The Secretariat-General of the European Commission is one of the central services of the European Commission, facilitating its smooth and effective functioning and providing strategic direction.

It is the President’s department, at the service of the President, the College and the other Commission departments. It manages the collegial decision-making process and ensures the alignment of EU policies with the political priorities of the Commission. In agreement with the President, the Secretariat-General provides support to the Vice-Presidents in the performance of their role.

According to the annual activity report of the Secretary General: “2019 was a transitional year for the European Commission. The focus in the reporting year was on completing work on the priorities of the Juncker Commission, while in parallel assisting the incoming President and Commission. The smooth passage from the Juncker to the von der Leyen Commission was the result of intensive preparatory work coordinated by the Secretariat General.

At the heart of the decision-making process, the Secretariat-General steered and coordinated all major policy initiatives and led on key cross-cutting policy files such as the negotiation of the future multiannual financial framework, the European Semester of economic policy coordination and the Cooperation and Verification Mechanism for Bulgaria and Romania. The sustained efforts led to a 100% implementation rate of the initiatives listed in the 2019 Commission Work Programme. The Secretariat-General also led on a range of corporate policies, such as the Commission’s better regulation agenda and data protection. It acted as the interface between the Commission and other institutions and bodies, facilitating agreements on the legislation previously tabled.

The discharge hearing will be based on information provided in public documents, such as the Court of Auditors' 2019 Annual Report, and the new Annual Report on Performance of the EU budget, as well as the Commission's Integrated Financial and Reporting package, and the 2019 Annual Activity Report of DG RTD.

All the relevant documents can be found on the CONT website.

In accordance with the timetable for the discharge procedure, the written questions for this meeting were sent to the Commission on 11 December 2020 and emailed to Members on the following day. The Commission’s answers are expected on 4 January 2021 and the CONT secretariat will forward them immediately to Members.

It is proposed that the hearing with the Commission Secretary General Juhansone proceeds as follows:

Introduction by the reporting Member of the European Court of Auditors, François-Roger Cazala, who will present the findings of the respective chapters of the Annual Report 2019, and the Report on the performance of the EU budget;

Today's presentation of the STOA in-depth-analysis “Exploring the performance gap in EU Framework Programmes between

EU 13 and EU 15 Member States” is geared towards answering the specific research questions the CONT committee posed: which countries benefited most from the programme and which institutions have received the funding? It analyses the existing distribution of funding and points to policy options at national and EU levels to reduce the gap between different Member States.

According to the annual activity report of DG Health and Food Safety, DG SANTE operates under the political leadership of the Commissioner for Health and Food Safety on the basis of multi-annual policies and financial frameworks. The 3rd Health Programme 2014-2020 provides funding for health policy and Regulation (EU) No. 652/2014 provides the financial framework for food safety, animal and plant health.

The total payments made by DG SANTE in 2019 represented EUR 435,9 million, while the committed amounts added up to EUR 482,0 million at year-end.

In 2019, DG SANTE's average residual error rate of 0,4 % was clearly below the materiality threshold of 2%.

No reservation was made in the Director-General's declaration of assurance.

The Court of Auditors has not done any relevant audits concerning the Health programme or Food Safety during the last year. Therefore, there will not be a member of the Court of Auditors present at this hearing. An ECA Review on COVID-19 response to public health is expected later in January.

- The ECA’s 2019 Annual Report on EU agencies;- The ECA’s Special Report on the Future of EU Agencies;- The replies from the EU Agencies to the written questions of the CONT Committee;

ACERThough ACER’s accounts received a clean opinion and also on the legality and regularity of revenue, ECA issued a qualified opinion on the legality and regularity of payments made by ACER, which was related to irregular procurement procedures.

EASOECA presented a qualified opinion on the legality and regularity of payments made by the Agency, which resulted primarily from findings related to 2016, 2017 and 2019. However, also in 2019, the ECA found payments related to an irregular selection procedure.

