The Referendum Process

• Ballots– mailed to all principals in a first class mailing on April 27, 2015

• High School Principals– Shall return the original ballot with signature no later than Friday, May

15, 2015, at 4:00 PM via regular mail. Voting is optional but return of the ballot is required.

• 7-8th Grade Principals– There is one issue for 7There is one issue for 7thth-8-8thth grade principals – 4-2-2 age grade principals – 4-2-2 age

• Share– the ballot and accompanying script, which is posted at ohsaa.org, with

all interested constituents within the school system

The Referendum Process

• Referendum Items– Approved by Board of Directors for Inclusion on Ballot– All items, if approved, become effective August 1, 2015, unless

otherwise specified by the Board. These alternative dates are denoted on the slides and on your ballot.

Outlined in Constitution Article 8

Due to the strong interest in these changes, please consider:

• Sharing this information with parents, booster members, others members of your administrative team, coaches, students, etc.

• Making information available to the public via your school website and/or directing interested individuals to the OHSAA website

• Reminding everyone that the results of the referendum vote will be posted to the OHSAA website on May 18, 2015

Issue 1B –Revise Bylaw 4-2-1 - Age

Effective Date: August 1, 2015If passed, this would amend to read:

Once a student attains the age of 20, the student will no longer be eligible for interscholastic competition notwithstanding where the 20th birthday falls in relation to the sports season.

And:Would amend exception one to strengthen the language

relative to students with disabilities to insure that:

1. Disability is defined within the Ohio Operating Standards for Ed. of Children with Disabilities and Part B of the Federal IDEIA

2. Student diagnosed contemporaneous with the events which caused him or her to be unable to meet the age standard.

4. Item “C” in the four part test is revised to stipulate that the student would not likely participate in any meaningful way or otherwise have any impact on the outcome of any contest in which he or she participates.

Issue 1B –Revise Bylaw 4-2-1 - Age

COMMENTS:1. Under current rules with the Aug 1 cutoff, many 19 year olds are

participating.2. This revision would allow all 19 year olds to play.3. Once 20, no more eligibility, including during an OHSAA

tournament, unless the student is truly disabled and ruled eligible.4. Exception one is a rule of compassion for students who would not

affect the outcome of a contest.5. Exception two is no longer needed as all students could play until

age 20.

Bylaw 4-3-1• All students participating in a school-sponsored

sport must be enrolled in and attending full-time in accordance with all duly adopted Board of Education or similar governing board policies of that school.

• Currently has eight exceptions. • In addition, new state laws have impacted this

ISSUE 2B – Bylaw 4-3-1 – Enrollment and Attendance

1. Add a note to remind readers that the transfer bylaw is in effect.2. Adjust exception 3 (community schools sponsored by a member school –

total 64 out of over 500 statewide) to permit current eligibility but expire in 2018-19 when state law provisions will be the only option for students who are enrolled in a community school = eligibility at the residential district school.

3. Add clarity to exception 5 to denote this references alternative schools sponsored by the district.

4. Adjust exception 6 – home schoolers – to affect non-public schools with partial enrollment only. All students who are exclusively home schooled are eligible only in accordance with state law.

5. Adjust exception 7 – STEM – to allow participation at the residential school when the STEM school does not sponsor a sport.

Effective Date: August 1, 2015If passed, these changes would:

Semester Bylaw 4-3-3

After a student completes the eighth grade, or is otherwise eligible for high school athletics pursuant to Bylaw 4-2-3, the student may be eligible for a period of time not to exceed eight semesters taken in order of attendance, whether the student participates or not. A student in grade 7 or 8 who attains the age of 15 before August 1 shall be eligible only at the high school level for a period not to exceed eight semesters taken in order of attendance, whether the student participates or not.

Issue 3B – Bylaw 4-3-3- Semesters

Effective August 1, 2015If passed, these changes would:

1. Mirror the changes in exception one to the age bylaw2. The disability is the primary reason why the student cannot meet the

semester requirement3. Item “C” in the four part test stipulates that the student would not likely

participate in any meaningful way or otherwise have any impact on the outcome of any contest in which he or she participates.

