SUMMARY/COMMENT
The Shire of Kondinin’s auditors Byfields have prepared the 2014/15 financial year’s Audit Report for
Council’s consideration.
The Report has been presented to Council’s Audit Committee at its meeting held on 10th December, 2015
and a Committee resolution and recommendation made to full Council.
The Audit Report prompts the conducting of an Annual Meeting of Electors where the Audit Report
(amongst other reports) will be presented to electors. This meeting is scheduled to be held after the 10th
February 2016 Council meeting.
Apart from a few minor issues, the annual audit demonstrates that administration of the Shire of Kondinin
has conducted the Shire’s affairs from a financial management and compliance viewpoint in a sound
manner. Appreciation is extended to Mr Vince Bugna for his responsible, efficient and accurate work in the
management of Council’s finances and the preparation of the Shires annual financial statements. It is noted
that in the entire financial management and annual financial statement reporting, no adverse comments
were made at all by the auditor. This is very pleasing indeed.

Summary/Comment
Hon Mia Davies, MLA has advised that the new Central Wheatbelt electorate boundaries for the March,
2017 State election have been confirmed.
In a media statement local member Hon Mia Davies MLA advised:
The new electorate of Central Wheatbelt was slightly different to the original proposal by the WAEC.
“The Commissioners have considered the feedback and objections submitted during the consultation phase
and have adjusted the boundaries accordingly,” Ms Davies said.
The electorate will now include the Shires of Yilgarn, Westonia, Pingelly, Wandering and Boddington in
addition to those Shires that already constitute Central Wheatbelt.
“The original proposal from the Commissioners moved Wongan-Ballidu, Dowerin, Koorda and Goomalling
into the electorate of Moore,” Ms Davies said.
“On advice and feedback from these communities and others who made submissions the Commissioners
accepted that they have more in common and are better connected to the other communities in Central
Wheatbelt.”
The current electorate is 62,363 square kilometres and encompasses 24,962 voters. The new electorate will
be 101,240 square kilometres and encompass 27,019 voters.
Ms Davies said The Nationals WA MPs were used to covering large distances and serving vast electorates.
“What is most concerning is the loss of an entire country electorate, and the creation of a new metropolitan
electorate,” she said.
“Our Leader, Terry Redman, has already flagged that we’d be looking to make changes to the legislation
that determines how many seats there can be in State Parliament to ensure we don’t see further erosion of
regional representation.
“Results like this are just another reminder of why it’s so important for regional people to vote as a block for
The Nationals to deal themselves into the decision making with the balance of power in the Parliament.
Paul Brown MP, Member for The Agricultural Region in his media release has welcomed the newly included
Local Government areas of Esperance, Yilgarn, Ravensthorpe and Westonia into his electorate.
“The Agricultural Region will now span all the way from Kalbarri in the North through to Esperance in the
South. It will cover over 280,000 sq km over our great state incorporating the four lower house seats of
Geraldton, Moore, Central Wheatbelt and the newly formed seat of Roe.”

personnel, a suitable 4 x 2 residence on condition that GROH are prepared to enter into a long term
rental lease and a satisfactory engineering report being obtained regarding the building’s structural
soundness if a second hand house is acquired; and
(ii) give consideration in the 2016/17 budget to additional housing needs.

Since the last meeting GROH representatives visited Kondinin and inspected both the current 3x1 residence
provided for the Kondinin Primary School Principal and the residence for sale owned by Ben Dennis in
Repacholi Parade, Kondinin. They have commented on the excellent condition this residence is in and have
advised a few minor items that require doing to bring in line with GROH standards such as hard wired
smoke alarms, security screens on windows, etc. We are awaiting GROH’s formal advice that they are
prepared to rent Ben Dennis’s property if purchased by the Shire on a long term basis. A 5 year, with 5 year
option, is being considered regarding rental lease term.

Adequate housing available in our town sites is an important strategic requirement in order to house Shire
employees, school teachers and hospital staff, as well as employees of private enterprise.

Obviously at this stage Administration has not committed to anything regarding the lease. They were
subsequently advised that the matter would be put to Council at the December council meeting . However,
an alternative 13 y.o. property has been mooted, in house, which would still involve the purchase of the
Dennis property in Repacholi Parade and a switch in residence for a staff member.
The Education Department have been requested to provide an indication if the alternative house would be
acceptable for a 5 +5 year lease however they are not prepared to comment at this stage until the offer
becomes concrete.

