Chairman’s Message

This year as we approach bull selling season we still have weather concerns for large parts of Australia.

One extremely bright spot on the horizon is the strong cattle market both domestically and internationally.

The live export of cattle is ticking along nicely. At least people in the dry areas can sell cattle for a decent price.

Our vendors have catalogued a smaller but select draft of bulls for your competition. One advantage of the drought years is that we all cull more stringently hence the smaller number of bulls.

I believe there will be bulls in the sale to suit all aspects of our industry from vealer production through to bullock finishers.

Stud Notes

Talgai Santas – Stud 1990Established in 2004 by owners Max & Roz Baldwin and managed by Malcolm & Chick Gadsby. The stud runs 200 Stud Females, plus a Grain & Hay operation over two properties, ‘Uruga’ and ‘Glenora’ situated on the Darling Downs, and with a Commercial herd at ‘Cloverdale’ & ‘Bull Bull’ in the Tyalgum district in N.S.W. Sire genetics used at present are Talgai Arnie, Tyndale Earthquake (P), Strathmore F262 (PS) & Talgai Gold. Each year we do an AI program by utilizing different genetics. For the first time, we have dabbled in doing an ET program with vet Peter Atkinson. Bulls are inoculated for three day, three germ blood, 7 in 1, Vibrio and Pestigard. Inoculations will be due again in July 2016.Scanning of bulls for EMA, RIB & RUMP FAT and IMP is done by Paul Kenny. Crush side semen tested, and soundness evaluation is done by veterinary Dr. Kurt Watter.

Whitalby Santas – Stud 1242Situated South West of St George, the Whitalby Santa Gertrudis Stud was established in the early 1980’s with the purchase of stud females from The Triple J dispersal sale (including cows from Brae View, Bilkurra and Tara studs) and the grading up of an existing commercial Santa Gertrudis herd. The herd has progressed with the introduction of stud sires from Ingaby, OHV Kajarabie, Glenroy, Triple J, Douglas, Burradoo, Omeo, Kendara, Kooyong, Glenview, Dunaird, Santalands, Santa Lyn, Santa Park and Bullamakinka.The stud herd is grazed on predominately buffel and mulga country, and the progeny grown out on the same, enabling our cattle to be productive in a range of different conditions. Our aim is to produce structurally correct cattle with a focus on temperament, fertility and hardiness throughout dry spells. Each of our bulls presented in this sale strongly portray these attributes. Previously we have focused mainly on paddock sales to local buyers, who return year after year to buy our bulls.Whitalby Santa Gertrudis Stud has long been a supporter of The Heartland sale, purchasing numerous stud sires from the sale over the years.All of our Bulls are semen tested, vet checked and vaccinated against, Vibrio, Pestivirus, and Lepto.

Oakdale – Stud 1159The Oakdale Stud was founded at Boonah in 1980 and later relocated to Chinchilla in 1993. In 1983 the Brisbane and Sydney Grand Champion Female - Yarrawonga Purdy was purchased. This proved to be a very successful line of cattle which has had a large impact in the herd. Most successful was a son of Purdy in Oakdale Forecaster. In recent times and most successful sire had been Oakdale Tarzan who sired the $22,000 sire Oakdale Whiskey. In 2009 Talgai Castlemaine was purchased. He is producing cattle with plenty of length and with a quiet temperament. One of his daughters - Oakdale Holly won 2013 Brisbane Grand Champion Female.In 2013 Yugilbar Glenvale was purchased and his calves to date have looked very promising. In 2014 Warenda Horton was purchased and we are looking forward to his calves in the spring. The Oakdale bulls have been inoculated with 7 in 1, Vibrio and were blooded with 3 Germ on the 13/6/15.

Carntyne – Stud 1556The Carntyne Stud was founded in 1990 with the purchase of stud females from the Amigo Stud at Kilcoy. Since then other females have been included to the stud from various dispersal sales and females graded up from our commercial herd.In 2004 the stud and commercial herds were moved from our country in the Brisbane Valley to Roma where they have gone ahead in leaps and bounds, coming off hard forest country to scrub. The need for our females to be efficient and fertile on the harder country on the coast has seen them excel on the softer country and cruise through drier times without to much hassle and still producing a healthy calf.

Dunrobin – Stud 1489Dunrobin Stud was started with cows upgraded from our commercial herd and we purchased females from Buckhaven Calga West and Wirrillee Studs.This year our bulls are by Pinaroo Titan and Talgai Omega.

