Having decided, at its fifteenth session, that this question should be made the subject of an inter­national convention,

Adopts this Convention on ihe fourteenth day of November 1970.

Article 1

For the purposes of this Convention, the term "cultural property" means property which, on re­ligious or secular grounds, is specifically desig­natedbyeachState as being of importance tor archae­ology, prehistory, history, literature, art or sci­ence and which belongs to the following categories:

( a) Rare collections and specimens of fauna, nora, minerals and anatomy, and objects of palaeontological interest;

(b) property relating to history, including the his­tory ol science and technology and military and social history, to the life of national lea­ders, thinkers, scientists and artists and to events of national importance;

(c) products of archaeological excavations (in­cluding regular and clandestine) or of arch­aeological discoveries;

( d) elements of artistic or historical monuments or archaeological sites which have been dis­membered;

( e) antiquities more than one hundred years old, such as inscriptions, coins and engraved seals;

( f) objects of ethnological interest; (g) property of artistic interest, such as:

( i) pictures, paintings and drawings pro­duced entirely by hand on any support and in any material (excluding indust­rial designs and manufactured articles decorated by hand);

( ii) original works of statuary art and sculpture in any material;

(iii) original engravings, prints and litho­graphs;

( iv) original artistic assemblages and mon­tages in any material;

(h) rare manuscripts and incunabula, old books, documents and publications of special interest (historical, artistic, scientific, literary, etc.) singly or in collections;

( i) postage, revenue and similar stamps, singly or in collections;

(j) archives, including sound, photographic and cinematographic archives;

Considerando que la Conferencia General de la Unesco aprob6 ya en 1964 una Recomenda­ci6n con este objeto, , ·

Habiendo examinado nuevas propuestas relativas a las medidas destinadas a prohibir e impe­dir la importaci6n, la exportaci6n y la trans­ferencia de propiedad ilrcitas de bienes cul­turales, cuesti6n que constituye el punto 19 del orden del d!a de la reuni6n,

Despu6s de haber decidido. en la 15a. reuni6n, que esta cuesti6n ser!a objeto de una conven­ci6n internacional, aprueba el d!a catorce de noviembre de 1970, la presente Convenci6n.

Art!culo primero

Para los efectos de~te Convenci6n se considerarln como objetos que, por razones religiosas o pro s, hayan sido expresamente designados por cada Estado como de importancia para la arqueolog!a, la "' prehi'storia, la historia, la literatura, el arte o la ciencia y que pertenezcan a las categor!as enumeradas a continuaci6n:

a) las coleccione.s y ejemplares raros de zoolo­g:(a, botlnica, mineralogi'a, anatom!a, y los objetos de inter6s paleontol6gico;

b) los bienes relacionados con la historia, con inclusi6n de la historia de las. ciencias y de las t~cnicas, la historia militar y la historia social, as! como con la vida de los dirigen­tes, pensadores, sabios y artistas nacionales y con los acontecimientos de importancia nacional;

c) el producto de las excavaciones (tanto auto­rizadas como clandestinas) ode los deacu­brimientos arqueol6gicos;

d) los elementos procedentes de la desmembra­ci6n de monumentos art!sticos o hist6ricos y de lugares de inter6s arqueol6gico;

e) antigQedadea que tengan mils de 100 aflos, tales como inscripciones, monedas y sellos ""-" grabados;

f) el material etnol6gico; g) los bienes de inter6s art:rstico tales como:

i) cuadros, pinturas y dibujos hechos ente­ramente a mano sobre cualquier soporte y en cualquier material (con exclusi6n de los dibujos industriales y de los art:rcu­los manufacturados decorados a mano);

ii) producciones originales de arte e13tatua­rio y de escultura en cualquier mate­rial;

iii) grabados, estampas y litograf!as ori­ginales;

iv) conju.ntos y montajes art!sticos origi­nales en cualquier material.

h) manuscritos raros e incunables, libros, do­cumentos y publicaciones antiguos de inter6s

Article 2 ---1. The States Parties to this Convention recog­nize that the illicit import, export and transfer of ownership of cultural property is one of the main causes of the impoverishment of the cultural heri­tage of the countries of origin of auch property and that international co-ojleration constitutes one of the most efficient means of protecting each coun­try's cultural property against all the <flulgers re­sulting therefrom.

