TheCaliforniaRegionalWaterQualityControlBoard,NorthCoastRegion(hereinafterRegionalWaterBoard),finds:
A. BasisandRationaleforRequirements.TheRegionalWaterBoarddevelopedtherequirementsinthisOrderbasedoninformationsubmittedaspartofthePermittee’sapplicationforpermitrenewal,monitoringdatasubmittedduringthetermofthePermittee’spreviousOrder,andotheravailableinformation.TheFactSheet(AttachmentD)containsfacilityinformation,legalauthorities,andrationaleforOrderrequirements.AttachmentsAthroughDareherebyincorporatedintothisOrderandconstitutepartoftheFindingsforthisOrder.
B. BackgroundandFacilityDescription.TheTownofSamoa(Town)isservedbytwodisposalsystems;anEasternSystemserving75homes,thedowntownretailareaandtheSamoaCookhouse;andaWesternSystemserving25homes.Priorto1985,neitherofthetreatmentanddisposalsystemswasregulatedbytheRegionalWaterBoard.In1985,theWesternSystemwasupgradedfromaponddisposalsystemtoaseptictankandleachfielddisposalsystemandOrderNo.85‐40wasissuedtoLouisianaPacificCorporation,thepropertyowner.In2001,theRegionalWaterBoardissuedOrderNo.R1‐2001‐62tothenewowner,SamoaPacificGroup,LLCthatincludedboththeEasternandWesternSystems.ThiswasthefirsttimethattheEasternSystemwaspermittedbytheRegionalWaterBoard.

TheEasternSystemconsistsoftwobarkfiltersatoplargeseptictanksfortreatment.Effluentdischargestoanunlinedsurfaceimpoundment.Fromtheimpoundment,effluentdischargestoapercolation/infiltrationarea.
OnJanuary23,2013thePermitteesubmittedaReportofWasteDischarge(ROWD)toupgradetheexistingdisposalsystems.ThePermitteeisproposingtosubdivideandredeveloptheTownintwomainPhases.Phase1oftheMasterPlancallsforrehabilitatingtheexistinghomesandpossiblybuildingseveralnewresidenceswhilePhase2callsfornewhomesaswellasnewcommercialandindustrialbusinessparks.TheROWDstatesthatthebarkfiltersareinoperativeandonlytheseptictanksarefunctioning,resultinginprimary‐treatedwastewaterbeingsenttoanunlinedpondfordisposal.
ThisOrderrequiresinstallationofanewWWTF.Aspartoftheinitialphaseofconstruction/redevelopment,theexistingEasternWWTFwillbeabandonedandanewWWTFinstalled.ThenewWWTFwillbeconstructedeither:1)accordingtothetimeschedulecontainedinthisOrder;2)concurrentwithrehabilitatingthefirstgroupofexistinghomes,or;3)priortocompletinganynewunits.
ThenewWWTFwillconsistofseptictankstoremovesolids,retrofittingtheexistingpondwithalinerforuseasanoxidationpondandequalizationbasin,followedbyrecirculatingtextilefilterssuppliedbyOrencoSystems,Inc.,disinfectionanddisposaltoland.ThenewWWTFwilltreatwastewatertoadvancedsecondarystandards.SurfacedisposalofwastewatertothecurrentpercolationareawillbehaltedonceanewWWTFisconstructed.
TheproposedOrderincludesatimescheduletoprovideadditionalinformationfortheWWTFdesign,supplyappurtenantinformationandconductgroundwatermodelling.ThescopeofthisOrderincludes:
1. Short‐termoperationofthecurrentWWTFuntilanewWWTFisconstructed.2. OperationsofthenewWWTFduringPhase1ofredevelopment.
CurrentcombinedflowratesfortheEasternandWesternsystemsare17,000‐25,000gallonsperdayasaveragedryweatherflow.ThisOrderdoesnotallowanyincreaseinwastewaterflowratesbeyondcurrentconditions.Beforeconstructionofanynewresidencesandincreasingwastewaterflowrates,thePermitteewillconductagroundwatermodellingstudytoevaluatethepotentialimpactongroundwaterfromincreasedflowsandmodifiedeffluentlimits.AnyproposaltoincreaseflowratesoverthecurrentconditionswillrequireanamendedReportofWasteDischargeandsubsequentamendmentoftheWasteDischargeRequirements.ThisOrderalsodoesnotincludePhase2development.Additionalbackgroundinformation,includingadescriptionoftheexistingandproposedfacilityisincludedinAttachmentD.
C. CaliforniaEnvironmentalQualityAct(CEQA).Thisproject(currentoperationsandPhase1)isexemptfromprovisionoftheCaliforniaEnvironmentalQualityAct(PublicResourcesSection2100et.seq)becauseitconsistsoftheoperation,repair,maintenance,permitting,leasing,licensingorminoralterationofanexistingfacilityinvolvingno,ornegligible,expansionofuseundertheCaliforniaCodeorRegulations,Title14,Section

