FOREWORD

The Commission for Higher Education (CHE) was established in 1985 by an Act of Parliament, Universities Act CAP 210B as a body corporate, to make better provisions for the advancement and quality assurance of university education in Kenya and for connected purposes. The operationalization of the Act was done through gazettement of the Universities Rules of 1989 which empowered the Commission to establish and accredit private universities and the programmes they offer.

The 2004 Rules enable CHE to validate diploma programmes offered by Post Secondary School Institutions (PSSI) for purposes of advancing graduands of the same to join university education. In addition to this, the PSSIs upon meeting set minimum standards are able to offer degree programmes through grant of authority for collaboration with accredited universities. In doing so, the commission regulates, coordinates and assures quality of university education in Kenya

The Commission will continue to exercise its mandate of ensuring the maintenance of standards, quality and relevance in all aspects of university education, training and research. The Commission mainstreams quality assurance practices in higher education and encourages continuous improvement in the management of the quality of university education. This is mainly accomplished through a peer process of audits and reviews.

The Commission takes cognizance of the on-going reforms and other emerging issues in the provision of education. Addressing these reforms holds the key to the country’s participation in the increasingly globalized knowledge society and achieving Vision 2030. In order to participate fully and reap the benefits of the globalised economy, the CHE enforces its mandate and ensures that high standards centered on quality assurance are maintained.

The fast changing higher education landscape has seen rapid expansion of universities over the years leading to the current 63 universities / university constituent colleges, comprising of: 7 public universities, 24 public university constituent colleges, 14 chartered private universities, and 5 private university constituent colleges, 11 private universities with Letters of Interim Authority and 2 registered private universities. So far the work of the Commission has been limited to private Universities. However, with the enactment of the proposed Universities Bill, the mandate of the Commission will extent to the Public Universities. This will ensure a level playing field in quality assurance regulation as well as harmonization of expected standards in quality of higher education.

Currently, private universities are inspected in the process towards receiving a charter. Once chartered, the private universities are re-inspected so as to evaluate the steps taken towards achievement of the aims and objects for which they were established. Once they are

ascertained to have met the set standards as given in the Rules, they are given certificates of re-inspection.

The Commission has also developed quality assurance policies in collaboration with regulatory bodies in Uganda, Tanzania and recently Rwanda and Burundi. The introduction of a harmonized quality assurance system in the East African region will ensure that there is comparability of the quality of university education among the member countries. Regionally organized quality assurance framework that embraces internationally recognized standards has become an accepted practice. This has essentially been triggered by globalization and internationalization of education. The Commission is also a full member of International Network of Quality Assurance Agencies for Higher Education (INQAAHE) and African Quality Assurance Network (AfriQAN).The Commission’s practices therefore embrace best practices, and also benchmarks with other regional and international regulatory agencies.

The Commission has taken cognizance of the new partnerships and opportunities that have resulted from establishment of the East African Community. In this regard, the Commission has initiated and organized various quality assurance initiatives and engaged the stakeholders in formulating systems for sustainable Quality Assurance (QA) in the region.

This report is useful in giving the current status of accreditation of Kenyan institutions of higher learning and an update on quality assurance projects that the Commission has been implementing since 2006. The great effort put in producing this report is a manifestation of the Commission’s recognition that the provision of higher education and training is fundamental to the implementation of world-class standards.

ACKNOWLEDGEMENT

Accreditation and Quality Assurance (AQA) activities are facilitated by various departments that are assigned to undertake various functions. These functions are coordinated by the Secretariat under the governance of the Commission and its specialist committees. The nature of the work of the Commission necessitates the involvement of resource persons who are critical to the success of the core functions of the Commission. This interplay of the various operational arms of the Commission has contributed to the success of the Commission in terms of expansion in the provision of sustainable, affordable and relevant higher education in the country.

These milestones would not have been achieved without support from the government of Kenya, partners from the university sector and particularly the private entrepreneurs who have invested heavily in the development of the private university sub-sector. The expansion of the university sub-sector has been as a result of the favorable environment made available by the Commission and by extension the Government. The achievements made so far would nonetheless not have been realized without the audacity of investors who saw the existing gaps and have invested in increasing access by establishing institutions that offer quality higher education programmes.

Quality assurance is the bedrock of the Commission and there are legal instruments that facilitate the undertaking of activities that ensure quality is not compromised even as access is enhanced. This notwithstanding, the Commission for Higher Education (CHE) would not have achieved much of its success without the immense contribution made by its collaborating partners both locally, regionally and internationally. Partners such as the International Network for Quality Assurance Agencies in Higher Education (INQAAHE), the African Quality Assurance Network (AfriQAN), the Inter-University Council for East Africa (IUCEA) and the German Academic Exchange Service (DAAD) stand out as the key partners who have provided fora for benchmarking of our standards, guidelines and processes.

