Your honor, my name is Eeshna Nath and this is my partner, Brynn Tarbell. We are the prosecutors representing the State of Minnesota in this action. The evidence will indicate that Madison Casco violated the law by committing credit card fraud. On April 3rd, 2013, Madison Casco was arrested by Officer Brosnan because evidence shows beyond a reasonable doubt that she is guilty.

OPENING STATEMENT - Defense

Your honor, my name is Brynn Tarbell and this is my partner, Eeshna Nath. We are the counsel for Madison Casco in this action. Witness Jamie Sung will be called to tell that Devon Wilshire has commited the crime of credit card fraud. On April 3rd, 2015, Officer Brosnan wrongfully accused Madison and arrested under false pretenses, when he should have arrested Devon Wilshire.

Ladies and gentlemen of the jury, defense would have you believe that Madiosn Casco is not guilty, but clearly, based on the evidence shown today, there can be no doubt that Madison Casco is guilty. Witness Chris Conley, their close teacher, saw Madison looking through his desk. She took his credit card and made these illegal purchases and she lied to her friends, and us, about Devon giving her these expensive electronics.She tried to frame her friend, but failed. Madison Casco has clearly comimitted credit card fraud.

CLOSING STATEMENT - Defense

Ladies and gentlemen of the jury, the defense has clearly shown that Madison Casco is indeed not guilty. There is evidence proving her innocence and pointing to Devon Wilshire, who tried to frame his friend. Based on the fact that Devon's story doesn't match up with anyone else's and the fact that Madison's personality would not point to her doing any of these actions, It is blatently clear that Madison Casco is indeed not guilty of credit card fraud.

OPENING STATEMENT - Prosecution

Your honor, members of the jury, my name is Garret Hintze with my partner Matthew Pastrana, the prosecutors representing the State of Minnesota in this action. Beginning in February 2015, the New Prague Police Department received phone calls from residents of the area stating that there were fraudulent charges on their credit cards. The purchases were on online websites. The IP address, or the Internet Protocol address, of the purchases were the same as the school library, where Madison volunteers. Everyday, Madison volunteers in the library, but during this time, she was frequently seen in the Russian language section of the library with Devon Wilshire. In early March, Devon Wilshire's mother noticed that Devon Wilshire had been coming home with very expensive items that his mother knew he could not afford. Devon explained that Madison had been supplying him with these expensive items for "half off". On April 3, 2015, Devon Wilshire and Madison Casco were seen acting very suspicious in the Russian language section of the library, and later a camera, a “Mammon C350 Digital Camera”, worth around $430, was found in the Russian language section according to Librarian Pat LaPoint. This camera matched one of the fraudulent purchases. On April 3, 2015 Madison Casco was searched, then found with $1000 in cash and was put under arrest for credit card fraud. I will prove without a reasonable doubt that Madison Casco is guilty on these charges.

This camera matched one of the fraudulent purchases. On April 3, 2015 Madison Casco was later searched, then found with $1000 in cash and was put under arrest for credit card fraud. I will prove that Madison Casco is innocent of these allegations.

Ladies and gentleman of the court we are here today to prove to you that madsison casco has used a credit card without the permission of the card holder, knew about the use of the card and has obtained money goods etc. With the use of the card. As she is seen many times in the library conducting suspicious activitys the Libbrain had called officer brosnan. And Madison was indeed found with the DVD player being guilty of having purchased/stolen property and she had knowledge of the acts

Ladies and gentleman we are here today to prove to you that Madison is not guilty and is merely just a victim of this situation. She claims Devan had given her the things and he was the one binging odd things to school not her. She states the reason for all the money in her bag was she doesn't trust banks and always has it on her. Mr.Leno had stated that Madison has a great personality and he wouldn't suspect her to do such a thing. Madisons employer says Madison has no reason to need money she makes 7$ am hr plus tips averaging 240$ a week.there for we the people of the court find this a false accusation Madison is mearly a victim.