15301.TheCountyofHumboldtcertifiedtheFinalMasterEnvironmentalImpactReportonOctober27,2009andapprovedaLocalCoastalPlanAmendmentonJuly17,2012.
D. NotificationofInterestedParties.TheRegionalWaterBoardhasnotifiedthePermitteeandinterestedagenciesandpersonsofitsintenttoprescribeWasteDischargeRequirements(WDRs)forthedischargeandhasprovidedthemwithanopportunitytosubmittheirwrittencommentsandrecommendations.
E. ConsiderationofPublicComment.TheRegionalWaterBoard,inapublicmeeting,heardandconsideredallcommentspertainingtothedischarge.
III. DISCHARGEPROHIBITIONS
A. Thedischargeofwastewaterfromnon‐domesticsources,suchasrecreationalvehicle(RV)waste,septagewaste,andcommercialorindustrialwaste,isprohibited.Smallbusinessesthatarecompatiblewithhistoricuseswithinthedowntownareamaybeallowed,conditionaluponcompletingafeasibilitystudymeetingtherequirementsofSectionVIII.GENERALPROVISIONS,G.Thisstudyshallbesubmittedto,andapprovedby,theExecutiveOfficer.
B. ThedischargeofanywastenotdisclosedbythePermitteeornotwithinthereasonablecontemplationoftheRegionalWaterBoardisprohibited.
C. Creationofpollution,contamination,ornuisanceasdefinedbySection13050oftheWaterCodeisprohibited.
D. Thedischargeofuntreatedorpartiallytreatedwaste(receivingalowerleveloftreatmentthandescribedinFindingII.B)fromanywherewithinthetreatment,collectionordisposalsystemisprohibited.
E. Thedischargeofwastetolandthatisnotownedby,orunderagreementtouseby,thePermitteeisprohibited.
F. Thedischargeofwaste,includingsludgeorsolidwaste,atanypointnotdescribedinTable2orauthorizedbyapermitisprohibited.
G. TheaveragedailydryweatherflowofwastewatertotheWesternSystemshallnotexceed7,500gallonsperday.TheaveragedailydryweatherflowintotheEasternSysteminexcessof17,000gpd,asdeterminedfromthelowestconsecutive30‐daydailyflow,or32,000gpdaswetweatherflowisprohibited.
H. TheaveragedailydryweatherflowofwasteintothenewWWTF,measuredasflowintotheOrencoAXMaxunits,inexcessof17,000gpd,isprohibited.Dryweatherflowwillbedeterminedfromthelowestconsecutive30‐daydailyflow.Averagewetweatherflowinexcessof32,000gpd,asdeterminedforanycalendarmonth,isprohibited.

G. SolidsHandling.Allcollectedsludge,greaseandsolidwasteshallberemovedfromscreens,sumps,ponds,andtanksasneededtoensureoptimalplantoperationanddisposedofinaccordancewithSECTIONIV.SOLIDSDISCHARGESPECIFICATIONS.
VI. SOLIDSDISCHARGESPECIFICATIONS
Sludge,asusedinthisOrder,meansthesolid,semisolid,andliquidresiduesremovedduringprimary,secondary,oradvancedwastewatertreatmentprocesses.Solidwastereferstogritandscreenings,scum,orgreasegeneratedduringpreliminarytreatment.Biosolidsaresludgethathasbeentreated,testedandshowntobecapableofbeingbeneficiallyusedpursuanttoFederalandStateregulationsasasoilamendmentforagricultural,silviculturalandlandreclamationactivities.
A. LandapplicationofbiosolidsisnotcoveredorauthorizedbythisOrder.BiosolidsthatareappliedtolandwithintheNorthCoastRegionshallcomplywithStateWaterBoardOrderNo.2004‐0012‐DWQ(GeneralWasteDischargeRequirementsfortheDischargeofBiosolidstoLandasaSoilAmendmentinAgricultural,Silvicultural,HorticulturalandLandReclamationActivities)orotherpermitsissuedbytheRegionalWaterBoard.

B. Use,storageanddisposalofsewagesludgeorsolidwasteshallcomplywithexistingfederalandstatelawsandregulations,includingpermittingrequirementsandtechnicalstandardscontainedin40CFR503.
C. Sixtydaysinadvanceofanyproposedchangeintheuse,storage,ordisposalof,sludgeandsolidwastefrompreviouslyapprovedpractices,thePermitteeshallsubmitaproposaltotheExecutiveOfficerforapproval.Theproposalwillincludethereuse,disposalorstoragelocation,wastecharacterization,asneeded,andhandlingpracticestoprotectwaterquality.
D. Sludgeandsolidwastestoragefacilitiesshallbedesignedandmaintainedtopreventwashoutorinundationfromatsunami,orastormwithareturnfrequencyof100years.
VII. RECEIVINGWATERLIMITATIONS–GROUNDWATER
A. Thecollection,treatment,storage,anddisposalofwastewatershallnotcauseorcontributetoastatisticallysignificantdegradationofgroundwaterqualityunlessatechnicalevaluationisperformedthatdemonstratesthatanydegradationthatcouldreasonablybeexpectedtooccur,afterimplementationofallregulatoryrequirementsandreasonablebestmanagementpractices,willnotviolategroundwaterqualityobjectives,orcauseimpactstobeneficialusesofgroundwater.
B. Thecollection,treatment,storageanddisposalofthetreatedwastewatershallnotcauseorcontributetolevelsofchemicalconstituentsingroundwaterthatexceedthelevelsspecifiedinTitle22,Division4,Chapter15,Article4,Section64435oftheCaliforniaCodeofRegulationsorlistedinTable3‐2oftheBasinPlan.
C. Thecollection,treatment,storageanddisposalofthetreatedwastewatershallnotcauseorcontributetolevelsofradionuclidesingroundwaterinexcessofthelimitsspecifiedinTitle22,Division4,Chapter15,Article5,Section64443oftheCaliforniaCodeofRegulations.
D. Thecollection,treatment,storage,anddisposalofwastewaterorrecycledwatershallnotcausegroundwatertocontaintaste‐orodor‐producingsubstancesinconcentrationsthatcauseanuisanceoradverselyaffectbeneficialuses.
E. Wheretheexistingorpotentialbeneficialuseofgroundwaterincludesdomesticandmunicipalsupply(MUN),thecollection,treatment,storageanddisposalofthetreatedwastewatershallnotcausethemedianconcentrationofcoliformorganismsoverany7‐dayperiodtoexceed1.1MPNper100millilitersor1colonyper100milliliters.
VIII. GENERALPROVISIONS
A. Availability.AcopyofthisOrderandtheassociatedMonitoringandReportingProgramshallbemaintainedatthefacilityandbeavailableatalltimestooperatingpersonnel.