The Commission has come a long way since its inception in 1985 when there were only five (5) private higher education institutions in operation to a present twenty seven (27) private universities in operation. We extend out gratitude to all our stakeholders and assure them of our commitment to further augment our quality assurance processes as we continue to work towards ensuring the improvement of the higher education standards in the country.

1.0 INTRODUCTION

The Commission for Higher Education (CHE) was established by an Act of parliament, Cap 210B of the laws of Kenya, in 1985 as a body corporate to make better provisions for the advancement of university education in Kenya and for connected purposes. The Commission for Higher Education is governed by a Commission comprising of 19 Commissioners and a working secretariat, with a Commission Secretary responsible for its management.

There are nineteen (19) stipulated functions in the Universities Act (Cap 210B) of 1985. These include:

(a) Promoting the objectives of university education, namely the development, processing, storage, and dissemination of knowledge for the benefit of mankind.

(b) Advising the Minister on the establishment of public universities. (c) Accrediting universities. (d) Co-ordinating the long-term planning, staff development, scholarship and physical

development of university education. (e) Examining and approving proposals for courses of study and course regulations

submitted to it by private universities. (f) Receiving and considering applications from persons seeking to establish private

universities in Kenya and making recommendations thereon to the Minister. (g) Making regulations in respect of admission of persons seeking to enroll in universities

and to provide a central admission service to public universities. (h) Ensuring the maintenance of standards for courses of study and examinations in the

universities. (i) Advising and making recommendations to the Government on matters relating to

university education and research requiring the consideration of the Government. (j) Advising the Government on the standardization, recognition and equation of degrees,

diplomas, and certificates conferred or awarded by foreign and private universities. (k) Co-ordinating education and training courses offered in Post Secondary School

Institutions (PSSIs) for the purposes of higher education and university admission. (l) Arranging for regular visitations and inspections of private universities. (m) Collecting, examining, and publishing information relating to university education and

research.

The operationalization of the Act was done through the gazettement of the Universities Rules of 1989 and Universities Rules of 2004. The Universities Rules of 1989 facilitate the Commission for Higher Education in the establishment and accreditation of private universities and the programmes to be offered therein. The 2004 Rules enable the CHE to validate diploma programmes offered by Post Secondary School Institutions (PSSIs) for purposes of advancing the graduands of the same to enter into university education. In addition to this the PSSIs, upon

meeting set minimum standards, are able to offer degree programmes through grant of authority for collaboration with accredited universities.

During the period under review the government of Kenya has through various organs put forth policy documents that have and are guiding higher education and human resource development in the country. Examples of these include Sessional Paper No. 1 of 20051, Public Universities Inspection Board (2006)2, the Kamunge Task Force on the Review and Harmonization of the Legal Framework on Education, Training and Research3, the National Strategy for University Education (2008)4, and Vision 20305. This is also the time when the government of Kenya began implementing performance contracts in all ministries and public institutions. In line with the new governance and management procedures, and policy documents, the Commission for Higher Education developed and implemented its first five year Strategic Plan (2005 to 2010). The second Strategic plan was developed by June 2010 for a period of five years (July 2010 to June 2015) and is currently being implemented.

The CHE’s vision, mission and core values, as documented in the second Strategic Plan, reflect its mandate and are given as:

Vision: Quality university education that is accessible and sustainable

Mission: To oversee quality assurance and expansion of university education ensuring sustainability, affordability and relevance

Quality Policy: Ensuring increased access to sustainable quality higher education and training through planning, coordination, resource mobilization, quality assurance enhancement, and information service

Corporate Values and Principles: Integrity, Professionalism and responsiveness, Accountability, Openness and Teamwork

The Commission has continued with the mandate of expanding university education and assuring quality of the same. This six year report highlights the achievements the commission has made towards these aspects.

2.1 ACCREDITATION

By March 2012 Kenya had 63 universities / university constituent colleges, comprising of: 7 public universities, 24 public university constituent colleges, 14 chartered private universities, 5 private university constituent colleges, 11 private universities with Letters of Interim Authority and 2 registered private universities (see Table 2.1a to Table 2.1f).