9.2.3 Hyden Sports Pavilion Extension

SUMMARY/COMMENT
At the November 2015 council meeting it was agreed that necessary work to complete the current
renovation work at the Hyden Sports Pavilion be carried out. I arranged a meeting on site attended by
DCEO, MOW, Tony Ibbotson, Craig Mayfield, Geoff Biglin, Murray James and myself, where the planning
and arrangements of all aspects of the work was determined and agreed. This work includes:
• Removal of old retaining wall on the western side of the building and the concrete construction of a
new area abutting the building. Work also involves relocating the electrical switch for the sewerage
pump, installation of a second back up pump and covering the septic tank and pump area. I have
engaged Tony Ibbotson following receiving his reasonable quote to carry out the concrete work and
a local electrician will be engaged to do the electrical work regarding the pump switch. After the
concrete and electrical work is completed, the Shire’s Manager of Works will arrange the suitably
covering of the septic tank/pump area and based on the levels of the concrete area, bring in gravel
fill and construct a car parking facility along the western side of the building. At a later stage when
bitumen works are undertaken in the Hyden area, we will bitumen this new parking area.
• Tony Ibbotson has been engaged to construct the limestone blocks defining the perimeter of the
children’s playground area and then Shire employees will fill the area with clean sand and re
assemble the play equipment. Pool type fencing will then be erected on top of the limestone bricks
incorporating an access/exit gate.
• Attractive benches for the ladies change room have been ordered and due to arrive shortly when
they will be installed by the Shire’s Building Maintenance person. We are waiting on the contractor
Nick Scorer to complete his overdue tiling work. The DCEO has sourced a 3 door fridge at a good
price which has been ordered and installed to service the pavilion’s bar area.
• A local electrician is being engaged to install security lighting for the western and southern sides of
the pavilion. Hand rails for the three step (disability) access areas is being obtained from Hyden
Steel and installed.
• Previously I was under the impression that the rendering of the external pavilion walls was going to
cost $20,000 plus, but at the site meeting it was revealed that Peter Marshall could do the job for

around $9,000.00. The purpose of carrying out the work listed above is to complete this stage of
the project and achieve an attractive presented building. The rendering is a necessary part of
achieving this and given Council’s intention and support that this be achieved, I authorized the
rendering work to progress.
The above work will all be completed as soon as is physically possible and from all reports, the Hyden
Sports Council is very happy with this positive and expeditious progress. Council’s support in allowing this
(unbudgeted) work to be carried is much appreciated by all.

SUMMARY/COMMENT
Dr Michael Gendy of Jupiter Health & Medical Services has confirmed that Dr Shukur will be leaving the
practice at the end of January, 2016, replaced by Dr Mackie (locum Doctor) until the new female Doctor
Deborah arrives at the beginning of March, 2016.
Many Kondinin locals have expressed that they are sorry to hear that Dr Shukur is leaving. It is understood
that him leaving has been prompted by the need for his wife, a Medical Doctor who specialises in cancers
and haematology, to pursue her career in a metropolitan area hospital.
I have requested Dr Michael Gendy of Jupiter to advise if the new Doctor Deborah will be servicing the
Kondinin Hospital.

9.2.5 Wheatbelt Business Network – Service Provision to Local Businesses

Summary/Comment
Caroline Robinson of Wheatbelt Business Network (WBN) has put a proposal to RoeROC that WBN provide
services to local businesses in the RoeROC area. The cost amounts to $5,000 per Shire which funds have
been budgeted for by all RoeROC Shire members. WBN have appointed Lisa O’Neill who will provide the
service proposed to RoeROC member local governments, as well as service WBN members in the Roe and
Central Wheatbelt areas, which includes the businesses located in the Shire of Kondinin.
Up until 30/6/2015, WBN provided a service to businesses under the state government’s ‘Business Local
Program’ contract. From 1/7/2015 this service was tendered by the state government and awarded to RSM
Bird Cameron. RSM have appointed Tanya French to deliver their service in this area to businesses. Tanya
has also been engaged by WBN one day per fortnight to run its Business After Hours in Wagin, Narrogin &
Dumbleyung and assists members in the Southern Wheatbelt.
WBN offer membership to WBN at a cost of $302.50 including GST per annum to local businesses. Shire of
Kondinin members include:

· Hyden CRC
· Waveline Hardware
· Bedford Engineering
· Landmark Hyden
· Shire of Kondinin
Caroline has advised: “at the moment the Shire of Kondinin (Sue Pegrum) emails out WBN member enews to
all businesses on her email distribution list, so they are receiving part of our member services
complementary. We also have 10 potential members that we have been working with to resolve some
business issues in Hyden. These include a small group of farmers. We have also always provided assistance
to non members – recently a business in Kondinin needed assistance with employment contracts and in
Hyden some marketing advice. Of our Shire of Kondinin members we assisted Middle East Engineering and
Holmbush Springs get $7500 of small business grants and the Hyden CRC is awaiting their grant outcome.”
RSM’s services under the Business Local Program is very limited and it is considered advantageous and of
benefit to our local businesses that we continue to have WBN service businesses in our towns.
The other three Shires in RoeROC are in agreement to engage WBN’s services. WBN has appointed Lisa
O’Neill as Membership and Business Development Officer and has advised that under its RoeROC contract
Lisa will be delivering economic development initiatives in the RoeROC including:
• Growing business networking in your Shires and helping them with any issues they have.
• Determining the multiplier effect of local and tourism dollars invested in your towns and the impact
of job losses/population movement.
• Continuing on the industrial land / business opportunities campaign

The Shire of Kondinin has been a financial sponsor for many years of the volunteer organisation Central
Agcare, based in Corrigin, which services amongst others, the Shire of Kondinin. Other sponsoring Shire’s
include Brookton, Bruce Rock, Corrigin, Kulin, Narembeen, Quairading & Wickepin. Central Agcare provides
individual and family counselling services to members of the community in need.
Central Agcare has asked if Council would like to have a representative to attend its bi monthly meetings.
Councillor Rowena Butler has kindly agreed to be Council’s representative. This appointment can be
included in Council’s list of appointed Councillors to various Council Committees and representation to
various groups.

