Tribute to India's Freedom Fighters through preservation of heritage sites Administration takes up conservation work of National Memorial Cellular Jail under ‘Swadesh Darshan Scheme’ Restoration work likely to be completed by end of 2021 Port Blair, Oct.12 A country's national heritage is its prized possession and the onus lies on the country to preserve and conserve its rich heritage sites as they hold many significant facts associated with the history of the place. The A&N Islands history is entwined with the historic Cellular Jail which speaks of many sacrifices that led to the liberation of the country from the clutches of the colonial rule. A visit to the National Memorial takes one Port Blair, Oct. 12 Indian Coast Guard in close liaison with other stakeholders is prepared to meet any threat emanating from the sea. To strengthen the existing security mechanism and mature interoperability, Coastal Security Exercise 'Sagar Kavach' is conducted and coordinated by Indian Coast Guard twice a year. The exercise aims to assess the effectiveness of the Coastal Security Structure in guarding against/preventing unauthorized landings and fishing community in serving as 'Eyes and Ears' for early warning towards seaward threat. The Coastal Security Exercise for the year 2020 will be conducted on Oct. 14 and 15, 2020. The exercise will be conducted with assets/ personnel drawn from all 17 stakeholders responsible for Coastal Security setup of the A&N Islands and overseen by the Chief Secretary, A & N Administration, a press release from Coast Guard said. The ODOPs identified for all the Districts of A & NIslands are South Andaman (Marine Fish Products), North & Middle Andaman(Coconut based products) and Nicobar (Coconut based products). Individual Micro food processing units would be provided credit link Capitalsubsidy at the rate of 35% of the eligible project cost with the maximum seedingof Rs. 10, 00,000 per unit. The scheme would also support clusters and groupssuch as FPOs/ SHGs/ Producers Cooperatives along their entire value chain forsorting, grading, assaying, storage, common processing, packaging, marketing,processing of agro-produce and testing laboratories. Grant at the rate of 35%with credit linkage and training support would be provided. The scheme alsoproposes to provide support to SHGs in the seed capital and support for capitalinvestment and training and hand holding supports. The eligible enterprises may seek financial assistance towards research andcapacity building. NIFTEM and IIFPT in partnership with State Level TechnicalInstitution would provide training and research support to the selectedenterprises/ group/ cluster. Online training module would be used for generaltraining and product specific training would be provided for the District forOne District One Product (ODOP). The Ministry has released detail guidelines for implementation of 'PrimeMinister Scheme for Formalization of Micro Food Processing Enterprises (PMFME)' under Aatmanirbhar Bharat Abhiyan with the slogan 'Vocal for Local'.The guideline is available in the Ministry of Food Processing Industries websiteat https://mofpi.nic.in/fme/. For sensitizing the scheme to the stakeholders and the target group, a one daySeminar is scheduled to be conducted in the Conference Hall of Directorate ofIndustries, Port Blair on Oct. 13 between 10 am to 1 pm. The seminar will beparticipated by line Depts. & other stakeholders like Agriculture, Fisheries,CIARI, NABARD, ACCI etc. The programme will be inaugurated by ShriAbhishek Dev, Secretary (Ind.) in the presence of Secretary (Fisheries), Secretary(Agriculture) and Heads/ Representatives from the line department andagencies. The terms and conditions of the appointment of member for State Commission are as follows:-

i. be not less than forty (40) years of age;

level or combined service as such in the district court and tribunal.

Provided that not more than fifty percent of such members shall be appointed; or

iii. a bachelor’s degree from a recognized university and is a person of ability, integrity and standing, and has

special knowledge and professional experience of not less than twenty years in consumer affairs, law, public

affairs, administration, economics, commerce, industry, finance, management, engineering, technology,

public health or medicine:

Provided that a person shall be disqualified for appointment as a member if he-

1) has been convicted and sentenced to imprisonment for an offence which involves moral turpitude; or

2) has is an undercharged insolvent; or

3) is of unsound mind and stands so declared by a competent Court; or

4) has been removed or dismissed from the service of the State Government or Central Government or a

body corporate owned or controlled by the Government; or

5) has, in the opinion of the State Government, such financial or other interest as is likely to prejudicially

affect his functions as the President or a member.

Salaries/Honorarium: - The salary/honorarium of selected candidates shall be regulated as per The

Andaman and Nicobar Islands Consumer Protection Rules, 2019 or as amended from time to time.

