Proposal Number One, An Amendment: RevisingState’s Redistricting Procedure

The proposed amendment to sections 4 and 5 andaddition of new section 5-b to Article 3 of the StateConstitution revises the redistricting procedure forstate legislative and congressional districts. Theproposed amendment establishes a redistrictingcommission every 10 years beginning in 2020, withtwo members appointed by each of the fourlegislative leaders and two members selected bythe eight legislative appointees; prohibitslegislators and other elected officials from servingas commissioners; establishes principles to beused in creating districts; requires the commissionto hold public hearings on proposed redistrictingplans; subjects the commission’s redistricting planto legislative enactment; provides that thelegislature may only amend the redistricting planaccording to the established principles if thecommission’s plan is rejected twice by thelegislature; provides for expedited court review of achallenged redistricting plan; and provides forfunding and bipartisan staff to work for thecommission. The proposed amendment to section 14 of Article 3of the State Constitution would allow electronicdistribution of a state legislative bill to satisfy theconstitutional requirement that a bill be printed andon the desks of state legislators at least three daysbefore the Legislature votes on it. It wouldestablish the following requirements for electronicdistribution: first, legislators must be able to reviewthe electronically-sent bill at their desks; second,legislators must be able to print the bill if theychoose; and third, the bill cannot be changedelectronically without leaving a record of thechanges.