OPENING STATEMENT - Prosecution

“Hello ladies and gentleman. My name is Emily Barrett and my partners name is Madison Ramola and we represent the state of Minnesota in this case. We are here today to decide if the defendant, Madison Casco, is liable for credit card fraud.This alleged crime occurred in the town of New Prague, and was reported to the local police station, in February, March and April of 2015. In the beginning of February the local police station of New Prague, Minnesota received phone calls saying people had fraudulent charges on their credit cards. Roy Brosnan, a police officer and school resource officer, started an investigation to find out why these charges were occurring.In the last week of February, Lola Wilshire called Officer Brosnan to say that her son, Devon Wilshire, has been coming home with new items that he cannot afford. Devon Wilshire is a student at New Prague High School. Officer Brosnan called credit card companies, in early March, to put together a list of fraudulent purchased items. Mr. Brosnan called the stores that sold the items and found that most items were purchased online. The retail stores provided an IP address from which the purchases originated from. On the date of March 11, 2015, the chemistry teacher of New Prague High School, Chris Conley, informed Officer Brosnan that there was a fraudulent charge on his credit card. Mr. Conley believes that a student of New Prague High School is the culprit. After speaking to Mr. Conley, Mr.Brosnan called a staff meeting to tell them about the fraudulent purchases and to look out for any of the students acting suspiciously.Right after the meeting, Mr. Brosnan had a private talk with the school librarian, Mr. Lapointe. Mr. Lapointe told Officer Brosnan that he saw Devin Wilshire and Madison Casco acting suspiciously in the library over the past couple of weeks.New Prague High School has also been seeing an increase in drug use in the past few years. The administrators, worried about the effects of drugs on their students, called for a canine dog sniff in the students’ cars and lockers. The school contacted Securities International (SI), a company who specializes in drug detection in school. SI sent a certified drug dog handler and Buddy, a German Shepherd who is trained to detect illegal substances. Five students were found with drugs during the September, October, November and December dog sniffs. After many false positive, the administration decided to check students belongings, for example backpacks and purses.In March, 2015, Officer Brosnan, Principal Heim, Buddy and the dog handler went into three classrooms, that were chosen at random. In March, the searches were successful so they decided to do another dog sniff, that would take place on April 3rd. On this date, Mr.Lapointe saw Madison go directly into a rarely visited section of the library and went to get Officer Brosnan. The two of them went back to the library and found a Mammon Digital Camera on the shelf. As they looked at the serial number they found it was the same as one of the numbers the retailers provided. After that Officer Brosnan went to do a drug sniff and put the fraudulent charges out of his mind. During the dog sniff with Principal Heim, Buddy, The dog handler and Officer Brosnan, the dog sniffed supposed drugs in two bags. One belonging to Tobey Wesley and the other, our defendant, Madison Casco. Officer Brosnan asked the students to take their belongings into the hallway. Once there, Principal Heim searched both bags. The principal found marijuana in Tobey Wesley’s bag but did not see any drugs in Madison Casco’s. However, Principal Heim found approximately $1,000 in a folder. The school does not allow students carry more than $100 at school. Principal Heim immediately showed the money to Officer Brosnan and took the money from Madison’s bag because of the money rule.After this, Madison was taken to the principal's office. When hearing all the information provided by Chris Conley, Pat Lapointe, and Devin Wilshire, and information from retailers and credit card companies Officer Brosnan believed that Madson Casco was guilty.Later that day, April 3, 2015 Officer Brosnan arrested Madison Casco for credit card fraud. Ladies and gentlemen, the defense may argue that Madison Casco had nothing to do with the credit card fraud, but witnesses say she went to a rarely used section of the library and, when officer Brosnan checked the section, a camera with a serial number matching that provided by the credit card company was found, where she may have left it for another student to take and later pay her, which would also explain why she had approximately $1,000 in her folder. She may have sold to students at a discount price, which would explain why Devon Wilshire was able to obtain items he typically wouldn’t be able to afford.

Prosecution Closing StatementLadies and Gentlemen of the jury, we, the state of Minnesota, believe that Madison Casco is guilty of credit card fraud. We believe this because Ms. Casco was found with Devin Wilshire acting suspiciously in the library in Mid-March according to Pat Lapointe, the school librarian. Also the chemistry teacher, Chris Conley, noticed that he had fraudulent charges on his credit card. Mr. Conley keeps his documents in a folder in his desk, the documents include receipts and payment stubs. Mr. Conley believes that a student had gotten into his deck and stole his information. When he realized this he told Officer Brosnan on March 11th. On April 3, Mr. Lapoint saw Madison walk into the Russian language section of the library, which people rarely visit, very quickly and informed Officer Brosnan. Mr.Lapointe and Officer Brosnan went back to the library, where they found a Mammon digital camera sitting on the shelf. The camera had the same serial number as the one provided by the retailers. When the dog sniff occurred, on April 3, the dog found two bags. One was Madison Casco, who didn’t have any drugs but had $1,000 dollars in a folder, in her bag. The school only allows students to carry $100 dollars on campus. After this, Madison was taken to the principal's office and after reviewing all the information was arrested for credit card fraud by Officer Brosnan. Ladies and Gentlemen, we would like you to consider the evidence we have found that proves Madison Casco is guilty of credit card fraud.

fraud. According to witnesses, you have heard that Madison Casco is a hard working, intelligent student and worker. She had no need to commit this crime because she had a good job that paid her well and she made nice tips. She was buying things for half price, from an e-mail her friend, Devon Wilshire, provided. She merely trusted the wrong person and didn’t realize what Devon was doing wrong. With only his allowance, it would be very difficult for him to buy the objects from Madison, even at half price, while it would have been much easier for Madison to unknowingly illegally buy the objects. Devon was also seen looking around in Chris Conley’s desk at the high school, which is where the receipt that was used to buy fraudulent purchases using his credit card. Many witnesses have stated that Devon is lazy and untrustworthy. He also said he thought a student at the school was the perpetrator of the fraud. This student was Madison Casco. Although some may say Madison’s not that type of person, Madison has either helped those witnesses in the past or caused their business to gain income. Madison has many opportunities during her day to get ahold of other people’s personal info. She spends her lunch period in Chris Conley’s room, where he keeps his receipts. She also works as a waiter at the Crius Restaurant. On behalf of the state of Minnesota, we ask you find Madison Casco guilty of credit card fraud. We are sure justice will be served in this matter. In February of 2015 the New Prague Police Department recognized that a serious case of credit card fraud was occurring in their town. After Officer Brosnan learned that the perpetrator was most likely a student (due to Ms. LaPoint’s and Mr. Conley’s testimonies) and money was found in Madison’s bag, she was arrested. However, it would make much more sense if the perpetrator was someone else, namely Devon Wilshire. Madison is known as helpful and a hard worker who has had part time jobs since she turned 16. By the beginning of March there were many reports of fraudulant charges and Bronson began to make a list of the items purchased , the companies that made the items and if the item was bought online or not. On March 11th Bronsan met a teacher by the name of Chris Conley and which he told the officer his credit card has been compromised because of a stolen recipt that he's sure a student took. In this case the student being 18 year old Madison Casco. Your honor, my name is Courtney Bissen, along with my co-counsel Tess Trombley and we are the prosecutors representing the state of Minnesota in this action. Beginning in December of 2015 the defendant of this case committed acts of credit card fraud on unsuspecting New Prague residents, including a high school teacher and received stolen property. At the conclusion of this case we will ask for a verdict of guilty. Ladies and gentlemen of the jury this case is about a woman whose greed got the better of her. The prosecution will call four witnesses to the stand. We will call Officer Rory Brosnan, a school resource officer, who will explain how he first became aware of the credit card fraud occurring in New Prague. He will also testify as to when he first started to suspect a high school student was involved. We will call Devon Wilshire a friend of the defendant who will testify about the involvement of Madison Casco in credit card fraud. We will call the school librarian, Pat LaPoint who will testify to the location of Madison Casco in the library during the time when the fraudulent purchases took place. Lastly, we will call Chris Conley, a high school chemistry teacher. Who will testify that he himself was a victim of credit card fraud that he believes first occurred when his private records were stolen from a desk drawer in his classroom. Your honor, my name is Tess Trombley along with my co-counsel, Courtney Bissen, representing Madison Casco in this action. I will prove to you that Madison is innocent, and is only a victim in this fraudulent case. Devon Wilshire started to show up to school with very expensive electronics. Wilshire told Madison that he could buy her anything she wanted for half of the price. She bought a DVD player off of him, but wanted more. She asked to buy a camera but was told that there was a new “system” that she had to go through. She was told to send an email to [email protected], because it was a different way to take deliveries. She received another email from this account saying that her order was in, and that she should drop off the money in an envelope in the Russian language section of the library. She quickly dropped it off, because she was nervous about how suspicious Devon was being. She later had her bag checked because of a false positive drug-dog search. They found about $1000 in her math folder because she feels more comfortable of having all of her money with her at all times. Madison is a hard working, well loved member of the New Prague society. She had no motive to commit this crime, because she makes a lump sum of cash from her job each week. She is only a victim in this crime, at the conclusion of this case we will ask for a ruling of not guilty.

