We are delighted to announce that the Scottish Arbitration Centre will host the 2020 Congress of the International Council for Commercial Arbitration (ICCA) in Edinburgh. This will see the biennial gathering of the world’s preeminent arbitration practitioners come to Europe for the first time in 12 years and, furthermore, the first time ever to Scotland.

The ICCA Congress is the largest regular gathering in the field of international arbitration. It brings together around 1,000 lawyers, arbitrators, academics and other professionals. Over four days, the Congress will feature presentations, discussions and workshops at which the theory and practice of international arbitration is explored at the highest level. The Congress attracts global attention from the legal professions and industry, and receives extensive coverage in the specialist press and wider media.

The Congress

The International Council for Commercial Arbitration (ICCA) is a worldwide non-governmental organisation (NGO) devoted to promoting the use and improving the processes of arbitration, conciliation and other forms of resolving international commercial disputes.

Its activities include convening international arbitration congresses, sponsoring authoritative dispute resolution publications and promoting the harmonisation of arbitration and conciliation rules, laws, procedures and standards.

An ICCA Congress is held every second year for the presentation and discussion of papers on different aspects of international dispute resolution. These meetings attract a large number of participants from all parts of the world and have made significant contributions to the development of dispute resolution theory and practice.

The first ICCA Congress took place in Paris in 1961. Edinburgh is delighted to host the ICCA Congress in 2020 where over 1,000 delegate will be in attendance.

About ICCA

actively in the preparation of the Arbitration Rules of the United Nations Commission on International ICCA has official status as an NGO accredited by the United Nations. In that capacity, ICCA has participated

Trade Law, the UNCITRAL Conciliation Rules and the UNCITRAL Model Law on International Commercial Arbitration.

The ICCA NGO consists of Governing Board Members and Members. Governing Board Members are

recognised specialists in the field of dispute resolution. At present there are 40 Governing Board Membersand 38 Advisory Members coming from 35 different countries. ICCA is a membership-based organization with over 1000 members drawn from the ranks of dispute resolution specialists. All ICCA Members are entitled to membership benefits including listing in hard copy and electronic Membership Directories,discounts to ICCA publications and Congresses, and participation in ICCA project committees.

The Hosts

The organiser of ICCA 2020 is the Scottish Arbitration Centre. Established in 2011, the Centre promotes Scottish arbitration and Scotland to the world as a place to conduct international arbitration. It is a non-profit company limited by guarantee, made up of the Law Society of Scotland (LSS), the Chartered Institute of Arbitrators (CIArb), the Royal Institution of Chartered Surveyors (RICS), and the Scottish Ministers (SG). Sir David Edward QC is Honorary President and Hew Dundas is Vice Honorary President of the Centre. Brandon Malone is Chairman of the Board and works with other Directors Jonathan Broome (CIArb), George Burgess (SG), Shona Frame (LSS), Ysella Jago (RICS), Jan Marshall (SG), Janey Milligan (RICS) and Brandon Nolan (CIArb). Andrew Mackenzie is Chief Executive of the Centre.

The Centre offers an arbitral appointments service, where the selection of an arbitrator is made by its arbitral appointments committee, which acts independently from the Board of the Centre. It has made both domestic and international appointments in recent years. The Centre does not administer arbitrations, so is not acting as a private court at this stage. Its premises on Princes Street in Edinburgh offers modern, centrally located, and affordable facilities for arbitration, mediation and other dispute hearings, and for conferences, events and meetings. The Centre also has a specialist energy division, the International Centre for Energy Arbitration, which is developing bespoke rules for energy arbitration.

Scotland as an arbitration venue

With its distinguished legal tradition, innovative legislation and the Centre, Scotland is well placed to compete as an attractive and cost-effective venue for arbitration on the global stage.

Scotland is an English-speaking common law jurisdiction, but Scots law has developed separately from that of England, and has its roots in Roman Dutch law. It is therefore a mixed system much in the way that international arbitration might be described as such, and an example of this is our restricted approach to document discovery.

Scotland is one of Europe’s ancient nations and arbitration has been practiced in Scotland for centuries, but in international arbitration terms, it is very much an emerging jurisdiction. It has been building the foundations of international arbitration in Scotland since the coming into force of the modern Arbitration (Scotland) Act 2010. The Act was modelled on the English Act 1996, but with improvements, such as strict provisions on confidentiality and anonymity through the courts. Scotland is also an open arbitral jurisdiction, so there are no limits on who may appear as counsel in an arbitration, or as an arbitrator, with supportive courts.

As a venue, Scotland is very easily accessible. London is an hour away by plane, but can also be reached by rail with regular trains. There are direct flights to almost all of the major European cities, as well as to New York, Washington DC, Boston, Chicago, Toronto, Abu Dhabi and Doha. Through easy to reach hub airports there are connecting flights to the rest of the world. There are also significant cost advantages compared to some more established arbitration seats.

The Edinburgh International Conference Centre (EICC) is a purpose-built, world class congress venue, located in the heart of Edinburgh’s financial district.
