“At 6.40pm or as soon as practicable thereafter, a period of not more than30 minutes is to be set aside for public question time during which any member ofthe public may ask questions relating to the activities of the Council.

“The Local Government (Meeting Procedures) Regulations 2015 provide as follows:

’29 (1) A councillor at a meeting may ask a question without notice –

(a) of the chairperson; or

(b) through the chairperson, of –

(i) another councillor; or

(ii) the general manager.

(4) The chairperson, councillor or general manager who is asked aquestion without notice at a meeting may decline to answer thequestion.

(5) The chairperson of a meeting may refuse to accept a questionwithout notice if it does not relate to the activities of the council.

(6) Questions without notice, and any answers to those questions, arenot required to be recorded in the minutes of the meeting.

(7) The chairperson may require a councillor to put a question withoutnotice in writing.’

If a question gives rise to a proposed matter for discussion and that matter is notlisted on the agenda, Councillors are reminded of the following requirements of theRegulations:

‘8 (5) Subject to subregulation (6), a matter may only be discussed at ameeting if it is specifically listed on the agenda of that meeting.

(6) A council by absolute majority at an ordinary council meeting, …,may decide to deal with a matter that is not on the agenda if –

(a) the general manager has reported the reason it was notpossible to include the matter on the agenda; and

(b) the general manager has reported that the matter is urgent;and

(c) in a case where the matter requires the advice of a qualifiedperson, the general manager has certified under section 65 ofthe Act that the advice has been obtained and taken intoaccount in providing general advice to the council.’

‘30 (1) A councillor, at least 7 days before an ordinary council meeting or acouncil committee meeting, may give written notice to the general managerof a question in respect of which the councillor seeks an answer at thatmeeting.

(2) An answer to a question on notice must be in writing.’

It is to be noted that any question on notice and the written answer to the questionwill be recorded in the minutes of the meeting as provided by the Regulations.

Any questions on notice are to be allocated to their appropriate DepartmentalBusiness section of the agenda.

347/2015 Delegation of National Heavy Vehicle Law and National Heavy VehicleRegulator (176/2014 – 16.06.2014)

The Director Infrastructure Services reported as follows:

“PURPOSE

The purpose of this report is to update the Council on the Heavy Vehicle NationalLaw (Tasmania) Act 2013 (the Act) and recommend the delegation of the Council'spowers as Road Manager to the General Manager.

BACKGROUND

In June 2014, the Council considered information on the progress of the HeavyVehicle National Law and by resolution (Minute No. 176/2014) updated previousapprovals by permitting “…the use of higher mass limit vehicles, with road friendlysuspension, subject to consideration by the Director Engineering Services andcompliance with the Heavy Vehicle National Law (Tasmania) Act 2013 and therequirements of the National Heavy Vehicle Regulator…” to use the Central CoastCouncil road network.

DISCUSSION

As the Road Manager, Local Government is recognised in legislation as beingresponsible for consenting to access for ‘restricted access’ vehicles on their roads,and the conditions under which they will operate.

Section 16 of the Act states:

‘16. Road manager

The following are declared to be the road manager for a road in thisjurisdiction for the purposes of the Heavy Vehicle National Law (Tasmania):

(a) for a road controlled by the State, the Minister administering theRoads and Jetties Act 1935;

(b) for a road controlled by a local government authority, the localgovernment authority; ’

The national law sets out the role of the Local Government as Road Manager andthen indicates responsibilities on a range of matters including the capacity toprovide consent to industry applicants seeking to travel on the relevant RoadManager's roads.

In order to satisfy the requirements of the Act and for officers to exercise powers forapprovals under the Act it is necessary for the duties to be delegated to the GeneralManager who can then delegate these powers to the appropriate Council officers.

In order for timely approvals and responses to be given to the Regulator under theAct the following requires delegation:

(a) Section 16(b) of the Act - to perform the duties of the Road Manager.

(b) Section 156 of the Act - to perform the duties of the Council if the Regulatorasks for the Council’s consent to the grant of a mass or dimension authority,decide to give or not to give the consent.

(c) Section 158 of the Act - to perform the duties of the Council if theconsultation with the other entity is not yet completed, to, as far aspracticable, deal with the request for consent and decide to give or not togive the consent (even though the consultation with the other entity is notcompleted).

