FAA CRRSA Act Funding072-509073 Grants Federal $23,000.00

EXPLANATION

The CRRSA Act provides funding to Non-Primary General Aviation Airports to cover airport operatingexpenses at the NH's airports.

One FAA grant was issued, AIR 3-33-SBGP-037-202I, to provide the funding to the Laconia MunicipalAirport and other NH airports to reimburse for the following:

• SBG 09-18-2021 for $23,000.00 to reimburse for costs related to operations, personnel, cleaning,sanitization, janitorial services combating the spread of pathogens at the airport, and debt serviceexpenses.

This award is retroactive dating back to January 20, 2020 with an end date of May 3, 2025.

The CRRSA Act provided grant funds for operating expenses at Non Primary General Aviation airportsthat arise due to the COVID-19 public health emergency. Under FAA's new Airport CoronavirusResponse Grant Program:

• Non-Primary Commercial Service and General Aviation Airports share not less than $45 million(less the amount allocated for non-primary airports participating in the FAA Contract TowerProgram) allocated based on the categories (National, Regional, Local, and Basic) published inthe most current NPIAS, reflecting the percentage of the aggregate published eligibledevelopment costs for each such category, and then dividing the allocated funds evenly amongthe eligible airports in each category, rounded up to the nearest thousand. Sponsors may usethese funds for costs related to operations, personnel, cleaning, sanitization, janitorial services,combating the spread of pathogens at the airport, and debt service payments.

CRRSA Act funds allow for the reimbursement of eligible expenses that were incurred on or afterJanuary 20, 2020 at a 100% federal share up to the amount of the grant. As such, the Department willadminister CRRSA Act funding to support the Laconia Municipal Airport, in accordance with FAAguidance. FAA has the sole authority to make the determination regarding the amount and eligibility ofwhat costs will be reimbursed.

The Contract has been approved by the Attorney General as to form and execution and the Departmenthas verified that the necessary funds are available. Copies of the fully executed contract are on file at theSecretary of State's Office and the Department of Administrative Service's Office and subsequent toGovernor and Council approval will be on file at the Department of Transportation.

In the event that the Federal funds become no longer available, General funds will not be requested tosupport this program.

In accordance with the FAA grant assurances C- Sponsor Certifications, Responsibility and Authority ofthe Sponsor, the grant funds must be immediately available for the project to execute the grant offer;therefore all funding for this project is encumbered in the first fiscal year.

15. Exclusive Rights. The sponsor shall not grant an exclusive right to use an air navigation facility onwhich thiS;Graht;has-beeri"expended. However, providing services^ airport by bniy one fixed-based operator is not an exclusive right if—

a. it is unreasohabiy costly, burdensome,,or impractical for more.than one»fixed,-based operator toprovide'the seTvJces; and

b. allowing more than one fixed-based operator, to provide the.sefvices requires a reductibn inspace leased under an agreernent existing on September 3,1982, between the operator and theAifpbft.

1'6. Airport Revenues.

' required or preScribed-by-'applicable Federal, state and local agencies for maintenance andoperation. It wiirnot.cause or permit any activity or'action thereon which would interfere.with Its

use for airport purposes: It-will suitably operate and maintain the Airport and al) facilities thereonor conne'cted.therewith; withdue regard to climatic and flood conditions. Any proposal totemporarily close the. Airport for npn-aeronautlcal purppseS;must:first be approved by theSecretary. In furtherance.of-thls assurance, the sponsor will have jn effect arrangemehts'for-

1) Operating the Airport's aeronautical facilities whenever required;,

2) Promptly niafking and lighting hazards resultihg;from airport conditions, includingtemporaryppnditions; and

3) Promptly notifying a jrmen of any donditiph affecting aeronautical Use of the Airport.Nothing-contained herein shall be construed to require:that the Airport be,operated foraeronautical,use during terhpora^ periods when snow, flood or other climatic conditions^Interfere with;sUchoperatiOn and maintenancev.Further, ridthihg hereih shall beconstrued as requiring the maintenance, repair; restoration, or replacement of anystructure or facility, which is substantially damaged.or destroyed due to an act, of God Orother condition or circumstance beyond the controfof the sponsor.

13. Hazard Removal and Mitigation. 16. AirbbrtRevenues.

Janitorial services; combating the;spfeadof pathogens at the Airport, and debt service payments-as prescribed in the Act.
