The Meaning of Zakat
No good translation to convey: 1- Purification, for it purifies one's money
from the suspicious earnings and one's heart from miserliness.
2- Increase, for it increases the recipient’s wealth as well as donor’s by the blessing of obedience and the supplications of the recipient.
3- Praise, for it will be a reason for praise for the donor on the day of judgment, also, s/he will be praised by the recipients, who would otherwise be envious and hateful of the wealthy.

Frequency of Paying Zakat

There is no zakat on property until an entire Islamic (lunar) year (hawl) has passed, except:
1. What comes out of the land [crops,mined metals and treasure troves.]
2.Growth of capital through profit or birth.
• Their hawl is that of their origin [30 cows at the beginning of year birth to 10, will pay zakat on 40.]

Non-Zakatable Wealth
1- Property for use and ownership (not trade)
Food – Clothing – Residence – Transportation -Domestic Animals - Tools - Agricultural Land.
2- Property in Public Trust and Endowments:
- Masajid, hospitals, governments’ assets, endowments.
3-Unlawful wealth:
Must be returned to owners - If impossible, to the poor.

When Becomes Due?
فإذا قومها، ثم حوال، نصاب وه التجارة بها نوي حتى فها زكاة وال• قمتها، من الزكاة أخرج والفضة الذهب من نصاب أقل بلغت
• No zakat on merchandise, until one intends trading,and it has been a nisab for a hawl .
• Then one should assess it, and if it reached a nisab ofgold or silver, whichever is less, one must pay zakat onits value.

Adding Up Currency & Trade Goods
وإن كان عنده ذهب أو فضة ضمها إلى قمة العروض ف تكمل •النصاب
• If one [also] owns gold or silver, one must add it to the value of his merchandise, to complete the nisab.

Change of Intention
وإذا نوى بعروض التجارة القنة فال زكاة فها، •
• If one intends for this merchandise to be for personal use, there would be no zakat.

• If, thereafter, one intends again to sell it, one should begin [counting] a new hawl for it.

Seller ships to buyer:
It moves to the ownership of buyer
when it reaches point upon which
they mutually agree.
When the money is paid for a product
in advance, it moves to the
ownership of the seller, even
before the product is received by
the buyer.
If product whose price was paid is
zakatable, zakat will be due on
seller as long as buyer didn’t
receive it.

Malik:
For the trader that doesn’t buy and
sell what he bought right away, but
awaits the change of markets:
He may give zakat on the
merchandize when he sells it for
only one year.
The Malikis disagree whether one
whose merchandise becomes non-
sellable, whether or not he takes
the aforementioned ruling.

• (Ahmad): affects the zakat of livestock.
• (Shafe’ee & a): it also affects the zakat of merchandise and crops. Hence, corporations of any sort will be treated like one entity.
• (Abu Haneefah): it does not affect the zakat of anything.

The Creditor & Zakat
Whoever is owed a debt by a solvent debtor,or has money he is capable of collecting, like:• if someone denies borrowing it, but he has
proof,• or someone who has had something taken by
force yet he is capable of taking it back,he must:• Majority: pay zakat when he finally takes
possession of it, for all the years that passed.
• ‘Ikrimah: he does not pay zakat until he gets it back and one full lunar year has passed because he does not have complete ownership of it, and cannot invest or spend it.
• Sa’eed ibn al-Musayyab and ‘Ata’: pay zakat for one year when the money returns.

The Creditor & Zakat
والمغصوب به، بنة وال جاحد على أو مفلس على كالدن متعذرا كان وإن•فه زكاة فال وجوده رجى ال الذي والضال
If someone owns money that is impossible to retrieve, asfor instance, because:• [the debtor] has gone bankrupt• denies the debt and there is no proof of it,• had something taken by force,• lost something, and no hope of finding it,There is n o z a k a t o n i t .

The Debtor & Zakat

Whoever has:
• a debt equal to or greater than the nisab he owns,
• or it makes it the money he owns less than the nisab,
there is no zakat on the money he possesses.

Investment Debts - انديو االستثارية
This includes, business debts, home mortgages, car loans…etc.
The only deductible portion is the amount due for payment within the year.
This is because the debt was incurred to purchase an item that is still present, its value covers the debt amount, and the payments may last for decades.

زكاة وال وفضة، ذهب:نوعان وه فجب درهم مائت تبلغ حتى الفضة ف

.مثقال• Currency is of two kinds: gold and silver.• No zakat on silver until 200 dirham [approx. 595 gm
of pure silver], and its zakat is 5 dirhams (2.5%),• No zakat on gold until 20 mithqal [approx. 85 gm of
pure gold], and its zakat is half a mithqal (2.5%).

Salaries
• Zakah is not due on the income itself, so whatever is spent prior to the due date is not Zakable.
• Whatever was saved and added to preexisting funds as an incremental increase, is Zakatable with the original capital at the due date, even if a lunar year did not pass on these particular increments yet.

When
ال جوز تأخرها عن وقت وجوبها إذا أمكن إخراجها، فإن فعل •. فتلف المال لم تسقط عنه الزكاة، وإن تلف قبله سقطت
• It is not permissible to delay it after the due time, if one is capable of paying.
• If one delays it, and the property gets ruined, zakat would not be cancelled,
• but if it is ruined before the due time, it would be cancelled.