B. Enforcement.ThePermitteeshallimplementtheprojectasdescribedinthisOrder.ViolationofanyrequirementscontainedinthisOrdermaysubjectthePermitteetoenforcementaction,includingcivilliability,undertheWaterCode.
C. Severability.Provisionsofthesewastedischargerequirementsareseverable.Ifanyprovisionoftheserequirementsisfoundinvalid,theremainderoftheserequirementsshallnotbeaffected.
D. SanitarySewerandOverflows.OnMay2,2006,theStateWaterBoardadoptedStateWaterBoardOrderNo.2006‐0003‐DWQ,StatewideGeneralWDRsforSanitarySewerSystems.OrderNo.2006‐0003‐DWQrequiresthatallpublicagenciesthatcurrentlyownoroperatesanitarysewersystemsapplyforcoverageundertheGeneralWDRsbyNovember2,2006.OnFebruary20,2008,theStateWaterBoardadoptedOrderNo.WQ‐2008‐0002‐EXECAdoptingAmendedMonitoringandReportingRequirementsforStatewideGeneralWasteDischargeRequirementsforSanitarySewerSystems.
1. BeginningonDecember1,2017,orthecompletiondateofthenewWWTF,thePermiteewillreplaceandrepairtheexistingcollectionsystemoverafiveyearperiodcompletingtwentypercentofthecollectionsystemperyear.
2. Within30daysofCSDformation,thePermitteeshallnotifytheCSDinwritingofitsresponsibilitytofileforcoverageunderOrderNos.2006‐0003‐DWQandWQ‐2008‐0002‐EXECandanyfuturerevisionstheretoforoperationofitswastewatercollectionsystem.
3. ThePermitteeshalltakeallfeasiblestepstohaltspillsandsanitaryseweroverflows(SSOs)assoonaspossible.Allreasonablestepsshouldbetakentocollectspilledmaterialandprotectthepublicfromcontactwithwastesorwaste‐contaminatedsoilorsurfaces.
ThePermitteeshallreportorally,andinwriting,totheRegionalWaterBoardstaffallSSOsandunauthorizedspillsofwaste.SpillnotificationandreportingshallbeconductedinaccordancewiththeMonitoringandReportingProgram.
E. OperationandMaintenance.ThePermitteeshallatalltimesproperlyoperateandmaintainallfacilitiesandsystemsoftreatmentandcontrol(andrelatedappurtenances)thatareinstalledorusedbythePermitteetoachievecompliancewiththisOrder.Properoperationandmaintenanceincludesadequatelaboratorycontrolandappropriatequalityassuranceprocedures.ThisprovisionrequirestheoperationofbackuporauxiliaryfacilitiesorsimilarsystemsthatareinstalledbyaPermitteeonlywhennecessarytoachievecompliancewiththeconditionsofthisOrder.
ThePermitteeshallmaintainanupdatedOperationandMaintenanceManual(O&MManual)forthefacility.ThePermitteeshallupdatetheO&MManual,asnecessary,toconformtochangesinoperationandmaintenanceoftheWWTF.TheO&MManualshallbereadilyavailabletooperatingpersonnelon‐site.TheO&MManualshallincludethefollowing:
1. Adescriptionofthefacility’stableoforganizationshowingthenumberofemployees,dutiesandqualifications,andplantattendanceschedules(daily,weekendsand