9.2.7 Cleaning, Building Maintenance and Ranger Services

SUMMARY/COMMENT
Greg and Lorraine Gleeson have expressed interest in offering their existing services to the Shire under a
contract arrangement through their company Dynamic Cleaning Services and General Building
Maintenance Kondinin, rather than as employees. Their proposal includes them providing a
cleaning/building maintenance vehicle, instead of a Shire owned vehicle.
Currently Greg carries out the following duties:

• Building maintenance work on all Shire owned premises across the whole of Shire.
• Cleaning services to Shire owned premises in the Hyden/Wave Rock precincts.
• Ranger duties across the whole of Shire on an as needed basis.
Lorraine’s duties include cleaning of Shire owned premises within the town of Kondinin.
The Manager of Works has appraised their indicative contract services offer and significant cost savings will
benefit the Shire under the proposed contract arrangement. However due to the estimated annual contract
amount involved, working the same hours as has been worked to date, it is necessary that the service be
put out to tender.

9.2.9 CEO’s General and Project Status Report
(1) Staff Matters
We continue to have a stable workforce throughout the organization with the exception of Hayden
Attwood resigning. Hayden has accepted another position elsewhere. This position, which is part of
the Hyden based road maintenance truck crew, has now been filled very satisfactorily by the
Manager of Works.
I am very happy with the level of professional management delivered by our senior management
team members, as well as all members of our administration team. Members of our Parks &
Gardens, Building Maintenance, Cleaning, Road Construction and Road Maintenance Crews are also
delivering good work under the supervision of our capable Manager of Works, Doug Davey,
assisted by Leading Hand, Gary Valenta.
Recently training and accreditation was provided to our outside road construction crew members
in Traffic Management.
LGIS, Council’s insurers, are providing at its cost, Shire employee training in February, 2016 as part
of its LGIS Health & Wellbeing Program. Health areas to be delivered to Shire employees include flu
injections, manual task training and ergonomic assessments, as well as one on one appointments
with a tertiary trained health professional giving a snapshot of an individual’s current health status,
including testing blood pressure, cholesterol, blood sugar levels, weight and waist measurement.
(2) Swipe Card System
October 2015- All 3 sites have now been completed and access is now only via swipe card. There
have been no indications of any problems or complaints so far. There is some concern regarding
the replacement of the standpipe with camlock fittings at McCanns Rock.
November 2015- The DoW has been advised of the concerns about McCanns Rock and we await
their reply.
December 2015- The DoW contacted the Karlgarin Progress Association representative, Jill
Fotheringhame, regarding the concerns raised regarding access to the water including mobile
phone coverage in case of an emergency and also payments for the water used. The perceived
concerns were satisfactorily resolved regarding the payment for the water and a practical phone
demonstration via the mobile phone between Mrs Fotheringhame, on site, and the DCEO, in the
office, in which the “fire mode” was enabled and disabled dealt with the other concern.
(3) King Rocks Dam Upgrade – Department of Water
November 2015- DoW advises that the cost to repair the dam wall ranges from $500,000 to
$800,000 depending on the chosen option. They have prepared a notice to the community seeking
information on who uses it and also advise that they are open to suggestions as to any alternative
ideas. They have requested that all responses be addressed to the shire.
December 2015 – Administration has placed a notice in the Hyden publications regarding the
planned King Rocks upgrade seeking comments and suggestions regarding the fate of the dam. DoW
have been advised and have acknowledged that we may not receive many replies until harvest has
finished and that the information is being received slowly. Several suggestions and comments have
been received to date.

(4) Water Supply – Karlgarin
DCEO Alan George has done an excellent job in organizing two unused water supplies located east
of Karlgarin town site to be made available for farmers with the provision of standpipes. One supply
off Want Road (locally referred to as “C Site”) is a 742,000 litre concrete water tank (covered)
serviced by a large granite rock catchment area. The other supply is a (13,000m3 – 13 million litres)
Water Corp unused dam currently full (18 feet deep), off Karlgarin East Road. The Department of
Water will meet the cost of the Want Road standpipe and we will be seeking a Department of
Water Community Water Supply Program grant for the standpipe and swipe card system at the
dam, which they have advised that they will view favorably.
(5) Yeerakine Rock – New Water Tank Proposal
Water Corp’ has formally advised that they are investigating the suitability of an alternative site for
the location of the new town water supply tank. If the new site proves suitable then Yeerakine Rock
will not be required by Water Corp and consideration will need to be given towards having the area
de-vested from Water Corp and vested in the Shire of Kondinin as a Reserve. If this can be
achieved, the further development of the site can be given consideration by Council.
(6) Community Strategic Plan
The Shire of Kondinin is required to review its Integrated Strategic Plan every four years, (Local
Government (Administration) Regulations 1996, Section 19C), to ensure that changing
circumstances and priorities relating to community needs and infrastructure provided by the Shire
are, where possible, incorporated in the Plans. It is Council’s specific role to determine these
priorities. Administration between now and the February, 2016 meeting of Council will be
conducting workshops on reviewing the Plans with a view to formulating recommendations for
Council to consider. Councillors are requested to review the Community Strategic Plan. This is best
accessed on the Shire’s website as the Plan file is too large to email electronically.
Because of the high importance of identifying and prioritizing future community infrastructure
projects that the Shire will aim to provide in future years, the timing on determining and finalizing
these matters is expected to extend beyond the February, 2016 Council meeting. However if
progress can be made to allow discussion at the February, 2016 Council meeting towards the
review, it is envisaged that the review process and adoption by Council of changes to the
Community Plan, (which will need to be reflected in the other supportive Integrated Plans), ought
to be achieved by the March or April, 2016 Council meetings. Community meetings in Kondinin and
Hyden are recommended during late February or early March, 2016, where community members
are invited to participate in advising their ideas regarding the provision of future infrastructure, etc.