Other terms and conditions of assignment shall be regulated in accordance with the provisions of the

Consumer Protection Act, 2019 and the Rules framed there under, as amended from time to time.

ORDER NO.278 Whereas as per the section 25(RESTRICTIONS ON NEW

OUTLETS AND NEW DISCHARGES) of Water (Prevention and

Control of Pollution)Act, 1974, No person shall, without the previous

consent of the State Board, establish or take any steps to establish any

industry, operation or process, or any treatment and disposal system or

an extension or addition thereto, which is likely to discharge sewage

or trade effluent into a stream or well or sewer or on land.

Whereas as per the section 21(RESTRICTIONS ON USE OF

CERTAIN INDUSTRIAL PLANTS) of Air (Prevention and Control

of Pollution) Act, 1981, subject to the provisions of this section, no

person shall, without the previous consent of the State Board, establish

or operate any industrial plant in an air pollution control area.

Whereas, it is the responsibility of the industrial unit to obtain

Consent To Establish(CTE) from Andaman Nicobar Pollution Control

Committee(ANPCC) before establishment of industry and also obtain

Consent to Operate(CTO) after establishment of unit. Non compliance

of this is the violation of the provisions made under Water (Prevention

and Control of Pollution)Act, 1974, Air (Prevention and Control of

Pollution) Act, 1981 and Environment (Protection) Act, 1986.

Whereas, it has come to the notice of ANPCC that the many of

Industrial Units have been established without obtaining CTE and also

started operating without CTO under the Water (Prevention and

Control of Pollution)Act, 1974 and Air (Prevention and Control of

Pollution)Act, 1981, which is a violation of the aforesaid rules.

Now therefore the ANPCC in its XXV meeting held on 24-01-

2020 has decided to regulate all such industrial establishment who

have not obtained CTE before establishment by giving one time 60

days window from 07-10-2020 to 05-12-2020 apply for getting CTO

from ANPCC. However the CTO will be issued subject to fulfillment

of environmental norms applicable to the industry.

Therefore, it is informed to all the stakeholders and general public

that it is the statutory responsibility of all the industries to obtain CTE

prior to establishment of any industry & CTO after establishment in

Andaman and Nicobar Islands. The industrial unit/entrepreneur

shall apply for CTE & CTO using the URL:

www.anocmms.nic.in for the fulfillment of requirement made under

Water (Prevention and Control of Pollution)Act, 1974, Air

(Prevention and Control of Pollution) Act, 1981 and Environment

(Protection) Act, 1986.

Any industrial unit which fails to obtain CTO from ANPCC within

the stipulated time shall be liable for action as the provisions of

Environment (Protection) Act, 1986.

No Consent to Operate will be issued to any industry after lapse of

60 days(i.e 05-12-2020) who have not obtained CTE before its

establishment.

Islands, hereby makes the following Rules regulating the method of

recruitment to the Group ‘B’ Non-Gazettted, Non-Ministerial post of Instructor (Physical Education) born in the establishment

Tagore Government College of Education, Port Blair, Andaman and

Nicobar Administration, Port Blair namely:-

1. Short title and commencement

i. (i) These rules may be called the Andaman and Nicobar Islands Group ‘B’ Non-Gazetted Non-Ministerial post of Instructor

(Physical Education) Recruitment Rules, 2020.

ii. (ii) They shall come into force on the date of their publication in

the Official Gazette.

2. Application

These rules shall apply to the post specified in Column (1) of the Schedule annexed to these rules.

3. Number of posts, Classification and scale of pay.

The number of post, its classification and the Pay Level attached

thereto, shall be as specified in para 2 to 4 of the Schedule annexed to these rules.

4. Method of recruitment, agelimit, qualification etc. The method of recruitment, age limit, qualifications and other

matters relating to the said post shall be as specified in paras 5 to 14

of the Schedule annexed to these rules.

5. Disqualification- No Person

i. (i) Who has entered into or contracted a marriage with any

person having a spouse living; or ii. (ii) Who having a spouse living has entered into or contracted a

marriage with any person, shall be eligible for appointment

to the post.

Provided that the Lieutenant Governor (Administrator), Andaman and Nicobar Islands may, if satisfied that such marriage is

permissible under any personal law applicable to such person and

other party to the marriage and that there are other grounds for so

doing, exempt any person from the operation of these Rules.

6. Power of Relax

Where theLieutenant Governor (Administrator), Andaman and

Nicobar Islands is of the opinion that, it is necessary or expedient to do so, he may, by order for reasons to be recorded in writing, relax

any of the provision of these rules with respect of any class or category of person.