Today I will prove to you that Madison Casco is guilty of credit card fraud and recieving stolen proporty. Beginning in Feburary 2015, The New Prague police department started receving calls from many New Prague residents, saying that fraudulent purchases had been made on their credit cards. Shortly following, Mrs. Lola Wilshire reported that her child, Devon Wilshire, had recently come home with new items that she knew he couldn't afford. On March 11, 2015, Chris Conley, who is a chemistry teacher at New Prague High, spoke to Officer Brosnan saying that a fraudulent purchase had been made on his credit card. Shortly after the meeting, Officer Brosnan spoke with librarian Pat LaPoint, and she claimed that she saw Madison Casco and Devon Wilshire acting very suspiclously in the library. Then, in March 2015 Officer Bronsan and Principal Heim, accomplained by Buddy the dog and the dog handler procceded to do a drug search. They entered three classrooms chosen at random. The dog alerted to four bags, although only three students were found with drugs in their bags. After, on April 3rd, librarian Part LaPoint saw Madison walk into the library and go straight to the seldom used section. LaPoint left the library to get Officer Brosnan. They returned to find a Mammon digital camera sitting on one of the shelves. Officer Brosnan took the camera from the shelf and found that the serial number on the camera matched with one of the serial numbers provided by the retailers. Soon after, Officer Brosnan found that it was the time for another drug search. They followed the exact prodecure as the one they did in March. This time, the dog alerted to only two bags. They belonged to Madison Casco and Tobey Wesey. They found marijuana in Tobey's bag, but no drugs in Madison's. Instead, they found approximately $1,000 in a folder. Principal Heim took the money from Madison's bag becayse the school does not allow students to carry more than $100 at school. Madison was taken to the principals office. Based on the information Officer Brosnan had recieved, he later arrested Madison for credit card fraud. But, many other students at the school had used those computers often too, not just Madison. When Pat LaPoint and Officer Brosnan went to the back of the library and found the camera, it is not proof that Madison had planted that. “Hello ladies and gentleman. My name is _____and my name is _____and we represent the state of Minnesota in this case. We are here today to decide if the defendant, Madison Casco, is liable for credit card fraud. This alleged crime occurred in the town of New Prague, and was reported to the local police station, in February, March, and April of 2015. In the beginning of February, the local police station of New Prague, Minnesota received phone calls saying people had fraudulent charges on their credit cards. Roy Brosnan, a police officer and the school resource officer at New Prague High School, started an investigation to find out who was causing the charges. In the last week of February, Lola Wilshire called Officer Brosnan to say that her son, Devon Wilshire, has been coming home with new items that he could not afford. Devon Wilshire is a student at New Prague High School. Officer Brosnan called credit card companies in early March to put together a list of fraudulent purchased items. Mr. Brosnan called the stores that sold the items and found that most items were purchased online. The retail stores provided an IP address from which the purchases originated from. On the date of March 11, 2015, the chemistry teacher of New Prague High School, Chris Conley, informed Officer Brosnan that there was a fraudulent charge on his credit card. Mr. Conley believed that a student of New Prague High School was the culprit. After speaking to Mr. Conley, Mr.Brosnan called a staff meeting to tell them about the fraudulent purchases and to look out for any of the students acting suspiciously. Right after the meeting, Mr. Brosnan had a private talk with the school librarian, Mr. Lapointe. Mr. Lapointe told Officer Brosnan that he saw Devin Wilshire and Madison Casco acting suspiciously in the library over the past couple of weeks. New Prague High School has also been seeing an increase in drug use in the past few years. The administrators, worried about the effects of drugs on their students, called for a canine dog sniff in the students’ cars and lockers. The school contacted Securities International (SI), a company who specializes in drug detection in school. SI sent a certified drug dog handler and Buddy, a German Shepherd who is trained to detect illegal substances. Five students were found with drugs during the September, October, November and December dog sniffs. After many false positive, the administration decided to check students belongings,backpacks and purses for example. In March, 2015, Officer Brosnan, Principal Heim, Buddy and the dog handler went into three classrooms that were chosen at random. In March, the searches were successful so they decided to do another dog sniff, that would take place on April 3rd. On this date, Mr.Lapointe saw Madison go directly into a rarely visited section of the library and went to get Officer Brosnan. The two of them went back to the library and found a Mammon Digital Camera on the shelf. As they looked at the serial number they found it was the same as one of the numbers the retailers provided. After that, Officer Brosnan went to do a drug sniff and put the fraudulent charges out of his mind. During the dog sniff with Principal Heim, Buddy, The dog handler and Officer Brosnan, the dog sniffed supposed drugs in two bags. One belonging to Tobey Wesley and the other, our defendant, Madison Casco. Officer Brosnan asked the students to take their belongings into the hallway. Once there, Principal Heim searched both bags. The principal found marijuana in Tobey Wesley’s bag, but did not see any drugs in Madison Casco’s. However, Principal Heim found approximately $1,000 in a folder. The school does not allow students carry more than $100 at school. Principal Heim immediately showed the money to Officer Brosnan and took the money from Madison’s bag because of the rule. After this, Madison was taken to the principal's office. When hearing all the information provided by Chris Conley, Pat Lapointe, Devin Wilshire, and information from retailers and credit card companies Officer Brosnan believed that Madson Casco was guilty. Later that day, April 3, 2015 Officer Brosnan arrested Madison Casco for credit card fraud. Ladies and gentlemen, the defense may argue that Madison Casco had nothing to do with the credit card fraud, but witnesses say she went to a rarely used section of the library and, when officer Brosnan checked the section, a camera with a serial number matching that provided by the credit card company was found, where she may have left it for another student to take and later pay her, which would also explain why she had approximately $1,000 in her folder. She may have sold to students at a discount price, which would explain why Devon Wilshire was able to obtain items he typically wouldn’t be able to afford.

