Approval of the The Chair called for a motion in regards to the minutes of the October 1, 2015 Minutes: meeting.

The DAG stated that on page 5, paragraph 4, the last sentence should read, “By re-reviewing the section along with the NCSBN Model Act/Rules that the Board previously adopted, we may justify any a re-interpretation by the Board.”

There being no further amendments, upon a motion by Mr. Joslyn, seconded by the Vice Chair, it was voted on and unanimously carried to approve the minutes of the October 1, 2015 meeting as amended.

Chair’s Report: Announcements/Introductions None. Vice Chair’s Report: Continuing Competency for Nursing Summit, October 20, 2015 The Vice Chair reported that she and Ms. Daub will be conducting the NCLEX

Member Board/Regulatory Body Review on November 11, 2015.

She also reported on her presentation at the October 20, 2015 Continuing Competency for Nursing Summit at which time she gave a presentation on the Board’s Perspective’s: Regulating and Auditing based on a power point created by the EO. She reported that other presentations at the Summit included a report on the Healthcare Workforce by Linda Chu Takayama, Director of the Department of Labor and Industrial Relations, Sandra LeVasseur, Associate Director for the Hawaii State Center for Nursing (‘HSCFN”), Cindy Kamikawa from Queen’s, Suzie Schulberg from Arcadia and Diane Knight from Hawaii Pacific University. The Continuing Competency presentations included Laura Reichhardt, Director for the HSCFN, Glenda Tali, Vice Chair for Hawaii Board of Nursing, Susie Lee, HSCFN Board member, Amy Thomas, HPH, Beth Hoban, Primecare Hawaii, Ashley Burt and Jeramae Marcellano, HiSNA and Josette Kawana and Maureen Meeham-Golonka from HGEA and HNA.

Practice Committee Ms. Kodama reported on the October 1, 2015 Practice Committee Meeting as Report: follows: Continuing Competency

The Committee will start researching and collecting information on Board approved learning activities for compliance with the continuing competency requirements.

Correspondence

1. LPN’s pushing medications – The Committee recommends that based on the nursing laws and rules (nurse practice act), the nurse practice act does not specifically prohibit an LPN from pushing medication, however, the LPN must have received the appropriate education and training to perform such a task and is under the direction of a dentist, physician, osteopathic physician, registered nurse, osteopath, or podiatrist licensed in accordance with chapter 448, 453, 457, 460, or 463E, or under the orders of a physician assistant licensed pursuant to chapter 453, practicing with physician supervision as required by chapter 453, and acting as the agent of the supervising physician. In addition, the LPN is also accountable and responsible for the quality of nursing care rendered. In addition, pursuant to HRS §457-1.5, “The scope of nursing practices established in this chapter and by the rules of the board shall serve as general guidelines and are not intended to address the appropriateness of the use of specific procedures in any particular work setting or to grant permission to implement specific procedures in any particular work setting.” In accordance with Hawaii Administrative Rules §16-201-90, the above mentioned interpretation is for informational and explanatory purposes only. It is not an official opinion or decision and is thus, not binding on the Board.

2. APRNs administering Naloxone – The Committee recommends that based on

the nursing laws and rules (nurse practice act), an APRN may administer Naloxone, a narcotic antagonist.

3. RN administering Propofol – The Committee recommends that although this is not considered a standard of practice recommended by both the manufacturer of the drug, the recommendation to the Board is that the nurse practice act does not provide direct guidance regarding deep or moderate sedation by RNs and does not specifically prohibit an RN from administering anesthesia or sedation or paralytic medications, however, the RN must have received the appropriate education and training to perform such a task and is under the direction of a dentist, physician, osteopathic physician, registered nurse, osteopath, or podiatrist licensed

in accordance with chapter 448, 453, 457, 460, or 463E, or under the orders of a physician assistant licensed pursuant to chapter 453, practicing with physician supervision as required by chapter 453, and acting as the agent of the supervising physician. Executive Officer’s Conferences/Seminars/Meetings Report: Leadership and Public Policy Conference, October 27-29, 2015, West Lake,

California Ms. Kodama asked if she could provide her report at the December meeting as

some of the materials from the conference are not yet available. Psychopharmacology Conference, Outrigger Reef Waikiki Beach Resort, Honolulu, Hawaii, February 3-5, 2016 (pending approval by the AANP)

The EO reported there will be a Psychopharmacology Conference February 3-5, 2016, pending approval by the AANP in case anyone was interested in attending.

2016 NCSBN APRN Roundtable, April 5, 2016, Rosemont, Illinois – Thomas Joslyn

The EO asked Mr. Joslyn if he would be able to attend the 2016 NCSBN APRN Roundtable.

Mr. Joslyn stated he was still not sure if he can attend but would check his schedule and

let the EO know as soon as possible.

2015 Legislature – Status Report Amend DLIR, DOH and DHS Statutes for APRN Recognition The EO reported that she emailed the draft to Ms. Reichhardt that included the

clarifying amendment to enforce the Board’s previous interpretation that APRNs with prescriptive authority may dispense non-controlled substances to patients under their care.

