Special Benefits of NativeAmerican Tribal Owned Company

• Federal legislation has created a group designated “Native Americans” that are afforded exclusive contractpreferences

• Native Americans are among poorest and most under-employed groups in America– U.S. Government has taken a number of steps to help promote self-sufficiency in this population– One of its most successful initiatives has been including these Native American groups in the Small

Business Administration’s 8(a) program as “socially and economically disadvantaged”• Important distinction between Native Americans and their non-Native American counterparts in the 8(a)

program– Non-Native American businesses represent one individual or one family– Native American businesses provide the benefits of the 8(a) program to 100% of the members of a

disadvantaged group– Benefits and profits are spread over a much larger population so each individual shareholder receives

much less than an individual company owner

• Small Business Administration has established an “Other Than Small” Classification under FAR 52.219-9(d)(1).

• In accordance with Government Accountability Office’s decisions, experience from one affiliated AmericanTribal Owned entity can be attributed to another affiliated American Tribal Owned entity if the proposaldemonstrates that the resources of the affiliated company with the relevant experience will contributeto performance of the contract.

• Such reliance on an affiliated entity’s past performance does not create an affiliation problem for sizepurposes for tribally owned firms under the Small Business Administration’s broad exemption fromaffiliation for tribally owned entities. See 13 CFR 124.109(c)(2)(iii). Thus, tribally owned entities may relyupon the past performance of sister companies with which they team on 8(a) set asides without beingaffiliated.

• Prime contractor can subcontract to WTIDC Companies and receive small business and smalldisadvantaged business (SDB) credit for life of contract without consideration of prime contract’s NAICScode or size standard.

• When one or more subcontractors are in the subcontract tier between the prime contractor and WTIDCCompanies , the prime contractor can still count our subcontract revenue towards achieving the contract’ssmall business and SDB subcontracting goals. When one or more subcontractors are in the subcontracttier between the prime contractor and WTIDC Companies , the prime contractor can still count oursubcontract revenue towards achieving the contract’s small business and SDB subcontracting goals.