Councillors and senior administration staff is important.
(7) Wheatbelt South Aged Accommodation Alliance
Cr Sue Meeking and the CEO attended a meeting at Narrogin Town Council offices on 9 December,
2015 attended by Mr Doug Faircloth of Verso Consulting and representatives from Wickepin,
Cuballing & Narrogin Shires/Town. Verso will be conducting a Needs Analysis of the nine local
Government members of the alliance to support the application for funding for aged
accommodation through the Wheatbelt Development Commission.
(8) Emergency Management Plan
Administration is currently reviewing the Shire’s Emergency Management Plan. The review process
will include meetings of the Volunteer Emergency Service (VES) organization members in Kondinin
& Hyden and include local police.
(9) General – Since the last Council meeting I have attended various meetings including Main Roads
WA (MRWA) Meet and Greet with the Wheatbelt MRWA Regional Manager & staff at Narrogin,
Regional Road Group meeting in Narrogin, Wheatbelt South Aged Accommodation Alliance meeting
in Wickepin, Wheatbelt Development Commission’s Aged Transport Initiative meeting in Wickepin,
Eastern Wheatbelt Primary Care Project meeting in Corrigin, RoeROC meeting in Corrigin and the
Great Eastern Country Zone of WALGA meeting in Merredin.

Summary
For Council to consider options for dust suppression on a 500m section on Chalkhill West Road between
Trevor Hinck’s beef feedlot and Frank James residence.
Background/ Comment
There are several products on the market for dust suppression.
1 DUSTMAG
DUSTMAG is applied by water cart and mixed into the road surface, it works primarily because it is
hygroscopic, meaning it attracts and retains moisture from the air.
2 DUSTERAZER
DUSTERAZER is applied by water cart and mixed into the road surface when diluted in water, offers
penetrating properties to allow the product to permeate into individual fine particles weighing them down
so they are unable to be blown away as dust.
The down side to the above products are the initial cost to treat the road surface and the ongoing
maintenance costs that will be required every 10 weeks.
The follow up maintenance procedure would be to add additional product regrade and compact.
SEALING
The other remedy would be to seal a section 500m long x 4m.Wide
Comment
The existing gravel surface has sufficient depth to be water bound without additional material being carted,
there is enough sealing aggregate that was surplus to requirements from other projects, the major costs
would be for the supply, spray and cover of bitumen product.

This project can be funded from the General Road Maintenance Account No M001. The Budget allocation is
$507,630 for 2015/2016, current expenditure $91,371, expenditure from this account will increase after
mid April when the R2R and RRG projects are completed however there will be adequate funds to eradicate
the dust problem.

9.4 Community Development Officer’s Report
Nyoongar Sports Day
The next Nyoongar Sports Day will be held on Thursday 21st January 2015 from 10.30am to 2.00pm at the
Kondinin Swimming Pool. Games and activities will be provided by the Nyoongar Sports Team and lunch
provided by the Shire. All children are welcome. The Shire’s Pool Manager has been advised and will be in
attendance during the day.
Yeerakine Lodge Extension
Following the AGM of the Kondinin Kulin Aged Care on the 26th October 2015 it was identified that the
progression of the Business Plan to Yeerakine Lodge be a priority. To ensure this is completed in a timely
and professional manner, the Shire has engaged Tammy King from Grants Empire to complete the Business
Plan and a Funding Model by February 2016. The Shire’s Community Development Officer and the
Secretary of the Kondinin Kulin Aged Care have been working closely with Tammy to ensure that she has all
the information required to complete the Business Plan and Funding Model.
Revised costing has been provided to the Shire for the proposed 4 unit extension indicating a total of
$921,902 for the actual construction. Additional consultancy fees have been quoted at $62,194, resulting in
a total project cost of $984,096.
On recommendation from Tammy King the Shire has also engaged RPS Group to prepare an Economic
Assessment of the proposed extension. It is considered this assessment will provide pivotal information
that will be considered valuable by potential funding departments, particularly Development Commissions
and Federal Government Departments.

