Executive Summary In October 2016 Council engaged ML Design through Cardno (QLD) Pty Ltd to provide planning and urban design services to support a number of priority projects, including The Mill.

ML Design has acquired extensive experience and knowledge about the site and The Mill at Moreton Bay project. This specialised experience and knowledge cannot be easily and practically duplicated by other consultancies within the timeframes required to suit the project schedule. Accordingly, it is recommended that ML Design be engaged to provide ongoing support to Council in the finalisation of The Mill at Moreton Bay Priority Development Area as well as other design and planning advice.

OFFICER’S RECOMMENDATION

1. That in accordance with section 235(b) of the Local Government Regulation 2012, Council is satisfiedthat because of the specialised nature of the services to be provided it would be impractical ordisadvantageous for the Council to seek quotes for the services.

2. That the Chief Executive Officer be authorised to enter into a contract with ML Design on behalf ofthe Council to undertake the work specified in this report.

REPORT DETAIL 1. Background In October 2016 Council engaged ML Design through Cardno (QLD) Pty Ltd to provide planning and urban design services to support a number of priority projects, including The Mill. This follows the engagement of Cardno (QLD) Pty Ltd in December 2015 to prepare the Concept Planning for the Petrie Mill Redevelopm ent Project. The ML Design team have been instrumental in facilitating the vision with Council and Stakeholders and delivering the vision through the various statutory and design processes. The following outlines the core involvement within the Mill and the PDA process to date;

1. Vision Confirmation

• Led the master planning process and charrette workshops that confirmed Council’s Vision for the site

• Coordinated the interests through the vision process of MBRC and USC

• Developed an overall vision plan for the development of the Mill site

• Benchmark review of University towns and development outcomes

2. Master Plan Development

• Understanding of the sites constraints and opportunities

• Development of a range of design scenarios and testing to determine the desired outcome

• Guided the overall mobility strategy with Cardno to determine the preferred outcome

• Land use allocation and consideration of uses across the site, including the proposed alternative for the combined Innovation precinct.

• Commercial input into the design and economic approach to the development of the site

• Identify the development yields for the site based on the master planning opportunities

• Coordinated Cardno technical involvement into the master planning process, including civil, environmental and landscape

• Coordinated with the key individuals for design feedback and peer review of works undertaken

• Facilitated the upfront discussions between MBRC and potential key developers for implementation options

3. Stage One works and design input

• Initial design input / review to Cardno to undertake design work for stage 1

• Review upon request from Cardno through the process

4. USC design consideration for Foundation Facilities

• Coordination and facilitation for the definition of the Foundation Facilities site and its inclusion in the PDA process

• Workshopping and assisting in facilitating USC objectives into the overall design outcome and PDA process

5. PDA Guidance and Production

• Strategic guidance to Council’s planning team in preparation of the PDA

• Ongoing negotiations and liaison with State departments for the drafting and ultimate approval of the PDA

• Assisting Council with the production of all mapping and visualisation material for the PDA

• Desktop publishing the PDA document on behalf of Council

• Ongoing assistance and guidance when required by the MBRC Team

6. Visualisation and communication

• Development of 3d modelling for the PDA site for community consultation

• Creation of VR hotspots for the development

• Creation of fly-through for the site, focusing around key PDA deliverables In addition to the works already undertaken Council requires support to finalise The Mill at Moreton Bay PDA and also in supporting Council’s collaboration with the University of Sunshine Coast for the foundation facilities and campus master plan. 2. Explanation of Item This report recommends that the Council contract with ML Design to carry out the additional work. This is considered to be the most practical and efficient way to ensure the additional work is completed within the timeframes required to suit the project schedule. This is because the additional work is largely informed by the initial work already undertaken ML Design and the specialised knowledge of and experience with the site and the project acquired as a result. At this point in the project it would be difficult for another consultancy to acquire the specialised knowledge and experience necessary to ensure the work is completed within the timeframe required for the project schedule. The Mill at Moreton Bay Development Scheme is required to be completed within a matter of weeks to meet legislative timeframes. The support of ML Design in the finalisation of this document is crucial together with the supporting imagery. Accordingly, it is considered that it would be impractical or disadvantageous to seek quotes for the additional work. 3. Strategic Implications 3.1 Legislative/Legal Implications

Under the Local Government Regulation 2012, the Council must seek quotes prior to entering into a contract for services expected to be worth between $15,000 and $200,000. This general requirement is subject to a number of limited exceptions. Section 235(b) of the Local Government Regulation 2012 provides that Council can enter into a contractual arrangement without firstly seeking quotes if it resolves that, because of the specialised or confidential nature of the services sought, it would be impractical or disadvantageous to invite quotes or tenders.