(d) Section 159 of the Act - to perform the duties of the Council to form theopinion a route assessment is necessary for deciding whether to give or notto give the consent and notify the Regulator.

(e) Section 160 of the Act - to perform the duties of the Council to impose roadconditions.

(f) Section 161 of the Act - to perform the duties of the Council to impose travelconditions.

(g) Section 162 of the Act - to perform the duties of the Council to imposevehicle restrictions.

(h) Section 167 of the Act - to perform the duties of the Council to expedite theRoad Manager’s consent for renewal of mass or dimension authority.

(i) Section 169 of the Act - to perform the duties of the Council to grant limitedconsent for trial purposes.

(j) Section 170 of the Act - to perform the duties of the Council to renewlimited consent for trial purposes.

(k) Section 172 of the Act - to perform the duties of the Council to issue astatement explaining adverse decision of the Road Manager.

(l) Section 173 of the Act - to perform the duties of the Council to issue anamendment or cancellation on the Regulator’s initiative.

(m) Section 174 of the Act - to perform the duties of the Council to issue anamendment or cancellation on request of the relevant Road Manager.

(n) Section 176 of the Act - to perform the duties of the Council to issue anamendment or cancellation on application by the permit holder.

(o) Section 178 of the Act - to perform the duties of the Council to issue anamendment or cancellation on the request of the Road Manager.

CONSULTATION

There has been ongoing consultation with the Local Government Association ofTasmania and the Department of State Growth since the inception of the Act and theNational Heavy Vehicle Regulator (NHVR) on access permit requirements. Thisrequest has been borne out of these discussions to ensure adequate delegation forofficers to perform their duties.

RESOURCE, FINANCIAL AND RISK IMPACTS

There is no financial risk on this item. There is potential liability risk for permitsissued without correct delegations for the purpose.

CORPORATE COMPLIANCE

The Central Coast Strategic Plan 2014-2024 includes the following strategies andkey actions:

A Connected Central Coast. Provide for a diverse range of movement patterns

Council Sustainability and Governance. Improve corporate governance. Improve service provision. Strengthen local-regional connections.

CONCLUSION

It is recommended that the following powers and duties under the Act be delegatedto the General Manager:

HEAVY VEHICLE NATIONAL LAW (TASMANIA) ACT 2013

(a) Section 16(b) of the Act - to perform the duties of the Road Manager.

(b) Section 156 of the Act - to perform the duties of the Council if the Regulatorasks for the Council’s consent to the grant of a mass or dimension authority,decide to give or not to give the consent.

(c) Section 158 of the Act - to perform the duties of the Council if theconsultation with the other entity is not yet completed, to, as far as

349/2015 Central Coast Arts and Culture Strategy 2015-2020

The Director Community Services reported as follows:

“The Community Services Group Leader has prepared the following report:

‘PURPOSE

The purpose of this report is to seek the Council’s support for the adoptionof the Central Coast Arts and Culture Strategy 2015-2020 (a copy of theStrategy is provided as an annexure to this report).

BACKGROUND

Arts and culture encompasses all forms of creative practice and artistic andcultural expression and activity. This includes but is not limited to visual art,music, dance, writing, craft, theatre, media art, multi-arts, design, public art,evets, festivals, exhibitions, community cultural development andpreservation of knowledge, stories, heritage and collections.

Central Coast has witnessed a resurgence of arts and cultural activity overthe last five years and there is strong evidence that this trend will continue.Bookings of the Leven Theatre and the Gnomon Pavilion at the Wharf Precinctfor community activities are very strong for 2016. Community driven

activities such as Friday Night Live@theWharf, Artizano, Jazz Live@theWharf,the Central Coast Farmers Market, Leven Regional Arts Gawler Galleryactivities and exhibitions and the Turners Beach Growers & Makers TwilightMarket are all attracting crowds to their spaces on a regular basis.Live@theWharf recently celebrated its 150th Friday night performance and isattracting 100 patrons on average to each performance.

On its website Arts Tasmania reports on the social impacts of creativeparticipation in arts and culture saying;

“…A growing area of policy direction both internationally andnationally is the social impact of ‘creative participation’ and ‘receptiveparticipation’ in arts and cultural activity on the community. Theeconomic value of the arts and cultural sector is widely recognised asbeing only one part of its net worth to the community.