holidays,part‐time,etc.).Thedescriptionshouldincludedocumentationthatthepersonnelareknowledgeableandqualifiedtooperatethetreatmentfacilitysoastoachievetherequiredleveloftreatmentatalltimes.
2. Adetaileddescriptionofsafeandeffectiveoperationandmaintenanceoftreatmentprocesses,processcontrolinstrumentation,andequipment.
3. Adescriptionoflaboratoryandqualityassuranceprocedures.
4. Allprocessandequipmentinspectionandmaintenanceschedules.
5. Descriptionofsafeguardstoassurethat,shouldtherebereduction,loss,orfailureofelectricpower,thePermitteewillbeabletocomplywithrequirementsofthisOrder.
6. Adescriptionofpreventive(fail‐safe)andcontingency(responseandcleanup)plansforcontrollingaccidentaldischarges,andforminimizingtheeffectofsuchevents.Theseplansshallidentifythepossiblesourcesofaccidentaldischarges,untreatedorpartiallytreatedwastebypass,andpolluteddrainage.
F. ChangeinDischarge.ThePermitteeshallpromptlyreporttotheRegionalWaterBoardanymaterialchangeinthecharacter,location,orvolumeofthedischarge.Newormodifiedstructuresforthetreatmentorstorageofwastewaterortreatedeffluentshallbeconstructedinamannerthatprotectsgroundwaterandsurfacewater.ThePermitteeshallsubmitdesignproposalstotheRegionalWaterBoardExecutiveOfficerforreviewandapprovalpriortoconstructionanddemonstratethatthestructurescomplywiththeWaterCodeandappropriateSectionsofTitle27oftheCaliforniaCodeofRegulations.Ponddesignandoperationplanmustincludefeaturesandbestmanagementpractices(BMPs)toprotectgroundwaterandpreventexceedancesofgroundwaterqualityobjectives.
G. EvaluationofNon‐DomesticWastewater.Ninetydayspriortostartupofanynewbusinessgeneratingnon‐domesticwastewater,thePermitteewillnotifytheExecutiveOfficerinwritingandprovideanevaluationtodetermineiftheWWTFmayacceptthewastestream.Theproposalwillincludeacharacterizationofthewastestream,theWWTF’sabilitytotreatthewastestream,theWWTF’scapacitytoacceptthewastestream,e.g.flowratesincreases,andanypretreatmentproposed.UponacceptancebytheExecutiveOfficer,theWWTFmayacceptthiswastestreamprovidedapprovedpretreatmentandmonitoringareestablished.Thisprovisionislimitedtosmallbusinessesthatwerehistoricallypresentinthedowntownwithsmalldailyflowratesandisnotintendedforindustrialorcommercialwastehavingcharacteristicssignificantlydifferentthandomesticwastewater.
H. ChangeinOwnership.IntheeventofanychangeincontrolorownershipoflandorwastedischargefacilitiespresentlyownedorcontrolledbythePermittee,thePermitteeshallnotifythesucceedingowneroroperatorofexistenceofthisOrder,andthestatusofthePermittee'sannualfeeaccount;acopyofwhichshallbeforwardedtotheRegionalWaterBoard.

J. MonitoringandReporting.ThePermitteeshallcomplywiththeMonitoringandReportingPrograminAttachmentCandanymodificationstothesedocumentsasspecifiedbytheRegionalWaterBoardExecutiveOfficer.Chemical,bacteriological,andbioassayanalysesshallbeconductedatalaboratorycertifiedforsuchanalysesbytheStateDepartmentofPublicHealthshallconformtoStateDepartmentofPublicHealthguidelines.
K. RecordsRetention.ThePermitteeshallmaintainrecordsofallmonitoringinformation,includingcalibrationandmaintenancerecordsandallstripchartsrecordingsforcontinuousmonitoringinstrumentation,copiesofallreportsrequiredbythisOrder,andrecordsofalldatausedtocompletetheapplicationforthisOrder,foraperiodofatleastthree(3)yearsfromthedateofthesample,measurement,reportorapplication.ThisperiodmaybeextendedbyrequestoftheRegionalWaterBoardExecutiveOfficer.
L. SignatoryRequirements.AllReportofWasteDischargeapplicationssubmittedtotheRegionalWaterBoardshallbesignedbyaprincipal,ExecutiveOfficer,rankingelectedofficial,orresponsiblecorporateofficer.
1. Forpurposesofthisprovision,aresponsiblecorporateofficermeans:
a. Apresident,secretary,treasurer,orvicepresidentofthecorporationinchargeofaprincipalbusinessfunction,oranyotherpersonwhoperformssimilarpolicyordecisionmakingfunctionsforthecorporation;or

M. Inspections.PermitteeshallpermitauthorizedstaffoftheRegionalWaterBoardthe
following:
1. Entrancetothepremisesinwhichtreatment,collectionormanagementofwasteoccurs,whereaneffluentsourceislocatedorinwhichanyrecordsrequiredbythisOrderarekept;
2. AccesstoinspectandcopyanymonitoringequipmentorrecordsrequiredforcompliancewithtermsandconditionsofthisOrder;and
3. Accesstosampleanydischargeormonitoringlocationassociatedwiththefacility.
N. Noncompliance.IntheeventthePermitteeisunabletocomplywithanyoftheconditionsofthisOrderduetobreakdownofwastetreatmentequipment,accidentscausedbyhumanerrorornegligence,orothercausessuchasactsofnature,thePermitteeshallnotifytheRegionalWaterBoardExecutiveOfficerbytelephoneassoonasitoritsagentshaveknowledgeoftheincidentandconfirmthisnotificationinwritingwithinfive(5)businessdaysofthetelephonenotification.Thewrittennotificationshallincludepertinentinformationexplainingreasonsforthenoncomplianceandshallindicatethestepstakentocorrecttheproblemandthedatesthereof,andthestepsbeingtakentopreventtheproblemfromrecurring.
O. RevisionofRequirements.TheRegionalWaterBoardwillreviewthisOrderperiodicallyandmayreviserequirementswhennecessary.
P. OperatorCertification.SupervisorsandoperatorsofwastewatertreatmentplantsshallpossessacertificateofappropriategradeinaccordancewithTitle23,CaliforniaCodeofRegulations,Section3680.TheStateWaterBoardmayacceptexperienceinlieuofqualificationtraining.Inlieuofaproperlycertifiedwastewatertreatmentplantoperator,theStateWaterBoardmayapproveuseofawatertreatmentplantoperatorofappropriategradecertifiedbytheStateDepartmentofHealthServiceswherewaterreclamationisinvolved.
Q. AdequateCapacity.IfthePermittee’swastewatertreatmentplantwillreachcapacitywithin4years,thePermitteeshallnotifytheRegionalWaterBoard.Acopyofsuchnotificationshallbesenttoappropriatelocalelectedofficials,localpermittingagencies,andthepress.Factorstobeevaluatedinassessingreservecapacityshallinclude,ata

