    ConceptNote I.BackgroundIndependenceofthejudiciaryisvitalforconsolidatingdemocracyandprotectinghumanrights.Theroleandindependenceofthejudiciaryiscrucialinpursuingcorruptionandpreventingabusesbythelegislativeandexecutivebranches.Unfortunately,judicialbodiesforgothisresponsibilityinmanyAsiancountries,actinginsteadasapowerintheirownright.Itiscommonlyfoundthataselectfewelitelegalprofessionalsmonopoliseandabusejudicialpower,insodoingfailingtoendimpunityandcorruption. Assuch,itisindispensibleforcivilsocietytomonitorthejudiciaryinordertomakeitindependentandtransparent.TheRegionalWorkshoponJudicialWatchaimstoshareAsiancivilsocietysexperiencesandstrategiesinmonitoringjudicialbodiesandcomeupwithacommonmonitoringguideline. Duringthe2011GwangjuAsiaForum,humanrightsdefendersfromIndonesia,TimorLeste,Taiwan,CambodiaandSouthKoreasharedtheirexperiencesregardingjudicialmonitoringintheirowncountries.ThisopportunityemphasizedtheneedtodevelopacommonjudiciarymonitoringguidelineapplicabletoallAsiancountries,regardlessofdifferencesinlegalsystemsacrossborders. Amongvariousjudicialmonitoringstrategies,thereviewofverdictischosenasthisyearstheme.Thereviewofverdictconsistsofdeliveringcritiquesonjudicialverdictsfromcivilsocietysperspective.ThisremindsthejudiciarythatcivilsocietycanactivelymonitorjudicialbranchesanddeterminewhetherornottheyprotectandpromotethebasicrightsenshrinedintheConstitution.Also,thereviewofverdictshowstheimportanceofhavingjudicialofficersfromdiversesocioeconomicandideologicalbackgrounds.WeexpecttocomeupwithacommonmonitoringguidelineonthereviewofverdictforAsiancivilsocietythatreflectstheseprinciples.II.PastDevelopments 1)DemocracyinAsia:ProgressorCrisis?,1920May2010IdentifiedemergingtrendsandchallengesinprotectinghumanrightsanddemocracyinAsiaandconductedgroupdiscussiononmonitoringthethreegovernmentbranches.PSPDshareditsexperienceregardingjudicialbodymonitoring.2)NGOParallelMeetingtotheBaliDemocracyForum:AdvancingDemocraticGovernanceinAsia:ChallengesandWayForward,89December2010Conductedgroupdiscussiononruleoflawandindependenceofjudiciary.ParticipantsfromKoreaandIndonesiasharedtheirexperiences.3)RegionalWorkshoponJudiciaryWatchbyAsianCivilSociety,1617May2011Asafollowuptoprevioustwomeetings,participantsfromIndonesia,TimorLeste,Taiwan,CambodiaandSouthKoreasharedtheirexperiencesandstrategiesonjudicialbodymonitoring.

    1) ToidentifydifferentlegalsystemsinAsiaandassesstheindependenceofthejudiciarybranchinrelationtopeoplesparticipation;

    2) ToshareexperiencesandstrategiesonjudicialmonitoringinAsia;and,3) Todevelopacommonjudiciarywatchguideline.
