The Maharashtra Welfare Officers (Duties, Qualificationsand Conditions of Service) Rules, 1966

FACTORIES ACT, 1948

No. FAC/1085/(9782)Lab–4.– In exercise of the powers conferred by sub-section (1) ofsection 85 of the Factories Act, 1948 (LXIII of 1948), the Government of Maharashtrahereby declares that all the provisions of the said Act shall apply to all premises or placeswherein manufacturing processes involving use, storage, handling, processing ofhazardous chemicals, which are toxic or highly inflammable or explosive or wherein suchsubstances are likely to be generated or given out are carried out notwithstanding.

(i) the number of persons employed therein, or whether the power is used therein in aid ofthe manufacturing process thereat;

(ii) that the persons working therein are not employed by the owner thereof but areworking with the permission of, or under agreement with, such owner:

Provided that, the manufacturing process is not being carried on by the owner only withthe aid of his family.

FACTORIES ACT, 1948

No. FAC/1082/8583/Lab-4.– In exercise of the powers conferred by sub-section (1) ofsection 85 of the Factories Act, 1948 (LXIII of 1948), the Government of Maharashtrahereby declares that all the provisions of the said Act shall apply to every premises orplaces including the precincts thereof, wherein any of the manufacturing processesmentioned in the schedule appended hereto is carried on with or without the aid of poweror is so ordinarily are carried on notwithstanding that–

(i) the number of persons employed therein is less than ten, if working with the aid ofpower; or (ii) the persons working therein are not employed by the owner thereof butare working with the permission of, or under agreement with, such owner:

Provided that the manufacturing process is not being carried on by the owner only with theaid of his family.

Explanation: For the purposes of this notification “flammable solvent” means any liquidhaving a flash point below 650F. or which can form explosive mixture due toprocess conditions.


SCHEDULE

1. Any of the following manufacturing processes when carried out using flammablesolvent, namely:–

(i) Paints, Varnishes, Lacquers or thinners.

(ii) Nail Polish, or Cosmetic Sprays,

(iii) Rubber beadings or rubber goods,

(iv) Artificial leather,

(v) Adhesive Tapes,

(vi) Linoleum, rexins or water proof fabrics,

(vii) Wall paper;

(viii) Metalizing Plastic or other goods,

(ix) Cleaning of fabrics or any other material.

2. Manufacture of textile auxiliaries by process of emulsification of silicon oil.

3. Manufacture of nitro cellulose paints.

4. Process involving use of ethylene oxide.

5. Manufacturing processes involving any chemical reaction such as nitration,amination, sulphonation, halogenation, polymerisation, isomerisation or aroma–tization.

6. Manufacture of chlorates, or perchlorates, or peroxide or salts of any of these.

17. Any process involving use of pressure vessels except air receiver tanks having airunder pressure.

8. Rotegravure, Printing Processes.

9. Manufacture of metallic powder of aluminium, nickel or zinc.

10. Pulverisation of sulphur, carbon, starch, chlorates or perchlorates.

11. Distillation of organic solvents or chemicals.

Provided that the manufacturing process is not carried on by the owner only with the aid ofhis family.

For a period of twelve months from dayon which more than four persons areemployed or were employed.

2. Every room or shed wherein the manu–facturing process of weaving cloth onpowerloom or any process preparatorythereto is carried on by only oneestablishment.

Explanation.– For the purpose of this notification, the expression “establishment”includes any business conducted whether by an individual, firm, company or otherassociation or body of persons.

FACTORIES ACT, 1948

No. FAC.1680/6765/Lab–4.– In exercise of the powers conferred by sub-section (1) ofsection 85 of the Factories Act, 1948 (LXIII of 1948), the Government of Maharashtrahereby declares that all the provisions of the said Act shall apply to a ‘saw mill’ or ‘woodwork-shop’ wherein the manufacturing process is carried on with the aid of power or is soordinarily carried on, notwithstanding that,–

(i) the number of persons employed therein is less than ten or;

(ii) the persons working therein are not employed by the owner thereof but areworking with the permission of or under agreement with such owner;

Provided that the manufacturing, process is not being carried on by the owner only withthe aid of his family.