The Shire is also engaging Peter Gow Surveyors to prepare a survey plan for the site, to clearly mark out the
area designated for the proposed extension to Yeerakine Lodge. It is intended that this plan replace the
existing plan in the current Lease Agreement with Kondinin Kulin Aged Care and WACHS.
A letter has been received from WA Country Health Service, the land owners of the site, who stated that
they ‘have no objection to adding buildings to the land, however there are concerns that the model of low
care is no longer supported by Commonwealth funding and this will impact on the ability for WACHS to
provide support.’ Despite this position, the Kondinin Kulin Aged Care are of the strong view that Yeerakine
Lodge offers a sound aged care model that offers a level of care to residents that simply cannot be provided
through West Court Retirement Village.
To formalise the WACHS’s approval on the proposed extension a planning application is also currently being
prepared, scheduled to be presented to the February 2016 Council Meeting, following the approval of
WACHS.
Kondinin Community Garden
Most of the summer vegetables are growing well. A drip hose was connected by the Deputy CEO which has
improved the watering efficiently over the summer months. A meeting and mini busy bee is scheduled for
12 December 2015 to discuss where to from here in 2016. More specifically items to discuss will include:
markets, nature play area, compost area, landscaping, more planting, outside wall murals and watering in
January 2016.
Carols By Candlelight
Carols by Candlelight has been scheduled for Sunday the 20th December 2015 from 7.00PM. The Carols will
be led by local musicians, including the Shire’s CEO John Read.
Pioneer Wall
Following the presentation by John Hinck at the Ordinary Meeting of Council held on 18th November 2015,
quotations are currently being sort for the stonemason works, concrete works and the plaques. On
finalisation of the project cost, an application for a Lottery West Grant will be submitted as soon as
practicable.
Regional Events Grant
Tourism WA is currently advertising their Regional Event Grant which closes on 1 February 2016. The
Scheme offers funding for eligible regional events held between July 1, 2016 and June 30, 2017 that have
the ability or potential to attract visitors to the region, achieve media attention and involve and inspire the
community. Event holders can apply for funding between $5,000 and $50,000.
An email was distributed to all Shire Staff and Councillors and locals and placed in the Echo and on the
Shire’s Facebook page seeking feedback and ideas on an event that might be suitable for this grant. Some
suggestions so far have been to expand on the Kondinin Art Exhibition and the ANZAC Day Service at
Yeerakine Rock and also a food related event with an ‘outback dinner under the stars’ with a celebrity chef
and local produce. Any suggestions from Councillors are welcome.
Roe Tourism
Attached is a copy of a letter received from the Roe Tourism Association regarding future funding
arrangements for the operation of the group. The item is presented to ensure Council are aware of the
proposal as presented. Basically the 4 RoeROC Councils have committed $5000 to Roe Tourism and this
money is made up of the previous ongoing commitment of $2500 per year plus the $2500 we had
previously paid directly to the Central Wheatbelt Visitor Centre. The MOU between Roe Tourism
Association and the Central Wheatbelt Visitor Centre has since lapsed and Roe Tourism has formally
advised the Central Wheatbelt Visitor Centre [the Shire of Merredin] that it does not wish to enter into a
new MOU. My understanding is that the letter should only have been written to the Shires of Quairading,
Bruce Rock and Lake Grace who currently only pay $2500 per annum to the Roe Tourism Association.
The contracting of an individual or organisation by Roe Tourism Association to provide the service of
Executive Officer for the organisation has been discussed at length at the last several Roe Tourism
Association Meetings and a position description has been drafted by members of the group. The main
intention of the position is to coordinate the day to day administration of Roe Tourism Association and the
promotion of the Pathways to Wave Rock Trail.
It is the view of all members of Roe Tourism Association that it would be beneficial for the group and
participating Shires in employing an Executive Officer to undertake the marketing and administration of the
group in a professional capacity.

Public Health Advocacy Institute Award
The Shire received an award for the Public Health Advocacy Institute for the children’s environment and
health local government report card project which was presented at a ceremony in Perth on the 8
December 2015. Unfortunately a Shire representative was not able to attend the ceremony so the award
certificate will be posted to the Shire.

The Shire received a letter dated 29 September 2015 from the Water Corporation seeking a Letter of
Consent from the Shire to send to the Department of Lands to support the proposed amalgamation of part
of Reserve 28833 with Reserve 36261.
As Reserve 28833 is vested in the Shire and under a lease agreement, a letter was sent to the lease holder
on 8 October 2015 seeking their input on the proposal.
A response from the lease holder was received by email on 6 November 2015 advising that they have no
objection to the boundary change, subject to the following conditions:
• Keeping the site clear or rubbish/building debris
• No clearing
• Limit access to traffic as the recent clearing would make a good illegal campsite
The lease holders also advised the Shire that on visiting the pump station site proposed to be enlarged it
was evident that the Water Corporation had already been to the site and cleared surrounding trees and
shrubs in the area of the Reserve still vested in the Shire of Kondinin. Photos of this were also provided.
This information was forwarded to the Water Corporation and the Acting Operations Officer advised that
‘We had a few trees in the compound at the Hyden Chlorinator site which needed to be removed. I had
organised this to be done by our operators they were instructed to clear the vegetation inside the compound
and remove the pile of dead wood at the compound gate. There was no instruction of any clearing to be

done outside the compound’.
I appears that instructions were not followed entirely, resulting in the trees being cleared and still lying
around outside the compound.
Conclusion
The proposed expansion of Reserve 36261 by the Water Corporation to accommodate safety issues due to
the use of chlorine has on site, the encroachment of services outside the current area and to enable the
installation of a non-combustible perimeter fence to help safe guard against bush fire seems a reasonable
request, in which it is recommended that the Shire support and issue a letter of consent accordingly.