Reports have indicated that the outcomes of participating in arts andcultural activity are manifold. They include: cognitive improvementand educational attainment, social behaviour, communitypride/identity, social cohesion, crime prevention, personal security,self-esteem, mood and development of life skills.

Policy development is increasingly focusing on the intersection ofparticipation in arts and cultural activity and other areas of publicconcern such as education, crime prevention, community identity anddevelopment. This focus led to the key national cultural strategydeveloped and implemented by the Australia Council (in conjunctionwith State and Territory arts agencies) called ‘Promoting the Value ofthe Arts’. …”

Arts and cultural programs enhance the liveability of our towns and ruralareas and help to build a positive image of Central Coast for residents. In2016 the Central Coast Council will partner with the Live@theWharfCommittee to stage the first “Festival of Small Halls” event at the SulphurCreek Hall. This three-hour event featuring international, national and localacts promises to make a difference to the cultural “vibe” of Sulphur Creek aswell as the broader Central Coast region.

DISCUSSION

The Strategy describes the Council’s leading role in fostering, supportingcommunity initiatives and celebrating artistic and cultural endeavour.

Community feedback from the consultation process conducted for theCentral Coast Strategic Plan 2014-2024 was that they valued:

. arts and theatre culture;

. community and cultural events; and

. that as a community we are: “creative and insightful”.

The Council has identified in the Strategic Plan 2014-2024 under StrategicDirection 2 – “A Connected Central Coast”, one of its strategies to improvecommunity wellbeing:

. Engage with the community to achieve meaningful local arts andcultural outcomes.

In the Arts and Culture Strategy 2015-2020, the Council has five broadobjectives. They are:

Objective 1: InclusionObjective 2: Stronger CommunityObjective 3: Arts and cultural practiceObjective 4: Skills, knowledge and networksObjective 5: Creative spaces and places.

The Strategy describes how the Council will achieve these objectives throughits Officers and Departments by:

. facilitating and coordinating arts and cultural development projects;

. promoting and advocating for arts and cultural improvement onbehalf of community;

. investing in infrastructure, cultural institutions and events that makea significant contribution to Central Coast and supporting communityinitiatives that do likewise;

. providing services and programs where gaps exist or developingpartnerships that fulfil an identified arts/cultural need in thecommunity.

CONSULTATION

The Council has ongoing relationships with Museum volunteers, the GawlerGallery, Ulverstone Repertory Society, Youth Theatre, Leven Regional Arts,Tasmanian Regional Arts as well as individual artists from multiple arts and

Ongoing relationships with and within these groups will enable continualconsultation and feedback as the Council moves forward to meet the aimsoutlined.

RESOURCE, FINANCIAL AND RISK IMPACTS

This Strategy will not require any additional funding over and above thatwhich is currently set aside in the budget. Funded opportunities include thecontinued development of the Gnomon Pavilion as a cultural and artisticspace, Community Services officers working in a proactive way to supportarts and culture-based community initiatives and actively pursuing fundingopportunities to help develop and/or support artistic and cultural programsand events.

CORPORATE COMPLIANCE

Issues –

1 Building envelope (setback from rear boundary of 9 Helen Street,West Ulverstone with an adjoining frontage) -The required setback from the rear boundary of 9 Helen Street,West Ulverstone is 4.5m. Part of the building would be 3.8m from therear boundary of 9 Helen Street, West Ulverstone. The PerformanceCriteria requires the siting and the scale of the dwelling must notcause an unreasonable loss of amenity by:

(a) overshadowing of the habitable rooms and the private openspace areas; and

(b) the visual impact caused by the apparent bulk, scale orproportions of the dwelling.

It also requires that the separation between buildings is compatiblewith that prevailing in the surrounding area. The building is locatedto the south of 9 Helen Street, West Ulverstone therefore there wouldbe no overshadowing of the habitable rooms and private open spacescaused to 9 Helen Street, West Ulverstone.

The two-storey building proposed would be between 5m and 6mfrom the side boundaries and approximately 7m in height. The sideboundary setbacks proposed are more than the required setbacks andthe separation between buildings is compatible with that prevailing inthe surrounding area. These factors indicate that the visual impact isnot unreasonable and on this basis, it is considered there iscompliance with the Performance Criteria.