Ladies and Gentlemen of the jury, we, the state of Minnesota, believe that Madison Casco is guilty of credit card fraud. We believe this because Ms. Casco was found with Devin Wilshire acting suspiciously in the library in Mid-March according to Pat Lapointe, the school librarian. Also the chemistry teacher, Chris Conley, noticed that he had fraudulent charges on his credit card. Mr. Conley keeps his documents in a folder in his desk, the documents include receipts and payment stubs. Mr. Conley believes that a student had gotten into his deck and stole his information. When he realized this he told Officer Brosnan on March 11th. On April 3, Mr. Lapoint saw Madison walk into the Russian language section of the library, which people rarely visit, very quickly and informed Officer Brosnan. Mr.Lapointe and Officer Brosnan went back to the library, where they found a Mammon digital camera sitting on the shelf. The camera had the same serial number as the one provided by the retailers. When the dog sniff occurred, on April 3, the dog found two bags. One was Madison Casco, who didn’t have any drugs but had $1,000 dollars in a folder, in her bag. The school only allows students to carry $100 dollars on campus. After this, Madison was taken to the principal's office and after reviewing all the information was arrested for credit card fraud by Officer Brosnan. Ladies and Gentlemen, we would like you to consider the evidence we have found that proves Madison Casco is guilty of credit card fraud.

Ladies and Gentlemen of the jury, we, the representatives of Madison Casco, believe that Madison Casco is not guilty of credit card fraud. According to witnesses, you have heard that Madison Casco is a hard working, intelligent student and worker. She had no need to commit this crime because she had a good job that paid her well and she made nice tips. She was buying things for half price, from an e-mail her friend, Devon Wilshire, provided. She merely trusted the wrong person and didn’t realize what Devon was doing wrong. With only his allowance, it would be very difficult for him to buy the objects from Madison, even at half price, while it would have been much easier for Madison to unknowingly illegally buy the objects. Devon was also seen looking around in Chris Conley’s desk at the high school, which is where the receipt that was used to buy fraudulent purchases using his credit card. Many witnesses have stated that Devon is lazy and untrustworthy. Ladies and Gentlemen of the jury, we believe Madison Casco is not liable for the charges held against her because she is a good, trustworthy girl who wouldn’t take advantage of people in this way.

She was spotted digging through Chris Conley’s desk and having expensive items. She worked at the library at the same time the purchases were made. Everything leads to Madison, which is why she should be guilty and charged.

We think that Madison is innocent and Pat LaPoint should be charged. Pat LaPoint is both good with computers and also has the access. She was working in the library at the time of the purchases. Madison and devon were getting items from Pat Lapoint or “Uncle Johnny.” Pat had access to all the log on for the extra accounts. The accounts where the purchases were made. OPENING STATEMENT - Prosecution

Madison Casco has been charged with two counts. Count 1 is is the credit card fraud which is grand theft or lesser crime of thet depending on the amount she stole. This counteracts to the different sections of he Minesota Statues. Firstly, Minnesota Statues Section 484g which states that every person who has the intent of fraud to obtain money or goods violates section 484e and is guilty of grand theft or theft. Secondly, the violation of section 484e which is having the credit card of someone without their consent or with he intent to use the information fraudulently. Lastly, Count 1 violates Minnesota Statue Section 487 that states that if anything that is stolen is over $450 it is considered grand theft but if anyting is stolen that is under $450 it is just considered theft. The second count that Casco is charged with is recieving stolen property. This violates section 496 that states that every person who recieves anything that has been stolen or obtained through theft who know that the property had been stolen should be imprisoned in the state jail for no more than a year. Some stipulaions having to do with this case that prove Casco is guilty are both the official diagram of the "List from Retailers" and the official diagram of "List from Credit Card Companies" have been certified as official businessrecords and the IP addressesn belong to the New Prague High School and the registered IP addresses are certified business records. Other stipulations are the arrest warant was issued properly and was based on a sufficient probable cause and all witness statemens were taken in a timely manner. Therfore, Madison Casco is guilty of both counts charged against her and should be imprisoned and charged for these counts.