7. Saving

Nothing in these rules shall affect the reservations, relaxation of

age-limit and other concessions required to be provided for the Schedule Castes, the Scheduled Tribes, Ex- Serviceman and other

specific categories of persons in accordance with the order issued by the Central Government from time to time in this regard.

NOTIFICATIONF.No. 9-5/2003-D-III.- In exercise of the powers conferred under

rule 20 of the Delegation of Financial Power Rules, 1978 read with rule 228

of General Financial Rules, 2017, and in supersession of the Notification

No. 9-5/2003-D-III, dated 29/08/2005, the Hon'ble Lt. Governor

(Administrator), Andaman & Nicobar Islands hereby makes the following

rules regulating the terms and conditions for Grant-in-Aid to State Sports

Council functioning in the Union Territory of Andaman and Nicobar Islands.

1. SHORT TITLE AND COMMENCEMENT:

1.1 (a) These rules may be called the "Andaman and Nicobar Islands

Grant-in-Aid to A & N State Sports Council Rules, 2019".

(b) These rules shall come into force on their publication in the Official

Gazette.

1.2 DEFINITIONS :

In these rules, unless the context otherwise requires:

(a) "Council" means Andaman and Nicobar State Sports Council, a

recognized organization engaged in development and promotion of sports

and games in Andaman and Nicobar Islands.

(b) "Lt. Governor" means the Lieutenant Governor of Andaman and Nicobar

Islands.

(c) "Administration" means the Andaman and Nicobar Administration.

(d) "Rules" means these rules, as may be amended from time to time by the

Administration with the approval of the Lt. Governor.

(e) "Year" means financial year from the month of April to March of the

following year.

(f) "Articles" means the Articles of the A & N State Sports Council as

approved by the Lt. Governor.

2. ELIGIBILITY FOR GRANT-IN-AID AND SANCTIONING

AUTHORITY:

2.1 The Chief Secretary, Andaman and Nicobar Administration shall be the

authority to sanction Grant-in-Aid out of the approved Annual Budget of

the Union Territory. The amount of Grant-in-Aid to be released during a

year shall be as decided by the Chief Secretary, Andaman and Nicobar

Administration.

2.2 The "Council" so engaged and sanctioned with Grant-in-Aid shall

function as per the provisions of the Articles of the "Council".

3. PURPOSE FOR WHICH GRANT-IN-AID TO BE SANCTIONED:

3.1 The "Council" may extend financial assistance out of the fund received

from the Government to various affiliated/recognized Sports Associations

in terms of approved Bye-laws/Articles of Andaman & Nicobar State Sports

Council.

3.2 The "Council" may release financial assistance to Regional States

Sports Councils affiliated with Andaman & Nicobar State Sports COUNCIL.

3.3 Grant-in-Aid will be utilized for payment of salary of Coaches and

other officials engaged on contractual basis by State Sports Council.

3.4 Grant-in-Aid will be utilized for the purpose of meeting expenditure in

terms of office expenses, rents and taxes.

3.5 Grant-in-Aid will be utilized for conducting tournaments as approved

by State Sports Council time to time.

3.6 Grant- in-Aid will be utilized for the procurement of goods and services

in accordance with delegation of Financial Power Rules and General

Financial Rules as amended from time to time.

4. PROCEDURE OF APPLICATION AND SANCTIONING

4.1 Every application for Grant-in-Aid shall be submitted by the State

Sports Council directly to the Director, Sports along with detailed statement

in respect of salary and other expenditure and Utilization Certificate.

4.2 Checks to be ensured before submitting the Grant-in-Aid applications:-

The following checks shall invariably be done by the President (SSC)/

General Secretary (SSC)/Joint Secretary (SSC)/Treasurer (SSC) of the

Council as the case may be before submitting the Grant-in-Aid applications:

(i) Whether the application is made in the prescribed format, if any, and in

complete shape.

(ii) Whether all the required informations and the documents as specified

in the format has been enclosed with the application.

(iii) Whether the Utilization Certificate is attached with the application.

(iv) Whether the particulars given in the opening balance in the Utilization

Certificate are correct.

(v) Whether the interest earned by the State Sports Council is remitted

into Govt. Account after finalization of accounts as mandated under Rule

230(8) of GFR, 2017.

