The California Regional Water Quality Control Board, San Francisco Bay Region,(hereinafter called the Board) finds that:

1. The Harsh Road Solid Waste Disposal Site is owned by the City ofHenlo Park and operated by San Mateo Disposal Company and theSouth County Garbage and Eefuse Df.spo sa l District. These tbreeparties are hereinafter referred to as the dischargers. TheBoard has previously adopted Order Nos. 70-";8, 71-77, 71-81, and74-40 for portions of the site then under different owners.

2. The landfill covers 155 acres and is located near San Francisco Bayon former salt ponds northeast of the Highway 101 and Harsh RoadinterchA.nge~ as shown On Attachment A which is incorporated hereinand made part of this Order. 4. The site is underlain by a substantial layer of essentiallyimpermeable bay mud below which lie highly plastic clays with dis­con t i.nuous lenses. Poor quality perched groundwa t er exists directlybeneath the site. A deeper useable aquifer is protected by extensivelayers of bay mud.

5. The beneficial uses of Westpoint Slough and San Francisco Bay are:

a. Habitat and resting areas for water f owlb. Fish and shellfish habita tc. Hec.reationd , As t he tLc enj oymente. Industrial Service Supplyf. Nav iga tion

6. Subsequent to the modifications nec e.ssary to comp ly with th i s Order,this disposal site ,\;]i11 meet the criteria c.ontained in the CaliforniaAdministrative. Cod e, Title. 23, Chapter 3, Subchapter 15, for class­ification of a portion of the site as a Class 11-2 disposal site toreceive Group 2 and :3 wastes.

7. The land wi thin 1000 feet of the site. is used for salt ponds,marshland, an industrial park, and a wastewater treatment plant.

8. The Board adopted a Water Quality Control Plan for the San FranciscoBay Basin in April 1975 and this Order implements the Water QualityObjectives stated in t ha t Plan.

9. This Board has notified the discharger and interested agencies andpersons of its intent to prescribe waste discharge requirements forthe discharge and has prov Lded them with an opportunity for a publichearing and an opportunity to submit their written views andrecommendations.

10.. The. Board, in a public meeting, heard and considered all commentspertaining to the discharge.

11. This project involves the continued op era t Lon of a publicly ownedClass 11-2 facility with minor alterations to the land. Consequently,this project will not have a significant effect on the environmentbased upon the exemption provided in Section 15101, Title 14,California Administrative Code.

IT IS HEREBY ORDERED that the City of Henl.o Park, San Mateo Disposal Company,and South County Garbage and Hpfuse Disposal District and any other personwho operates this site, shall comply with the following:

1. The disposal of waste shall not caus e pollution or a nuisanc.e.

2. Group 2 wastes shall not bp placed in or aLl.owcd to contact ponded'\va ter from any source whatsoever.

3. Group 1 wastes shall not be s t.or ed or deposited at this site.

4. Wastp materials shall not be. disposed of in any location where t heycan be carried from the disposal site and discharged into waters ofthe State.

5. Sewage sludge and high moist·ore content group 2 wa s t es shall not bedischarged at the site unless authorized in writing by theExecutive Officer of this Board.

6. The dLschar ger shall remov e and r e Loc a t e any wastes which are d Ls ­posed of at this site in violation of the above requirements.

1. Leachate from Gr-oup 2 wastes and ponded wa t e r c cn t.a LnLng leachate orin contact with refuse shall not be discharged to wa t er s of the State.

2. Hater used during disposal site operation shall be used judiciouslyfor dust control, fire suppression, and other nec.essary ac.tivities.

3. The disposal areas shall be protected from any washout or erosionof wastes Or covering material, and ['tom inundation~ which couldoccur as a result of floods having a p:redicted frequency of one in100 years.

4. Vertical and lateral hydraulic continuity with usable gr-oundwa t er-sshall be prevented by the presence of a soil barrier above thegroundwater at least five feet in the thickness with the top eighteeninches of soil to be compacted to ninety percent compaction orattain a permeability of 1 x 10-6 cm/sec or less or an equivalentcombination of soil thickness and permeability.

5. Surface drainage from tributary areas, and internal site drainagefrom surface or subsurface sources shall not contact or percolatethrough group 2 wastes during disposal operation and for the activelife of the sites. The perimeter drainage ditches and all otherfacilities shall be designed to convey maximum anticipated stormrunoff, and withstand differential settlement. These facilitiesshall be constructed over a natural ground or through lined channelor pipes.

6. The discharge of waste shall not cause the following conditions toexist. in waters of the Stat.e at any place:

a. Surface Hater

Floa ting, suspended ~ or deposited macroscopic par t i.cu La t erna tter or f oam;

Bottom deposits or undesirable aqua tic. growt.hs;

Alteration of temperature, t\Jrbidity, or apparent color beyondpresent natural background levels;

Toxic or other deleterious substances to be present in concen­trations or quantities which 'I;\1i11 cause deleterious effects onaquatic biota, wildlife or waterfowl, or which render any ofthese unfit for human consumption either at levels created inthe receiving waters or as a result of biological concentration.

7. The migration of methane gas from the disposCll sites shall be con­trolled as necessary to pr.event the creation of nuisance.

c. Provisions

1. The discharger shall comply with all sections of this Order exceptsp ecLf Lca tLous B.3 and B.4 immediately upon adoption.

2. The discharger shall submit a report no later than February 1, 1979describing status of compliance with Sections B.3 and B.4 of thisOrder. If compliance is not currently being achieved, plans shallbe submitted for ac.h.i ev Lng compliance. In any case, Section B.3 andB.4 shall be complied with no later than September 1, 1980. Allreports and plans described above shall be prepared by a registeredcivil engineer or certified engineering geologist.

3. The discharger shall insure that slope stability of this site ismaintained under condition generated during maximum probable earth­quake. To accomplish this objective the discharger sha11 submit slopestability analyses sa t I.sf ac tory to the Executive Officer specifyingthe maximum height and slope of the fill necessary to insure slopestability and the proposed implementation plan. This analysis andimplementation plan shall be submitted no later than May 15, 1979.

4. The discharger(s) shall submit a site closure plan to the Board nolater than June 1, 1979 which shall conform to Resolution No. 77-7adopted by this Board. The plan shall be prepared by or under thesupervision of a registered engineer or a certified engineeringgeologist.

5. This Board considers the property owner to have a continuingresponsibility for correcting any problems which may arise in thefuture as a result of this waste discharge or water applied to thisproperty during subsequent use of the land for other purposes.

6.. The discharger shall file with the Board technical reports or self­monitori.ng work pe-rformed according to the detailed specificationscontained in any Monitoring and .Reporting Program which may bedirected by the Executive Officer.

7. The discharger shall permit the Regional Board:

(a) Entry upon premises On which waste are located or in which anyrequired records are kept ~

(b) Access to copy any records required to be kept under terms andconditions of this Order,

(c) Inspection of monitoring equipment or records, and

(d) Sampling of any discharge.

8. The discharger shall maintain a copy of the Order at the site oroffice so as to be available at all times to site operating personnel~

9. The discharger shall fi1e with this Board a report of any materialchange or proposed change in the character, location or quantity ofthis waste discharge. For the purpose of these requirements, thisincludes any proposed change in the bound arLes , contours or ownershipof the disposal area,

10. The Board's Order No .. 71-81, Order No. 71-77, Order No. 70-78 andOrder No. 74-40 ar e hereby rescinded ..