During the 2011/2012 financial year two (2) universities with LIA were approved for award of Charter. These are Great Lakes University of Kisumu and KCA University. The actual granting of the award awaits the Presidential ascent. Adventist University of Africa is at an advanced stage towards award of charter. The institutions draft charter has been evaluated and is currently under revision. Meanwhile two (2) proposed universities have been inspected by the Inspection Accreditation Committee and approved for grant of LIA, subject to reorganizing the governance structure and trust deeds. The said proposed universities are Pioneer International University and Riara University. They are expected to comply and be granted the respective LIA in due course.

2.2 STUDENT ENROLLMENT

The student enrollment in the universities has increased tremendously since 2003. It rose from 58,637 in 2004/05 to 122,847 in 2008/09, to 177,735 in 2009/2010. By 2010/11 the enrollment stood at approximately 231,871. This was attributed to the increase in the establishment of more constituent colleges. The increase in enrollment, for example by the Joint Admission Board for public universities increased from 23.4% from 17,100 in 2008/2009 to 21,000 in 2009/2010 to 34,000 in the 2010/2011 academic year. In order to meet the demand for university education the public universities had a double intake for the academic year of 2010/2011 that began in August / September 2011. This also served as a stop gap to reduce the delay in admission of qualifying students into university education (Republic of Kenya, 20106, 6 Republic of Kenya, 2010. CHE unpublished report, 2012). The student body is distributed between the public and private universities as 80% and 20%, respectively. Less than 20% of candidates who qualify for admission each year actually gain admission into the higher education institutions in the country (Republic of Kenya, 2008a7). The country thus loses foreign exchange through student migration in search for higher education in neighbouring countries and abroad. It is against this back ground that the government commissioned tasks forces to look into ways of expanding access, financing, and improving the quality and relevance of higher education in the country. Some of the findings of the commissions and task forces have been documented in the Koech report (Republic of Kenya, 19998), Sessional Paper No. 1 of 2005 (Republic of Kenya, 20059), the Public Universities Inspection Board (PUIB, 200610) and the Wandiga report ( Republic of Kenya, 2008b11). These have been integrated into the MOHEST Strategic plan (MOHEST, 201012). Notable strategies in the Strategic plan in respect to this paper are: Promotion of access and equity (strategic objective 5), enhancing quality and relevance of higher education and technical education (strategic objective 6), enhancing resources and funding for science, technology and innovations and higher education (strategic objective 7), and improving corporate governance and management (strategic objective 8) . The Commission has endeavoured to mainstream the above strategies into her strategic plan and activities in order to increase access in university education while assuring its quality, sustainability, affordability and relevance.

2.3 RE-INSPECTION OF CHARTERED UNIVERSITIES Two of the functions of the Commission as stipulated in the 1985 Act are: to ensure the maintenance of standards for courses of study and examinations in the universities (Clause 6 (k)) and to arrange for regular visitations and inspection of private universities (Clause 6 (r)). Coupled with Rules 12 and 19 of the Universities Rules of 1989, Chartered universities are re-inspected every four to five years after a given cohort has graduated in accordance to the 8-4-4 education system currently in operation in Kenya. The purpose of the re-inspection of the

universities is to evaluate the steps a university has taken towards achievement of the aims and objects for which it was established, and whether it has complied with the set standards as given in the Rules therein and improved the quality of education it is offering (Quality Assurance Purposes). Where the universities satisfy the Commission that the quality of education on offer has been maintained or improved as per the minimum standards, they are issued certificates of re-inspection.

During the period under discussion a number of universities were re-inspected and their quality noted to have improved with time as evidenced in the infrastructural and staff development, resource mobilization and expansion of academic programmes with the requisite resources for running the same. One major issue worth of mention is the turn over rate of staff in institutions as a result staff movement due to competition in recruitment and opportunities between higher learning institutions. In some cases this has led to a great proportion of some programmes being taught by part-timers. The institutions in question have however put mechanisms in place to mitigate this problem. Such mechanisms include rigorous staff training and development of incentives for staff retention. Table 2.3 gives the list of universities that have been re-inspected, and the respective year, since the Commission was established.

3.0 PROGRAMME ACCREDITATION

In accordance to Clause 6 (h) in the Cap 210B Act (1985) and Universities Rules 1989 Clause 19 (1) (iii) programmes and courses to be taught in private universities are approved by the Commission before they are launched. The Commission since its establishment has approved programmes being offered in the private universities. From 2004/05 to 30th June 2012 the Commission has approved a total of two hundred and twenty nine programmes (229) as shown

4.0 COORDINATION OF POST SECONDARY SCHOOL INSTITUTIONS (PSSIs) FOR UNIVERSITY EDUCATION

Clause 6 (q) of the Universities Act (1985) states one of the function of the Commission as “to co-ordinate education and training courses offered in post secondary school institutions (PSSIs) for the purposes of higher education and university education”. The implementation of this clause has been through operationalization of the gazette Universities Rules of 2004. During the second half of 2006 the Commission began the process of validation of diploma programmes and also granting authority to collaborate to institutions with accredited universities and on approved (accredited) programmes.

