3. SITE MAP AND SCOPE OF THE BRISBANE MARKETS®

REGULATIONSThe Brisbane Markets® Regulations (Regulations) apply to the access-controlled area of the Brisbane Markets® as shaded in blue on the map below. Remedial Actions may be applied by BML in the event of non-compliance with the Regulations.

4. BRISBANE MARKETS LIMITED

Brisbane Markets Limited (BML) owns and operates the Brisbane Markets® on Sherwood Road, Rocklea. The Markets is a distribution, marketing and storage hub for the fresh fruit, vegetable and flower industries in Queensland. BML’s management of this Site includes:• Managing compliance, maintenance

and improvements to our buildings, Site infrastructure and services.

• Managing Tenancy Agreements with Tenants.• The ongoing development, redevelopment and

improvement of the Brisbane Markets®.• Managing Site rules, Site security, cleanliness,

waste and pest management, traffic management and safety.

• Managing risk, hazards, the environment and emergency procedures.

BML implements operating rules as set out in the Regulations so as to comply with our obligations at law.

This Guide to the Regulations has been designed to provide Tenants, Tenant Employees and other Market Users with a summary of the operating rules enforced at this Site. This Guide is not intended to replace the Regulations nor does it provide an exhaustive overview of all of the rules described in the Regulations.

It does set out the key operating requirements that apply to the access-controlled precinct of the Brisbane Markets®.

BML has the overarching duty of care to promote safety, manage Pedestrian and Vehicle traffic and ensure a clean work Site in all areas not tenanted or rented (Common Areas). However, Tenants are responsible at law for providing a safe workplace in their Tenancy Areas which includes a requirement for Tenants to develop their own Traffic Management Plans (TMP) in connection with their business operations at this Site.

Note, there are a number of capitalised terms used in this Guide. These terms have the same meaning as the terms defined in Section 13 – Definitions - in the Regulations.

Please refer to the Brisbane Markets® Regulations for the complete operating and traffic management rules that apply at this Site.

5. ACCESS RULES Access to the Brisbane Markets® is conditional upon your acceptance to comply with and be bound by the General Terms and Conditions of Entry (see Schedule 4) and the Regulations.

BML engages a team of Authorised Officers to administer the Regulations at this Site and provide direction and guidance to Market Users as required. It is a condition of entry to comply with all directions given by Authorised Officers.

GENERAL ACCESS REQUIREMENTSYou are required to wear Personal Protective Equipment (PPE) including, as a minimum, a “Hi-Vis” Vest and leather enclosed shoes. Businesses at the Brisbane Markets® may require their employees to wear additional PPE.

PPE must be worn while you are in the Common Areas of the Markets or while driving a Forklift, golf buggy or other open Vehicle.

It is not necessary to wear PPE:• inside a Tenancy or a Vehicle unless your

employer requires you to do so; or• if you are a member of the general public

entering this Site during the General Public Entry Days (10:00 am to 11:30 am on Thursdays and Fridays [excluding public holidays]).

All children under the age of 15 entering this Site must be accompanied and supervised by an adult.

VEHICLE ACCESSThere are four Vehicle boom-gated entrances into this Site shown in the map and table on the following page.

BML has introduced Licence Plate Recognition (LPR) Technology at the boom-gated entrances to the Brisbane Markets® which provides automated entry to Vehicles registered with BML for LPR Site access. The driver and any passenger(s) in LPR registered Vehicles must all be BML Site access approved, that is, they must hold a valid Access Card.

Contact BML’s Site Services Office for more information on registering your Vehicle for LPR Site access.

Where Vehicles are not registered for LPR Site access, if you have been issued with an Access Card that permits Vehicle access, this card may be swiped at the proximity reader at each boom-gated entrance.

Drivers who are not BML Site access approved will need to advise an Authorised Officer why they require entry to the Site. If access is required for the delivery of Goods, drivers will need to submit a manifest of those Goods to an Authorised Officer as a condition of entry.

PEDESTRIAN ACCESSThere are five main Pedestrian access gates / turnstiles at the Brisbane Markets®.

Pedestrian access through the boom-gated entrances is unsafe and therefore, prohibited.

The Map of the Brisbane Markets® on the following page shows the location of the Vehicle entrances (blue) and the Pedestrian entrances (green).