OPENING STATEMENT - Defense

Madison Casco is not guilty of credit card fraud or recieving stolen items. The first reaon for this is that all items were bought and all credit cards were used fraudulently during Madison's third hour. Durng thirdhour, Madion voluneers at thelibrary. The librarian, LaPoint, reports that Madion is usually stacking shelves and just helping around the library so she would not have time to buy items online using other people's credit cards. Another factor involving the libray is that there are no emails on the computers so there is no proof of her commiting these crimes. Lastly, Madison just wanted to gt some stuff for cheaper than usual and believed she could trust Devon beause they had been friends for 10 years. Therefore, Madison Casco is not guilty.

Madison Casco is guilty of credit card fraud and recieving stolen property. She created a whole scheme about an 'Uncle Johnny" who supplied her with half off items. She told mutiple people about this and offered them deals such as Devon Wilshire. She also has access to school computers during the time the items were stolen and the credit cards were used fradulently. So she could've used the computer during this time to buy expensive items using other people's credit cards. Madison was also found with $1000 in her backpack. The libarian saw Madison rush into the ibrary and run out and then found a camera where Madison had gone that was of high value. Madison was also found snooping though the desk of her chemistry teacher, Mr. Conley. Mr. Conley later found a reciept for the camera on his desk. To conlude, Madison Casco is guilty.

I believe that Devon Wilshire is guilty of these two counts and my client, Madison Casco, is innocent of these alleged charges. As Madison had claimed, Devon was reieving many high-end electronics that he woud not be able to afford. He alo does not have a job, as said by Rver Leno, which seems irresponsible and only someone irreponsible would commit credit card faud. Madison is the opposite of irrespnisble,she isvery nice to all her customers and has been able to keep her part time job at Crius restaurant. K.C. Cline, Madison's boss, states that Madison makes about $250 a week so she would not need to get these items at half off or commit credit card fraud. Another reason that Madison is not guilty is that her neighbor Jamie, who has known Madison since she was born, say that Madison is very kind and hard-working so she would not commit this crime. Jamie has reported that when her arm was broken, Madison helped her while Devon just laughed. Jamie also reported seeing Devon pick up two different boxes from the mail that could potentially be stolen items and Madison has not picked up any boxes. Therefore, Madison is not guilty of these charges.

The evidence and facts of this case will prove that Madison Casco is guilty of Credit Card Fraud and Receiving Stolen Property. Beginning in February 2015 residents of New Prague, Minnesota reported fraudulent charges on their credit cards. In early March, with even more residents reporting credit card fraud, the New Prague Police Department compiled a list of the fraudulently purchased items. On March 11th, 2015, a chemistry teacher at New Prague High School came forward reporting a fraudulent purchase on his credit card and explained there was reason to believe that one of the students at New Prague High School was the perpetrator. In response Rory Brosnan, an officer in the New Prague Police Department, joined a staff meeting at New Prague High School and told the teachers of the recent credit card fraud problems in the area and that he suspected the high school students may be involved. The officer asked the teachers to keep an eye out for suspicious activity. After this meeting Officer Brosnan spoke privately to a librarian who said that Madison Casco and Devon Wilshire had been acting suspiciously in the library in the last few weeks. On April 3rd, 2015, the librarian saw Madison walk into the library and go to a seldom used section. The librarian left to library to find Officer Brosman, the two of them returned to the library where they found a digital camera sitting on a shelf. The serial number on the camera matched one of the serial numbers on the list of the fraudulently purchased items. Later that day $1000 was found in Madison Casco’s purse during a dog search for drugs, the money was confiscated because the school does not allow students to carry more than $100 at school. Madison was taken to the principal's office and later arrested for credit card fraud. Madison wanted things that she did not have the money to buy so she turned to credit card fraud and purchased items with money that was not hers.

Your honor, my name is Tess Trombley along with my co-counsel, Courtney Bissen, representing Madison Casco in this action. I will prove to you that Madison is innocent, and is only a victim in this fraudulent case. Devon Wilshire started to show up to school with very expensive electronics. Wilshire told Madison that he could buy her anything she wanted for half of the price. She bought a DVD player off of him, but wanted more. She asked to buy a camera but was told that there was a new “system” that she had to go through. She was told to send an email to [email protected], because it was a different way to take deliveries. She received another email from this account saying that her order was in, and that she should drop off the money in an envelope in the Russian language section of the library. She quickly dropped it off, because she was nervous about how suspicious Devon was being. She later had her bag checked because of a false positive drug-dog search. They found about $1000 in her math folder because she feels more comfortable of having all of her money with her at all times. Madison is a hard working, well loved member of the New Prague society. She had no motive to commit this crime, because she makes a lump sum of cash from her job each week. She is only a victim in this crime, at the conclusion of this case we will ask for a ruling of not guilty.