CompliancewiththeeffluentlimitationscontainedinSectionIVofthisOrderwillbedeterminedasspecifiedbelow.
A. AverageMonthlyEffluentLimitation(AMEL)

I. SUMMARY
TheTownofSamoaisservedbytwodifferenttreatmentanddisposalsystems.ThelargestsystemisindisrepairanddischargesprimaryeffluenttoanunlinedpondinasandduneenvironmentontheSamoaSpit.Thedepthtogroundwaterisunknownandmonitoringwellstoevaluatetheimpactstogroundwaterhavenotbeeninstalled.ThePermitteeisproposingtoredeveloptheTowninphases.Constructionofanewwastewatertreatmentfacilitytoreplacetheexistingdisposalsystemswouldoccuraspartofthefirstphaseofredevelopment.TheexistingEasternSystemwouldbedecommissionedimmediatelywhiletheWesternSystemwouldpotentiallybeabandonedduringPhase1pendingcompletionofthegroundwatermodellingstudy.ThisrepresentsasignificantupgradetotheTownandanimprovementtowaterqualityinthearea.ThePermitteesubmitedaReportofWasteDischargein2013.AdditionalinformationisrequiredandincludedinthetimescheduleofthisOrder.Specifically,thescopeofthisOrderincludesatimescheduletodesignandinstallthenewwastewatertreatmentfacilityaspartoftheinitialphaseofredevelopment,andrequireagroundwaterstudytodocumentexistingconditionsandevaluateanypotentialfutureimpactstogroundwater.ThisevaluationmayformthebasisforrevisedeffluentlimitsandantidegradationfindingswhentheTownexpandsinthefuture.InterimeffluentlimitsforoperationsoftheexistingtreatmentfacilityandfinaleffluentlimitsforthenewwastewatertreatmentfacilityareincludedinthisOrder.AmoredetaileddescriptionofthefacilityandrationaleforspecificprovisionsoftheOrderarepresentedbelow.
II. FACILITYINFORMATION
A. GeneralFacilityInformation
TheTownofSamoaanditswastewatertreatmentfacilitiesiscurrentlyasingleparcelownedbythePermittee.TheTownisservedbytwoindependentwastewatertreatmentsystems,describedinSectionBbelow.In1985,theWesternSystemwasupgradedfromaponddisposalsystemtoaseptictankandleachfielddisposalsystemandOrderNo.85‐40wasissuedtoLouisianaPacificCorporation,thepropertyowner.In1999,SimpsonSamoaCompany,thenewpropertyowner,submittedaReportofWasteDischarge(ROWD)reflectingachangeinownership.PriortotheRegionalWaterBoardadoptingarevisedpermit,thepropertywassoldtoSamoaPacificGroup,LLC.In2000,theSamoaPacificGroup,LLC,filedanROWDtooperatetheonsitewastewatersystems.OnJune28,2001,theRegionalWaterBoardissuedOrderNo.R1‐2001‐62tothenewowner,(hereinafterPermittee),thatincludedboththeEasternandWesternSystem.ThiswasthefirsttimethattheEasternSystemhadbeenpermittedbytheRegionalWaterBoard.

OnJanuary23,2013,thePermitteesubmittedanincompleteROWDpresentingaphasedredevelopmentplanfortheTownandconstructionofanewwastewatertreatmentfacility(WWTF).
B. ExistingWastewaterTreatmentFacility
TheTownofSamoaisservedbytwodisposalsystems:
• AnEasternSystemserving75homes,thedowntownretailareaandtheSamoaCookhouse.LargegreasetrapshavebeeninstalledtoservetheCookhouse.
• AWesternSystemwhichisastandardsepticandleachfieldsystemserving25homeswithaflowof7,500gallonsperday.
Priorto1985,neitherofthetreatmentanddisposalsystemswasregulatedbytheRegionalWaterBoard.
TheEasternSystemconsistsoftwobarkfiltersatoplargeseptictanksfortreatment.TheJanuary2013ReportofWasteDischargedescribesthebarkfiltersasdefunct.Primaryeffluentfromtheseptictanksisdischargedtoanunlinedoxidationpond.Theoxidationpondisapproximately25feetwideby100feetlongandninefeetdeep.Effluentfromtheoxidationpondflowstoapercolation/infiltrationarea.Thisareais30‐125feetwideby750feetlong.Portionsofthepercolationareaareconsistentlywetthroughouttheyear.Awetlanddelineationfortheentireparcelhasbeencompleted.Findingsindicatethatthewesternportionsoftheinfiltrationareahavebeenmappedasadunehollowenvironment.ClearevidenceofwetlandhydrologyinthisareacouldnotbedemonstratedandthereportstatesthatthisareaisnotWatersoftheU.S.TheareahasbeencategorizedasanEnvironmentallySensitiveHabitatArea(ESHA).DisposalofwastewatertothisareawillbehaltedoncethenewWWTFisconstructed.DisposaloftreatedwastewatertothisareamaybeallowedinthefutureasenhancementuponapprovaloftheCoastalCommission.