SITE INDUCTIONSSite Inductions must be completed by: Tenants, Tenant Employees, Forklift Operators, Buyers and Service Providers before they are permitted to access the Brisbane Markets® and, thereafter, once every 12 months.

TENANTS AND TENANT EMPLOYEE ACCESSTenants and Tenant Employees will need to complete a Site Induction and an Access Card application form prior to being issued with an Access Card.

BRISBANE MARKETS’® SITE ACCESS POINTS


If BML has reason to believe that a person has applied for Tenant Employee access to either get early access to the Central Trading Area so as to buy Goods outside of Trading Hours or to conduct their own business interests, we will ask for evidence that the Tenant Employee is a legitimate employee. If we are not satisfied with the legitimacy of employment, the application for an Access Card may not be approved or, if already issued, may be cancelled.

Tenants must keep BML notified of staff changes and return any Access Cards from former employees. Former Tenants and Tenant Employees must not keep their Access Card for ongoing access to this Site.

BUYER ACCESS Buyers will be issued with an Access Card when an application form has been completed and that application is endorsed by Brismark. Buyers must also complete a Site Induction. Ongoing Buyer access to this Site is subject to Buyers completing an annual Buyer registration, Site Induction and, where relevant, a Forklift Safety Course.

Buyers who purchase Goods from Selling Floor Tenants may consolidate same:• in a CUA Parking Bay licensed to the Buyer;• under a Tenancy Awning with the prior consent

of the Tenant;• within a Tenancy Area (100 sqm or less) with the

prior consent of the Tenant.

Buyers are not permitted to consolidate their Goods on the Common Area at the Brisbane Markets®.

Note that Buyers must exit the Markets by 12:00 pm each Trading Day. Buyers must only purchase Goods from a Selling Floor Tenant. Any other purchase arrangement is not compliant with the Regulations.

SERVICE PROVIDER ACCESSService Providers who require regular access to the Brisbane Markets® in order to supply their services to Tenants and others will need to apply for Site access approval. Only those Service Providers who have been granted with BML’s conditional consent to access this Site may provide services to Tenants. However, Service Providers who supply consultancy services only (eg: bookkeeping, accountancy, IT) to Tenants are exempt from this requirement.

Service Providers must not carry out any works in Tenancy areas including building work, alterations

to services or property, unless BML has provided its written consent for this work to be carried out.

VISITORS AND SUPPLIERSBefore Visitors and Suppliers enter the Markets, they are are required to sign in and out at:• BML’s Site Services Office on the Ground Level

of the Fresh Centre during business hours; or• The Main Entrance Gatehouse after hours.

PPE must be worn by Visitors and Suppliers while at this Site.

THE GENERAL PUBLICThe General Public is permitted to access the Central Trading Area (CTA) in the Brisbane Markets® on General Public Entry Days (Thursdays and Fridays from 10:00 am to 11:30 am). An entrance fee is payable. Entry is subject to the General Public’s compliance with the requirements set out in this Guide, the Regulations and the General Terms and Conditions of Entry to the Brisbane Markets®.

6. CONDUCT RULES SAFETY CONDUCTTo promote safety for all Market Users at this Site, BML has implemented a number of rules of conduct. Without limitation, the following behaviours and actions are not permitted at this Site:• Anti-social, inappropriate or offensive behaviour.• Deliberately damaging any property on Site.• Littering, dumping rubbish or contaminating

cardboard waste with general waste.• Operating a pallet jack on Roads in this Site.• Driving an uninsured or unregistered Vehicle in

this Site (unless accepted under law ie: Forklifts that are operated in Buildings only).

• Driving Vehicles without the appropriate licence and / or driving in a dangerous manner (eg: burnouts, speeding).

• Operating any Vehicle while under the influence of: – a prohibited substance or – alcohol if this exceeds the lawful limits

permitted for drivers in charge of a Vehicle.• Bringing animals on Site unless these are

registered guide, hearing or assistance dogs.• Smoking in a designated non-smoking area.• Using a Forklift, car, truck or other equipment

without the authority of the owner.


BUSINESS CONDUCTGoods may only be sold from the Selling Floor Buildings (Buildings A, B, C, D and E – see Schedule 1 on page 15 for a Site map) by BML authorised Selling Floor Tenants.