Ladies and gentlemen of the jury, today a case involving credit card fraud was argued. Madison Casco was proved to be guilty beyond a reasonable doubt. She was the only student to have access to the computers in the library between 10 and 10:50 who also had access to the usernames and passwords of extra student access. Madison was found with items proven to be bought via credit card fraud. The defendant had access to Chris Conley’s receipts when she had lunch in his room unsupervised, and a close friend of Madison’s testified that he had seen Madison snooping through Conley’s drawers. The defendant lied to her close friends about how she obtained the items for herself and for them, claiming she received a discount from her “Uncle Johnny”. The defendant denies knowledge of the fraud and even blamed it on Devon, but can we really trust her? What would you say to be found not guilty of a crime you did commit? Ladies and gentlemen of the jury, we hope you come back with the correct verdict. We hope you find Madison Casco guilty.

Ladies and gentlemen of the jury, we have represented the defendant in the trial today. The opposing council has done an honorable job today. But they have not proved beyond a reasonable doubt that it was my client who committed credit card fraud. They have simply showcased that Madison was involved with the scheme, but we have proved that Madison didn’t know there was anything illegal going on. She simply believed her close friend when he said he was getting a good discount and was willing to share it with her. A close mutual friend of both Devon Wilshire and the defendant has testified to the fact that it was in fact Devon behind the credit card fraud and not Madison Casco. The burden of proof falls on the prosecution and they have not proved beyond a reasonable doubt that it was the defendant at fault. Ladies and gentlemen of the jury this is a case about cheating where the defendant, Barry Martin, killed the one person who would expose his dirty deeds. The evidence will show that on friday June 7th, Ms. Sara Marcus had overheard the defendant and his friend, Henri Ward, whispering in the hallway. During their conversation, the defendant removed photocopied papers from their backpack. Sara saw the papers and took them, she then realized that the papers were a copy of the test with handwritten answers on them. She immediately recognized the handwriting belonged to the defendant and Henri. As soon as the Sara realized the two had been cheating, she immediately told them that if they did not turn themselves into Dean Taylor Wermerskirchen by Monday morning, she would turn them in herself. Unknown to either Henri or the defendant, later that evening Sara delivered the photocopies to the Dean. On Sunday June 9th, Sara was rock climbing at Tettegouch Beach which is located just north of Duluth as she was known to regularly does. Later that evening, Henri and the defendant drove to the location that they knew she would be at. Once the two got to the beach, they saw the Sara climbing the cliff. Henri and the defendant went up a 40 ft ridge and lay and wait for Sara to scale that high, once she got there the physically accosted her and then they argued about Sara exposing his secret. All three of them started walking towards the cove while Sara and the defendant continued to argue. Henri then went back to the car around 7:50 pm as Sara and the defendant continued to argue.. While the two argued, Sara reaffirmed that she would turn the papers in to the dean if Henri and the defendant would not do so himself. The defendant realized that the only way to make sure that Sara would not squeal, is to shut her up permanently by doing the ultimate, to kill. He then bashed Sara's head with a hand sized rock knocking her unconscious and you will learn that the rock had Sara’s blood on it and was left on the top of a rocky shelf. The defendant, assumes she is dead, takes her down to the cove dispose of her body by pushing it out to sea. Her body did not make it to sea but got hung up by the rocks which is where the body was found. The defendant then returned to the car around 9pm. On June 10th, 2014 the defendant in this case was charged with first degree murder or the lesser crime of manslaughter of Sara Marcus. At the end of this case we ask for a verdict of guilty.

No matter where they come from, no matter how much they love volunteering and fluffy bunnies, every person can break. Barry Martin just broke in the worst way possible: he broke someone else. There is substantial evidence to prove he committed this deed; he refused to answer questions, he has a violent history, and he was the last person to interact with her before she was murdered.On the date of June 7th, 2015, Sara Marcus caught Henri Ward and Barry Martin using pre-prepared answers to cheat on an exam. With the school’s enforced honor code, and the level of competition among the students, Sara knew she had to turn them in. On Sunday, June 9th, Henri and Barry went to confront Sara about the issue. After watching Sara and Barry pointlessly argue, Henri left them and went back to his car. Barry returned much later to find Henri waiting for him. Barry told Henri he “had things handled”. Barry was the only person who knew head trauma had been a primary evidence of Sara’s death.Barry had a bright, successful future going for him, and he knew it. He also knew that when he had been caught cheating, all of that promise was gone. Hello your honor my name is Joseph Koller, I represent the state of Minnesota. This unfortunate event started on June 7th and involved Barry Martin and Henri Ward cheating on the final exam of their Honors English Literature class by photocopying an unanswered copy of the test and then working to find the perfect answers over the following weeks up to the test. Both Barry and Henri aced the test but shortly after the test Sara Marcus intercepted the copy of the test with both Barry's and Henri’s handwriting on it. She knew immediately that both boys had cheated and told them that she would turn them in if they did not turn themselves in. On June 9, 2014 the defendant went to Tettegouche State Park to talk with Sara Marcus with the intent of trying to convince Sara to not talk about this cheating situation and after several minutes of vigorous arguing between Barry and Sara, Henri left the scene. Barry and Sara continued to argue and then Barry decided to pick up a heavy rock and bash Sara in the head with it, then proceeded to push her into the cove. He left the scene with Henri. Then the following morning he broke into Sara’s locker to take the papers but he never found them because Sara had turned them in the week before. Ladies and Gentlemen of the Jury, this case is about a young man who made a mistake and turned it into a tragedy. I will be calling three witnesses to the stand, Dr. Aidan Hobbs to talk about the crime scene and the body. I will then question Henri Ward to ask about the possible motives of Barry. Then I will talk to Dean Taylor Wermerskirchen to learn a little more about Barry’s past. I will prove to the jury without a reasonable doubt that Barry Martin committed manslaughter on these charges.