Summary:
The purpose of this report is for the Council to consider and endorse the Schedule of Submissions attached
to this report including the recommendations contained therein, recommend to the Minister for Planning
to amend the consolidated version of the amended Town Planning Scheme No.1 in accordance with the
Schedule of Modifications attached to this report; submit the relevant documentation to the Minister for
Planning for approval of the amended Town Planning Scheme No.1 and subject to approval from the
Minister for Planning authorise the Shire’s Administration to incorporate the approved amendments of the
Scheme and publish the consolidated amended version of the Shire’s Town Planning Scheme No.1 in the
Government Gazette.
Background:
In April 2013 Council resolved to proceed with the consolidation of the Shire of Kondinin Town Planning
Scheme No.1 (TPS No.1) rather than a full scale review due to costs.
A consolidated version of TPS No.1 was subsequently prepared by the reporting officers incorporating all
modifications made to the scheme since it first came into operation in December 2004.
The consolidated version of TPS No.1 was submitted to the Western Australian Planning Commission
(WAPC) in March 2014 for approval to commence public advertising.
In July 2014 the WAPC confirmed the Minister for Planning’s formal approval to the proposed consolidation
of TPS No.1 and instructed the Shire to proceed with public advertising of the newly consolidated version of
TPS No.1.
In August 2014 public advertising of the consolidated version of TPS No.1 commenced for a period of 66
days. A summary of that process, including outcomes, is provided below under the heading ‘Community
Consultation’.
The public consultation process confirmed that TPS No.1 is relatively effective however a number of
changes were required, including but not limited to the following:
i) Updates to the format of the Scheme Text to bring it into line with contemporary planning standards
as prescribed by ‘Appendix B - Model Scheme Text’ of the Town Planning Regulations 1967 (as
amended);
ii) Incorporation of a number of new planning controls into the Scheme Text to ensure consistency with
new planning legislation and policy and to address a range of land use and development issues that
have arisen since TPS No.1 was first gazetted;
iii) Corrections to a number of minor errors and anomalies in the Scheme Text;
iv) Various updates to the Scheme Maps to reflect changes to cadastral boundaries resulting from
subdivision development over the past ten (10) years, particularly in the agricultural areas of the Shire;
and
v) Various updates to the Scheme Maps to reflect changes to the boundaries, classification and use of
various Crown reserves.
In accordance with the provisions of section 90 of the Planning and Development Act 2005 the Shire’s
Planning Officer prepared and presented a report to the Minister for Planning on the operation of TPS No.1
with due regard for the outcomes from the first public consultation process. The report was submitted on
the 27 November 2015 and included:
a) details of all submissions received during public consultation;
b) summary and recommendations regarding the details contained in all submissions received; and
c) the recommendation to amend the existing Scheme.
In a letter the Shire received from the Western Australian Planning Commission dated 2 April 2015 the
Shire was advised by the Minister for Planning that it supported the Council’s recommendation to amend
the consolidated version of the Shire’s Town Planning Scheme No.1. This letter also advised the Shire to
amend the Scheme in accordance with an accompanying Schedule of Recommended Modifications and any
other modifications to ensure that the Scheme aligns with the Draft Planning and Development (Local
Planning Schemes) Regulations 2014. In summary these amendments included:
• New use classes being included in the Zoning Table and corresponding land use permissibility as
applicable
• Update the format of the Town Planning Scheme No.1 to align with the model provisions in the
Planning and Development (Local Planning Schemes) Regulations 2015
• Include information on structure plans