Only Selling Floor Tenants may:• sell Goods to any Person within the Brisbane

Markets®;• deliver sold Goods to any Person within the

Brisbane Markets®.

The sale or delivery of Goods to Persons in the Markets by Tenants or other Persons who do not lease a Selling Floor is not permitted.

7. LINE MARKINGAll Vehicle Operators accessing this Site should familiarise themselves with the line-marked Traffic Controls at this site as shown below.

8. PARKING RULESPRIVATE VEHICLESTenants and Tenant Employees will not be issued with an Access Card that provides Vehicle access unless they rent a reserved Parking Bay from BML. Vehicles must not be parked on any Common Area inside the Brisbane Markets® unless in compliance with the Regulations.

Forklift Work AreaForklift Work Areas in the CTA and in loading zones designate a working area set aside for Forklifts. All other Vehicles are excluded from these areas.

Pedestrians must use Pedestrian Walkways, where these are available, to walk through this Site.

Pedestrian Crossings Pedestrians have right of way while on these crossings. All Vehicles must give way to Pedestrians using Pedestrian Crossings.

TENANT COMMERCIAL VEHICLESTenant and Tenant Employees may park their Tenant Commercial Vehicles (TCVs) inside their Tenancy Areas, in designated TCV parking areas, or, during Trading Hours, in the Selling Floor Loading Zones.

Tenants who own or control five or more TCVS must prepare, submit to BML and implement a Fleet Management Plan which describes where and how TCVs will be parked and the times during which they will be parked at the Brisbane Markets®. Tenant Fleet Management Plans are subject to BML’s approval and may be subject to change at the request of BML.

HEAVY VEHICLES (19 m AND LONGER)Vehicle operators must not park Heavy Vehicles on the Common Areas in the Brisbane Markets® unless authorised to do so by an Authorised Officer. Heavy Vehicles may on a short-term basis be parked in the truck holding areas as shown on the Site map attached to Schedule 1 on page 15 of this Guide. However, Heavy Vehicles and all other Vehicles must not be parked in the truck holding areas for more than 8 hours in any 24 hour period.

Heavy Vehicles must not enter the CTA during Trading Hours from 6:00 am to 10:00 am, Monday to Wednesday and from 6:00 am to 11:30 am Thursday and Friday unless authorised to do so by an Authorised Officer.

Vehicle operators are responsible for ensuring that the surface of BML’s Roads and loading dock areas are protected at all times by placing wooden supports that bear the weight of trailers under trailer legs.

9. TRAFFIC RULES – CENTRAL TRADING AREA (CTA)

TRAFFIC RULES - GENERALBML has introduced new traffic controls in the CTA to separate Pedestrians from Vehicles, including Forklifts, so far as this is practicably possible.

These traffic controls include Pedestrian crossings, shared zones and Pedestrian only access on CTA Footpaths from 6:00 am to 8:00 am from Monday to Friday.

In addition, new line marking has been applied to the CTA to define:• Tenant Trading Out Areas• Licensed Tenant Display / Consolidation Areas

• Licensed Tenant Forklift Work Areas• Licensed Buyer Car Parking Bays

The map on the following page provides a detailed overview of the traffic controls and line marking that applies to the CTA.

CTA UNLOADING SERVICESThere are two Unloading Service Providers who are licensed to use the undercover area of the CTA from 10:00 pm to 4:00 am (the Unloading Hours).

Each of the Unloading Service Providers is responsible for the management and direction of Vehicles being loaded and unloaded at the CTA during the Unloading Hours.

CTA PEDESTRIANSPedestrians are required to keep to the Pedestrian Footpaths unless they are crossing from one CTA Building to another or are accessing their Vehicle in a Licensed Buyer Parking Bay.

Pedestrians have right of way on Pedestrian Crossings and must use the Crossings between Building D and Buildings B and C to move between these Selling Floors.

Where Pedestrians need to cross the Roads and Parking Bays between Buildings B and C, they will enter a “Shared Zone” (marked by an ochre border and shaded in ochre in the map on page 8) once they leave the Pedestrian Footpath.