2. To this end, the ·sttrtee::Pa'rties undertake to oppose such practineff"witli the means at their dis­posal, and particularly by removing their causes, putting a stop to current practices, and by helping to make the necessary reparations.

Article 3

The import, export or transfer of ownership of cul­tural property effected contrary to the provisions adopted under this Convention by the States Parties thereto, shall be illicit.

Article 4

The States Parties to this Convention recognize that for the purpose of the Convention property which belongs to the following categories forms part of the cultural heritage of each state:

( a) Cultural property created by the individual or collective genius ~f nationals of the State con­cerne_d, and cultural property of importance to the State concerned ci'eateti within the ter­ritory of that State· by foreign nationals or stateless persons resident within such terri­tory;

(b) cultural property found within the national ter­ritory;

(c) cultural property acquired by archaeological, ethnological or natural science missions, with the consent of the. competent authorities of the country of origin of such property;

( d) cultural property which has been the subject of a freely agreed exchange;

(e) cultural property received as a gift or purch­ased legally with the consent of the competent authorities of the country of origin of such property.

Art!culo 2

1. Los Estados Partes en la presente Conven­ci6n reconocen que la importaci6n, la exporta­ci6n y la transferencia de propiedad illcitas de los bienes culturales constituyen una de las cau­sae principales del empobrecimiento del patrimo­nio cultural de los pa!ses de origen de dichos bienes, y que una colaborac16n internacional constituye uno de los medios mas eficaces para proteger sus bienes culturales respectivos contra todos los peligros que entral'lan aquellos actos.

2. Con este objeto, los Estados Partes se com­prometen a combatir esas prd.ctioas con los m#' dios de que dispongan, sobre todo suprimiendo sus causae, deteniend~ su curso y ayudando a efectuar las reparaciones que se impongan.

Art:Cculo 3

Son il1citas la importac16n, la exportaci6n y la transferencia de 'propiedad de los bienes cultu­rales que se efeotden infringiendo las disposi­ciones adoptadas por los Estados Partes en vir­tud de la presente Convenci6n.

Los Estados Partes en la presente Conveno16n reconocen que para los efeotos de la misma, forman parte del patrimonio cultural de oada Estado los bienes que pertenezcan a las catego­rfas enumeradas a continuaci6n:

fl/l!!"tienes culturales debidos al genio individual o colectivo de nacionales de Estados de qu1ii" se trate y bienes culturales importantes · para· ·ese mismo Estado y que hayan sido creados en su territorio por nacionales de otros parses o por ap4tridas que residan en ~1;

b) bienes culturales hallados en el territorio nacional;

c) bienes culturales adquiridos por misiones ar­queol6gicas, etnol6gicas o de ciencias natura­les con el consentimiento de las autoridades competentes del pais de origen de esos bienes;

d) bienes culturales que hayan sido objeto de intercambios libremente consentidos;

e) bienes culturales recibidos a t!tulo gratuito o adquiridos legalmente con el consenti­miento de las autoridades competentes del pars de origen de esos bienes.

Article 5

To ensure the protection of their 'cultural property against illicit import, export and transfer of own­ership, the States Parties to this Convention under­take, as appropriate for each country, to set up within their territories one or more national ser­vices, where such services do not already exist, for the protection of the cultural heritage, with a quali­fied staff sufficient in number for the effective carrying out of the following functions:

( a) Contributing to the formation of draft laws and regulations designed to secure the protection of the cultural heritage and particularly pre­vention of the illicit import, export and trans­fer o! ownership of important cultural property;

(b) establishing and keeping up to date, on the ba­sis of a national inventory of protected property, a list of important public and private cultural property whose export would constitute an ap­preciable impoverishment of the national cul-tural heritage; .