4.1 VALIDATION OF DIPLOMA PROGRAMMES

One hundred and forty seven (147) diploma programmes from sixty nine (69) PSSIs have been validated since 2006 to date. The validation is for specific programmes in the said institutions and being offered in the specific designated physical location where the academic resources that met the set minimum standards were inspected at that time. The validation of the programme is not transferable to another physical locality. The specific programmes in the stated PSSIs and their physical location are given in Appendix 2.0. Of the 68 PSSIs, six (6) of them have since become universities or constituent university colleges. These are: Kenya School of Professional Studies (Inoorero University), Thika Institute of Technology (Mt. Kenya University), Kenya College of Communications Technology (Multi Media University College of JKUAT), Kenya Institute of Management (Management University of Africa), Muranga College of Technology (Muranga University College of JKUAT), and Co-operative College of Kenya (Co-operative University College of JKUAT).

4.2 GRANT OF AUTHORITY TO COLLABORATE

By 30th June 2012 thirty four (34) PSSIs had been given authority to collaborate in sixty four (64) programmes with universities. These were distributed as follows: 21 Diploma, 2 Postgraduate Diploma, 37 Bachelors, and 4 Masters programmes. Specific names of the programmes in the respective PSSIs and the collaborating universities are given in Appendix 3.0. As stated under section 4.1, some of the institutions have since become universities or university constituent colleges.

4.3 RE-EVALUATION OF THE STATUS OF PSSIs

Since the implementation of the validation of programmes and granting of authority to collaborate of PSSIs, a number of the institutions have changed their physical location and thus breached the requirement for operationalization of the Universities Rules 2004. Notable among

these include Swiss Management Academy formerly found along Thigiri ridge at New Muthaiga. Some collaborating universities have also revoked in writing the collaboration or not renewed the memoranda of agreement since their lapse. This has affected institutions such as Augustana College with JKUAT, and Riccatti Business College of East Africa (RBCEA) with University of Nairobi. The de-gazettement of these institutions, where applicable, is awaiting the Commission’s Board decision in due course.

The Commission has since 2011 being embarking on re-inspection of the approved PSSIs under validation and those granted authority to collaborate for the purpose of assuring the maintenance of the quality, as stipulated in the Universities Rules of 2004. So far Australian Studies Institute (AUSI), Oshwal College, Intel College, and Wisemen Trainers Consultants have been re-inspected. In general the institutions have been found viable in the implementation of the programmes. However, the Collaborating universities have been slow in renewing the MOAs where they have lapsed and some have changed the governance structure from the original one found at the time of approval. The Challenges faced in this area will be re-examined by the Commission and new strategies put in place to ensure that quality of the programmes in force is not compromised.

5.0 STAKEHOLDERS’ FORA

Several Stakeholders’ workshops have been held in the area of accreditation and quality assurance with the aims of developing and reviewing guidelines and standards for various facets in quality assurance. Such facets include curriculum guidelines and standards, library guidelines and standards, and training of peer reviewers. Some of the major fora that have been held during the period of review are enumerated below.

6.0 PROJECTS

The regulatory agencies of Kenya, Uganda and Tanzania, namely: Commission for Higher Education (CHE), National Council for Higher Education in Uganda (NCHE), and Tanzania Commission of Universities (TCU) signed a Memorandum of Co-operation (MoC) in Nairobi on 27th July 2006. The MoC outlined key areas of common concern which included:

(a) Development of Students Credit Accumulation and Transfer System (CATS) at the East African regional level.

(b) Development of a framework for describing and qualifying the content of study programmes in universities and diploma-awarding institutions in order to standardize for equating and recognizing of qualifications, and

(c) Development and use of common criteria and benchmarks for quality assurance in higher education and ensuring those universities and other higher education institutions develop and apply Internal Quality Assurance (IQA) measures such as academic audits.

From the above, key areas were identified and projects developed jointly with development partners and relevant collaborators. Two such projects have been under implementation since 2007. The overview of the projects is given in sections 6.1 and 6.2, respectively. In addition to this the Commission undertook a project on the development of a Portal with the assistance of UNESCO. An overview of this project is given under section 6.3.

