Notes:1 The Budget Revenues and Budget Expenditures as shown are per the Indiana Department of Local

Government Finance's (DLGF's) official budget orders for 2013 and 2014, respectively, for budgeted funds,as amended by DLGF's supplemental orders.

2 Actual revenues reflect losses in property taxes due to the circuit breaker of $3.61 million, and $3.51 million,respectively, for 2013 and 2014.

3 In 2014, $274,000 was transferred to the Rainy Day Fund from the Bus Replacement Fund. This amount isincluded in the receipts and expenditures of these funds respectively. However, the transfer out from the BusReplacement Fund is not counted by the State Board of Accounts nor DLGF for purposes of determiningstate compliance with authorized budget expenditures.

4 Transfers from the Debt Service Fund (in the aggregate amount of $2,503,486) and from the Pension BondDebt Service Fund (in the amount of $96,209) were made in 2014 to the Capital Projects Fund, theTransportation Fund, the Referendum Fund, and the Bus Replacement Fund at the direction of the DLGF tocomply with the "Protected Taxes" provisions of IC 6-1.1-20.6-9.9 to allocate the circuit breaker lossesproportionately among those funds. These amounts were included in the receipts and expenditures of thesefunds respectively.

5 The December 31, 2014 balance of the General Fund includes $461,150 in Teacher Performance Pay andrelated payroll taxes and costs totaling $70,160 to be paid to or on behalf of teachers. This amount wasincluded in projections for 2014 expenditures. However, due to certain timing issues and logistical constraintsrelated to receipt of the Performance Pay funds from the Indiana Department of Education, the actualpayment did not occur until after 2014 year-end on January 16, 2015. This resulted in expenditures beingless than projected and the ending cash balance being larger than expected by this total amount of $531,310.

Facts of this Matter: In an ongoing effort to keep board policy current with Indiana statue and as recommended by our NEOLA (policy service) representative, the following bylaws and policy are being recommended for revision. Bylaw 0144.1 Compensation

Change reflects the new month in which the Board determines their annual salary. (Exhibit A)

Bylaw 0144.3 Conflict of Interest

The revisions are being recommended to more accurately describe the Conflict of Interest Disclosure Form and when it should be filed with the State Board of Accounts and the Clerk of the Circuit Court. (Exhibit A)

Policy 5200 Attendance

The revision incorporates the provision in state law that a student in good academic standing may be given five (5) days of excused absence to attend the Indiana State Fair if that student or a member of his/her household has an exhibit at the fair. (Exhibit B)

MEMBERSHIP 0144.1 Compensation Board members shall set basic compensation each July January in

its organizational meeting. Expenses of a Board member shall be reimbursed when incurred in the performance of his/her duties or in the performance of functions authorized by the Board and duly vouchered. Board members shall not be eligible to participate in the district’s group insurance plan. An exception is made for members of the Board of School Trustees who were enrolled in the District's group insurance plan as of July 1, 2010, with that exception expiring at the end of their current term, no later than June 30, 2014.

I.C. 20-26-4-7 The following guidelines have been established by the Board to

ensure appropriate and proper reimbursement of expenses for Board members.

A. Expenses will be reimbursed only for activities authorized by

the Board. B. Reimbursement for mileage will not exceed the current rate

established for Corporation employees. C. Attendance at Board-approved conferences should be at the

location closest to the Corporation. D. When attending a Board-approved conference, all fees,

parking, mileage, meals, and lodging will be reimbursed. E. Purchase of any printed or other materials relating to

Boardmanship will be reimbursed if prepurchase approval is given by the Board. If such approval is not possible or feasible, a voucher must be submitted to the Board for approval. No postpurchase voucher will be approved if it exceeds $200.

When the Board attends a community or school-related event as a Board function, or if a Board member attends as the designated representative of the Board, any incurred expenses, including mileage, will be reimbursed by the Board. If a Board member attends such events as a private citizen, any incurred expenses are to be paid by the Board member.

G. No entertainment expenses or purchases of alcoholic

beverages are reimbursable. H. A voucher detailing the amount and nature of each expense

must be submitted to the Board for approval within 90 days after the expenses have been incurred.