Explanation.– For the purposes of this notification,–

(i) ‘saw mill’ or ‘wood work-shop’ means any place or premises including theprecincts thereof, wherein wood, in any form, is used in the manufacturingprocess, and the manufacturing process is carried on with the aid of poweroperated wood-working machinery.

(ii) ‘wood-working machinery’ means a circular saw, band saw, log saw, resawingband saw, planning machine, chain mortising machine, vertical spindle mouldingmachine and includes any other kind of machine operating on wood or workby power.

S.O. 961 (E) :– In exercise of powers conferred by sub-section (2) of section 1 of theFactories (Amendment) Act, 1987 (20 of 1987), the Central Government herebyappoints.–

(i) the first day of December 1987; as the date on which sections 2, 3, 4, (so far as it relates to new section 7A) 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20 (so far as itrelates to new sections 41A, 41B, 41C, 41D, 41E, 41G, and 41H), 21, 22, 23, 24, 25,26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44 45 (so far as itrelates to the First Schedule) and 46; and

(ii) the first day of June, 1988, as the date on which sections 4 (so far as it relates to newsection 7B), 20 (so far as it relates to new section 41F including the Schedule referredto therein) and 45 (so far as it relates to the Second Schedule).

Shall come into force.

(Notification under Section 8)

No. FACT 10, 2001/4269/684/LAB-4.– In exercise of the powers conferred bysub-sections (1), (2), (2A), (6) and (7) of section 8 of the Factories Act, 1948 (63 of 1948),and in supersession of all the previous notifications issued in this behalf, the Governmentof Maharashtra hereby:–

(1) appoints each of the Officers in the Directorate of Industries Safety and Healthmentioned in column 2 of the Schedule hereto, to be the Inspector, the Chief Inspector, the Joint Chief Inspector, the Deputy Chief Inspector or other Officer to assist theChief Inspector, as the case may be as shown against each such Officer in column 3thereof;

(2) assigns to each of them the local limits as shown against each of them in column 4 ofthe said Schedule, within which they shall exercise their powers;

(3) specifies against each of them in column 5 of the said Schedule the authority to whicheach of them shall be officially subordinate; and

(4) declares each of the Inspectors specified in column 6 of the said Schedule to be theInspector to whom prescribed notices in respect of factories situated in the areasspecified against each of them in column 7 of the said Schedule, shall be sent.

The Joint Chief Inspector and the Deputy Chief Inspector appointed by this Notificationunder sub-section (2A) to section 8 of the said Act shall exercise the following powers ofthe Chief Inspector, namely:–

(1) Approval of plans under section 6 of the Factories Act, 1948 read with rule 3 of theMaharashtra Factories Rules, 1963.

(2) Disposal of applications for amendment of licence under Rule 7, of the MaharashtraFactories Rules, 1963.

(3) Disposal of applications for renewal of licence under Rule 8 of Maharashtra FactoriesRules, 1963, and

(4) Power to make exempting orders under section 65(2) of Factories Act, 1948.

FACTORIES ACT, 1948

In exercise of the powers conferred by sub-section (1) of section 85 of the Factories Act,1948 (LXIII of 1948), the Government of Maharashtra hereby amends Government Notification, Industries, Energy and Labour Department, No. FAC. 1082/8583/Lab-4,dated the 1st July 1985, as follows, namely:–

In the Schedule appended to the said notification, for entry 7, the following shall besubstituted, namely:

“7. Any process involving use of pressure vessels, except air receiver tanks having airunder pressure”.

In exercise of the powers conferred by clause (i) of sub-section (1) of section 40-B of theFactories Act, 1948 (LXIII of 1948), the Government of Maharashtra hereby requires that every factory in the State wherein one thousand or more workers are ordinarilyemployed, the occupier shall, employ Safety Officers as specified in column 3 of theSchedule hereto for the number of workers mentioned against them in column 2 thereof:

FACTORIES ACT, 1948

In exercise of the powers conferred by section 112 of the Factories Act, 1948 (LXIII of1948) and of all other powers enabling it in that behalf, the Government of Maharashtrahereby makes the following rules, further to amend the Maharashtra Welfare Officers(Duties, Qualifications and Conditions of Service) Rules, 1966, the same having beenpreviously published as required by section 115 of the said Act, namely:–

1. These rules may be called the Maharashtra Welfare Officers (Duties, Quali–fications and Conditions of Service) (Amendment) Rules, 1988.