(c) promoting the development or the establish­ment of scientific and technical institutions (museums, libraries, archives, laboratories, workshops ... ) required to ensure the preser­vation and presentation of cultural property;

(d) organizing the supervision of archaeological excavations, ensuring the preservation "in situ" of certain cultural property, and protec­ting certain areas reserved for future archae­ological research;

(e) establishing, for the benefit of those concerned (curators, collectors, antique dealers, etc.) rules in conformity with the ethical principles set forth in this Convention; and taldng steps to ensure the observance of those rules;

(f) taking educational measures to stimulate and develop respect for the cultural heritage of all States, and spreading knowledge of the provi­stions of this Convention;

( g) seeing that appropriate publicity is given to the disappearance of any items of cultural property.

Article 6

Th'\_ States Parties to this Convention undertake:

( a) To introduce an appropriate certificate in which the exporting State would specifythatthe export of the cultural property in question is authorized. The certificate should accompany all items of cultural property exported in ac­cordance with the regulations;

contribuir a la preparaci6n de los proyectos de textos legislativos y reglamentarios que permitan la protecci6n del patrimonio cultu­ral y de un modo especial la represi6n de las importaciones, exportaciones y transfe­rencias de propiedad ilicitas de los bienes culturales importantes; establecer y mantener al dia, a partir de un inventario naciona~ de protecci6n, la ~ lista de los bienes culturales importantes, · p'dblicos y privados, cuya exportaci6n consti­tuiria un empobrecimiento considerable del patrimonio cultural nacional; fomentar el desarrollo o la creaci6n de las instituciones cient:rficas y t6cnicas (museos bibliotecas, archivos, laboratorios, talleres, etc. ), necesarias para garantizar la conser­vaci6n y la valorizaci6n de los bienes cultu­rales; organlzar el control de las excavaciones ar­queol6gicas, garantizar la conservaci6n "in situ" de determinados bienes culturales y proteger ciertas zonas reservadas para futu­ras investigaciones arqueol6gicas; dictar, con destino a las personas interesa­das (directores de museoJ;~, coleccionistas, anticuarios, etc.) normas que se ajusten a los principios 6ticos formulados en la pre­sante Convenci6n y velar por el respeto de esas normas; ejercer una acci6n educativa pa:tta estimula~ y desarrollar el respeto al patrimonio cul­tural de todos los Estados y difundir amplia­mente las disposiciones de la presente Convenci6n; velar por que se d6 la publicidad apropiada a todo caso de desaparici6n de un bien cul­tural.

Articulo 6

Los Estados Partes en la presente Convenai6n se obligan:

Article 8

The states Parties to this Convention undertake to impose penalties or administrative sanctions on any person responsible for infringing the prohibi­tions referred to Under Articles 6 (b) and' 7 ('b) above. ·

Article 9

Any State Party to this Convention whose cultural patrimony is in jeopardy from pillage of archaeo­logical or ethnological 'tnatel':l.als may call upon other States Parties who are a!fectedl 'The states Parties to this Convention undertake, in these cir­cumstances, to participate in a concerted interna­tional effort to. determine and to··carry out the -necess·ary concrete measures, including the-control of exports and imports and international commerce in the specific materials concerned. Pending agreement each State concerned shall take provi­sional measures to the extent feasible tb prevent irremediable injury to the cultural heritage ofthe requesting state.