• Include new provisions relating to industry mining in Part 4 of the Scheme and in the Zoning Table
• Include a new provision relating to development of lots not abutting a constructed public road in
Part 4 of the Scheme
• Amend the definitions in Scheme 1 of the Scheme in accordance with the general definitions and
land use terms in the Planning and Development (Local Planning Schemes) Regulations 2015
• Reclassify Lot 3175 Raine Road, Hyden from ‘Rural’ to ‘Conservation’
• Reclassify Lot 3140 Holland Track from ‘Conservation and Recreation’ to ‘Conservation’.
The Planning and Development (Local Planning Schemes) Regulations 2015 were gazetted on 25 August
2015 and became operational on 19 October 2015. These new regulations include ‘deemed provisions’ in
relation to structure plans, exempt development, information to be submitted with an application, matters
to be considered when assessing an application and the form for determining an application. These
provisions are the same across all Local Governments and cannot be amended and have been removed
from the Shire’s original version of the Town Planning Scheme No.1. This has resulted in the Town Planning
Scheme being separated into two parts:
• PART A - Town Planning Scheme No.1 (Text and Maps)
• PART B – Planning and Development (Local Planning Schemes) Regulations 2015 (Schedule 2)
Following the amendment of the Shire’s Town Planning Scheme No.1 to incorporate the amendments
recommended by the Minister for Planning, the Scheme was again advertised for a period of 42 days
closing on the 6th November 2015. Details of this are documented in the ‘Community Consultation’ section
below.
Having regard to the outcomes from the second round of public consultation as summarised in the
Schedule of Submissions attached, a Schedule of Modifications has been prepared that outlines further
recommended amendments to the Shire’s Town Planning Scheme No.1 to be considered by the Minister
for Approval. In summary these include:
• Rezone Wave Rock Water Treatment Plant and Pump Station on Reserve 36261 Wave Rock Road,
Hyden from ‘Tourism and Recreation’ to ‘Public Purpose (IS) – Infrastructure Services’
• Rezone Kondinin Water Treatment Plan on Lot 1 D88903 Sloan Road, Kondinin from ‘Rural’ to
‘Public Purpose (IS) – Infrastructure Services’
• Insert two (2) new Special Control Areas into clause 34 of the Shire’s consolidated Town Planning
Scheme No.1 to designate appropriate buffer areas around the Hyden Waste Water Treatment
Plant on Reserve 21253 Lovering Road, Hyden and the Wave Rock Water Treatment Plant and
Pump Station on Reserve 36261 Wave Rock Rod, Hyden respectively and amend the Scheme Maps
accordingly.
Conclusion
In light of the information provided above, it is recommended that the Council endorse the Schedule of
Submissions and Schedule of Modifications as shown in the attachment to this report to progress to the
final stages of the consolidation of the Shire’s Town Planning Scheme No.1.

At the completion of public advertising on 6 November 2015 a total of thirteen (13) submissions had been
received by the Shire, all of which were from government agencies and key essential service providers.
These are tabled and summarized in the Schedule of Submissions for Council consideration as shown as an
attachment to this report.
FINANCIAL IMPLICATIONS
The Shire has allocated $55,000 in its Town Planning Scheme Review budget item to cover costs of
advertising and map preparation. Professional services are being undertaken in-house by the Shire’s
Planning Officer.

of a new Local Planning Scheme and associated Local Planning Strategy.

9.6.1 PROPOSED HEALTH LOCAL LAW 2016
Summary
That Council endorse for advertising the draft Shire of Kondinin Health Local law 2016 as part of the
required review of local laws. In undertaking this process now, significant time and cost savings can be
achieved as this process will be done concurrently with the Shires of Kulin, Corrigin, Bruce Rock and
Narembeen.
Background
The Environmental Health Officer (EHO) whilst conducting a review of current health local laws discovered
that the Health Local Law for Kondinin was gazetted in 1998. This makes the current local law 17 years old
and has not been reviewed. The Local Government Act 1995 requires that the Council every eight years
after adoption of any Local Law, or the last review, conduct a review of the Local Law to ensure that is still
retains currency. Presently the Shires of Corrigin is already well down the process of preparing a new
Health Local Law that has already gone through the lengthy review process. With the ‘hard yards’ done
already it is most fortuitous to seize this opportunity to take the proposed draft Health Local Law and
proceed to bring to Council in order to concurrently align with the same adoption process of Corrigin,
Narembeen, Bruce Rock and Kulin. In doing so the administration time and cost burden is dramatically
reduced in no uncertain terms.
Comment
The purpose of this report is to allow Council to resolve to prepare, with the specific local law making
power of the Health Act 1911 and pursuant to the processes for making local laws outlined in the Local
Government Act 1995, the proposed Shire of Kondinin Health Local Law 2016. Notice is to be publically
given of the purpose and effect of the Shire of Kondinin Health Local Law 2016 which are to be read out
loud by the Shire President as written here:
PURPOSE: The purpose of the proposed Shire of Kondinin Health Local Law 2016 is to provide for the
regulation, control and management of day to day public health matters within the Shire of Kondinin.
EFFECT: The effect of the proposed Shire of Kondinin Health Local Law 2016 is to establish various health
standards and requirements which people living and working within the Shire of Kondinin must observe.
The Shire of Kondinin Health Local Law 2016 shown in Attachment 1 has been collated from the Shire of
Corrigin Health Local Law 2015 as reviewed by the senior staff of Corrigin Shire, the Department of Local
Government and Communities and the Department of Health Western Australia. The attached Shire of
Kondinin Health Local Law 2016 is amended for application to the Shire of Kondinin.
The proposed Shire of Kondinin Health Local Law 2016 will require the following process to be initiated:
1. Give Statewide and local public notice of proposed Shire of Kondinin Health Local Law 2016,
summarizing purpose and effect of proposed local law;
2. Send a copy of the Statewide public notice and proposed Shire of Kondinin Health Local Law 2016
to the Honorable Minister for Local Government and the Executive Director of Public Health;
3. Consider any submissions received in regard to the proposed Shire of Kondinin Health Local Law
2016 (a period of at least 6 weeks must have elapsed since date of publication in the newspaper,
discounting public holidays; it is very good practice to allow a couple of extra weeks to
accommodate any unforeseen delays); and
4. A copy of the proposed local law is to be made available at the Shire counter and provided to any
person requesting a copy of the Shire of Kondinin Health Local Law 2016.
The proposed Shire of Kondinin Health Local Law 2016 will again be presented to Council for consideration