2 Private open space requirements -

The requirements for private open space for the Residential unit(Unit 6), inter alia, require that it is in one location, at least 24m2 inarea, have a minimum dimension of 4m and is not located to thesouth of a dwelling. Unit 6 would have a 15.75m2 deck with aminimum dimension of 3m that is located to the south of the unit.There are no private open space requirements for the VisitorAccommodation use of the proposal in the Scheme, however, a deckis proposed for each unit.

The applicable Performance Criteria requires private open space mustbe capable of serving as an extension of the dwelling conveniently

The proposed deck for Unit 6 would be directlyaccessible from the living area and would receive adequate sunlightparticularly in the morning and afternoon. These factors demonstratethe proposed private open space complies with the PerformanceCriteria.

3 North facing living areas -

There would be no habitable room (other than a bedroom) in whichthere is a window that faces between 30 degrees west of north and30 degrees east of north.

The applicable Performance Criteria states that a dwelling must besited and designed so as to allow sunlight to enter at least onehabitable room (other than a bedroom). The design of the buildingwould allow some sunlight to enter the habitable living spaces.Accordingly, the proposal meets the Performance Criteria.

4 Parking area located at frontage -

The Scheme requires that an external parking area be located behindthe primary frontage of a building. The proposal would provide carparking located in front of the building. The Performance Criteriastates that the parking area must be consistent with the streetscape,be required by a constraint and provide physical screening.

The parking area would be consistent with the streetscape as units at19 Helen Street, West Ulverstone have car parking located in front ofthe units. The parking area located in front of the building is alsorequired due to the L-shaped shape of the site. Landscaping islocated in front of the parking area to provide physical screening andif approved, a condition is proposed to require this landscaping to beprovided and maintained. Compliance with the Performance Criteriais achieved.

5 Signage -

The signage proposed would include a free standing sign with a facearea of 5.25m2 approximately 3m in height and located at the front ofthe site. Also proposed are two panel signs 2.7m2 each in area on thewestern and eastern elevation of the building below the eave line.Signage in the General Residential zone is restricted to no more than

The applicable Performance Criteria relates to whether the signagewould visually dominate or intrude on the appearance of the site orstreetscape and whether visible beyond the immediate locality. Theproposed signage would not visually dominate the streetscape as thesignage proposed is relatively small. The signage proposed wouldnot be visible beyond the immediate locality. For these reasons, anexercise of discretion is supported.

The purpose of this report is to consider the tenders received for theprovision of security services to Central Coast Council for the period1 January 2016 to 31 December 2018.

BACKGROUND

The Council has a need for security services in the form of security patrols,facility lock-ups, boom gate and picnic shelter lock ups, alarm monitoring,cash pick-up and, on occasion, alarm/duress callout and other securityservices.

Tenders for this service were called on Saturday, 17 October 2015 and closedat 2.00pm on Tuesday, 10 November 2015.

The provider for the Council’s security services for the past three years hasbeen Retail Security Services who has undertaken the tender in a professionaland timely fashion.

All tenderers generally meet the requirements of the specifications and havethe capabilities to provide the service. Four of the tenderers have indicatedthat they would be sub-contracting some services to other providers due tothe inability of their company to provide the services completely.

The standard weighted tender assessment method used in the Council’sassessment of tenders was used. This is based on:

. compliance with tender documents;

. previous experience with local government security services;

. quality, delivery and service;

. management/supervisory personnel;

. WHS Policies and Procedures; and

. tender price.

Based on the detailed assessment undertaken by the Tender Evaluation Panelusing the above criteria and weighting process (confidential copy attached),the tender from Retail Security Services was found to provide the best valuefor money for the Council. The tender is therefore recommended foracceptance.

CONSULTATION

This item has followed a public tendering process.

Probity procedures were followed.

RESOURCE, FINANCIAL AND RISK IMPACTS

The provision of these services is included in numerous maintenance/operational budgets. The tender prices have remained stable whencompared with the tender from three years ago and are easilyaccommodated within these budgets.

It was briefly mentioned and a question by Cr Gerry Howard as to whether anyaction had been taken was answered by the General Manager with the single word,‘Yes’.