4. Disability is defined within the Ohio Operating Standards for Ed. of Children with Disabilities and Part B of the Federal IDEIA

5. Student diagnosed contemporaneous with the events which caused him or her to be unable to meet the age standard.

Issue 4B – Bylaw 4-7-2 - Transfer

Pursuant to Const. 8-8-1, this became effective Nov. 17, 2014 and is subject to ratification.

This change in the bylaw and Note 3 reference the new state laws relative to the non-enrolled student. The changes:1. Excuse non-public school, community school and STEM school students from the 50% sit out if they participate for their public high school in one sport and their school of attendance in a different sport.2. Does not excuse a home educated student from the transfer bylaw if that student plays for a different school after establishing eligibility at one school.

Examples• Plays FT at School A (public res. school) and BK at

the non-public school of attendance = elig. Transfer bylaw not impacted

• Attends Community School A and runs cross country; participates in wrestling at public school of residence = elig. Transfer bylaw not impacted

• Plays three years of VB at res. public school; private school now sponsors VB; must play back at private school and is eligible. Transfer bylaw not impacted.

Issue 5B – Bylaw 4-7-2 – Transfer – New Exception

8Effective August 1, 2015If passed, this change would:

1. Permit the Office to waive the 50% sit out when a student transfers to another high school to enroll in the International Baccalaureate (IB) Program

2. Require the approval of the Office for the waiver3. Provide sanctions if the student drops out of the program

including immediate ineligibility

Issue 6B – Bylaw 4-7-2 – Transfer – New Exception 9

1. Reintroduce the one-time transfer into the public high school provision which was eliminated two years ago.

2. Permit one transfer into the public high school in the parents’ residential district

3. Require the submission of the Ex. 9 form4. Stipulate that it does not apply to transfers between high

schools in multi-high school districts/systems5. Stipulate that it cannot be used to transfer from the public

high school in the district of one parent to that of the other.

Effective Date, August 1, 2015If passed, this change would:

1. Reintroduce the exception permitting a free transfer when a district drops its entire sports programs which was eliminated two years ago.

2. Require formal BOE action to completely discontinue the entire sports program

3. Require an application to the Office to restore eligibility4. Permit a transfer back to the same school upon restoration of

the sports programs provided it takes place before the start of the next school year following the school year in which the program sponsorship resumed.

Issue 8B – Bylaw 4-8-2 – Return from an

International Exchange Program

1. Remove the phrase “at the point of interruption” from the bylaw.

2. Add a statement to reinforce that the purpose of these programs is education. Thus, when students study abroad they are expected to be academically engaged and have received passing grades in five courses which count toward graduation in the last grading period of the program.

3. Reinforce that semesters of eligibility are used when studying in these programs, and students are of course encouraged to be involved in extra curricular athletics and activities.

Effective Date, August 1, 2015If passed, this change would:

Issue 9B – Bylaw 4-9 – Recruiting – Amend 4-9-2,

4-9-4 and 4-9-6

1. Permit the Office to suspend a student for up to 30 days during a recruiting investigation (4-9-2).

2. Require a coach to refrain from any communication with students at the former school if taking a new position.

3. Create a “rebuttable assumption” that if any student transfers to the new school, recruiting has taken place rendering the student ineligible for one year. (New #8 – 4-9-4). Ex. Coach’s child is transferring.

4. Require a coach to disclose any contact by a parent or other individual re. a prospective student to a school administrator and cease such contact until acceptance or enrollment.