A Shared Zone is an area that is used by both Pedestrians and Vehicles. Pedestrians have right of way in a Shared Zone. Vehicle operators (including Forklift Operators) are responsible for avoiding any Vehicle / Pedestrian collisions. However, Pedestrians must take due care while they are in the Shared Zone.

CTA SELLING FLOOR TENANTSDuring Trading Hours, Selling Floor Tenants in Buildings B, C and D are each licensed to:• Trade out to the trading boundary line adjacent

to their Tenancy Area;• Display and consolidate Goods in the line-

marked Display / Consolidation Area; and• Use the line-marked Forklift Work Area to

manage Goods.

Selling Floor Tenants must:• keep the Pedestrian Footpath clear at all times;

and• clear and clean the Licensed Areas at the end of

Trading Hours.

CTA FORKLIFT OPERATORSOn Trading Days, Forklift Operators are prohibited from driving onto the Pedestrian Footpaths adjacent to Buildings B, C and D from 6:00 am to 8:00 am.

CTA BUYERSBuyers who are authorised for early entry may enter the Brisbane Markets® from 6:00 am. Otherwise, Buyer entry is from 7:00 am. Buyers who are licensed to park in the CTA Licensed Buyer Parking Bays, may occupy their Licensed Parking Bay from 6:00 am (if authorised for early entry) to 11:00 am to consolidate and load Goods consigned to their Bay, and to conduct Buying.

Buyers who are not licensed to park in the CTA Licensed Buyer Parking Bays have the option of parking:• in a Parking Bay that is licensed to them outside

of the CTA; or• in a Selling Floor Loading Zone at the rear of the

Selling Floor Buildings; or• the tram tracks on a short-term basis.

The Selling Floor Loading Zones at the rear of Buildings B, C and D are shown on the following page.

Vehicles parking in Selling Floor Loading Zones must not be parked over the Pedestrian Walkways, Forklift Work Areas or Roads.

CTA GENERAL PUBLIC ENTRY DAYSMembers of the General Public are permitted to buy from the CTA Selling Floor Tenants on Thursdays and Fridays from 10:00 am to 11:30 am. The Brisbane Markets® is a working industrial Site. Accordingly, all public access to these Markets must be coordinated by Authorised Officers who are also trained traffic controllers. Members of the general public must comply with all directions from Authorised Officers.

The General Public must observe the Traffic Control rules in the table on the following page.

VEHICLES IN THE CTAThe speed limitation in the CTA is 10 km/h. Remedial Actions under the Regulations apply to non-compliance with this speed limit. Schedule 3 on page 17 shows the extent of the CTA precinct.

Pedestrian access • Pedestrians must park their Vehicles outside of the Markets and enter through the

CTA Entrance Gate (see the map on page 3).• Pedestrian entrance is subject to an entry fee.

Vehicle access • Vehicles must enter through the Main Entrance Gate (see map on page 3) and will

• Pedestrians must cross the Road to the CTA using the Pedestrian Crossing and as directed by an Authorised Officer.

TRAM TRACKS“Tram Tracks” provide short-term parking for Buyers and Tenant Commercial Vehicles.

Tram Tracks – Buildings A and B; and Buildings C and E/F. The Roads on either side of the tram tracks between these buildings are dual carriageways as per the diagram below.

Tram Tracks – Buildings DThe tram track north of Building D is directly adjacent to the Building D Loading Zone with a dual carriageway abutting the Building D tram track.

10. TRAFFIC RULES – WAREHOUSE PRECINCT

WAREHOUSE PRECINCT – SPEED LIMITAll Vehicles must comply with the 20 km/h speed limit within the Warehouse Precinct. Schedule 3 on page 17 shows the extent of the Warehouse Precinct. BML’s Authorised Officers conduct regular radar checks on Vehicle speeds at this Site. Remedial actions may apply to any non-compliance with this Site’s speed limits.

PEDESTRIAN RULESWithin the Warehouse Precinct, Pedestrians must use:• Pedestrian Crossings to cross Roads where these

are available.• Pedestrian Walkways to walk through the

Warehouse Precinct where these are available.

In the event that these controls are not available, Pedestrians must use due care to cross Roads and walk through the Warehouse Precinct and must:• When walking on Roads with two-way traffic

flows, walk in a direction facing oncoming traffic wherever possible;

• Remain aware of any Vehicles entering or leaving Loading Zones and Warehouse entrances when walking past these areas;

• Not use mobile phones or other electronic equipment while walking in the Warehouse Precinct.