C. RedevelopmentPlanandNewWastewaterFacilities
TheTownofSamoaisaprivately‐ownedundividedparceloflandroughly171acresinsize.
ThePermitteehaspreparedaMasterRedevelopmentPlanfortheTownofSamoa.TheMasterPlancallsforsubdividingthepropertyandcreatingindividuallotsforeachresidentialhome,building154newhomes,creatinga23‐lotbusinesspark,developing24acresforlightindustrial,andestablishingagasstation,ageneralstoreandafirestation.
TheMasterPlancallsfortwomainphasesofdevelopment.Thefirstphaseincludes;1)constructionofanewWWTFsizedtoacceptthewastewaterfromtheEasternandWesternSystems,2)decommissioningtheexistingEasternSystem3)rehabilitatingtheexistinghomesandcreatingindividuallotsforeachthehomes,and4)pendingresultsgroundwatermodellingstudythePermitteemaybuildan80‐unitlowincomehousing

developmentanddecommissiontheWesternSystematafuturedate.WastewaterpreviouslydischargedtotheWesternSystemwouldthenbesenttothenewWWTF.RevisedWasteDischargeRequirementswillbeneededatthattimetoaddresstheincreaseinflowrates.
Thesecondphasecallsforconstructionofnewhomesanddevelopmentofcommercialandlightindustrialareas.OnJanuary232013,thePermitteesubmittedaReportofWasteDischargeproposingasequenceofdevelopmentforPhases1and2.
ThisOrderincorporatesatimescheduletosubmitadditionaldesigninformationandagroundwatermonitoringplan.ThescopeofthisproposedOrderincludesoperationoftheexistingWWTFonaninterimbasisuntilanewWWTFisbuilt.Interimeffluentlimits,carriedforwardfromthepreviousOrder,areintendedforuseuntilthenewWWTFisconstructed.TheOrderalsopresentseffluentlimitationsforthenewWWTFduringPhase1ofredevelopment.RationalefortheeffluentlimitsispresentedinSectionIIIbelow.
ThisOrderdoesnotauthorizeanincreaseinflowratesoverhistoricalflows.ThescopeoftheproposedOrderislimitedtothedischargeofdomesticwastewater(withaminorexception).Historically,thedowntownareasupportedagrocerystore,gasstations,firedepartment,smallrestaurantandadeli.ThesehistoricalusesareincludedwithinthispermitconditionaluponreviewoftheirimpactonthecapacityoftheWWTFwithrespecttoitsabilitytoservetheexistingresidencesandtheneedforpretreatmentofthewaste.
PhaseIIofdevelopmentisnotincludedinthisOrder.Atthistime,implementationofPhase2maybe10yearsdistant.Withtheadditionofindustrialandcommercialareas,wastewaterflowratesandcharacteristicswillchange.Are‐evaluationofthetreatmentprocessandeffluentlimitswillbenecessary,andupdatedWDRsshallbeadopted.Re‐evaluationofeffluentlimitsinthefuturewillbebased,inpart,onthegroundwatermonitoringdatagatheredduringPhase1,andmodelingeffortsconcerningfutureimpactstoreceivingwaters.
III. RATIONALEFOREFFLUENTLIMITATIONSANDDISCHARGESPECIFICATIONS
TotalNitrogenandNitrate.TheMaximumContaminantLevel(MCL)fornitrateis45mg/Lasnitrateor10mg/Lexpressedasnitrogen.FinaleffluentlimitshavebeensetataTotalNitrogenconcentrationof10mg/LasNitrogen.ThislimitaddressesallformsofnitrogenpresentintheeffluentandwillpreventthedischargefromexceedingtheMCL.Biodegradationofnitrogen‐containingcompoundsinthesandysoilcolumnunderthedisposalfieldhasnotbeenevaluatedbythePermitteeandnoallowancehasbeengrantedatthistime.ThePermitteemayprovideadditionalinformationinthefuturetoreconsiderthismatter.ThislimitwillbeevaluatedasthesumofTotalKjeldhalNitrogenandNitrate.TotalColiformBacteria.Coliformbacteriaareapollutantofconcerninallwastewatersofdomesticorigin,andtheOrderestablishesfinaleffluentlimitationstoensurethatwaterqualityobjectivesingroundwater,asestablishedbyChapter3oftheBasinPlan,willbemaintained.