Hello your honor my name is Joseph Koller, I represent Barry Martin and I am here to prove that Sara Marcus’s death was an accident and in no way Barry’s fault. On June 9, 2014 Sara Marcus went to rock climb at Tettegouche State Park. In the midst of her climb session Barry Martin and Henri Ward spoke with Sara. Henri left the cove to go back to the parking lot and waited for Barry. Barry and Sara continued to interact and once Barry had finished talking to Sara he proceeded to walk away from the cove and leave the state park. Sara proceeded to climb the cove and then tragically slipped on the slick rocks, hitting her head on the rocks in one blunt force and then scraping her head across the rock knocking a palm-sized rock loose as she fell down to the rocks below drowning and her body was trapped by the boulders below later to be found be a local resident. Ladies and Gentlemen of the Jury this case is about a young man who was accused of causing an unfortunate tragedy. I will bring three witnesses to the stand. The first being Ranger Dale Plotnick who was at the Cove the night of the incident. Then I will question Dr. Sage Garcia who has some new facts that could split this case wide open. Once again the prosecutor's burden is to prove beyond a reasonable doubt that Sara Marcus was murdered. Let’s review the evidence. Dr. Hobbs concluded that she was stuck in the head, her arms were bound, and she drowned. Henri concluded that Barry was in an agitated state, was with the victim at the time of the murder, and had blood on his wrist. Barry’s testimony concluded that he was agitated, had a confrontation with the victim, but the most incriminating thing we heard was Barry’s statement to officer Kripke, “It’s sad that Sara hit her head and died.” When he said that, no one had previously made that statement, and infact he was reporting what had occurred. He hit her head and she then died. The state respectfully submits that Barry Martin committed first degree murder.

CLOSING STATEMENT - Defense

Once again, the state's burden is to prove beyond a reasonable doubt that Barry Martin is guilty of murder in the first degree and manslaughter. Now ladies and gentlemen, let’s look at the evidence. Dr. Sage testified after a post mortem examination that Sara Marcus’ death was accidental. With this I have a reasonable doubt that Barry Martin committed murder of the first degree and alternatively manslaughter. There was no eyewitness to Sara’s death. For anyone to conclude that there was a murder is purely conjecture and completely inconsistent. With Dr. Sage’s testimony, he concluded that Sara’s death was accidental, clearly creating a reasonable doubt of Barry’s guilt of first degree murder or manslaughter. The defence respectfully submits that Barry is innocent of all charges.

Ladies and gentlemen of the jury this is a case about cheating where the defendant, Barry Martin, killed the one person who would expose his dirty deeds. The evidence will show that on friday June 7th, Ms. Sara Marcus had overheard the defendant and his friend, Henri Ward, whispering in the hallway. During their conversation, the defendant removed photocopied papers from their backpack. Sara saw the papers and took them, she then realized that the papers were a copy of the test with handwritten answers on them. She immediately recognized the handwriting belonged to the defendant and Henri. As soon as the Sara realized the two had been cheating, she immediately told them that if they did not turn themselves into Dean Taylor Wermerskirchen by Monday morning, she would turn them in herself. Unknown to either Henri or the defendant, later that evening Sara delivered the photocopies to the Dean. On Sunday June 9th, Sara was rock climbing at Tettegouch Beach which is located just north of Duluth as she was known to regularly does. Later that evening, Henri and the defendant drove to the location that they knew she would be at. Once the two got to the beach, they saw the Sara climbing the cliff. Henri and the defendant went up a 40 ft ridge and lay and wait for Sara to scale that high, once she got there the physically accosted her and then they argued about Sara exposing his secret. All three of them started walking towards the cove while Sara and the defendant continued to argue. Henri then went back to the car around 7:50 pm as Sara and the defendant continued to argue.. While the two argued, Sara reaffirmed that she would turn the papers in to the dean if Henri and the defendant would not do so himself. The defendant realized that the only way to make sure that Sara would not squeal, is to shut her up permanently by doing the ultimate, to kill. He then bashed Sara's head with a hand sized rock knocking her unconscious and you will learn that the rock had Sara’s blood on it and was left on the top of a rocky shelf. The defendant, assumes she is dead, takes her down to the cove dispose of her body by pushing it out to sea. Her body did not make it to sea but got hung up by the rocks which is where the body was found. The defendant then returned to the car around 9pm. On June 10th, 2014 the defendant in this case was charged with first degree murder or the lesser crime of manslaughter of Sara Marcus. At the end of this case we ask for a verdict of guilty.

CLOSING STATEMENT - Prosecution

Once again the prosecutor's burden is to prove beyond a reasonable doubt that Sara Marcus was murdered. Let’s review the evidence. Dr. Hobbs concluded that she was stuck in the head, her arms were bound, and she drowned. Henri concluded that Barry was in an agitated state, was with the victim at the time of the murder, and had blood on his wrist. Barry’s testimony concluded that he was agitated, had a confrontation with the victim, but the most incriminating thing we heard was Barry’s statement to officer Kripke, “It’s sad that Sara hit her head and died.” When he said that, no one had previously made that statement, and infact he was reporting what had occurred. He hit her head and she then died. The state respectfully submits that Barry Martin committed first degree murder.

CLOSING STATEMENT - Defense

Once again, the state's burden is to prove beyond a reasonable doubt that Barry Martin is guilty of murder in the first degree and manslaughter. Now ladies and gentlemen, let’s look at the evidence. Dr. Sage testified after a post mortem examination that Sara Marcus’ death was accidental. With this I have a reasonable doubt that Barry Martin committed murder of the first degree and alternatively manslaughter. There was no eyewitness to Sara’s death. For anyone to conclude that there was a murder is purely conjecture and completely inconsistent. With Dr. Sage’s testimony, he concluded that Sara’s death was accidental, clearly creating a reasonable doubt of Barry’s guilt of first degree murder or manslaughter. The defence respectfully submits that Barry is innocent of all charges.