TRAFFIC FLOWSThere are a number of one-way systems on Roads in the Warehouse Precinct. Where there are one-way traffic flows, Forklift Operators are permitted to drive against the one-way traffic flow using designated Contraflow lanes where these are available.

Buildings R, M and LThe Road between Building R and Buildings M / L is under review. Currently, there is a one-way system between Buildings R and M / L. However, the Road reverts to dual carriageway at the intersection so as to provide smaller Vehicles access to the Parking Bays on either side of the Road.

All Vehicles must take due care when driving along this section of Road and should access the Buildings on either side of this Road from the West only.

DELIVERY RULESDrivers of Vehicles delivering Goods to Tenants at this Site must:• Not congest Roads, exclusion zones, Forklift

Work Areas, Loading Zones or Docks while waiting for their Vehicles to be loaded or unloaded.

• Park their Vehicles in the Truck Holding Areas (See Site map attached to Schedule 1 on page 15 of this Guide) until a Loading Dock or Loading Zone becomes available at the Tenancy in question.

• Not park their Vehicles / Trailers in the Truck Holding Areas for more than 8 hours in any 24-hour period.

All B-Double Vehicles entering the Brisbane Markets® must be split in the Truck Holding Area into their respective A and B trailers. Only one trailer may be unloaded at loading docks or in the CTA (after 10:00 pm and before 4:00 am) at any one time. “A trailers” must either have covered skid rails or barrier protection.

Tenants are responsible for managing Goods being loaded or unloaded at their Tenancy Areas and do need to ensure that Vehicle Operators comply with the above delivery rules.

UNLOADING RULESThere are three licensed Unloading Services at the Brisbane Markets® which are authorised by BML to unload and deliver consigned Goods to Tenants of the Brisbane Markets®. No other party is authorised to unload Goods from Vehicles onto BML’s common area and then deliver those Goods to multiple tenants.

The Unloading Services are responsible for managing Vehicles that are being loaded or unloaded in Licensed Unloading Areas and do need to ensure that Vehicle Operators comply with the Regulations.

The Unloading Services must not unload Goods that will be collected either directly or indirectly by Buyers.

SECURED LOADSAll Vehicles must have secured loads when being driven on any Road.

11. FORKLIFT RULESForklift operators must:• Obey the direction of Authorised Officers.• Carry or wear their Forklift Operator’s Permit at

all times while within the Brisbane Markets® and produce the same on demand by an Authorised Officer.

• Always give way to Pedestrians.• Wear seatbelts if fitted.• Observe all speed limits – ten (10 km/h) in the

Central Trading Area and twenty (20 km/h) on other Roads.

• Travel on the left side of all Roads in the direction of travel and obey all signs. Where Contraflow Lanes are provided, use the Contraflow Lanes.

• Where Roads are marked, travel within the Road and not cut corners.

• Not drive across or within marked exclusion zones.

• Travel with forks approximately twenty (20) cm above the road whether laden or not laden.

• Not pass other Vehicles travelling in the same direction at intersections, blind spots or other dangerous locations.

• Drive responsibly. • Not engage in racing, spinning tyres or other

unacceptable driving practices. • Travel in a forward direction if no load is being

carried, or if a load is being carried which does not obstruct the driver’s view or if a load is being driven up gradients.

• Travel in a reverse direction if a load is being carried which obstructs the driver’s view or if a load is being driven down a gradient.

• Obey all Queensland Road Rules (including securing loads to Vehicles) on designated Roads.

• Always look in the direction of travel and stay alert.

• Maintain safe distances between moving Vehicles.

• Use indicators where these are fitted to the Forklifts.

• Not drive on designated walkways except when entering or exiting a Tenancy Area and travelling at right angles to the walkway. For the avoidance of doubt, Forklifts must not be driven across the CTA Pedestrian Footpaths between 6:00 am and 8:00 am each Trading Day.

• Give way when entering Roads.• Not use a hand-held mobile phone, two-way

radio or any form of communication device while moving.


• Not drive under the influence of drugs or alcohol in accordance with the Regulations.