My question to Council is, ‘What specifically has been done – without mentioningany names or addresses.’ ”

“The Local Government (Meeting Procedures) Regulations 2015 provide that ameeting of a council is to be open to the public unless the council, by absolutemajority, decides to close part of the meeting because one or more of the followingmatters are being, or are to be, discussed at the meeting.

Moving into a closed meeting is to be by procedural motion. Once a meeting isclosed, meeting procedures are not relaxed unless the council so decides.

It is considered desirable that the following matters be discussed in a closedmeeting:

VISIONTo foster and support arts and cultural development within Central Coast, and toensure that the art and cultural assets held by our cultural institutions are accessibleto all.

The Council encourages the growth of arts and culture initiatives as part of anintegrated response to the ongoing development and promotion of Central Coast as aunique and thriving community that offers a wide range of opportunities and benefitsto current and intending residents and visitors. Active community participation andengagement in arts and cultural activities is encouraged and the importance offostering innovation and excellence is also recognised.

ARTS AND CULTUREArts and culture encompasses all forms of creative practice and artistic and culturalexpression and activity. This includes but is not limited to visual art, music, dance,writing, craft, theatre, media art, multi-arts, design, public art, events, festivals,exhibitions, community cultural development and preservation of knowledge, stories,heritage and collections.

‘Culture’ means different things to different people and the word itself has manycontexts. It can be used to describe a sub-group or experience (skate culture); ashared set of values and way of doing things (team culture); and to evoke ancientcivilisations (Indigenous culture). Sometimes ‘culture’ signifies a community’s beliefs,heritage and distinct characteristics and other times it is used to mean ballet, theatre,sculpture – ‘the arts’.

The United Nations Education Scientific Cultural Organisation’s (UNESCO) definition ofculture provides a useful touchstone:

“…the set of distinctive spiritual, material, intellectual and emotional featuresof a society or a social group, that encompasses not only art and literature, butlifestyles, ways of living together, value systems, traditions and beliefs.”

UNESCO, 2001

This strategy does not seek to limit the term ‘culture’, instead it encourages ourartists, residents and visitors to explore what ‘culture’ means to them.

What do we consider ‘cultural activity?

Cultural activity includes but is not limited to, visual and performing arts, music,museums and galleries, history and heritage including the natural environment,Indigenous culture, craft, libraries, literature, publishing, digital and new media,design, architecture, food, film, fashion, television and radio.

This definition of cultural activity reflects the cultural domains defined in UNESCO’sFramework for Cultural Statistics 2009.

INTRODUCTIONCentral Coast is proud of our artists and our arts and cultural organisations. TheCouncil is committed to partnering with them to facilitate activities and assist them asthey explore, create and challenge us to see the world and ourselves differently.

Arts and culture can play a vital role in supporting community cohesion and wellbeing,and generate community pride as well as fostering economic development and touristvisitation.

Arts and cultural programs enhance the liveability of towns and rural areas and help tobuild a positive image of Central Coast for residents and visitors alike.

The Council will work to ensure that our artistic and cultural assets held and createdby our arts and cultural institutions are accessible to the broad community.

This Strategy will also outline actions the Council can undertake to build and sustainfruitful and collaborative relationships with our arts and culture organisations andindividuals, understanding that strong relationships provide the best foundation forbuilding the arts and culture offering in the Central Coast, which stands to benefit notonly the local population but builds value that is economic, cultural and social.

The ways in which individuals engage with arts and culture is deeply personal, whetherfrom an audience or creative perspective and the Council will endeavour to supportthose institutions that work actively to offer opportunities to the community toparticipate in artistic endeavour.

In addition to the contribution of employment and products of the creative industries,there are significant economic benefits to be gained from cultural activities such ascultural festivals and events.

It is intended that the Central Coast Arts and Culture Strategy be oriented to provide aframework to support the development of arts and culture in Central Coast throughCouncil and community partnerships. It is fundamentally a guide for the delivery ofCouncil services and Council support to ensure that there is a whole-of-Councilresponse to community cultural development.