SettleableSolids.Settleablesolidsareanindicatorofsystemperformance.However,sincefinaldisposaloftreatedwastewaterwillbetoland,selectingsettablesolidslimitsderivedforsurfacewaterdischargeisnotappropriate.SettablesolidswillnotbeincludedintheEffluentLimitsforthatreasonbutwillberetainedinthemonitoringsectionasanindicatorofsystemperformance.ProperoperationoftheWWTFisrequiredbyVIII.GENERALPROVISIONS.E.ChlorineResidual.TheBasinPlanestablishesanarrativewaterqualityobjectivefortasteandodor.Presenceofchlorineconcentrationsingroundwatermaycausetasteandodorissuesresultinginnuisanceconditionsandimpacttothebeneficialusesofgroundwater.Therefore,thisOrderestablishesanumericalwaterqualityobjectivebasedonapplicationofthenarrativestandard.NondetectablechlorineconcentrationsareestablishedasEffluentLimits.
BiochemicalOxygenDemand(BOD5).BODisanindicatorofthebiologicallyoxidizablecompoundspresentinwastewaterandiswidelyusedasanindicatorparameterfortheeffectivenessofwastewatertreatmentplantoperations.TheWWTFisdesignedtotreattoadvancedsecondarystandardsinordertoprotectgroundwaterquality.Assuchafinaleffluentlimitof15mg/LforBOD5isestablished.ModificationstoFinalEffluentLimits.TheOrderrequiresanevaluationofgroundwaterimpacts.Effluentlimitsmaybemodifiedinthefuturependingtheresultsofthatstudy.
IV. RATIONALEFORGENERALPROVISIONS
A. MinorExemptionforwastewaterfromnon‐domesticsources.Sincetheinitialphasesofconstructionfocusonrehabilitatingtheexistinghomesandpossiblyconstructionofalimitednumberofnewunits,nocommercialorindustrialdischargesareanticipatedandareprohibited.ThereforeSectionIII.DISCHARGEPROHIBITION,Aprohibitsallnon‐domesticwastestreamsunlessabusinessconductsanevaluationofimpactsontheWWTFandpretreatmentneeds.Thestudyshallbeprovidedto,andapprovedby,theExecutiveOfficer.Thisminorexemptiontotheprohibitionisintendedtobeappliedtosmallbusinessesorrestaurantsthathavehistoricallybeenpresentwithinthedowntownareaandthatmaybere‐establishedwithinthedowntownareaduringPhase1.Itisnotintendedtobeusedforbusinessesthatwerehistoricallynotpresent,businesseswithhighflowrates,orindustrialorcommercialwastestreamswithcharacteristicsdifferentthandomesticwastewater.ContentsofanacceptableevaluationarepresentedinSectionVIII.GENERALPROVISIONS,G.
B. ComplianceSchedule.TheOrderpresentsatimescheduletocompletetheROWDandaddressoutstandingissues:
1. ConstructionofnewWWTF.AtimescheduletosubmitdraftandfinaldesigndetailsforthenewWWTF.

SoilManagementPlan.ManyareaswithintheTownhavebeendeedrestrictedduetosoiland/orgroundwatercontamination.Constructionofnewfacilitiesandsewerlateralsmayencroachontheseareas.Toaddressexcavationwithinareasofknowncontamination,thegeneralapproachwithinRegion1requirespreparationofaSoilandGroundwaterManagementPlandetailinghowconstruction,storageanddisposal

3. EvaluationandProtectionofGroundwaterResourcesfromExpansionoftheWWTF.ThePermittee’sMasterPlancallsforfutureexpansionoftheTownandWWTF.Therehasbeennoevaluationregardingtheimpacttogroundwaterfromtheproposedexpansion.Beforeexpanding,anevaluationregardingthefateandtransportofpollutantsandtheimpactstogroundwaterisnecessary.Thisstudywilldetermineaquifercharacteristicsandusemodellingtoevaluatetheimpactfromvariouseffluentlimitationsandwastewaterflowrates.Thisstudywillformthebasisforanti‐degradationfindingsrelatedtoexpansionoftheWWTFandfurtherdevelopmentoftheTown.
4. PretreatmentProgram.ThisOrderestablishesatimeschedulethatrequiresthePermitteetoprepareapretreatmentandsourcecontrolprogramtoensurethatpollutantsdonotinterferewith,passthrough,orareincompatiblewithtreatmentoperations,interferewiththeuseordisposalofsludge,orposeahealthhazardtopersonnel.ThepretreatmentprogramwillbedraftedconcurrentlywithformationofaCommunityServicesDistrict.
5. FormationofCommunityServicesDistrict.TheMasterPlancallsforcreatingindividuallotsfortheexistinghomesalongwithnewdevelopmentatsomefuturedate.FormationofaCommunityServicesDistrictwithlegalauthoritiesisanecessarystepinmakingthetransitionfromasingle,privateownertomultipleownersinanunincorporatedtown.ThePermitteeisnegotiatingwithlocalagenciestocreate,orannextheTowninto,aCommunityServiceDistrict.AnnexationoftheTownintoanexistingCSDisoutsidethecontrolofthePermitteeandtheschedulewithintheOrderrepresentsbestestimatesasofthisdate.However,thePermitteehasstatedthatitcanformaCSDonitsownaccordifexistingpublicentitiesdonotannextheTownintoanexistingagency.Therefore,formationofaCSDbythedateprovidedinthisOrderisachievable.Itispossiblethatthesituationmaychangeinthefuture.Staffwillfollowthisissueasitdevelopsandifnecessarymakeadditionalrecommendationsinthefuture.
V. FINDINGS
A. LegalAuthorities.ThisOrderservesasWasteDischargeRequirements(WDRs)fordischargestolandissuedpursuanttosection13263oftheCaliforniaWaterCode(WaterCode).ThisOrderalsoservesasReclamation(RecycledWater)Requirementspursuanttosection13523oftheWaterCode.
B. BasinPlan.TheBasinPlancontainsimplementationplansandpoliciesforprotectingwatersofthebasin.TheBasinPlanimplementsStateWaterResourcesControlBoard(StateWaterBoard)ResolutionNo.88‐63,whichestablishedstatepolicythatallwaters,withcertainexceptions,shouldbeconsideredsuitableorpotentiallysuitableformunicipalordomesticsupply.AsrequiredbyWaterCodeSection13263(a),theseWDRsimplementtheWaterQualityControlPlanfortheNorthCoastRegion(BasinPlan),andinsodoing,the