Article 10

The States Parties to this Convention undertake:

( a) To restrict by education, int ormation and vi­gllance, movement ot cultural property meg­ally removed from any State Party to this Convention and, as appropriate for each coun­try, Oblige antique dealers, subject to penal or administrative sanctions, to maintain are­gister recording the origin of each item of cultural property, names and addresses of the supplier, description and price of each item sold and to inform the purchaser of the cultural property of the export prohibition to which such property may be subject;

(b) to endeavour by educational rneans to create and develop in the public mind a realization of t!te value of cultural property and the threat to the cultural heritage created by theft, clande­stine excavations and illicit exports.

Article 15

Nothing in this Convention shall prevent States Parties thereto from concluding special agree­menta among themselves or from continuing to im­plement agreements already concluded regarding the restitution of cultural property removed, what­ever the reason. from its territory of origin, be­fore the entry into force of this Convention for the States concerned.

Article 16

The States Parties to this Convention ·shall fn their periodic reports submitted to the General Confer-

. eiice of the United Nations Educational, Sci'entific and'Cultural Organization on dates and in a· manner to be determined·by it, give information on the le­gislative and administrative provisions which they have adopted and other action which they have taken for the application of this Convention, together with details of the experience acquired in this field.

Article 17

1. The States Parties to this Convention maycall on the technical assistance of the United Nati()ns Educational, Scientific and Cultural Organization, particularly as regards:· ·

( a} Information and education; (b) consultation and expert advice; (c) co-ordination and good offices.

2. The'United Nations Educational, Scientific and Cultural' Organization may, on its own initia­tive conduct research andpublisb studies dn mat­ters relevant to tlie illicit movement of cultural propel'ty.

3. To this end, the United Nations Educational, Scientific and Cultural Organization may also call on the co-operation ot any competent non-govern­mental organization.

4. The United Nations Edu.cational, Scientific and Cultural Organization may, on its own initiative, mBk\e proposals to States Parties to this Conven­tion for its implementation.

5. At the request of at least two States Parties to thl,s Convention which, are engaged in a dispute over its implementation, Unesco may extend its good offices to reach ~ settlement between them.

Los Estados Partes en la presente Convenci6n indicarin, en los informes peri6dicos que pre­sentarin a 1a Conferencia General de 1a Organi­zaci6n de las Naciones Unidas para 1a Educac16n, la Ciencia y la Cultura, en las fechas y en 1a forma qtle hta determine, las disposiciones le­gislativas y reglamentarias, asl como las de­mAs medidas que hayan adoptado para aplicar la presente Convenci6n, con detalles acerca de la experiencia que hayan adquirido en este campo.

Articulo 17

1. Los Estados Partes en la presente Conven­ci6n podrAn recurrir a la ayude; tllcnica de la Organizac16n de las Naciones Unidas para la Educaci6n, la Ciencia y la Cultura, sobre todo en lo que respecta a:

a) la inform:ac16n y la educaci6n; b) la consUlta y el dictamen de expert'os; c) la coordinaci6n y los l:Suenos oficios. -

2. La Organizaci6n de las Naciones Unidas para la Educaci6n, la Ciencia y la Cultura podrA por- su propia' iniciativa, realizar inves­tigaciones y publicar estudios sobre asuntos relacionados con la circulaci6n fl!cita ·de bienes culturales.

3. Con este objeto, la Organizaci6n de las Naciones Unidas para la Educaci6n, la Ciencia fJt y la Cultura pod.rA tambi6n recurrir a la coope­raci6n de toda organizaci6n no gubernamental competente.

4, La Organizac16n de las Naciones Unidas para para la Educaci6n, la Ciencia y 1a Cultura podrA, por propia iniciativa, presentar propues­tas a los Estados Partes con miras al cumpli­miento de la presente Convenci6n.

Article 18

This Convention is drawn up in English, French, Russian and Spanish, the four texts being equally authoritative.

ArticleE

1. This Convention shall be subject to ratification or acceptance by States ,members of the United Nations Educational, Scientific and--Cultural Organ­ization in accordance with their respective consti­tutional procedures.