4.3 (a) On receipt of an application made under rule 5 (a) for Grant-in-Aid,

the Director (Sports) shall cause such enquiry as he/she thinks fit to be

made into the statement contained in the application and into the purpose

for which Grant-in-Aid is applied for and after being satisfied forward the

application along with his/her recommendations to the Secretary, Sports.

He/ She shall may think fit and after satisfying himself/herself recommend

the case to the Component Authority i.e. Chief Secretary through Financial

Division of Andaman and Nicobar Administration.

(b) If it appears to the Competent Authority that the financial assistant is

needed for any one of the purposes indicated in rule 3, the Competent

Authority may, after such inquiry as he deems necessary, accord sanction

of Grant-in-Aid with due regard to the principles enunciated in the General

Financial Rules, 2017, as amended from time to time and also impose special

condition, if required.

(c ) The Grant-in-Aid application so received under Rule 4.1 and 4.2 shall

be processed by the Director , Sports and orders of the Competent

Authority thereof shall normally be communicated within 60 days.

(d) The Grant-in-Aid shall not be sanctioned to the State Sports Council in

case the Utilization Certificate in Form "12 -A" as specified in Schedule-I

is not furnished along with the Grant-in-Aid application.

5. MODE Of PAYMENT OF GRANT-IN-AID:

The Grant-in-Aid to State Sports Council may be paid in one full installment

or more at the discretion of the sanctioning authority subject to the

following conditions:

a) Due prudence and frugality shall be exercised by the grantee institution

while incurring expenditure out of GIA and no wasteful expenditure,

whatsoever, shall be incurred in any matter.

b) Expenditure will be incurred only for the purpose for which GIA has

been sanctioned and for the targets, which have been assigned to the

grantee institution by the Administrative Department .

c) The State Sports Council should submit UC within stipulated period of

12 months as provided under GFRs 2017.

d) The Administrative Department shall carryout periodical appraisal of

the performance of the grantee institution for ascertaining as to whether

the targets/goals assigned to the grantee institution are being achieved or

not and as to whether the GIA should be continued or not.

e) The Administrative Department will lay down adequate control

mechanism/checks for prevention and detection of errors and financial

irregularities in the working/functioning of subordinate/grantee institution

for avoiding wasteful expenditure and loss of money.

g) The payment of Grant-in-Aid shall be made through e-payment in favour

of the State Sports Council .

h) The State Sports Council should maintain separate accounts in respect

of this grant. The accounts will remain open for inspection by the officer/

representative from the office of the Comptroller and Auditor General of

India/Government of India/UT Administration.

i) Utilization Certificate in the prescribed format GFR 12-A is to be submitted

before release of subsequent installment.

j) Audited statements of accounts in respect of previous grants may be

obtained, scrutinized and submitted with the comments of Administrative

Branch, if any, before release of subsequent installment.

k) Audited statements of accounts in respect of previous grant are to be

submitted after closing the financial year.

l) All statutory clearance, if any, required may be obtained before incurring

expenditure .

6. MAINTENANCE AND AUDITING OF ACCOUNTS:

6.1 The 'Council' will maintain separate accounts in respect of grants

released under this rule. The accounts will remain open for inspection by

the Officers/representatives from the office of the Comptroller and Auditor

general of India/Government of India/Union Territory Administration of

the Andaman and Nicobar Islands with or without Notice.

6.2 All payments shall be made through Cash Book and relevant Vouchers

be retained in records.

6.3 The "Council" will have the accounts of the Grant-in-Aid audited

either by the Government Auditor or Registered Chartered Accountants

and submit the complete set of copies of the following Audited Statement

of Accounts to the Administration by 30th September in respect of Grant-

in-Aid sanctioned during previous year.

i. The Receipt and Payment Statement of Accounts.

ii. The Income and Expenditure Statement of Accounts.

iii. The balance sheet.

iv. The Utilization Certificates in the prescribed form (GFR12-A) alongwith

the itemwise expenditure actually incurred.

v. A statement in the prescribed form (GFR12-A) on assets created from

out of non-recurring grants in terms of the instructions contained in Rule

228 of the General Financial Rules, 2017 as amended from time to time.

vi. To maintain a register for all items procured by the Council above a

defined value (say Rs. 1000/-) alongwith any movable/immovable assets

of the Council.

vii. In case of winding-up of A&N State Sports Council, the ownership of

all assets (if any) must invariably vest with A&N Administration.

6.4 No Grant-in-Aid shall be sanctioned to the Council for a year unless

accounts for previous year are audited and report submitted to the

Administration. Notwithstanding the above, the Administration at its

discretion, may sanction Grant-in-Aid in the exceptional circumstances.