6.1 CREDIT ACCUMULATION AND TRANSFER SYSTEM (CATS)

In a bid to create a harmonized and integrated regional system, the Commission is participating in a regional project on (Credit Accumulation Transfer System (CATS) for the East African region. The aim of the initiative is to enhance cooperation and quality assurance between institutions.

The CATS project will also facilitate movement of students both within the national and regional institutions. The initiative was first supported by Rockefeller Foundation at regional level in 2007, in collaboration with the higher education regulatory agencies in the East African region. After the first phase, subsequent phases have been funded by the Kenya Government at National level. In implementing this project the Commission works with various universities in academic programmes that are common. The initial fields selected in phase one were Agriculture, Human Medicine, Engineering and Basic Sciences. During the second phase in the Kenyan context, the Commission selected the fields of Computer Science, Information Technology and Business Studies. During the 20011/2012 financial year the field of Education was considered and minimum standards developed.

6.2 INTERNAL QUALITY ASSURANCE (IQA)

The Inter- University Council of East Africa (IUCEA) and the national higher education regulatory agencies in East Africa, are working toward putting in place a harmonized quality assurance (QA) system that will be used by universities in the region. A harmonized QA system will ensure that East African students enjoy quality higher education in all universities of the member states. The initiative began in 2006 with the support of German Academic Exchange Services (DAAD) and the German Rectors Conference (HRK). The collaborating partners included Oldenburg University in Germany, the national regulatory agencies in the East African region and voluntary member universities within IUCEA. So far forty seven (47) universities, amongst which fifteen (15) are Kenyan, have participated in the project. Phase one of the project ended in 2010 and the second phase for the next three years started in December 2011.

The successful implementation of the Internal Quality Assurance (IQA) project has enabled participating universities to embrace and operate IQA mechanisms. The tool for use in the region has been developed: A Roadmap to Quality, using existing national benchmark standards, systems and international practices. There is now a move towards harmonization of university quality assurance systems through training and establishment of directorates / units of QA at university level.

Kenya has moved the project to a higher notch by institutionalizing QA in all the universities. This has been through training, by the Commission for Higher Education, on QA and building capacity in the universities through workshops and setting of guidelines for IQA policy formulation by the higher education institutions (HEIs). By May 2012 about twenty five (25) new HEIs, including constituent colleges of public universities, had appointed Quality Assurance Officers and initiated the setting up QA directorates / units. The Commission will continue with the training of QA officers, Deans and Chairs of various academic programmes for spearheading programme assessment and pear review processes. It will also monitor and evaluate IQA mechanisms that are in use in universities with the aim of improving on the implementation process and massification of the same into other programmes.

6.3 UNESCO PORTAL

The Commission, with assistance from UNESCO, has created a website (portal) through which students and other stakeholders in higher education can access authoritative information on recognized institutions and academic programmes in pilot countries. Students planning to study in other countries, other than their own are the primary target audience of this portal. This initiative, which was undertaken in 2007/08, provides access to information that will assist in making informed decisions. It also links to websites that are deemed reliable. Kenya is the second country in Africa to have such a portal, the first one being Nigeria.

7.0 EXHIBITION BY KENYAN UNIVERSITIES The idea of having annual exhibition by Kenyan universities spearheaded by the Commission for Higher Education was mooted in 2001. By this time foreign universities had began flooding the Kenyan market, conducting fairs and exhibitions for purposes of selling their universities. The origin of such universities was mainly Australia, India, United Kingdom and Uganda. The goal of the annual exhibition by Kenyan universities was to address the misconception of the quality of higher education offered in the country, and also to guide form four leavers on career guidance and opportunities available in the local higher education institutions. There was need to emphasize that university education in Kenya was of acceptable quality and comparable to that offered outside the country. In addition to the above the exhibitions have since provided a platform for interrogation on pertinent higher education topics, and sharing of information amongst higher education providers and the public. Since the exhibitions started in 2002, ten of them have been conducted. The venue has since 2007 been rotated around the provinces throughout the country. They have been an invaluable source of information on university education in the country to the secondary school students, who form the greatest input in the admission process of the universities.

8.0 DOCUMENTATION The Commission has published some of the work it has undertaken over the period of review. However some of the reports are in an unpublished form within the Commission. The commission has also endeavoured to place some of the documents in a downloadable format within its website, www.che.or.ke. Section 8.1 enumerates the published reports while section 8.2 gives the list of unpublished documents.