• Not operate a LPG, diesel or petrol operated Forklift within a Tenant Warehouse that has been enclosed with insulated panel.

• Attend BML training programs as and when required by BML, including a Forklift Safety Course and an annual Forklift Refresher Course.

• Otherwise comply with the Traffic Rules under the Regulations.

• Not smoke while operating a Forklift.

12. FORKLIFT OPERATING PROCEDURES

Forklift operators must:• Hold a valid certificate of competency or permit

required under legislation.• Hold a valid Forklift Operator’s Permit issued by

BML.• Have taken part in a Forklift Safety Course or an

annual Forklift Refresher Course.

All Forklifts must be either speed governed to 20 km/h or have a speedometer installed.

Where Forklifts are operated on Brisbane Markets® Roads, they will need to be:• Registered with BML.• Insured with Compulsory Third Party coverage.• Conditionally registered with Queensland

Transport.

Where Forklifts are re-fuelled at BML’s LPG Facility, they must be fitted with an Automatic Fill Limiter (AFL) valve and Forklift Operators must complete a short course on how to use the LPG Facility.

13. HAZARDS, INCIDENTS AND EMERGENCY PROCEDURES

HAZARD REPORTINGAll incidents and hazards, including any accident, injury, or spillage, fire, LPG leak or bomb threat, must be immediately reported to the Main Entrance Gate on (07) 3915 4274 or to an Authorised Officer.

All Persons within the vicinity of an incident or hazard must follow the directions of an Authorised Officer.

FIRETenants and their employees must take part in an annual fire drill coordinated by BML.

It is prohibited to:• use or tamper with Fire Detection and

Prevention Equipment. This Equipment must only be used in an emergency; and

• block access to Fire Detection and Prevention Equipment.

EMERGENCIESIn the event of an emergency, all Persons must comply with the directions of Authorised Officers and Emergency Services Personnel including any requirement to evacuate Tenancy Areas or this Site.

14. SITE PRESERVATIONAlterations and Additions must not be made to BML’s property, buildings, services or common areas without BML’s written consent.

15. ENVIRONMENTAL MANAGEMENT

Dumping or discharging any waste at this Site is prohibited.

All chemicals and other hazardous substances must be stored and handled in accordance with the relevant laws and Australian Standards. Tenants are required to keep an up to date Material Safety Data Sheet and Hazchem information on all chemicals and other dangerous substances within their Tenancy Area and produce this information on request from an Authorised Officer.

Tenants are required to manage waste from their Tenancy Areas. Tenants must ensure that their waste is placed in suitable bins with lids and that waste is removed from this Site on a frequent basis. Waste must not be permitted to overflow from bins.

Tenants must comply at all times with all relevant laws regarding food safety.

Waste liquids, materials or other hazardous substances must not be dumped or be allowed to drain into the stormwater system at this Site.


There are no general Vehicle washing facilities within the Brisbane Markets®. Vehicles must not be washed down at this Site unless:• there is specific washing facilities within Tenants’

Tenancy Areas, including an interceptor trap; or• an alternative provision has been arranged with

BML’s approval in writing.

Vehicles must not be serviced within the Brisbane Markets® unless the Vehicle is a Forklift and is serviced in BML’s Forklift Service Bays by a licensed Forklift Service Provider.

16. REMEDIAL ACTIONSNon-compliance with Regulations may result in BML imposing Remedial Actions which could include without limitation:• The recovery of BML’s Costs associated with

remedying acts of non-compliance (for example, administrative Costs or Costs associated with repairing damages or cleaning, waste disposal and towing Costs).

• The recovery of any levies, fines or fees imposed by Governmental Authorities (for example, any fines imposed as a result of discharging waste into the stormwater system).

• The recovery of legal costs.• Suspension of a BML Forklift Operator’s Permit.• Suspension of a BML LPR registration.• A period of Limited Exclusion which restricts a

Person to Pedestrian entry to this Site.• A period of Full Exclusion during which a Person

will not be permitted to enter this Site.• The recovery of parking fees.

17. NOTICESNon-compliance with Regulations will be recorded by way of a Notice which will be issued to the Person in question (and, in the case of a Tenant Employee, the relevant Tenant Employer) and which will describe the non-compliance together with any outcome which may range from a warning being issued to more serious Remedial Actions being taken.