Revised 11/8/10 0144.3 Conflict of Interest Board members shall perform their official duties in a manner free from

any possible criticism or prejudice or self interest. To this end: A. every effort shall be made to avoid the possibility of a claim being

made that an individual participated in reaching a decision on a matter in which s/he had either a direct or an indirect financial interest of a substantial nature;

B. each member of the Board shall resist every temptation and

outside pressure to use his/her position as a Board member to benefit either himself/herself or any other individual or agency apart from the total interest of the School Corporation;

C. when a member of the Board determines that the possibility of a

personal interest conflict exists, s/he should, prior to the matter being considered, disclose his/her interest in accordance with statute (such disclosure shall become a matter of record in the minutes of the Board); (I.C. 35-44-1-3)

D. no member of the Board may obtain, for at least one (1) year after

termination of service on the Board, a pecuniary interest in any Corporation contract or purchase which was approved during his/her tenure. (I.C. 35-44-1-7)

Board members shall utilize the authority of their position solely for the benefit of the school community. To this end:

A. Conflict of Interest Disclosure If a Board member or a spouse or dependent has a pecuniary

interest in a contract or purchase to be approved by the Board, or a Board member or a spouse or dependent will profit from a contract or purchase to be approved by the Board, the Board member shall submit a written Conflict of Interest disclosure on State Board of Accounts Form 236. The disclosure shall be submitted for approval by the Board before the Board considers approval of the contract or purchase addressed in the disclosure. The Board member shall not participate in the discussion or vote on the acceptance of his/her disclosure or approval of the contract or purchase, and the role played by this Board member shall be described in the minutes of the meeting.

A written conflict of interest disclosure on State Board of

Accounts Form 236 that is approved by the Board shall be filed by the Superintendent with the State Board of Accounts and the Clerk of the Circuit Court within fifteen (15) calendar days after approval by the Board. I.C. 35-44-1-3

B. Profiteering From Public Service For one (1) year after leaving the Board, a member of the Board shall not obtain a

pecuniary interest in any contract or purchase which was approved by the Board during his/her Board service unless the former member:

1. was screened from any participation in the contract or purchase 2. has not and will not receive a part of any profit from the contract or

purchase by the Board; and 3. promptly gives notice to the Board of his/her interest in the contract or

ATTENDANCE The Board of School Trustees, as an agency of the State, is required to enforce regular attendance of students. The Board recognizes that the presence in the classroom enables the student to participate in instruction, class discussions, and other related activities. As such, regular attendance and classroom participation are integral to instilling incentives for the student to excel. Attendance shall mean to be physically present in a school or at another location where the school’s educational program is being conducted during regular school hours on a day in which the educational program in which the student is enrolled is being offered. Attendance shall be required of all Corporation students, except those exempted under other provisions of State law, during the days and hours that the school is in session or during the attendance sessions to which s/he has been assigned. Exceptions to compulsory attendance that shall be recognized by the school corporation as provided by state statute are: A. service as a page or honoree of the general assembly

(I.C. 20-33-2-14) B. service on a precinct election board or helper to a political candidate

on the date of an election (I.C. 20-33-2-15) C. subpoena to appear in court as a witness in a judicial proceeding

(I.C. 20-33-2-16) D. service in active duty with the National Guard for not more than

ten (10) days (I.C. 20-33-2-17) E. participating as a member of the Indiana wing of the civil air patrol

for not more than five (5) days (I.C. 20-33-2-17.2)

F. participating in an educationally related non-classroom activity

which is consistent with and promotes educational philosophy and goals of the school corporation, facilitates the attainment of specific educational objectives, is part of the goals and objectives of an approved course or curriculum, represents a unique educational opportunity, cannot reasonably occur without interrupting the school day, and is approved in advance by the school principal (I.C. 20-33-2-17.5)

For any of these exceptions a student shall not be recorded as absent from school. The Superintendent shall require, from the parent of each student or from an adult student who has been absent for any reason, a phone call or written statement of the cause for such absence. The Board reserves the right to verify such statements and to investigate the cause of each absence. In addition to the excused absences listed in State statutes, the Board considers the following for excused absences: A. illness verified by a note from the parent B. illness verified by a note from a physician C. recovery from accident D. required court attendance E. professional appointments – Parents are encouraged to schedule

medical, dental, legal, and other necessary appointments other than during school hours. When appointments are necessary during the school day, the student shall report back to school immediately after the appointment with a signed statement from the doctor, dentist, lawyer, counselor, etc.