3.3 Policy Implications Given the work already undertaken and the extensive experience and knowledge acquired conducting this work it would not be advantageous for MBRC to go to the market to complete this work.

3.4 Risk Management Implications The matters related to the work are still confidential; introducing a new consultant into the process would increase Council’s exposure to –

• a confidential matter being released; • delay the works as the new consultancy comes up to speed with the project

3.6 Financial Implications It is proposed to include a budget of $200,000. The contract with ML Design will be costed to the Uni - Precinct Master Planning budget (33093.001.22004).

Director Brent O’Neill is an urban designer and master planner with a focus on delivering viable, quality design outcomes. His experience in property, planning, and urban design spans over 20 years and has taught him, above anything, to constantly keep questioning, searching, and exploring. Fascinated by understanding design as a philosophy and concept, Brent sees great importance in observance and, to really understand a subject, topic, or surrounds.

As a consulting urban designer, Brent’s expertise in development spans all sectors to include master planning, context analysis, conceptual design, feasibility investigations, development controls, and planning approval negotiations.

REPORT DETAIL 1. Background Pursuant to section 233 of the Local Government Regulation 2012, Council is able to enter into a medium-sized contractual arrangement or large-sized contractual arrangement for goods and services, without first inviting written quotes or tenders if the contract is entered into with a supplier under a preferred supplier arrangement or register of prequalified suppliers. The competitive rates from preferred suppliers approved through the tender process, are available to all staff responsible for procurement in Council to access should they require the services the preferred suppliers offer. Tenders were advertised on 4 March 2017 and closed on 28 March 2017 for the following purchasing arrangements, for a period of 12 months with an option to extend for a further two 12 month periods if beneficial:

The Council requires the above goods and services in large volumes and frequently. It is able to obtain better value for money by accumulating the demand for the goods and services, and the nature of the goods and services is well understood in the respective industries. 2. Explanation of Item Once the submissions were opened, they were assessed by the respective tender assessment teams in accordance with Council’s Purchasing Policy and the selection criteria set out in the tender documents. Submissions that did not address mandatory assessment criteria were assessed as “Non-Conforming” and did not progress in the evaluation process. The submissions were then assessed on qualitative criteria that included Company Profile, Experience of Company Personnel, Safety Track Record, Environmental Considerations and whether the company was a Local Business and/or Industry. REPORT DETAIL 1. Background The project is located at the Redcliffe Museum, 75 Anzac Avenue, Redcliffe. The project scope involves an extension to the eastern side of the Redcliffe Museum building. The extension has been designed to complement the architecture of the existing building. The objective of the project is to provide additional space for exhibitions and public programming and to replace the externally accessed toilets with new internally accessed toilets, including the provision of disabled compliant facilities. This will improve customer convenience and create a safer working environment for staff and volunteers.

Construction is programmed to commence in July 2017 and be completed by December 2017, weather permitting, which is in line with a coordinated closure of the Museum whilst works are underway.

11 MJ Ferguson Pty Ltd 69.13 A summary of the top three tenderers is listed below: Bryant QLD Pty Ltd received the highest ranking from the assessment panel based upon the selection criteria and submitted a comprehensive, well-priced and well-presented tender. Their experience and construction methodology was considered to be very good and they have demonstrated completion of similar construction works. At a tender clarification meeting, Bryant QLD demonstrated their understanding of the project and delivery method to complete the project. Astute Projects Pty Ltd received the second highest ranking from the selection panel based upon the selection criteria. Their submission was comprehensive and demonstrated a clear understanding of the project requirements and capacity to complete the works; however their submission was more expensive. LEAF Building Group Pty Ltd received the third highest ranking from the selection panel based upon the selection criteria. LEAF Building Group submitted a very comprehensive and well-presented tender; however their submission was more expensive. 3. Strategic Implications 3.1 Legislative/Legal Implications

Due to the estimated value of the works exceeding $200,000, Council called an open public tender for the work in accordance with the Local Government Act 2009.