Repeal Joint Formulary Advisory Committee Bill The EO reported that she has not received any word on the status of this admin

bill. Amend Board Member Terms to Four Years Bill The EO reported that she has not received any word on the status of this admin

bill. NURSYS Bill The EO reported that she has not received any word on the status of this admin

bill.

Amendments to Title 16, Chapter 89 The EO reported that she is preparing 5 amendments to the admin rules on issues that have been previously discussed by the Board. She asked that the Board consider the following amendments:

Mandatory Reporting Based on information researched by University of Phoenix students who were

requested to research other state’s regulations for language pertaining to mandatory reporting of unprofessional conduct.

The proposed amendment would be to add language under section 16-89-60

Types of unprofessional conduct., making it a violation for failing to report any disciplinary action, termination or resignation of a nurse related to clinical competence or unprofessional conduct.

Limit Number of Times Can Take NCLEX, Remediation The proposed amendment to section 16-89-9 Examination policies., has to do with

determining the number of times an individual may take the NCLEX exam and fail before requiring a remedial course. Currently, there is no limit and the Board was concerned that the exam candidate may keep taking the exam and failing without any remediation.

The Board reviewed language from other states that had remediation language if

an individual failed the NCLEX after a certain number of tries. The Board also reviewed language on board-approved remedial courses from other states.

Amend §16-89-126 and 16-89-128 to include adoption of APRN scope of practice These sections would be amended to include the APRN scope of practice that will

align with HRS section 457-2.7. Correction to National Certifying Bodies (3/2011 BON Meeting) The proposed amendment would be to correct and update the national certifying

bodies recognized by the Board under section 16-89-85. Random audits of APRNs with prescriptive authority renewal requirements The EO asked if the Board would consider conducting a random audit for APRNs

with prescriptive authority renewal requirements. Currently, upon renewal of the APRN license, those APRNs with prescriptive authority are required to submit 30 hours of continuing education, of which 8 hours are in pharmacology related to the APRNs clinical practice specialty area and the remaining 22 hours in the APRNs practice specialty area. In addition, the APRN must also submit proof of a current/valid national certification in the nursing practice specialty.

The EO stated that in most cases where a licensee has renewal requirements, the

Board would require an attestation on the renewal by the licensee that they have completed the renewal requirements and understand they will be subject to an audit that they must comply with. Failure to comply would result in the automatic forfeiture of the nurse’s prescriptive authority and a RICO referral.

After further review, it was the consensus of the Board to direct the EO to prepare a draft of the proposed amendments to the administrative rules for the Board’s consideration.

Ms. Kim arrived 9:25 a.m. Additions to the The Chair called for a motion to add the following to the agenda: Agenda Additions 7. Executive Officer’s Report d. Continuing Competency Program 7) Swank Healthcare Upon a motion by Mr. Joslyn, seconded by the Vice Chair it was voted on and

unanimously carried to add this item to the agenda. Continuing Competency Program If an individual has a Hawaii LPN and RN license, do they have to complete 2

learning activities? The EO reported that she was speaking with a nurse who has both an LPN and

RN license who wanted to know if she had to complete 2 learning activities, one for the LPN and one for the RN?

The EO asked the Board, shouldn’t the learning activity depend on the nurses’

clinical practice so if a nurse is practicing as an LPN but maintains an RN license, shouldn’t they complete a learning activity to enhance their current practice?

After some discussion, it was the consensus of the Board that if an individual

maintains more than one nurse license, i.e. LPN and RN, RN and APRN (no national certification), then the individual must complete one learning activity at the higher license level, i.e. LPN and RN, individual must complete learning activity for RN level, RN and APRN (no national certification), individual must complete one learning activity for APRN level.

Comprehensive Health Center – Clarification of CE and Refresher Course Learning Activities

The Board reviewed the following email inquiry and after some discussion, it was the consensus of the Board to respond as follows:

Pursuant to reading the HRS Chapter 457 Nurses; §457 - Learning Activity

Options, I would like to request clarification to the following if the applicant is a

currently licensed LPN or RN seeking a renewal:

1. Thirty Contact hours of continuing education activities-Accepted/ Approved "contact" hours are defined as activities obtained via:

a. Face-to-face, In-person, physically present, etc.

b. Internet, Subscription, Teleconference, Webinar, etc.

c. OR a combination of all of the above

2. How/Whom would one receive Board approval for a selected refresher course

Response: You may submit the information for the course that includes the provider, instructor, objectives of the course and course materials, etc. for Board approval.

3. "(10) A similar type of learning activity"

a. What types of learning activity qualifies for this requirement

Response: That was left “open” in case there were other “learning activities” that were not specifically listed. So if you have an activity that you would like to see could be recognized as a Board approved learning activity, you may send in the information for the Board’s consideration.

b. Is Board approval required for the selected learning activity

Response: Yes, Board “recognized” means Board approval.

c. How directly related to nursing must the learning activity be, for example:

i. Leadership/management seminars

ii. Human resources conferences

iii. Liberal arts classes (math, social science, writing, etc.)