Kondinin Health Local Law 2016 has been tabled at the December 2015 Ordinary Meeting of Council for
consideration. During the review of the aforementioned local law the EHO became aware that a local law
pertaining to Animals, Environment and Nuisance under the Local Government Act 1995 powers concurrent
with the Health Act 1911 was also available. A review of this local law called the ‘Animals, Environment and
Nuisance Local Law’ shows that it has pertinent use for the Shire of Kondinin in addressing particular public
health aspects which could arise within the Shire of Kondinin and have accordingly been presented for
Council consideration.
Comment
The purpose of this report is to allow Council to resolve to prepare, with the specific local law making
power of the Local Government Act 1995 and pursuant to the processes for making local laws and the
enforcement of provisions outlined in the Local Government Act 1995, the proposed Shire of Kondinin
Animals, Environment and Nuisance Local Law 2016. Notice is to be publically given of the purpose and
effect of the Shire of Kondinin Animals, Environment and Nuisance Local Law 2016 which are to be read out
loud by the Shire President as written here:

Notice boards, all of which needs to be astutely documented. As this local law is being done concurrently
with the Shires of Bruce Rock, Corrigin, Kulin and Narembeen the Officer’s time will be dispersed over the
full 5 Shires thus resulting in administrative cost and, more importantly, time savings.

That Council pursuant to Section 3.12 of the Local Government Act 1995:
1. Adopts the proposed Shire of Kondinin Animals, Environment and Nuisance Local Law 20166 for
advertising;
2. Gives Statewide public notice and stating that:
(i) The Shire of Kondinin propose to implement the Shire of Kondinin Animals, Environment
and Nuisance Local Law 2016;
(ii) The purpose of the proposed Shire of Kondinin Animals, Environment and Nuisance Local
Law 2016 is to provide for the regulation, control and management of animals and the
prevention of environmental damage and nuisances within the Shire of Kondinin; and
(iii) The effect of the proposed Shire of Kondinin Animals, Environment and Nuisance Local
Law 2016 is to establish the requirements with which any person keeping animals, or
undertaking activities that have the potential to impact the environment or create
nuisance must comply.
A copy of the proposed local law may be inspected or obtained at any place specified in the notice; and
Submissions about the proposed local law may be made to the Shire before the day specified in the
notice, being not less than 8 weeks after the notice is given.
3. Provides a copy of the proposed local law and notice to the Hon. Minister for Local Government
and the Executive Director of Public Health; and
4. Directs the Chief Executive Officer to prepare a report to Council detailing submissions from the
community at the first Council meeting following the closure of the designated submissions period.

being installed as rocks still being thrown into dive pool after hours.

Any Other Issue: The paint in the lap pool is becoming chalky and no amount of scrubbing is
fixing the problem. Can the shire look at tiles for this pool which will save
having to empty pool and repaint every 3 years.

I have recently found some very faint hair cracks in some of the tiles in the pool whilst doing an inspection. I
have alerted Commercial Aquatics about this issue, they have requested some photographs of the tiles to
determine possible cause and the right tradesperson for the job. I am currently waiting on a high-resolution
camera to arrive, which should be here any day now.
The school has just completed their first swimming lessons season in the pool and from what I could tell
everybody was enjoying the facility. The swimming instructors planned an emergency evacuation and all
went well, however the entrance hall made for a slippery exit. I would recommend to place a strip of carpet
through the entrance hall.
I would like to hold an outdoor movie night under the stars at the pool for Australia Day. I believe this can
be achieved for little expense $300-$400 tops. This would be for materials ply wood, steel, paint and some
quickset cement. The screen size will be approximately 3.6 meters x 2.4 meters I can make it so it can easily
be erected and taken down with 2 people. Depending on the turnouts I’m hoping that this could be a
regular event throughout the summer’s hot nights on the weekends. With a BBQ some music and a movie
I’m looking forward to a great Australia Day weekend!
I would like to have a pin up notice board in the entrance hall as the pool is a popular venue in Kondinin for
locals and tourists. I think this may be good for local events, tourist attractions and local business
advertising.

9.9 MAINTENANCE REPORT
The Month was quiet but steady. Routine maintenance was carried out at Kondinin caravan park and chalets as
required.
The Eastern end old fence near the pump house at the Hyden pool has now been removed and the new gates
and fence are completed along with new barb wire etc. A new wall mounted fan was installed in the kiosk. This
now concludes the 2015 winter maintenance programme for the pool and work will only be done on an "If
required " basis over the next 6 months.
After vandals visited the Hyden public toilets we needed to install new toilet roll holders etc.
A new tap was set up at McCann’s Rock to be able to use a hose.
The bin in the Hyden travel stop car park was refurbished along with new "No Camping" signs erected.
New security screens were installed on all the windows at the Hyden works depot.
The "Exit" signs at most of the Shire buildings were checked and new light tubes replaced where required.

There was one Feral cat trapped and impounded for 6 days then destroyed.

A couple of months back I reported on a matter of illegal dumping of rubbish within Lake Gounter Nature
Reserve in Hyden. After information received in the last week or so no further action will be taken
regarding this particular matter and the rubbish will be cleaned up soon.