3.2 Corporate Plan / Operational Plan This project is consistent with the Corporate Plan outcome - Valuing Lifestyle: Quality recreation and cultural opportunities - celebrating local arts, culture and community.

3.3 Policy Implications This project has been procured in accordance with the provisions of the following documents:

• Council’s Procurement Policy 10-2150-006 • Local Government Act 2009 • Local Government Regulation 2012 Chapter 6.

3.4 Risk Management Implications The project risk has been assessed and the following issues identified. The manner in which the possible impact of these risks are mitigated or minimised is detailed below. Financial: a. A third party review of the financial status has been undertaken, and the successful tenderer was

rated “sound”. Construction: a. The contractor will provide a program of works, traffic management plan, environment

management and safety plan and will be required to fence off the areas where construction is being undertaken to meet relevant workplace health and safety requirements as part of the contract.

b. The proposed works will be undertaken in accordance with the required planning approvals (Material Change of Use) including the provision of building approval and engineering Form 15 and 16 certificates.

c. The tendered methodology has been assessed to ensure construction risks associated with the works are understood and a management plan will be in place to manage such risks.

d. The contractor has demonstrated an understanding of the need to manage and minimise the impact of the works to the adjoining park area and community service facilities.

e. Prior to construction commencing on site, the contractor will submit for approval a workplace health and safety management plan. Regular audits of these plans will be undertaken by Council inspectors throughout the construction period to ensure compliance.

3.5 Delegated Authority Implications

There are no delegated authority implications relating to this project. 3.6 Financial Implications

Council has allocated a total of $900,000 in the 2016/17 and 2017/18 Capital Works budgets for this project, to be debited to budget number 101949. Design costs $ 80,000 Tender price (construction) $ 801,688 Contingency (10%) $ 80,000 QLeave $ 4,000 -------------- Total project cost $ 965,688 ======== The estimated increase in the ongoing operational/maintenance costs is $18,700 per annum for air conditioning, energy usage, cleaning, repairs and maintenance. The budget amount for this project is insufficient, allowing for project contingencies. Should additional funds be required, these will be sought via a formal 2017/18 budget quarterly review.

3.7 Economic Benefit Providing improved facilities and attractions will support the Museum’s capability to attract and increase visitors to the region, with a wider economic benefit resulting from increased tourism and visitor expenditure.

3.8 Environmental Implications There are minimal environmental implications posed by these works. The successful tenderer will be required to submit an environmental management plan for the works.

3.9 Social Implications

The project will have positive social and cultural implications, increasing use and appeal of the facility and ensuring the region’s cultural heritage and social history collections are enjoyed, preserved and protected.

3.10 Consultation / Communication A communication plan, together with a pedestrian management plan, will be implemented with the successful contractor prior to works commencing on site. This will include utilising Council’s project signage which will be displayed prior and throughout the works. There has been significant involvement by Council staff and facility manager throughout the design process. Significant consultation has been undertaken with Moreton Bay Regional Council Libraries, Galleries and Museums department to minimise disruption of services. The Divisional Councillor has been consulted and is supportive of the project and consultation plan.

Services) Executive Summary At its 30 May 2017 workshop, Council agreed with the officer’s proposal to set general entry fees for the fitness facility at the Caboolture Pool and Fitness Centre, and requested officers present a report detailing the proposed fee structure. Council officers have developed a fixed five-year schedule of fees for entry to the Caboolture Fitness Facility to be included in the pending public tender. Establishing agreed entry fees will ensure that the local community maintains affordable access to quality health and fitness equipment and services as well as providing the tenderers with a known framework for which they can tender. REPORT DETAIL 1. Background Council has utilised a contracted fitness provider to operate the fitness facility at the Caboolture Pool and Fitness Centre since opening in 2015. This report proposes the fee structure for fitness centre for the next five financial years, commencing in the 2017/2018 financial year. 2. Explanation of Item Officers propose that council retain ownership of the fitness facility, and maintain control over a casual entry fees to ensure affordable and equitable access for the community. As indicated (and as is consistent with the recent aquatic centre agreement tender), officers propose that council set the casual entry fees for the duration of the initial term of any successful tenderer. After this period, the operator would need to seek council approval for fees on an annual basis. This will provide council with certainty regarding the ongoing affordability and equity of access. The proposed fee structure for the Caboolture Fitness Facility is as follows:
