PADI Combined Liability Insurance V-Insurance Group, in conjunction with PADI EMEA, is very pleased to provide an exclusive Liability policy to current PADI EMEA Individual Members. The policy is customised to include the following covers all combined into one policy;

Introduction This insurance brochure summarises the main benefits of the combined liability insurance policy that is available to current PADI EMEA Individual Members.

This policy has been designed exclusively by PADI working with scuba insurance specialists, V-Insurance Group.

Who is the insurer? The insurer for the PADI EMEA Master Combined Liability Policy is Liberty International Underwriters (LIU).

Liberty International Underwriters is a trading name of Liberty Mutual Insurance Company, ABN 61 086 083 605. Incorporated in Massachusetts, U.S.A. (the liability of members is limited).

LIU has been the Liability insurer for PADI Asia Pacific for the last 14 years. As a global insurer, LIU can meet local insurance requirements by utilising their offices around the world. For example, members based in the UK and EU access LIU’s policy via their Liberty Mutual Insurance Europe Limited office.

Who is the insured? Nominated and current PADI EMEA Instructors, Assistant Instructors, Divemasters and EFR Instructors.

Important notes PADI Professionals involved in scuba instruction within certain countries of PADI EMEA’s service territory must carry professional liability insurance to qualify for PADI Teaching/Active Status. However, professional liability insurance is strongly recommended to all PADI Professionals regardless of location/status. This insurance is arranged as a Master Policy for PADI EMEA Individual Members. As such, it has not been arranged to take into account your personal circumstances. To take out this policy, you must be a member of PADI EMEA at the time you effect cover and renew your policy.

What is covered? Classroom and water based learning activities and modules including first aid training and certification, the determination of standards by the accrediting agency and all activities relating to training, instructing, observing and control of recreational scuba diving.

The cover includes all activities relating to snorkelling, skin diving, swimming, recreational surface supplied air, free diving, technical diving, servicing, hiring and repairing of equipment and sales of related products, reef tours on glass bottom boats (not involving vessels over 12 metres in length), transportation of people by water from one island to the other, bird watching, guided tours when not diving, jungle and/or bush walking, kayaking/canoeing, fishing, underwater photography and/or video, whale watching, scuba doos/underwater scooters, beach games and the collection and reporting of data obtained by volunteer snorkelers and divers on the health of coral reefs, Stand Up Paddleboarding (SUP), coral reef conservation and coral reef management issues to the general community, business and Government Agencies.

The Insurance policy also includes Marine Hull Liability and Passenger Liability for Marine Hulls under 12 metres in length, please note that Marine Hull Liability and Passenger Liability arising from Personal use (i.e. not business use) is not covered.

Insurance Cover There are essentially 4 different sections of cover in the combined liability insurance policy, these are as follows:

1) Public & Products Liability

This section provides protection for insured entities and persons that are held liable for a negligent act that results in property damage or bodily injury to a third party, as a result of an accident occurring during the period of insurance (including an accident arising and reported to the insurer from the loaning of dive gear, the servicing of equipment and/or air tank refilling) but excluding professional duty (refer to section 2).

Limit of Liability:

Public Liability – The limit of indemnity is £5,000,000 any one claim*

Products Liability – The limit of indemnity is £5,000,000 any one claim and in total for the period of insurance*

* Limits of liability are sub limited to USD5,000,000 any one claim and in total for the period of insurance for claims and actions lodged to which the laws of the USA and Canada apply.

Legal Costs and Expenses:

These are paid in addition to the limit of liability, except for claims made in the USA and Canada.

2) Professional Indemnity

This section provides indemnity to insured entities and persons if they are held liable for an error or incorrect advice which results in injury or property damage or financial loss to a third party, which have been committed or alleged in connection with scuba diving and other insured activities.

Limit of Liability:

Professional Liability – The limit of indemnity is £5,000,000 any one claim and in the aggregate during the period of insurance.

Other benefits:

Coverage extends to include all scuba diving activities you are involved in, and is not limited to the instruction of courses via PADI.

No exclusions for enriched air or technical diving.

Automatic run-off insurance is included to provide cover once you have ceased actively working.

No need to upgrade insurance when you attain a higher qualification.

Coverage for surface supplied air, scuba doos/underwater scooters, sea walker and similar activities.

The definition of bodily injury has been broadened to include, sickness, disease, death, disability, shock, fright, mental anguish and mental injury, false arrest, wrongful detention or imprisonment, malicious prosecution, wrongful entry or eviction, assault and battery not committed by or at the direction of the insured unless committed for the purpose of preventing Injury and/or damage or eliminating danger, or libel, slander, defamation of character or invasion of right of privacy.

3) Criminal Prosecution, Coroner’s Inquest and Legal Defence Costs

This section indemnifies you for legal costs and expenses incurred in or at:

Defending a criminal prosecution.

Pleas of mitigation for a criminal defence against an insured.

Any Coroner’s inquest or inquiry.

Any Royal Commission or Government inquiry.

Limit of Liability:

Criminal Prosecution, Coroner’s Inquest and Legal Defence Costs £150,000 any one claim and in the aggregate

What is the Policy Excess?

There is no excess to pay.

4) Crisis / Media Management

This benefit is payable in the event of a death or permanent disability claim for costs such as counselling and/or media management.

Limit: £150,000 in the aggregate during the period of insurance.

Significant Exclusions The following are a summary of some of the exclusions applicable to this policy.

Claims previously notified under any previous policy.

Claims made against you prior to the commencement of the policy period.

Claims and Circumstances known to you prior to taking up a PADI Membership.

Marine Hull liability for hulls over 12 metres in length. For hulls under 12 metres in length, please note that personal use is excluded from the PADI Policy.

Note: Any claims and circumstances may be indemnified by your previous insurer if they have been reported.

Claims / Incidents In the event that you are involved in a diving related incident you must complete a PADI Incident Report form as soon as possible and return it to PADI. A PADI Incident Report form is available on the PADI PROs’ site www.padi.com/mypadi.

In the event that you receive correspondence holding you responsible for an incident, you must pass this information onto V-Insurance Group (c/- Scrutton Bland) as soon as possible. V-Insurance (c/- Scrutton Bland) will then be in contact with you and advise the next steps. This may include a lawyer in your local area being engaged to work on your behalf.

In the event of a claim, it is an insurance policy condition that you must not admit liability to a third party.

About the Insurance:

Q. How do we buy (take out) a policy?

Visit www.padiinsurance.com and login to access/buy our exclusive PADI EMEA insurance policy.

Q. When does cover commence and expire?

The policy is an annual policy which commences on 31 December 2017 or the day your application is completed and payment is received by V-Insurance Group, whichever is the later date. If your application is not completed correctly or the premium is not paid, then cover will not be effected until these matters have been resolved. Cover ceases on 31 December 2018 regardless of when the policy is purchased.

Q. Can I apply for Insurance over the phone with a credit card?

Unfortunately we are unable to effect insurance over the phone.

Legislation and compliance require you to make declarations in writing or online. The easiest and quickest way to effect cover is to visit our website www.padiinsurance.com and click Buy Now. If you have any problems please contact the V-Insurance (c/- Scrutton Bland) service team on +44 (0) 1473 267 000.

Q. What do I receive as confirmation of my insurance?

Once you have successfully completed your online application you will be able to view/print your Certificate of Insurance online. Your Certificate of Insurance will also be emailed.

Q. If my application is returned to me, am I still covered?

No. Coverage is not effective until the correctly completed application form and payment is received by V-Insurance Group (c/- Scrutton Bland).

Q. I am not sure where I will be working this year. Does this policy cover me wherever I work in the world?

Yes. So long as you are a PADI EMEA Individual member when you take out this insurance policy. If you move to a country serviced by another PADI Regional Headquarters at a later date, you will need to notify PADI EMEA of your change in teaching location. This change may require your membership to be registered with another PADI Regional Headquarters and if this is the case, your combined liability policy will cease on 31 December 2018 and you will be required to renew with your local PADI office.

Q. Am I covered for commercial diving activities?

No. Commercial diving is excluded under the combined liability insurance policy.

Q. Can a PADI Americas or PADI Asia Pacific member purchase a PADI EMEA insurance policy?

If you are residing/teaching within the service area of PADI EMEA, you will need to request a transfer of your membership to PADI EMEA before purchasing a PADI EMEA insurance policy.

Q. Does the Public Liability, Product Liability and Professional Indemnity insurance cover me for scuba instruction through other scuba certifying agencies?

Yes, you will be covered for the same certification level as your PADI membership.

Q. Does this insurance cover me for personal medical bills as a result of a diving accident?

No, this insurance policy does not include diving accident or equipment insurance.

Q. Does this insurance policy cover me for teaching Enriched Air, TEC and Freediving?

Yes, there are no exclusions for Enriched Air, TEC & Freediving.

Q. Will I be covered by the combined liability insurance policy when I retire or cease professional diving activities?

Yes, the PADI Combined Liability policy provides automatic run-off cover for you after you retire or cease professional diving activities. The runoff cover continues to cover you for incidents which have already occurred but you do not know about yet for as long as the PADI Insurance Program is available and has this extension.

Q. Can I extend the combined liability policy to cover other activities like surf training?

It may be possible to extend your policy. Please contact V-Insurance Group (c/- Scrutton Bland) to discuss your requirements.

Q. Do I need to be a citizen of the country where I am working or have the appropriate visa to be covered?

No. However it is strongly recommended that the correct working visa is obtained to avoid breaking the laws in the country concerned.

Q. If I am sued, does the insurer appoint a local lawyer to represent me?

Yes. An appropriately experienced lawyer who is local to you and within the jurisdiction of the relevant court where the matter is being heard will be appointed to defend you, anywhere in the world.

Q. Am I covered for teaching Emergency First Response (EFR) courses?

Yes.

Q. Am I covered for the loan or hire out of equipment?

Yes. However, please note that damage to the equipment itself is not covered. Only your legal liability arising from its use.

Q. Can we increase the limit of liability?

Yes, please contact V-Insurance Group (c/- Scrutton Bland) on +44 (0) 1473 267 000 or [email protected] to arrange for additional premium payments to be made to increase your limit of indemnity.

Q. Will my helpers be covered as well?

No. If you employ individuals you may require additional insurance, including Employers Liability insurance to protect you in respect of liability to them. Please contact V-Insurance Group (c/- Scrutton Bland) for further details.

Q. Am I covered for my own social diving?

You will be defended in a claim of professional liability against you, even if you were not acting in a professional capacity at the time of the incident. Although it is rare, claims have been made against professionals simply because they were present, because they attempted a rescue etc.

Q. I just became a PADI EMEA Individual Member and need insurance to start work. I don’t seem to be on the V-Insurance database to be able to take out insurance.

It normally takes a few days to update the database for new members, or members who have just transferred their membership from another region. Should you need insurance urgently, please contact V-Insurance Group (c/- Scrutton Bland).

Q. My membership status has changed from Divemaster to Instructor. Do I need to pay additional premium and receive a new insurance policy?

PADI EMEA will automatically advise V-Insurance when your membership status has changed. The same insurance policy will remain in place and no additional premium will be charged.

Q. Is there a refund if I decide to cancel my policy?

No. The premium is non-refundable/cancellable. The policy is designed this way to protect you against any future liability law suits which may be brought against you that you are not aware of right now.

Q. Does my PADI Combined Liability Policy cover me while conducting referral dives?

Yes. There is no exclusion for conducting open water training dives for a student diver who has completed academic and confined water training with another instructor or certification agency.

Q. Is the limit of indemnity just for myself, or is this shared with all PADI EMEA members?

The limit of indemnity is just for you. Each insured person has their own limit of indemnity under the policy.

Q. Is it mandatory for PADI Individual Members to have the insurance?

PADI members involved in scuba instruction within certain countries of PADI EMEA’s service territory must carry liability insurance for PADI Teaching/Active Status.

Duty of Disclosure

This duty requires you to tell the Insurer everything that you know that is relevant to their decision to insure you and, if so, on what terms. A matter is relevant, if you or a reasonable person in the circumstances, would know it is relevant. You must tell the Insurer these things before cover is issued, and whenever you renew, extend, vary or reinstate a policy of insurance.

If you don’t tell the insurer everything that you know is relevant, they may:

refuse a claim

reduce a claim payment or settlement, cancel your policy, or

in some cases, treat your policy as if it never existed.

You do not have to tell the Insurer things that:

reduce the risk,

are common knowledge,

the insurer already knows or should know in the course of our business, or

the insurer indicates they don’t want to know

Cancellation This is a non-cancellable/refundable policy, unless cancelled within the 14 day cooling off period provided no claim has been recorded. The policy is designed this way to protect you against any future liability law suits which may be brought against you that you are not aware of right now.