Your honor, ladies and gentleman of the jury: My name is Abbie Amundsen and today I will be representing the state of Minnesota. Sara Marcus was a popular, celebrated student at her school. She followed the rules, worked hard in school, and had goals and plans for her life. She was following the rules on June 7th when she informed Dean Taylor Wermerskirchen that Henri Ward and Barry Martin cheated on their english exam. On the 9th of June, Henry Ward and Barry Martin found Sara at Tettegouche beach where Barry tied Sara up, struck her with a rock and threw her from the cliff into the water where she died. At the conclusion of this case we will ask that the jury find Barry Martin guilty of all charges.

OPENING STATEMENT - Defense

Barry Martin is a model member of his church and star of the rowing team. Barry Martin stands here falsely accused of the very serious crime of first degree murder. What happened to Sara Marcus was a tragic accident. Sara loved to rock climb and was in general quite good at it, yet she still suffered from accidents and injuries from time to time. Leaving it very plausible that she suffered a fall while climbing at Tettegouche Beach. While Barry Martin made the regrettable choice to cheat on english exam, it is a terrible injustice to think him capable of murder. At the conclusion of the case we will ask for a verdict of not guilty.

It is evident that Barry Martin was frantic and upset over being caught cheating, Barry Martin was known for being aggressive and manipulative, and It is shown through the injuries on Sara Martins body that she was tied up, hit ,and thrown from a cliff on Tettegouche Beach. In conclusion, we would ask that you find the defendant guilty as charged. Thank you.

Ladies and gentlemen of the jury, It is evident that Barry Martin is not guilty. The injuries on the body of Sara Marcus are not injuries of someone who was assaulted. Saras injuries are consistent with a climber who suffered a terrible fall. What happened was a tragic accident, not murder. So we ask the jury to find Barry Martin not guilty.

Your honor, my name is Henry D. Holcomb, the prosecuter representing the State of Minnesota in this action. Today the State of Minnesota will prove that the defendent, Barry Martin is guilty of murder. The reason that Martin took the life of Marcus was because Sara was going to turn him in. She was going to turn Martin and Ward in to the dean. This would eliminate all chances of the two of them getting into their desired college. It was this motive that led him to take the life of Sara Marcus.

OPENING STATEMENT - Defense

Your honor, my name is Henry D. Holcomb, counsel for Barry Martin in this action. Today the defense will prove that Barry Martin is not guilty of murder. Our following witnessess will prove beyond a doubt that Martin did not kill anyone. Additionally we will prove that he in fact had no motive to kill Marcus. In fact the evidence supplied by our witnessess indicates that Marcus fell and died due to mistake made while climbing.

So you said that near the body of Marcus you found a fist sized rock, can you tell me about the rock's location? 2. You stated that during your interregaton with Martin that he knew about Marcus' head wound, had you told anyone else about that? 3. Did Martin show unease during the interrogation?Dr. Aidan Hobbs: 1. You stated that in your autopsy you found ligature marks on both of Marcus' wrists and that there have been other cases that match these marks, have there been any cases in which the marks were not due to bound wrists? 2. Additionally you stated that the rock that was found with the dried blood would have had to have been wedged against other objects to produce the laceration. Officer Kripke stated that the rock was not wedged against anything, is there any other plausible way that the rock produced that injury to her head than someone hitting her with it? 3. Finally you stated that the dried blood on the rock matched Marcus' blood correct?

You said that the cuts and bruises could have came from the surf correct? 4. Isn't falling onto a rock that just happens to be there less likely than another cause of injury? 5. Are you saying it is likely that the rock just happens to have blood that matches Marcus' blood all over it and hat it is just a coincidence?Rev. Stacey Jimenez: 1. You said Martine is repectful in church, are people normally respectful in church? 2. Can a respectful person turn into a hateful murderous person when prevoked? 3. You said Maritn seemed distraught because he cheated on a test, was this because he cheated or because he was caught? 4. Additionally you stated that Martin wanted nothing more than to follow in his parents footsteps, correct? 5. Did Martin mention anything while he was talking to you about Marcus?

In conclusion, the State of Minnesota firmly believes that Barry Martin is guilty of murder. Our witnessess have proved that Barry Martin is guilty without a reasonable doubt. Martin stole the keys to Boyd's cabinet which proves that he is ruthless and would stop at

nothing to pass the exam. This also indicates that he would have the the mental ability to kill Marcus. All the evidence indicates that Barry Martin assaulted Sara Marcus, tied her up, struck her with a rock to head causing a laceration and a skull fracture. He then proceeded to throw her into the water where she then drowned. We cannot allow this man to walk free. He took the life of a young girl in order to cover up his actions.

CLOSING STATEMENT - Defense

In conclusion, the defense firmly believes that Barry Martin is not guilty of the charges placed against him in this case. Our witnessess have testified that Barry had no motive to take the life of Sara Marcus, on the contrary our witnessess say that he in fact saved her life earlier the night of her death. Additionally our witnessess have proven that there are numerous ways that a person coud sustain the injuries that Marcus did wihout foul play. If you condemn this man, then you are condemning an innocent man to a life's sentence in prison.

He was not "a little angry" over Sara turning him in and ruining his college chances, he was extremely outraged and, given the chance, snapped and murdered an innocent and honest girl, Sara Marcus.