F. death in the immediate family or of a relative G. observation or celebration of a bona fide religious holiday in

accordance with Policy 5223 H. maternity I. military connected families’ absences related to deployment and

J. such other good cause as may be acceptable to the Superintendent

or permitted by law. An unexcused absence is any absence not covered under either the definition of excused absence or listed as an exception to compulsory attendance. An out of school suspension shall not be considered an unexcused absence. Repeated instances of unexcused absences may result in disciplinary action up to suspension or expulsion of a student. Truancy is defined as a student absence from the school campus without knowledge of the parent and school. Habitual truant is defined as a student who is truant three (3) times during any semester. A student who is truant is considered unexcused. I.C. 20-33-2-11 provides that any person, while of the ages of thirteen (13) or fourteen (14), who is determined to be a habitual truant as defined by Board policy, cannot be issued an operator's license or learner's permit until the age of eighteen (18), or until the student's attendance record has improved as determined by the Board upon review of the student's record. The Superintendent or an attendance officer having jurisdiction shall report a child who is habitually absent from school to an intake officer of the juvenile court or the Department of Child Services. Attendance need not always be within the school facilities, but a student will be considered to be in attendance if present at any place where school is in session by authority of the Board. The Superintendent is hereby authorized to: ( ) ensure a school session which is in conformity with the

requirements of the law;

A. ensure that students absent for any excusable reason have an

opportunity to make up work they missed; B. govern the keeping of attendance records in accordance with the

rules of the State Board; C. ensure that any student who, due to a specifically identifiable

physical or mental impairment, exceeds or may exceed the Corporation's limit on excused absence is referred for evaluation for eligibility either under the Individuals with Disabilities Education Act (IDEA) or Section 504 of the Rehabilitation Act of 1973.

Such authorization provides that a student's grade in any course is based on his/her performance in the instructional setting and is not reduced for reasons of conduct. Such authorization also provides that if a student or a member of the student’s household is in good academic standing, and has an exhibit at the Indiana State Fair for educational purposes, that student may receive up to five (5) excused absences. If a student violates the attendance or other rules of the school, s/he should be disciplined appropriately for the misconduct, but his/her grades should be based upon what the student can demonstrate s/he has learned. The policy ensures that attendance practices properly address the matter of truancy by including a process which: A. identifies the habitual truant; B. investigates the cause(s) of his/her truant behavior; C. considers, when appropriate, modification of his/her educational

program to meet particular needs which may be causing the truancy;

D. ensures that truant students are disciplined in accordance with the

Corporation's policies and administrative guidelines on student discipline;

students who have been suspended for the second time during a school year, expelled, or excluded for misconduct.

Facts of this Matter:  Recent news articles have extolled the virtues of our universal preschool programming to children of typical  and  atypical  development.  Sign‐ups  for  the  fall  term  are  strong. We  are  dealing with  our increasing K‐12 enrollments in our westernmost elementary schools by moving some of the preschool program locations where space exists around the district.  This is being well‐received by parents and staff members alike.  We are in process of updating our reporting of ages and programs served to the Indiana Department of Education.  In this pursuit, we would  like to have an affirmative Board action regarding the slight revisions to our program designations to reflect preschool program offerings.  All  facilities  are  fully  appropriate,  rated,  and  approved  for  the  programs  to  be  accommodated.  Staffing is a function of the GROW division of our Office of Special Projects, and is cost neutral to all other  funds  (to  include payment of  indirect costs to the General Fund to mitigate utility  impacts of offering this programming at the new sites).  Our school program spans should be characterized in reporting to the state as:
