Each video is “tagged”, makes videos available just by typing a single

words.

In July 2006 YouTube posted their stats:

o100 million Videos being watched a day.

o2.5 Billion videos were watched for 2006

o65,000 video are posted daily.

In August 2006 YouTube hosted 6.1 million videos.

As of Feb 26 2008 a simple search of ”*” will generate 72.6 million videos.

Over 500,000 users

45 terabytes of storage needed in 2006.

Requires Several million $$$ worth of bandwidth a month to transmit.

Ernie Rogers a 23 year old from California “lamo1234” holds the title of “YouTube Rock star”

Universal Tube & Rollform Equipment, with a domain utube.com sued for the right to the name after their website kept crushing from people not sure of the correct domain address.

DMCA was passed in 1998, with unanimous vote in the US Senate

DMCA amended title 17 of the US code, which now extended to limit liability of online providers from Copyrights infringement by their users.

The act is broken down to 5 titles:

WIPO Copyright and Performances and Phonograms Treaties Implementation Act.

Online Copyright Infringement Liability Limitation Act.

Computer Maintenance Competition Assurance Act

Miscellaneous Provisions

Vessel Hull Design Protection Act

Online Copyright Infringement Liability Limitation Act

How it actually works.

1) We hand in our presentation on YouTube, the Instructor decided to post it on her YouTube account.

2) We surf the web and find our presentation, we notify YouTube by filing an official claim which states that in “good faith belief” the presentation is posted illegally.

3) YouTube removes it from their site and freezes the instructors account, following with a notice of DMCA violation to the instructor.

4) The instructor may counter-notice to YouTube, officially by stating that in “good faith belief” the notice is a mistake.

5) YouTube will now wait for 10-14 days giving us the chance to counter-counter notice and file a lawsuit. If we do not do so the presentation and the instructors account will be reinstated.

A dispute between two opposing groups, Rational Response Squad and Creation Science Evangelism ministry.

Account was frozen, pending investigation.

Any content of the group was removed.

Liability soley on user.

Public domain enforces rules.

Positive:

Open channel of communication.

Easy and fast way to stop copyright infringements.

Makes the service provider fast and immediate in processing.

Negative:

Limits Freedom of speech.

Fast and efficient way to silence opinions.

Election year.

“If they cater too much to their users, they risk getting sued for copyright violations and losing the support of content companies. If they’re seen as favouring content companies, however, they could lose their millions of fans”

For the average Joe it is impossible to know if something posted is in fact infringing the DMCA rule.

It seems that for the average Joe it will be easier to just ignore and remove the content then to fight it.

When some one uses the Online Copyright Infringement Liability Limitation Act from DMCA as a tool to silence and opinion, there are no clear penalties against such a person/s.

Rational Response Squad is now actively fighting to have this act rewritten.

To date there were only handful changes done to the original act.