6.5 The "Council" shall submit performance-cum-achievement report on

the project for which it received Grant-in-Aid.

6.6 No assets acquired wholly or substantially from out of the Grant-in-

Aid will be disposed off or encumbered and /or otherwise utilized for the

purpose other than for which sanctioned.

6.7 A quarterly/half-yearly progress report (as appropriate) and Annual

Performance Report should be submitted by the Council to the A&N

Administration.

6.8 A&N Administration shall reserve the right of inspection of proposals/

plans/estimates for impact/performance/audit and an internal team can be

appointed for the same.

6.9 If the Administration is not satisfied with the progress of the project or

considers that the sanction is being violated, it reserves the right to

terminate the Grant-in Aid and take such action as it deem fit.

6.10 Any unspent balance of Grant-in-Aid will be refunded by the 'Council'

immediately after the close of the relevant financial year unless adjusted

by the Administration from the subsequent grant which may fall due.

6.11 The 'Council' will not obtain grant for the same purpose/project from

any other source, including the Government Source and in case receives

grant for the same purpose/project, the same will be intimated to the

Administration.

6.12 In respect of the matters, not specifically covered in these rules, the

provision of G.F.Rs of Central Government as amended from time to time

relating to sanction of Grant-in-Aid shall be applicable.

7. Procurement Process:

(a) The goods and services available on Government e-market place (GeM)

shall be procured mandatorily from the GeM portal as per Rule 149 of

General Financial Rule, 2017.

(b) In case of goods and services of required specification or within

required delivery period etc. are not available on GeM, the procuring entity

can resort to Rule 154 and 155 of General Finance Rule, 2017 as amended

from time to time.

(c) In respect of State Sports Council, the Jt. Secretary, A&N SSC shall

have power to incur expenditure upto 1.5 Lakhs on each occasion with

the following condition that-

(i) He will have power to purchase goods upto the value of Rs. 25,000/-

(Rupees Twenty Five Thousand Only) on each occasion without inviting

quotations of bids on the basis of a certificate to be rendered by him as

prescribed in Rule 154 of General Financial Rule, 2017.

(d) Any purchase exceeding of Rs. 25,000/- (Rupees Twenty Five Thousand

Only) and upto Rs. 2,50,000/- Rupees Two Lakh Fifty Thousand Only).

Thereafter purchase shall be made through local purchase committee as

per the provision of Rule 155 of GFR Rules, 2017.

(e) In respect of the State Sports Council, the General Secretary, A&N SSC

shall have power to sanction expenditure between 1.5 lakhs to 3 lakhs

with the following condition:

(i) The contingent expenditure beyond the power of Joint Secretary (SSC)

shall be incurred by the General Secretary (SSC). The contingent

expenditure as defined in delegation of Financial Rule, 1978 as amended

from time to time. However, all expenditures shall be made duly observing

the provisions of General Financial Rules, 2017 as amended from time

to time.

(f) In respect of State Sports Council, the President, A&N SSC shall have

power to incur expenditure over 3 lakhs and will have full powers to

sanction expenditure within the approved budget of the State Sports

Council.

The contingent expenditure shall be as defined in delegation of

Financial Power Rule, 1978 and as amended from time to time. However, all

expenditure shall be made duly observing the provisions GFR 2017 as

amended from time to time

(g) Outsourcing/hiring of manpower shall be done as per in Rule 177 to

Rule 206 of General Financial Rules, 2017.

(h) Hiring of vehicles shall be done in accordance with relevant rules and

procedures as laid down in General Financial Rules, 2017 and as per A&N

Administration order issued from time to time.

(i) All tender enquires, corrigenda thereon and details of bid awards must

be published on Central Public Procurements Portal (CPPP) and all bids

received through e-procurement Portal in respect of all procurements as

laid down in Rule 159 & 160 of General Financial Rules, 2017.

f) The Administrative Department will ensure that the mechanism/checks

contemplated in pint 5 are effectively applied for ensuring that the funds

8. POWER TO REMOVE DIFFICULTIES : If any difficulties arise in giving

effect to the provision of these Rules , the Administrator may subject to

such restrictions and conditions, if any, as he may think impose, dispense

with or relax the provision of any of these Rules.

9. SAVING: The Administrator may alter, amend, include or exclude any

provision(s) of these rules and schedules thereunder as may be warranted

to safeguard public money, at any time for reasons to be recorded in

writing.