Murgo – Stud 1468We have no bulls for sale this year. Following are some results from present clients:G&D Burey, “Torwood”, Mungallala sold weaner steers in the 14,000 head sale earlier this year at Roma for 219c/kg-the highest price in their weight range.G&J Chambers, “Glenelg”, Mungallala had steers in the feedlot that put on 2.68kg/day to return $1,780.00 per head.We hope this dry time finishes soon for everyone.

Pinaroo – Stud 1150Back in the early 70s we first tried Santa Gertrudis for an experiment to combat bloat on a heavily clovered property in Bowral. It worked, so we started buying Santas.Around the mid 70s, I started a composite breed using Santas and Angus. When I first showed them to my future father-in-law, the late Brian Bootes, he said “they’re too bloody hamie”. For a honeymoon I dragged Robin around New Zealand looking for top Angus sires, which we used in an AI program.In 1980 we moved to the Horton Valley and became much more involved with Santa Gertrudis. The composite breed sort of went by the wayside and were used in our grading up program. As we’ve never culled for colour we now have a herd of pure black Santas.In 1982 we purchased 300 cows from the Cumberland Stud, along with some top older sires, eg Cumberland Ragtime and T155. Possibly the best bull we have ever bought was Boongarry Lancelot, who we used heavily, giving us great size and exceptional udders. In 1984 we purchased Waratah 134, who bred Pinaroo Boris. Boris amassed well over $200,000 in his 13.5 years, the most noted being Pinaroo Eureka ($40,000) sold to J Bolster, The Lakes, Pinaroo Edgar ($30,000) sold to Goonoo Goonoo, and Pinaroo Exodus ($11,000) sold to the Greenup Family, Rosevale.In 1997 we purchased ‘Claren Park’ Augathella where our cattle have adapted well. Pinaroo cattle have enjoyed success in the show ring, as well as carcass competitions and feedlot trials.

Chilgerrie Hill – Stud 991Santa Gertrudis cattle were first introduced into the Chilgerrie Hill herd in the mid 1960s with the purchase of a bull from Rosevale, then next year a bull from Yarrawonga was introduced. Before these two bulls, a Hereford Shorthorn base herd was used.After the introduction of more Santa genetics and the grading up of the herd a stud was formed in 1974 by Mervyn and Val Mayes. After a reduction sale in which we purchased females from them Adam and Karen took over the stud in 1998.We run approximately 80 stud cows and heifers and 80 commercial cows on agistment. Sires in use at present include, Tyndale Z10, Rockingham Doc and Chilgerrie Hill Claret.

Tyndale – Stud 1882Tyndale Stud, operated by Glen & Sharon Yeates and sons Russell and Dale, was registered in 1998.The initial registered herd was mainly females graded up from our commercial herd which had almost 30 years of breeding behind it.The females and weaners are run on forest country with no pampering. They are bred to survive.All breeders are pregnancy tested and anything not in calf is culled - no exceptions. Females displaying bad temperament are also culled. Replacement heifers are selected on structure and conformation. Those not measuring up are culled.The sale bulls are prepared on oats and rye grass to ensure they are fit and ready to perform.

Murgona – Stud 2049Murgona was established in 1998 by Daniel Phillips and is currently run on a family property West of Wandoan by Daniel and Kasey with the assistance of our two children, Taylor and Brian. Female bloodlines include Murgona, Murgo, Scotlea, Talgai, Kabunga, Dangarfield & Yarrawonga Waco.We are pleased to once again offer in our sale team not only a range of female genetics but also bulls. Three different sires are represented this year in our offering of 7 head.We had the privilege of leasing Cardona Hardy for a season from the Bassingthwaighte family. He is represented by Lot 12, 13, 15, 50 & 51.Yarrawonga Vanderdrift was joined to our heifers resulting in Lot 14. He was purchased in 2008 for $5000.Dangarfield Quambone was used lightly in 2012 and is represented by Lot 16 who possess his softness and doing ability. Quambone sold at auction for $6000 to Ted Perrett in 2008. We had the opportunity of watching him hold his condition year after year and decided we must have him in 2011. We purchased him privately for $7000.All our bulls are semen tested, breeding soundness evaluated, and vaccinated with three germ blood, three day, vibrio & 7 in 1. If you have any issues with your purchase please let us be the first to know.We single sire our heifers in June, July & August each year. This results in them calving at approximately 2.5 years of age. We find this ends in less calving difficulties and a high percentage of heifers going back in calf when re-joined with the rest of the herd in November, December, January & February.We only join our cows for 4 months. We pregnancy test at weaning time and anything not in calf is culled unless there are exceptional circumstances. We pride ourselves on offering accurate, detailed dam notes in the catalogue to help you with your decisions.Our cattle are handled by men, women and children, dogs, horses and motorbikes.We advertise through our Facebook page, Murgona Cattle Co, and by exhibiting cattle at our local shows as well as the Ekka most years. This year we entered the Wandoan Show Pair of Unled Interbreed Bulls for the first time and placed second and third.