EBAThe European Banking Authority (EBA) moved offices from London to Paris in 2019, and a new executive director was appointed. The ECA gave a clean opinion on the EBA’s accounts, and made an observation on the reservation of just over EUR 10 million that resulted from the move to Paris.

ECDC For ECDC it is crucial to note the importance of developing tools for the digitalisation of healthcare in the Union, in particular in the context of tackling the current pandemic. The discharge authority made this recommendation in the framework of the 2018 discharge, though ECDC still has not taken full action towards it. The European Court of Auditors’ did not present findings or recommendations for the year 2019.

EMAECA gave a clean opinion on the EMA’s accounts and legality and regularity of its revenue and expenditure. It nevertheless made a number of observations about how it had performed a number of procurement procedures and provided a travel allowance to its staff.EMA managed in 2019 to sublet its former office in London that it had to vacate in 2019 due to the United Kingdom’s unilateral decision to leave the European Union and resulting move to Amsterdam. Though the financial risk of the continuing lease agreement on its former London office might have been reduced, EMA is concerned that the effort that needs to be given to managing a commercial property will continue to distract EMA from achieving its primary objective.

FRONTEXECA pointed to several areas where improvements are needed in Frontex’s financial management, mainly the legality and regularity of transactions and internal controls. ECA also noted improvements, regarding of the ex-ante verifications and re-introduction of ex post verifications on reimbursements.

It is proposed that the exchange of views shall proceed as follows: Introduction by the Member of the European Court of Auditors, Mr Alex Brenninkmeijer who will present

the findings of the ECA Annual Report on EU agencies for the financial year 2019 and the Special Report on the Future of EU Agencies;

For the financial year 2019, the eight Joint Undertakings (JUs) subject to the discharge procedure by the Parliament are the following: European Joint Undertaking for ITER and the Development of Fusion Energy (F4E), Single European Sky Air Traffic Management Research Joint Undertaking (SESAR), Clean Sky Joint Undertaking (Clean Sky), Innovative Medicines Initiative Joint Undertaking (IMI), Fuel Cells and Hydrogen Joint Undertaking (FCH), Electronic Components and Systems for European Leadership Joint Undertaking (ECSEL), Bio-based Industries Joint Undertaking (BBI) and Shift2Rail Joint Undertaking (S2R).

On 12 November 2020, the Court of Auditors published its annual report on JUs in the form of a single consolidated report on all JUs. In its report, the Court:

states that JUs' accounts are reliable, and none of the eight JUs has exceeded the materiality threshold of 2%;

notes that some JUs under Horizon 2020 fell short of targets but completed most of the call procedures, and had awarded and/or signed an average of 78 % of their planned activities by the end of the year;

notes that several JUs still had weaknesses in their procurement, grant payments and recruitment procedures;

draws attention to ITER / F4E, citing the risk of further cost increases and delays in implementing the International Thermonuclear Experimental Reactor (ITER) project.

The review examines the EU’s approach to the issue of land-based plastic waste, with a particular focus on plastic packaging waste. It highlights some of the gaps, risks, challenges and opportunities of the approach adopted. The Court focused on plastic packaging waste as it represents the single biggest part of plastic waste (61 %).

The new EU’s Plastics Strategy includes the updating of the 1994 Packaging and Packaging Waste directive (PPWD). The revised PPWD set new plastic packaging recycling targets for 2025 (50 %) and 2030 (55 %). In order to reach these new recycling targets, the EU must reverse the current situation whereby incineration prevails on recycling. The introduction of new stricter reporting rules will likely lead the EU’s reported average plastic packaging recycling

rate to drop. Industry sources estimate, this could mean a drop from 41% to 32-29%.

Even for plastic packaging, the most developed arm of the plastics strategy, concerted action by stakeholders at EU and Member States level will be required to bridge the considerable gap between the current recycling rate and where we need to be in only 5 to 10 years’ time.

It is proposed that the presentation of the review proceeds as follows:
