2017 Legislative Changes

1. Modernized definition of “welfare system”

2. Enhanced ability to coordinate with county correctional agencies

3. Enhanced ability to coordinate with schools

MN Health Records Act, Federal laws still apply

Modernizing Welfare System

Definition of “welfare data” • Prior to July 1st: DHS, social services, county welfare

agencies, state nursing homes, etc.…. • After July 1st: in addition to above, includes public

health, veterans services and county housing

Sharing can occur between personnel of the welfare system to: • coordinate services for an individual or family • determine eligibility, amount of assistance, and the need

to provide services to an individual or family across programs;

• evaluate the effectiveness of programs • investigate suspected fraud

Enhanced Coordination with

Schools

Consent process for schools to share with County.

County welfare agencies can inform school they are providing services to a family.

Enhanced Coordination with

County Correctional Agencies

Welfare system and county corrections personnel can share limited data to coordinate services and diversion programs.

Establish processes and tools to coordinate services for families in schools, clients in need of county housing services, corrections clients, etc.

Establish processes and tools for informed client consent where necessary under state/federal law.

Establish audit and other data compliance processes
