided with the draft Amendment Notice on 2 August 2017. Comments received from the Licence Holder on 4 August 2017 have been considered by the Delegated Officer. The Licence Holder requested that the type of equipment not be specified in the amendment notice as this may restrict manufacturer and supplier of equipment. The Delegated Officer considered the request reasonable and determined to include reference to similar equipment.

2. Condition 1.3.5 of the Licence is amended by the insertion of the underlined red text shown below:

1.3.5 The Licensee shall ensure that waste is stored and/or contained within

infrastructure in accordance with Table 1.3.3 and that the integrity of the containment infrastructure is maintained.

is maintained and operated in accordance with the infrastructure requirements of Table 1.3.4.