2. In the Maharashtra Welfare Officers (Duties, Qualifications and Conditions ofService) Rules, 1966, for the words “Commissioner of Labour” wherever they occurthe words “Chief Inspector of Factories” shall be substituted.

FACTORIES ACT, 1948

No. FAC–2096/(556)Lab.-4.– In exercise of the powers conferred by sub-section (1) ofsection 85 of the Factories Act, 1948 (63 of 1948), the Government of Maharashtra herebydeclares that all the provisions of the said Act shall apply to all places or premises, wherein handling or processing of asbestos, manufacture of any article or ancillary products ofasbestos, and any other process of manufacture, in which asbestos is used in any form, iscarried on, notwithstanding that,–

(i) the number of persons employed therein is less than ten; if working with the aid ofpower; and

(ii) the number of persons employed therein is less than twenty if working without the aidof power:

Provided that the manufacturing process is not being carried on by the owner only with theaid of his family.

FACTORIES ACT, 1948

No. FAC 1091/1837/Lab-4.– In exercise of the powers conferred by sub-sections (1), (2)(2-A), (6) and (7) of section 8 of the Factories Act, 1948 (63 of 1948), and in supersessionof all the previous notifications issued in this behalf, the Government of Maharashtrahereby....

(1) appoints each of the Officers in the Inspectorate of Factories mentioned in column 2 of the Schedule hereto to be the Inspector, the Chief Inspector, the Deputy ChiefInspector or other officer to assist the Chief Inspector, as the case may be, as shownagainst each such officer in column 3 thereof;


(2) assigns to each of them the local limits as shown against each of them in column 4 ofthe said Schedule, within which they shall exercise their powers;

(3) specifies against each of them in column 5 of the said Schedule the authority to whicheach of them shall be officially subordinate; and

(4) declares each of the Inspectors specified in column 6 of the said Schedule to be theInspector to whom prescribed notices in respect of factories situated in the areasspecified against each of them in column 7 of the said Schedule shall be sent.

2. The Deputy Chief Inspector appointed by this Notification under sub-section (2-A) ofsection 8 of the said Act shall exercise the following powers of the Chief Inspector,namely:–

(1) Approval of plans under section 6 read with Rule 3 of the Maharashtra FactoriesRules, 1963.

(2) Disposal of applications for amendment of licence under Rule 7.

(3) Disposal of applications or renewal of licence under Rule 8 of MaharashtraFactories Rules, 1963.

(4) Power to make exempting orders under section 65(2) of the Factories Act, 1948.

FACTORIES ACT, 1948.

No. FAC-2011/CR-256/LAB-4.-In exercise of powers conferred by sub-section (1) ofSection 85 of the Factories Act, 1948 (LXIII of 1948), the Government of Maharashtrahereby declares that all the provisions of the said Act shall apply to every premises orplaces including the precincts thereof, wherein any of the manufacturing processesmentioned in the Schedule appended hereto is carried on with or without the aid of poweror is so ordinarily carried on, now withstanding that-

(i) the number of persons employed therein is less than ten, if working with the aid ofpower and less than twenty, if working without the aid of power; or

(ii) the persons working therein are not employed by the owner thereof but are workingwith the permission of, or under agreement with, such owner,

Provided that, the manufacturing process is not being carried on by the owner with the aidof his family.

SCHEDULE

1. Any of manufacturing process which involves use, handling and storage of anymaterial involving any form of Silica or dust containing any form of Silica is used,generated or formed in a process;

2. Any of the process mentioned below are carried on, namely:-

(i) Cutting or manipulation of stone, granite or marble;

(ii) Stone crushing;

(ii) Glass manufacturing;

(iv) Cement Manufacturing;

(v) Tiles manufacturing;

(vi) Moulding or Casting manufacturing;

(vii) Cleaning of casting;

(viii) Murmure, popcorn etc. making;

(ix) Sand paper, Grind wheel, Electrical insulator, Pottery Manufacturing;