Response: It should be “directly” related to the nurse’s job,

however if in doubt, you may submit the information for the Board’s consideration.

4. Finally, am I understanding correctly, the continuing competency

requirements must be met for one to apply for license renewal in/on

July 1, 2017?

Response: No, a nurse licensee will be required to complete one

of the learning activity options prior to renewing by June 30,

2019…so the July 1, 2017 dates indicates when the nurse licensee

can “start” taking one of the learning activity options.

Power Point Presentation on “Continuing Competency – Hawaii State Board of

Nursing’s Perspectives: Regulation and Auditing” The Board was provided with a copy of the Power Point Presentation on

“Continuing Competency” – Hawaii State Board of Nursing’s Perspectives: Regulation and Auditing that was given by the Vice Chair at the Continuing Competency for Nursing Summit on October 20, 2015.

Board of Examiners in Optometry Sample Forms The Board reviewed the following forms:

Program Sponsor Agreement for Continuing Education

The EO stated the Board of Examiners in Optometry uses these forms for programs that want Board approval on their CE courses. The EO recommends the Nursing Board consider creating similar forms.

Further discussion was deferred. North Carolina Board of Nursing’s Continuing Competency Requirements The Board reviewed the following from the North Carolina Board of

Nursing.

The EO stated she will look further at their laws and rules to see if they have

criteria for continuing education. Further discussion was deferred.

ACCME or Hawaii Based HCCME Education Acceptable? The Board reviewed an email inquiry asking if grand rounds that are accredited by

ACCME and local HCCME may be acceptable as meeting the CEU requirements.

After a brief discussion, the Board by consensus determined that if it is a CME grand round and/or ANCC approved, it would be acceptable as meeting the continuing education requirement learning activity option.

Swank HealthCare

The Board reviewed information from Swank HealthCare regarding online continuing education courses they distribute from multiple providers.

Ms. Kodama stated Swank Healthcare is accredited and is used a lot by nurses.

They have a very good method of tracking the individuals’ records. Mr. Joslyn stated the military also uses them. The Chair stated we should refer this to the Practice or Education Committee for

research. Mr. Joslyn stated he will do research and get back to the Board. Further discussion was deferred.

2016 Board Meeting Schedule The Board was provided with a copy of the 2016 Board Meeting Schedule as

Hawaii State 2016 Legislature Center for Nursing:

Ms. Reichhardt was not able to attend today’s meeting so the EO gave a brief report.

Criminal Background Check Bill

The EO stated they are still looking into a Criminal Background Check bill.

Compact Licensure Bill

The EO stated she is not sure if a Compact Licensure bill will be introduced this year because they are still trying to meet with interested stakeholders to get their feedback and figure out language.

Continuing Competency for Nursing Summit, October 20, 20015 – Vice Chair Presenter This was reported on previously. Correspondence: FTC Staff Guidance on Active Supervision of State Regulatory Boards

The Board was provided with a copy of the FTC Staff Guidance on Active Supervision of State Regulatory Boards Controlled by Market Participants for their information.

Employer Asking if They Allowed to Require an MD’s Signature on a Medical

Note Signed by a Nurse Practitioner The Board reviewed an email inquiry from an employer asking if they can request

an NP to get an MD’s signature on a medical note. The EO stated she spoke with the employer on the phone and their concern is that

their employee operates heavy machinery and was prescribed narcotics by the NP which have an effect on your ability to operate heavy machinery. The NP, instead of providing a date that the employee is ok to return to work, left it up to the patient to decide if he/she can return to work.

The Chair stated this is a matter of practice, this has to do with one particular APRN or NP practicing. It is not regarding APRN practice. The employer should speak with that particular APRN.

Mr. Joslyn stated he understands the employers concern with liability, but that has

nothing to do with the Board. The Board by consensus determined that this issue is not addressed in the laws

and rules.

Old Business: Scope of Practice Guidance Document

Discussion on the topic was deferred as the EO is still working on it. Applications: The Board moved into Executive Session. Executive Session: At 10:23 a.m. upon a motion by the Vice Chair, seconded by Ms. Daub, it was

voted on and unanimously carried to move into Executive Session in accordance with HRS, 92-5(a) (1) and (4), “To consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in section 26-9 or both;” and “To consult with the board’s attorney on questions and issues pertaining to the board’s powers, duties, privileges, immunities, and liabilities”.

At 10:48 a.m. upon a motion by the Vice Chair, seconded by Ms. Daub, it was voted on and unanimously carried to move out of executive session.

Chapter 91, HRS The Chair called for a recess from the meeting at 1-:48 a.m. to discuss and Adjudicatory Matters: deliberate on the following adjudicatory matter(s) pursuant to Chapter 91, HRS:

In the Matter of the License to Practice Nursing of Thomas L.