• Const. 8-1-8,9 (p 37) – Requires return of the ballot by 4:00 PM on May 15. • Bylaw 2 – Competitive Balance and Reclassification – See note on page

39 regarding the implementation of the new system in 2016-17.• Bylaw 4-3-1 (p. 44) – New ex. 8 references the ORC mandates.• Bylaw 4-3-4 (p. 45)- Permits eligibility four semesters only for students in

grades 7-8.• Bylaw 4-3-6 – (p. 45) If student is a graduate, ineligible in spite of semesters

available.• Bylaw 4-3-7 – (p. 45) Rules for students who receive schooling outside the

US in terms of being considered a graduate.• Bylaw 4-4-1 – Notes (pp. 45-46) Accept scholarship requirements from

another state; use the grading period of the member school for students in alternative placements.

• Bylaws 4-4-4, 4-4-5 (p 47) – Added same language for 7-8th grade scholarship standards as appears in the high school standard.

• Bylaw 4-4-7 (p 47) – References other educational options as well as summer school in terms of compliance with any scholarship bylaw.

Review of Selected Const/Bylaws Approved for 2014-15

• Bylaw 4-6-3 – Residence (p. 48) – Rewrote exception 2 for better clarity in terms of maintaining continuous enrollment after the 15th day of the junior year.

• Bylaw 4-7-2 – Transfer (p. 54) - Clarified the 50% sit out consequence as INELIGIBLE for all contests until after the first 50% of the maximum allowable (Board adopted) regular season contests have been competed in any sport the student played during the 12 months preceding the transfer.– Clarified by note 2 the impact of a during season transfer (Bylaw 4-7-3)

on the calculation of this 50% provision– Permitted a 90 day grace period in exception one when one parent who

lives more than 100 miles from the former residence is unable to move at the same time as the other parent.

– Allowed the Office to waive the requirement of a court-ordered legal change of custody in exception two when the adult student (age 18) is compelled to transfer and reside with a parent in Ohio

– Added notes to clarify Exception 3– Added Exception 7 – Anti-harassment, bullying and intimidation

• Bylaw 4-9-3– Recruiting (pp. 54-55) – Permitted open houses in church or school-owned facilities; also permitted alternative public settings with a waiver request; Prohibited students attending athletic events from standing on the sidelines; running with the team; entering the locker rooms or having a meal with the squad.

• Changes in Sports Regulations for 2014-15– 7.1 & 2 –Non-Interscholastic Programs (p.66) – Clarified the

concept of non-recognized sports and non-interscholastic teams or competition.

– 13 – Ejection Procedures for Schools (p. 73) – Established the procedure for receiving notice of and responding to an ejection of a coach or student.

– 14 – Ejection for Unsporting Conduct –Players (p. 73) – Clarified that players under this suspension shall not sit on the team bench, be in the locker room, travel with the team or be affiliated in anyway during the period specified.

– 14 – Ejection for Unsporting Conduct – Coaches (p. 74) – Clarified what the coach may and may not do on the day of an ejection and during the period of suspension.

OHSAA Updates

• Changes in Sports Regulations for 2014-15– 16 – Tournaments (p 75) – Clarified how individual sports receive

team designation and clarified how schools are assigned to divisions.

– 20 – Regular Season Participation Limitation Penalty (p. 77) – Clarified that any school which exceeds the regular season contest limitation will not be allowed to play in the OHSAA tournament.

– 24 – Athletic Contest (p. 77) – Included Foundation Games and Jamborees as examples of contests.

– Keep in mind that there may be additional changes to sports regulations including amendments to these specific regulations for the 2015-16 school year.

OHSAA Updates

• Significant Changes in Specific Sports Regulations for 2014-15– All Star Games– See Baseball, Basketball, Field Hockey, Soccer,

Softball and Volleyball – Now permits an unlimited number of contests provided SR 7 is observed. Coaches may coach their own players if they are seniors and at least four schools are involved.

– Baseball and Softball– 32 playing dates permitted– Football – Running clock permitted after 1st half with scoring differential

greater than 30 points.– Volleyball – May play any non-dual (duals already permitted) varsity

match (tri, quad, tournament) in a best of five formal provided the contest is contracted in advance with all schools and officials. No contract = play best of three.