5 Vendor Guarantee • Saveandexceptforcalvesatfoot,allBULLSareguaranteed

breedersandtosoprovewithinsixmonthsofthedateofsaleorbyreachingtheageof30monthswhicheverdateshallbethelater.

• Claims under the guarantee of fertility shall bemade to thevendorwithinsix monthsfromthedateofsaleorpriortotheanimalenteringaquarantineareaotherthanonthevendor’sproperty.

• All claimsmust be accompaniedby aveterinary certificatewhichshallclearlyidentifythebasisoftheclaim.

• Infertility resulting from injury or diseaseoccurringafter thesaleoftheanimalshallnotbecoveredbythisguarantee.

• Thevendor retains the right tohave theanimalplacedonapropertynominatedbyhimor returned tohisownpropertyforfurther assessmentoffertilityforaperiodnotexceedingsixmonths.Intheeventoftheanimalbeingprovenfertilewithintheperiod,thecostsincurredshallbebornebythepurchaser.Intheeventoftheanimalnotbeingprovenfertilewithintheperiodthecostswillbebornebythevendor.

• Except forcostsdefinedelsewhere in theconditionsof sale,theliability of a vendorinrespectofclaimsrelatingtofertilityshall not exceed the purchase price of the animal(s) or toprovidemutuallyagreeduponreplacementanimals.

• Intheeventofaclaimbeingsubstantiatedandthepurchasepricebeingrefunded,theanimal(s)shallautomaticallybecomethepropertyofthevendorandbereturnedtohimordisposedofaccordingtohisinstructionsathisexpense.

(b)thepurchaserhascollectedandstoredsemenfromabull. • Intheeventofadisputeastowhetheralotisabreeder,such

1. Thehighestbidder shall, subject toCondition2,be thepurchaserprovided that thevendorreservestherighttobideitherbyhimselforthroughhisagentorauctioneerandshouldanydisputeariseamongthebiddersforanylot,duringorimmediatelyaftersaleofthelot,itshallbesettledattheauctioneersabsolutediscretionwhomay,shouldoneofthedisputantsadvance,putthelotorlotsupagain.Thebiddingfromtimetotimeshallberegulatedbytheauctioneerandnobidshallberetracted.

2. 7. Intheeventofanydisputeinrespecttothesaleofanylot:- (i)Thepurchasershallneverthelessbeobligedtopaytotheauctioneerthefull

purchasepriceandanyothermoneysorinterestpayablebythepurchaserinaccordancewiththesetermsandconditions.

(ii)Thevendorandthepurchasershallresolvethedisputebetweenthemselves; (iii)The auctioneer shall have no liability or responsibility in regard to the

dispute;and (iv)Nolotshallbereturnedtotheauctioneerandthepurchasershallindemnify

theauctioneerforallcosts,expensesanddamageswhichtheauctioneerisputtoorincursbyreasonofthepurchasersodoing.

8. Thenameofthevendorforwhomtheauctioneeractsisacknowledgedtohavebeenfurnishedtopurchaserspriortosaleandfurtherparticularswillinallcasesbefurnishedtoapurchaserifrequired.Inthecaseofanydisputetheremedyofthepurchasershallbe against the vendor only and in no case or under any circumstances against theauctioneerwhoistoberegardedforallintentsandpurposesasagentforadisclosedprincipal.

9. (a)PAYMENT-Unlesspriorcreditarrangementshavebeenmadeinwritingwiththeauctioneer the full purchaseprice for each lot shall bedueandpayableto the auctioneer in cashuponacceptanceof thehighest bidor thehighestbidder’sofferbythevendorandpriortodelivery.Notwithstandingthatdeliveryisgiventoorpossessionobtainedbythepurchaser

or hisrepresentativepriortothepaymentofthepurchasemoneyinfullthepropertyinanylotwhichissoldshallnotpasstothepurchaseruntilthefullpurchasepriceandallcheques,promissorynotes,billsofexchange,acceptanceordersordraftsgiveninconnectionwithsuchpaymenthavebeenpaidandliquidated,anduntilpropertyshallpass,thepurchasershallholdsuchlotasbailee,providedthatinallcasesshouldsuchpaymentnothavebeenmadeandliquidatedwithin14daysofthedateofthesaletheauctioneerreservestherightto:-

annum.IfatanytimetheFinancialReviewceasestopublisha90dayBillRate,theauctioneershalldetermineandadvisethepurchaseroftheinterestratetoapplyforthepurposeofthiscondition.