2. The instruments ·ot ratification or acce'ptance shall be deposited with the Director-General ofthe United Nations Educational, Scientific and Cultural Organization.

Article 20

1. This Convention shall be open to accession by all states not members of the United Nations Edu­cational, Scientift.c and Cultural Organization which are invited to accede to it by the Executive Board of the Organization.

2. Accession shall be effected by the deposit of an instrument of accession with the Director­General of the United Nations Educational, Scienti­fic and Cultural Organization.

Article 21

This Convention shall enter into force three months after the date of the deposit of the third instrument of ratification, acceptance or accession, but only with respect to those States which have deposited their respective instruments on or before that date. It shall enter into force with respect to any other state three months after the deposit of its instru­ment of ratification, acceptance or accession.

Article 22

The States Parties to this Convention recognize that the Convention is applicable not only to their metropolitan territories but also to all territories for the international relations of which they are re­sponf!ible; they undertake to consult, if necessary, the g'overrunents or other competent authorities of these territories on or before ratification, accep­tance or accession with a view to securing the application of the Convention to those territories, and to notify the Director-General of the United Nations Educational, Scientific and Cultural Organi­zation of the territories to which it is applied, the

Article 23

1. Each State Party to this Convention may de­nouhce the Convention on its own behalf or on be­half of any territory for whose international relations it is responsible. -

2. The denunciation shall be notified by an in­strument in writing, depo'sited with the Director­General of the United Nations Educational, ·scientific and Cultural Organizatio~.

3. The denunciation shall take effect twelve months after the receipt of the instrument of de­nunciation.

Article 24

The Director-General of the United Nations Educa­tional, Scientific and Cultural Organization shall inform the States members- of the Organization, the States not members of the Organization which are referred to ill' Article 20, as well as the United Nations, of the deposit of all the instruments of ratification, acceptance and accession provided for in Articles 19 and 20, and of the notifications and denunciations provided for in Articles 22 and 23 respectively.

Article 25

1. This Co~ention may be reVised by the General Corlference o( the United Nations Educational, Sci­entific and Cultural Organization. Any such revi­sion shall, however, 'bind only the States which shall become Parties to the revising cOnvention.

2. If·the General.Confe:nence·should adopt a new convention revising this Convention in whole or in part, then, unless the new convention otherwise provides, this Convention shall cease to be open to ratification, acceptance or accession, as from the date em which the new revising convention en­ters into,force~

Article 26 --\.--In conformity with Article 102 of the Charter of the United Na,Uons, this Convention shall be registered with the Secretariat of the United Nations at the request of the Dir~ctor-General of the United Na­tions Educational, Scientific and Cultural. Organiza­tion.

El Director General de la Organizaci6n de las Naciones Unidas para la Educaci6n, la -Ciencia y la Cultura informar!'i a los Est ados Miembros de la Organizaci6n, a los Estados no miembros a que se refiere el art!culo 20, as! como a las Naciones Unidas, del depOsito de todos los ins­trurnentos de ratificaci6n, de aceptaci6n o de adhesiOn que se mencionan en los artrculos 19 y 20, al igual que de las modificaciones y de­nuncias respectivamente previstas en los artrcu­los 22 "¥ 23.

Articulo 25

1. La Confel'encia 'General de 1a Organizaci6n de las Naciones Unidas para la Educaci6n, la Ciencia y la Cultura podr4. revisar la presente Convenci6n. Sin embargo, la revisiOn s6lo obli­gar~ a los Estados que lleguen a ser partes en la Convenci6n revisada.'

2. En caso de que la Conferencia General apruebe una nueva Convenci6n que constituya una revisiOn total o parcial de la presente, y a menos que la nueva Convenci6n disponga otra cosa, la presente Convenci6n dejar4. de estar abierta a la ratificaci6n. a la aceptaci6n o a la adhesi(m, a partir de la fecha de entrada en vigor de la nueva Convenci6n revisada.