18. FINAL WARNINGSIn the event that a Person is issued with 5 or more Notices in one calendar year or 3 or more Notices in 6 months, BML may issue a Final Warning and place that Person on a 90 day Safety Prohibition Period and require that Person to complete a Site Induction, monthly meeting with BML or other training during that time.

If the Person is issued with a further Notice during the Safety Prohibition Period, BML may elect to impose a permanent Full Exclusion.

If the Person is not issued with any Notices during the Safety Prohibition Period, BML may withdraw its Final Warning.

SCHEDULE 4 GENERAL TERMS AND CONDITIONS OF ENTRY TO THE BRISBANE MARKETS®

All Persons entering the Brisbane Markets® agree to comply with and be bound by the Brisbane Markets® Regulations, Policies and the General Terms and Conditions of Entry that relate to this Site. If Persons wishing to enter the Brisbane Markets® are not willing to comply with these General Terms and Conditions of Entry then they must immediately leave the Brisbane Markets®.

The Brisbane Markets® is a privately owned industrial Site. All Persons entering the Brisbane Markets® must be aware of the use of heavy transport Vehicles on this Site and exercise caution

so as to take an appropriate level of care for their own safety and for the safety of others, as would be reasonably expected in an industrial Site.

The owner of the Brisbane Markets®, BML, reserves the right to refuse admission to any Person, or to require any Person already within the Brisbane Markets® to leave the Brisbane Markets®, for any reason.

It is a condition of entry to the Brisbane Markets® that all Persons promote a safe operating environment by complying with these General Terms and Conditions of Entry and the Brisbane Markets® Regulations and in particular:

Closed circuit television technology and/or other video surveillance technology is used within this Site for security purposes. In entering the Brisbane Markets®, you consent to the collection, use and disclosure of any images recorded and stored by BML for any of the purposes of protecting the rights and safety of yourself and other Parties, maintaining security and in the investigation of incidents, accidents or unlawful acts.

Each Person who enters the Brisbane Markets® enters at their own risk and releases BML, its Authorised Officers, employees and agents against

any Claim by or on behalf of that Person due to that Person’s use of or presence at the Brisbane Markets®; and indemnifies BML, its Authorised Officers, employees and agents against any Claim arising from any: loss, damage, death or injury to any property or Person in or about the Brisbane Markets® caused or contributed to by any act or omission of that Person or any use of or presence at the Brisbane Markets® by that Person; or negligence of that Person; or breach of the Regulations, any Policy and/or the General Terms and Conditions of Entry; or combination of those things.

YOU MUST NOT:(unless otherwise authorised) • Enter the Brisbane Markets® except during times

when access is permitted.• Ride push bikes, skateboards, roller blades or

scooters.• Permit animals to enter the Brisbane Markets®

(registered guide, hearing or assistance dogs excepted).

• Distribute hand bills or other advertising materials. • Solicit unauthorised Goods, products or business.• Attempt to Sell any Goods, products or services.• Be barefooted or wear open shoes.• Scavenge discarded fresh fruit and vegetables from

bins around the Brisbane Markets’® Site.• Smoke in any non-smoking area designated by BML

or as specified at law.• Behave in an offensive or generally anti-social

manner.• Record any images of Persons or property at the

Brisbane Markets® without the prior consent of a BML Authorised Officer.

YOU MUST:• Make any Vehicle under your control available for

inspection by an Authorised Officer upon request.• Obey an instruction of an Authorised Officer of BML.• Cross Roads at the designated Pedestrian Crossings.• Use the CTA Pedestrian Footpaths or Pedestrian

Walkways where these are available while walking through the Markets.

• Beware of Forklift and other Vehicular activities.• Enter upon and/or park Vehicles only in those

areas specifically designated for public access, and consent to any Vehicle under your control and parked outside the designated areas to be towed away (without notice and at the owner’s expense) by BML or a Person authorised by BML for that purpose.

• Enter upon and/or park Vehicles at your own risk.• Comply with the Brisbane Markets® Regulations and

Policies (which are available from BML’s Site Services Office and website) while in the Brisbane Markets®.

• Wear fully enclosed footwear and a HVSG in accordance with the Brisbane Markets® Regulations.