(b)The auctioneer is selling as the del credere agent of the vendor and thefull purchase price of any lot sold shall be payable by the purchaser to theauctioneerandbefullyrecoverablebytheauctioneerinitsownname.

10. Ifthepurchasershallneglectorfailtocomplywithanyofthewithinconditions,anylotpurchasedbyhimmaybeimmediatelyresoldbypublicauctionorprivatecontract,withorwithoutnotice,attheriskoftheformerpurchaser,whowillbeheldresponsibleforalllossandexpensesarisingoutofsuchresale,andshallnotparticipateinanyprofitaccruingtherefrom.

11. Anyvendororpurchaserremovingthesalenumberfromanylotafterithasbeensoldwillfullyindemnifyallaffectedpartiesforanyloss,costsordamageshouldthelotbewronglydelivered.

12. Thepurchasers,ifmorethanone,shallbejointlyandseverallyboundbytheseTermsandConditions,andshalljointlyandseverallycarryoutandperformsame.

13. Anypersonwhoadvancesabidonalotshalldosoontheexpressedconditionandunderstandingthatshouldthatperson’sbidbethehighestbidandsuchbidisacceptedbythevendor,thenthatpersonwillbeheldpersonallyliableforthepricesoagreedupon,regardlessofthefactthatthatpersonmaybeactingonbehalfofanotherparty,either disclosed or undisclosed to the vendor or the auctioneer, provided however,thatthisConditionshallnotinanywaynegatethevendor’srighttoclaimagainstanyprincipal and in such case the bidder’s liability shall be construed to be byway ofguarantee.

14. Theauctioneermay,shoulditthinkfit,makearrangementsonapurchaser’sbehalfforthefeeding,watering,trucking,shippingofandgeneralattendancetoanylotaftersalebutnoresponsibilitywillbeacceptedbytheauctioneerandallsuchservicewillbeatthepurchaser’sriskandexpense.

15. No lotwillbedelivereduntil thesales invoicehasbeencheckedandsignedby thepurchaserorhisdulyauthorisedrepresentative.

16. (a)Each lot inallcases shallbesoldwithall faults, ifany,andexcepting thoseconditionsandwarrantiesimpliedbytheTradePracticesActoranyapplicableState legislation which cannot be contractually excluded and exceptingconditionsandwarrantiesexpresslycontainedintheseTermsandConditionsof Sale, any express or implied condition, statement or warranty, statutoryor otherwise, is hereby excluded.The auctioneer is not liable in respect ofany error, misdescription or omission in any particulars appearing or statedregardingthedescriptionsorpedigreesofanylotofferedforsaleandnosucherror,misdescriptionoromissionshallentitlethepurchasertoannulthesaleorrejectthelotorclaimanycompensation,damageorabatementinprice.

(b)EachlotwillbesoldsubjecttopassingallveterinarytestsrequiredbythelawoftheStateorcountrytowhichthepurchaserintendstotransportthatparticularlot, such tests to be undertaken at the purchaser’s expense and concludedimmediatelyfollowingthesale.Intheeventofalotfailingtopassthesetests,thesaleshallbenullandvoid,anypurchasemoneyspaidbythepurchasershallberefundedandpropertyinthelotshallreverttoorremainwiththevendor.

17. GUARANTEESOFFERTILITY:-

17.1 BULLS.Saveandexceptforcalvesatfoot,allbullsareguaranteedbreedersandtosoprovewithinsixmonthsofthedateofsaleorbyreachingtheageof30monthswhicheverdateshallbethelater.

17.2 FEMALES.Saveandexceptforfemalecalvesatfoot,allfemalesareguaranteedtobeincalforgointocalfwithinsixmonthsofthedateofsaleorbytheageof30monthswhicheverdateshallbethelater.

A positive pregnancy test certified by a qualified veterinary surgeon shall besufficientevidencethattheanimalisincalf.

17.3 ClaimsunderClauses17.1and17.2guaranteesof fertility shallbemade to thevendorwithinsixmonths fromthedateof saleorprior to theanimalenteringaquarantineareaotherthanonthevendor’sproperty.