أما إذا دفعها إلى السعاة فقد
برئت ذمته،
وبقى على هؤالء إصالها، وال
جوز لهم إمساكها إال لحاجة
.كتنظم توزعها ونقلها
Zakat is binding to be given immediately once
due.
Deferring it out of negligence or laziness is
impermissible.
If one deferred it to look for the more
deserving, that would be fine.
Once given to the agents who collect it, the
payer is not liable for its delay.
The agents must not defer once they receive
unless they do that for a need such as the
logistics of distribution and transfer.

• It is permissible to pay it early if he has nisab, not before. • If one pays it early to non-deserving recipient, it would
not count, even if he became deserving at the due time. • If one pays it early to a deserving recipient, then [that
recipient] dies, no longer needs it or becomes an apostate, it would count for him [donor],
• If his capital is ruined after paying it, he may not ask for it back.

It is not allowed to transportzakat to a land [far enough that] it would be permissible to shorten the prayer, unlessone does not find anyone to take it [who deserves it] in his own area.

Who May Be Given The Zakat : Poor and Needy
: وهم ثمانة
They are eight (types):
. الفقراء، وهم الذن ال جدون ما قع موقعا من كفاتهم بكسب وال غره: األول
• The first type, the poor and those don’t afford what they need through earning or otherwise.
. المساكن، وهم الذن جدون ذلك وال جدون تمام الكفاة: الثان
• The second type, the needy (al-masakeen, Pl. of Miskeen): those who afford some of their needs, but not enough.

Zakat workers & Whose Hearts to be reconci led
. العاملون علها، وهم السعاة علها ومن حتاج إله فها: الثالث
• The third type, the zakat workers: those who collect it and those that are needed for it (all workers hired by the zakat administration)
المؤلفة قلوبهم، وهم السادة المطاعون ف عشائرهم الذن رجى بعطتهم دفع شرهم : الرابع.أو قوة إمانهم أو دفعهم عن المسلمن أو إعانتهم على أخذ الزكاة ممن متنع من دفعها
• The fourth type, those whose hearts are to be reconciled: the authorities within their tribes who are hoped by giving them that
their evil will be availed
or their faith will be strengthened
or they may help protect the Muslims
or help them collect zakat from those who withhold it.

Slaves & Debtors
. الرقاب، وهم المكاتبون وإعتاق الرقق: الخامس
• The fifth type, slaves: the contracted slaves and [may also be used] in freeing [other] slaves.
الغارمون، وهم المدنون إلصالح نفوسهم ف مباح، أو إلصالح بن : السادس. طائفتن من المسلمن
• The sixth, those in debt: who burrowed money
for themselves to afford permissible things
or to reconcile between two Muslim parties.

In the cause of Al lah & the Wayfarers
.ف سبل هللا، وهم الغزاة الذن ال دوان لهم: السابع
• The seventh type, in the cause of Allah: and those are the fighterswho are not part of the organized army units (unpaid)
.ابن السبل، وهو المسافر المنقطع به وإن كان ذا سار ف بلده: الثامن
• The eighth, the wayfarer: and that is the traveler who lacks the means to go back home even if he was well off in his homeland.
فهؤالء هم أهل الزكاة، ال جوز دفعها إلى غرهم،
• Those are the only deserving recipients of zakat.

Pay Al l to One?
وجوز دفعها إلى واحد منهم ألنه صلى هللا عله وسلم أمر بن •
أقم ا : زرق بدفع صدقتهم إلى سلمة بن صخر، وقال لقبصةقبصة حتى تأتنا الصدقة فنأمر لك بها،
• It is permissible to pay it to only one of them since
the Prophet (pbuh) instructed bani zaurayq to pay it to Salamah ibn Sakhr,
and he (pbuh) said to Qubaisah: “Stay here Qubaisah until the sadaqah (here means zakat) comes and then we will give it to you.”

وصله إلى بلده، وال زاد واحد منهم على ذلك،
• The poor and needy are given what is sufficient for their needs
• and the worker: the fair recompense for his work
• and the one whose heart is to be reconciled: what will reconcile him
• and the contracted slave and the debtor: what they need to pay off what is due on them
• and the fighter: what he needs for fighting
• and the wayfarer: enough to get him to his homeland
None of them may be given more than that.

Pay to Wealthy?
الفقر، والمسكن، والمكاتب، : وخمسة منهم ال أخذون إال مع الحاجة وهم. والغارم لنفسه، وابن السبل
• Five of them will not take except in the case of need, and those are: the poor, needy, contracted slave, the debtor for himself and the wayfarer.

• It is permissible for four of them to be given of it evenwhen well off and those are the zakat worker the one to be reconciled the fighter and the debtor who incurred the debt to reconcile between disputants.

Must Intend Zakat & Look for Poor
وال جوز دفع الزكاة إال بنة إال أن أخذها اإلمام قهرا، •
• It is not permissible to pay zakat except with intention except if the (imam) ruler takes it by force.
.وإذا دفع الزكاة إلى غر مستحقها لم جزه إال لغن إذا ظنه فقرا •
• If he paid it to someone not deserving, it will not be sufficient except to someone he thought was poor.

Taxes NOT Substitute.
• Zakah is a permanent and continuous pillar
of Islam. Taxes are a governmental
obligation.
• Recipients of Zakah are divinely designated
categories. Taxes are generally paid to enable
functions of the state.