D. CaliforniaWaterCode.TheCaliforniaWaterCode(WaterCode)establishesthe
authorityfortheRegionalWaterBoardtoestablishwaterqualityobjectives,imposedischargeprohibitions,andprescribewastedischargeandreclamationrequirements.WaterCodeSection13241requireseachregionalboardto“establishsuchwaterqualityobjectivesinwaterqualitycontrolplansasinitsjudgmentwillensurethereasonableprotectionofbeneficialusesandthepreventionofnuisance[…].”ThecontrolofpollutantsdischargedisestablishedthrougheffluentlimitationsandotherrequirementsinWDRpermits.WaterCodesection13243providesthat“Aregionalboard,inawaterqualitycontrolplanorinwastedischargerequirements,mayspecifycertainconditionsorareaswherethedischargeofwaste,orcertaintypesofwaste,willnotbepermitted.WaterCodeSection13260etseqestablishesregulationsassociatedwiththeprescriptionofwastedischargerequirementsandWaterCodeChapter7(Section13500etseq)establishesregulationsassociatedwiththeprescriptionofreclamationrequirements.
ItistheRegionalWaterBoard’sintentthatthisOrdershallensureattainmentofwaterqualitystandards,applicablewaterqualityobjectives,andprotectionofbeneficialusesofreceivingwaters.ThisOrderthereforerequiresthePermitteetocomplywithallprohibitions,effluentlimitations,dischargespecifications,reclamationspecifications,reclamationprovisionsandrequirements,receivingwaterlimitations,standardprovisions,andmonitoringandreportingrequirements.
E. CaliforniaCodeofRegulations(CCR).Thisproject(currentoperationsandPhase1)consistsoftheoperationof,andrepairto,anexistingfacilitywhichinvolvesminimumchangeinusebeyondthatpreviouslyexisting.Therefore,thisprojectisexemptfromprovisionoftheCaliforniaEnvironmentalQualityAct(PublicResourcesSection2100et.seq)becauseitconsistsoftheoperation,repair,maintenance,permitting,leasing,licensingorminoralterationofanexistingfacilityinvolvingno,ornegligible,expansion

F. AntidegradationPolicy.TheStateWaterBoardestablishedCalifornia’santidegradationpolicyinStateWaterBoardResolutionNo.68‐16.ResolutionNo.68‐16requiresthatexistingqualityofwatersbemaintainedunlessdegradationisjustifiedbasedonspecificfindings.TheRegionalWaterBoard’sBasinPlanimplements,andincorporatesbyreference,theStateantidegradationpolicy.ThepermitteddischargeisconsistentwiththeprovisionsofStateWaterBoardResolutionNo.68‐16,StatementofPolicywithRespecttoMaintainingHighQualityofWatersinCalifornia.
Staff’sevaluationregardingtheimpactsfromconstructionofanewWWTFfindsthatthemassloadingofBOD5andTotalNitrogenwillbesignificantlydecreasedcomparedtocurrentconditions,resultinginanoverallbenefittotheenvironment.ConstructionofPhase2andadditionalexpansionoftheWWTFwillnotoccurwithoutcompletingagroundwatermodellingeffort,ensuringcompliancewiththeState’santidegradationpolicy.
AttachmentCofthisOrderrequiresongoinggroundwaterandeffluentmonitoringtoassesswhetherconcentrationsofpollutantshavethepotentialtoadverselyimpactbeneficialuses,orsignificantlyincreasepollutantsinthegroundwater.
ThisOrderisconsistentwiththemaximumbenefittopeopleoftheStatebecause:(i)itimprovesoperationofwastewatertreatmentfacilities;(ii)reducesthemassemissionofpollutantstotheenvironmentand,(iii)requiresmonitoringofpotentialgroundwaterimpacts.
G. EndangeredSpeciesAct.ThisOrderdoesnotauthorizeanyactthatresultsinthetakingofathreatenedorendangeredspeciesoranyactthatisnowprohibited,orbecomesprohibitedinthefuture,undereithertheCaliforniaEndangeredSpeciesAct(FishandGameCodeSections2050to2097).ThePermitteeisresponsibleformeetingallrequirementsoftheapplicableEndangeredSpeciesAct.
H. MonitoringandReporting.WaterCodeSections13267and13383authorizetheRegionalWaterBoardtorequiretechnicalandmonitoringreports.TheMonitoringandReportingProgramestablishesmonitoringandreportingrequirementstoimplementfederalandStaterequirements.ThisMonitoringandReportingProgramisprovidedinAttachmentC.TheExecutiveOfficeroftheRegionalWaterBoardisdelegatedtheauthoritytomodifytheMonitoringandReportingProgram,asdeterminedappropriatetoprotectwaterquality.