17.3.1 All claimsmust be accompanied by a veterinary certificate which shall clearlyidentifythebasisoftheclaim.

17.3.2 Infertilityresultingfrominjuryordiseaseoccuringafterthesaleoftheanimalshallnotbecoveredbythisguarantee.

17.3.3 Thevendorretainstherighttohavetheanimalplacedonapropertynominatedbyhimorreturnedtohisownpropertyforfurtherassessmentoffertilityforaperiodnotexceedingsixmonths.Intheeventoftheanimalbeingprovenfertilewithintheperiod,thecostsincurredshallbebornebythepurchaser.Intheeventoftheanimalnotbeingprovenfertilewithintheperiodthecostsincurredshallbebornebythevendor.

17.4 LIABILITYOFAVENDOR.Exceptforcostsdefinedelsewhereintheconditionsofsale,theliabilityofavendorinrespectofclaimsrelatingtofertilityshallnotexceedthepurchasepriceoftheanimal(s)ortoprovidemutuallyagreeduponreplacementanimals.

17.5 REFUNDS.Intheeventofaclaimbeingsubstantiatedandthepurchasepricebeingrefunded,theanimal/sshallautomaticallybecomethepropertyofthevendorandbereturnedtohimordisposedofaccordingtohisinstructionsathisexpense.

17.6 Thisguaranteeshallbevoidedbythepurchaserif- (a)Theanimalisreturnedtothevendor- (i)inpoorphysicalconditionorwithanyinjury; (ii)testscarriedoutonbehalfofthevendorwithinfourteendaysofsuchreturn

proved positive to any diseaseswhichmay affect the animals fertility orabilitytobreednaturally;or

(b)thepurchaserhascollectedandstoredsemenfromabullorembryosfromafemale.

17.7 In the eventof adispute as towhether a lot is abreeder, suchdispute shall beresolvedby thevendorand thepurchaserand theauctioneer,whilehewillusehisbestendeavourstoassist,shallhavenoliabilityorresponsibilityinthatregard.Intheeventthatalotisallegedorprovednottobeabreeder,thepurchasershallneverthelessbeobligedtopaytheauctioneerthefullpurchasepriceandanyothermoniesor interestpayableby thepurchaser inaccordancewith theseTermsandConditions.

18. (a)Eachlotshallbeattheriskofthevendorinrespectofanydamageorinjury,whetherbydisease,accidentorotherwise,fortheperiodthatthelotbeinthecustodyoftheauctioneer,PROVIDEDTHATtheauctioneer,itsservants,agentsandemployeesshalluseallreasonablecaretoprotectandcontrolthelotwhileit is in theauctioneer’scustodyANDPROVIDEDTHATwhena lothasbeensold,itshallbeattheriskofthepurchaserinallrespects.

(b)Ifanyvendorbringstothesalepremisesanylotwhichisdangerous,orinfectedwithanydisease,thatvendorshallbeliableforallinjury,damages,costs,losses,orexpenseswhichtheauctioneermaysustain,incurorbeputtoeitherdirectlyorindirectlyasaresultofthevendorsodoing.Theauctioneerreservestheright,atitsabsolutediscretion,toexcludefromthesale,orputoutofthesalevenueordisposeof,anylotwhichinitsopinionshowssignsofanydisease,whetherinfectious,contagiousornot,orofanyseriousfaultorofbeingdangerous.

19. DELIVERY-ExceptatthediscretionoftheauctioneernolotshallbedeliveredtothepurchaserunlesspaymentofthepurchasemoneytogetherwithanyadditionalchargesincurredincludingthoseexpensesincurredbytheauctioneerpursuanttoCondition14hereof,isfirstmadebythepurchasertotheauctioneer.Releaseoflotsmaybewithheldbytheauctioneeruntilpersonalchequesarecleared.

20. IntheseConditions:- (a)Referencesto“Auctioneer”shallbetakentomeanasthecontextsoadmits,the

sellingagentoranymember,subsidiaryorrelatedcorporationorbody,officer,agentoremployeethereof,authorisedbythevendortoconductthesaleofthelot;

(b)“Purchaser”shallhavethemeaningascribedtoitinCondition1; (c) “Vendor”shallmeanthepersonorcorporationuponwhoseaccount lotsare

offeredforsaleandwhereastudorfarmisnamedshallmeantheproprietorofthatstudorfarm;

(d)“Lot” shall be taken tomean the animal offered for sale and/or sold by theauctioneeronbehalfofavendor.
