The Economy and Housing Muddle Along Various economic reports from the government do not fill one with confidence, but at worst they suggest an economy muddling along as housing holds on to modest gains over the past several months. Single-family starts and permits advanced in November, while multifamily starts fell and multifamily permits plummeted. Congress passed, and President Obama signed into law, an extension of the 2001 and 2003 tax cuts and renewed a set of expiring housing-related tax provisions late last week. Also, the President’s deficit reduc-tion commission, along with other groups, recently proposed changes to the tax code that would significant-ly affect housing. Links to blog postings over the past two months about the recently passed tax bill and proposals to change housing-related tax treatment are provided following the latest Eye on Housing post-ings.
Housing Construction in November
November housing starts rose 4%, powered by single-family starts, which rose 7%. Multi-family starts fell 9%. Single-family building permits were up, but multifamily permits fell dra-matically, down 23%. Posted: Dec. 16
Update: Senate Passes Bill With Expiring Housing Tax Provisions Discussion of provisions within the Senate’s tax bill that affect housing. Posted: Dec. 15
Energy Prices Rise More Slowly; Rents Increase The recent rise in energy prices slowed in November, helping to hold the Consumer Price Index (CPI) to modest gains. NAHB is forecasting that inflation will remain tame over the next two years. Rents rose at their fastest rate in almost two years. Posted: Dec. 15
December NAHB/Wells Fargo Housing Market Index The December NAHB/Wells Fargo Housing Market Index (HMI) of 16 was unchanged from November. Builders remain wary of the future of the housing market over the next six months. Posted: Dec. 15
Household Balance Sheet Repair Continues Households have generally been working on increasing their net worth over the last several quarters. Even as they continue to increase the amount of their savings, their savings rate has started to fall back towards historical norms and should continue to do so. Posted: Dec. 14
Energy Costs Continue to Push Residential Building Materials Prices Up November’s PPI rose 0.8%, largely due to higher energy prices. Core PPI rose 0.3%. Resi-dential building materials were up 0.4%. Posted: Dec. 14

These are exciting times for the Builders Association of the Hudson Val-ley and for us as individuals. We are certainly coming out of one of the most challenging economies many of us have ever or will ever face. History teaches us that we are in a cyclical business and there are good times ahead. While no one knows with certainty when these good times will return we know they are coming. The BAHV is a great vehicle for each of us to use to network, advocate for our industry and look to for educational programming.
I am honored to be the BAHV President for 2011, to follow in the foot-steps of the Builders who have taken this responsibility before me. I take this responsibility seriously and look forward to a great year work-ing in close collaboration with the Staff, members and the future mem-bers we must sign up to ensure our continued success. ** Construction Fair Play Act in Effect - IMPORTANT **
As of October 26, 2010, the New York State ‘Construction Industry Fair Play Act’ is in ef-fect!!!!
The law creates a new standard for determining whether a worker is an employee or inde-pendent contractor in the construction industry. It provides new penalties for employers who fail to properly classify their employees.
New Standard: The law presumes that individuals working for an employer are employees unless they meet all three criteria below. The individual must be:
1. Free from control and direction in performing the job, both under contract and in fact
2. Performing services outside of the usual course of business for the company
3. Engaged in an independently established trade, occupation or business that is similar to
the service they perform.
Separate Business Entity: The law also contains a 12-part test to determine when a sole proprietor, partnership, corporation or other entity will be considered a “separate business entity” from the contractor for whom it provides a service. If an entity meets all of the 12 cri-teria, it will not be considered an employee of the contractor. Instead it will be a separate busi-ness that is itself subject to the new law regarding its own employees.

Penalties: An employer that willfully violates the Fair Play Act by failing to properly classify its employees will be subject to civil penalties of up to a $2,500 fine per misclassified employee for a first violation and up to $5,000 per misclassified employee for a second violation within a five-year period.
Employers also may be subject to criminal prosecution (a misdemeanor) for violations of the act with a penalty of up to 30 days in jail, up to a $25,000 fine and debarment from Public Work for up to one year for a first offense. Subsequent misdemeanor offenses would be pun-ishable by up to 60 days in jail, up to a $50,000 fine and debarment from performing Public Work for up to five years.