ALIGNMENT WITH CENTRAL COAST STRATEGIC PLAN2014-2024Community feedback from the consultation process conducted for the Central CoastStrategic Plan 2014-2024 was that valued by the citizens of Central Coast were:

and that as a community we are:

The Council has identified in the Central Coast Strategic Plan 2014-2024 underStrategic Direction 2 – “A Connected Central Coast”, one of its strategies to improvecommunity wellbeing:

Strategic Direction 3 – “Community Capacity and Creativity” identifies that the Councilwill cultivate a culture of creativity in the community through the following keystrategies and actions:

. Investigate feasibility of creating a local creative industries and arts hub;

. Conduct a review of the Ulverstone Civic Centre to optimise usage and improvecommunity outcomes;

. Progress the implementation of the Ulverstone History Museum Strategic Planand Interpretive Strategy;

. Review the Central Coast Arts and Culture Strategy; and

. Implement the Central Coast Events Strategy.

The Council’s intention is to create an environment where a range of individuals andcommunity groups can prosper and develop their potential. The Council aims tofacilitate partnerships between community groups, government and other agencies,with a view to maximising available resources for the betterment of community life andfor economic and tourism development.

Support artists, arts and cultural workers, organisations and the community inthe development, presentation, delivery and distribution of high quality artsand cultural products, processes and services.

Objective 4: Skills, knowledge and networks

Provide opportunity for the development of skills, knowledge and networks inthe community to support creative practice and the delivery of arts and culturalprograms and activities.

Objective 5: Creative spaces and places

Support the development of spaces and places that contribute to a vibrant artsand cultural life in Central Coast.

To achieve these objectives the Council will:

Coordinate/facilitate

The Council will actively support, nurture and guide, where possible, thedevelopment of arts and creative industries and cultural development projects,particularly where the Council can build partnerships with other governmentagencies and the private sector.

Promote/advocate

The Council will, where possible, help to promote arts and cultural activities toensure that they gain the exposure they need to succeed and contribute tocommunity enrichment.

ACTIONS AND INTENTIONSOpportunities for the Council to assist the growth of arts and culture in Central Coast.

Open space activation

Support the development of art programs and cultural events held in public spaces,that work to generate activity and a sense of community connection and caring for theenvironment.

Artwork platforms

Explore the creation of vibrant public spaces through the identification of suitablelocations, for the temporary exhibition of artworks and art forms. The platformswould provide opportunities for a range of performance art, ephemeral and installationworks music performance.

Rethinking and revitalising our arts and culture infrastructure

Cultural infrastructure enables the people of, and visitors to Central Coast to accessmany art forms. Arts and cultural facilities are essential for creation and presentationof works by artists and cultural workers. The Council will scope opportunities to renewand develop further our cultural infrastructure and ensure we have sound businesscases for development, prioritising opportunities with the potential to deliver thegreatest impact for the people of Central Coast.

Activating the use of other Council facilities

The Council has a rich and diverse range of facilities that could be better utilised forcultural activities.

In addition to the Civic Centre, Outdoor Entertainment Centre, Gnomon Pavilion,History Museum, and the Ulverstone Sport and Leisure Centre, the Council has localhalls which can be better utilised for arts and cultural activities, and the Council willwork to encourage and promote community usage of all Council facilities, includingthose not normally associated with arts and cultural activities.

The Council will work collaboratively with other Councils and government bodies (ArtsTasmania, Tasmanian Regional Arts) to facilitate creative industry development forumsand to acknowledge the importance of creative industries as a driver of innovation andchange. Arts and culture is a potentially significant sector for increased employmentopportunities and contributing to the Central Coast economy.

Cultural capacity building

The Council will, where possible, support through applying for grants and funding, andthrough the facilitation of programs and forums, assist Central Coast artists to maketheir practice, or organisation more sustainable.

Showcase arts and culture

Explore opportunities to showcase the diversity, creativity and excellence of CentralCoast creative endeavours.

Connecting creative people

By its nature creative industries practitioners tend to work in isolation, often incompetition. The Council will work to make it easier for artists to connect and explorecollaborative opportunities and approaches with a view to development, growth andsustainability.

To make the Central Coast Council website and potential social media spaces the ‘goto’ point to find opportunity for engagement and participation in arts and culturalevents.

Making connections - making it easy

The Community Development Officer and Cultural Facilities and Events Officer to bethe first point of contact for those wishing to develop and host arts or cultural eventsin Central Coast.