Jim Brooks, of Chester, has been elected to serve as President of the New York State Builders Association (NYSBA) for 2011. NYSBA is a state-wide trade association founded in 1951. The Association, along with its 16 local affiliates and partnership with the National Association of Home Builders, works to create a fa-
vorable business environment through legislative participation, as well as enhance its members’ ability to provide quality housing for all New Yorkers through its ed-ucational programs and community partnerships. Thomas S. Tripodianos is a partner at the law firm of Welby, Brady & Greenblatt, LLP. Welby, Brady & Greenblatt, LLP emphasizes the practice of Construction Law, representing general contractors, subcontractors, sureties, developers, owners, suppliers, engineers, homeown-ers and other entities connected with the construction industry in transactions, litigation, arbitration, mediation, public and private construction contracts, mechanics liens, surety law and environmental law. Welby, Brady & Greenblatt, LLP has its principal office in White Plains, New York, and also has offices in New Jersey and Connecticut. Mr. Tripodianos resides in Orange County.
Question. Lienor, filed a mechanics lien against Owner for work performed on property. The lien was based on work Lienor performed under contracts with Owner, which were provided in the verified statement. Owner demanded Lienor produce a verified statement under Lien Law §38, including the names and addresses of the subcontractors and the work performed. Lienor argues the information requested goes beyond the scope of §38. Owner argues it should be provided with more detailed information to ensure it is not "double liened." Does the Owner’s request for detailed information go beyond the scope of §38's requirements?
Answer. Yes. . Where the lien is based on a contract, nothing would be accomplished by requiring the lienor to furnish an itemiza-tion of materials and labor performed under that contract. Only those items in dispute must be provided in a detailed statement
Under Section 38 of the Lien Law, "on demand in writing" a lienor must deliver to the owner a verified statement that sets forth "the items of labor and/or material and the value thereof which make up the amount for which he claims a lien, and which shall also set forth the terms of the contract under which such items were furnished." If the lienor fails to produce this statement within five days of the demand, the lienee may petition the court for an order "directing such compliance." The intent of these provisions is to en-sure that the lienee is apprised of the detail of the lienor's claim, and of the basis for the statement of value as set forth in the lien.
Section 38, however, does not give a lienee an absolute right to a detailed statement from a lienor as to all the items for which he claims a lien. Itemization of all materials and labor is required only in a case where the lien is based on quantum meruit i.e. the rea-sonable value of the work. Where the lien is based on a contract for an agreed price, nothing would be accomplished by requiring the lienor to furnish an itemization of materials furnished and labor performed in performance of the contract. Only those items in dispute such as claims for extra work and material must be provided in the detailed statement.
Here, it appears that the lien is based on work that Lienor and its subcontractors performed pursuant to contracts with Owner's general contractor. The Verified Statement contains copies of these contracts setting forth the work performed and the agreed upon price. Lienor has also provided signed change orders to the contracts. Furthermore, Owner has not indicated that there are specific items in dispute or that Lienor is asking for quantum meruit compensation. Instead, its only argument is that it should be provided more detailed information to ensure it has not been double liened.
If, as it appears here, the claim is based on agreed upon contracts that have been performed, Lienor need only supply enough infor-mation to allow Owner to check whether it has been double liened by subcontractors of Lienor. It has no obligation to provide more information than is already in the contracts. Requiring itemization of all material, work performed, and labor rates as Owner requests would accomplish nothing. Lienor's Verified Statement includes the names of its subcontractors on which the lien is based, providing the information necessary to allow Owner to determine if it has been double liened.

NYSERDA Announces Cash Incentive to Spur Green Home Building
I am sure that many of you are aware of the NYSER-DA incentives for builders that construct certified green homes to the National Green Building Stand-ard.
Below is a short description of the incentives:
Incentives start at $5,125 for a single-family home and increase to $13,375 for an 11-unit building. The pro-gram’s guidelines include the following:
Types of Buildings: Incen ves are available to owners of new residen al or mixed-use buildings (some resi-den al space and some commercial space) or substan-ally renovated exis ng residen al buildings with 11
units or fewer, including manufactured and modular housing units that are permanently sited in New York State.

Performance Requirements: Eligible buildings must be cer fied at the Silver level or higher using the Na-onal Green Building Standard™ and meet other pro-
gram energy efficiency requirements. The Standard provides a na onally recognized, comprehensive, third-party-verified system for measuring green building performance for residen al buildings through the NAHB Research Center.
The NAHB Research Center would like to help your builders get their homes certified to the Standard so that they can qualify for the incentive. We have free program materials available at:
http://www.nahbgreen.org/News/materials.aspx for your builders, developers, and remodelers. The Re-search Center has a number of services that we offer that you may find useful. We can work with you to set up an educational session for your members on the National Green Building Standard and the Research
Center’s green certification program. A number of municipalities have asked their local HBAs to help educate them on the National Green Building Standard and we would be happy to help you in that effort.
For those of you that plan to travel to the Builders Show in January in Orlando we have planned a Green Networking Lounge on Wednesday, January 12th where you and your members can meet Research Center staff and other green building professionals. We hope that you’ll stop by while you are in Orlando.

Posting: Construction industry employers must post a notice about the Fair Play Act in a prominent and accessible place on the job site. The Commissioner of Labor will post the re-quired notice on the department’s web site within 30 days of the effective date of the law. Fail-ure to post the notice can result in penalties of up to $1,500 for a first offense and up to $5,000 for a second offense.
