Where as, it is become necessary to prescribe

the right and duties of the employee in detail so

as to make the authority to behave effective,

impartial, efficient, sustainable and transparent

human resource management;

Where as, it is necessary to make the tax

collection system modern and fair through

laying down employee administration procedure

having assigned non-corrupt amd ethical

employees through taking in to account the

functions of the authority which requires special

occupational traits;

Where as, it is become necessary to incorporate

newly created organization, working system,

thinking and other related issues in the

regulation that has been introduced in

connection with business process re-

engineering;

Now therefore, in accordance with article 44(1) of

proclamation No 133/2010 issued to determine the

power and duties of the executive organs of the

Southern Nations, Nationalities and Peoples

Regional State, the executive council has hereby

22.. DDeeffiinniittiioonn

In this regulation, unless the context

otherwise requires:-

1. “Region” means the Southern Nations,Nationalities and Peoples Regional State.

2. “Authority” means Revenue Authority of

the regional state.

3. “Employee” means a person employed or

assigned permanently or temporarily across

the revenue authority and offices under it,

excluding appointees.

4. “Ethics Liaison Officer” means a

professional assigned to follow up the ethics

of the employees and department heads of

the Revenue Authority.

5. “Work Process” means a work flow being

designed as core and support work process

to perform a particular activity from the

start to completion and having internal and

external customer on the basis of the

tangible situations and work conditions of

the authority.

6. “Revenue Laws” means any legislation

issued under federal or regional government

regarding tax, custom or revenue to be

collected.

7. “Advisory Board” means advisory board

of the Southern Nations, Nationalities and

Peoples Regional State revenue authority.

8. “Director-General” or “Deputy- Director”

means Director-General or Deputy-director of

the revenue authority respectively.

የሥነ ምግባርና የሙስና ችግር ያለበት ወይም

በአገልግሎት አሠጣጥ ችግር ያለበት \‰t¾

ነው፡፡

14. ''የህክምና ማስረጃ'' ማለት ከመንግስት ወይም ሕጋዊ

ፈቃድ ካለው l@§ ጤና ተቋም ስለሰራተኛው

የጤÂ ሁኔታና ሕክምና ስለመከታተሉ የሚሰጥ

3. የëታ አገላለê

በዚህ ደንብ ውስጥ በወንድ ëታ የተደነገገው ለሴት

ëታም ያገለግላል፡፡

9. “Head” means the director-generalappointed to lead the authority, workprocess owner and heads of main branchoffice and branch offices at differenthierarchy.

10. “Main Branch Office” means branch

office of the Authority across zones and

Hawassa city administration.

11. “Branch Office” means a branch officeof the authority across special woreda,woreda or in other city administrations.

12. “Disability” means employment injurythat may sustain a decrease or lose ofworking capacity; “permanent partial”or “permanent total” shall hold theirrespective definition under the pertinentproclamation.

13. “Inefficient Employee” means a person

who does not qualify the required skills

of the position, having a problem in

relation to ethics and corruption or

service delivery.

14. “Medical Certificate” means acertificate given by the state or any otherlegal health institution else having legalpermit to attest the health conditions ofthe employee and his attendance tomedical treatment.

15. “Administrative Decision” means any

decision made by the head of the

authority regarding the employee.

16. “Salary” means a base pay determinedfor a particular position and periodicalincrement thereon.

17. “Promotion” means assigning a workerto a higher grade.

33.. GGeennddeerr RReeffeerreennccee

In this regulation, the provisions refered bymasculine gender shall also apply tofeminine gender.

44.. SSccooppee ooff AApppplliiccaattiioonn

This regulation shall apply on Revenue

Authority; and main branch office and branch

offices of the revenue authority under each

administrative hierarchy.

55.. SSttrruuccttuurree ooff tthhee AAuutthhoorriittyy

1. Head Office

The head office of the Authority shall besituated in the capital city of the region,Hawassa, and may have branch offices atZone, Special woreda, Woreda, cityadministration and as may be necessaryin sub-city.

2. Organization of the Authority

A/ The accountability of the authority is to

the chief executive of the region and

shall have director-general and deputy

director appointed by the chief executive.

B/ The authority shall have work process

owner, coordinator and executives

appointed by the director-general or

as may be necessary assigned by

merit.

66.. PPoowweerr aanndd DDuuttiieess ooff tthhee AAuutthhoorriittyy

Without prejudice to the power and duties

specified under article 23 of proclamation No

133/2010, the authority shall have the

following power and duties:-

l. የባለሥልጣኑ ዋና ሥራ አሥፈÉሚ በመሆን

ÃStÄD‰L½ YöÈ-‰L½ ያስፈጽማል፣

1. The authority shall have its own

organization, study the salary scale and

allowance of the employee by taking in

to account the existing economic

changes and other conditions and submit

same to the executive council and

thereby implement same up on approval;

2. Strive draft law to be prepared and

approved thereon by the concerned body

where legal gaps to be filled while in

charge of its duty and implement up on

approval;

3. Implement tax administration and other

tasks in justifiable manner that has been

given and going to be given in

delegation from the federal government;

4. Follow up and provide support towards

the revenue collection and

administration of the region to be

harmonized and successful;

77.. PPoowweerr aanndd DDuuttiieess ooff tthhee DDiirreeccttoorr--ggeenneerraall

1. The Director-general shall:-

a) Apply the power and duties of the

authority specified under article 23 of

proclamation No 133/2010 issued to

determine the power and duties of the

region’s executive organs;

b) Lead, organize, administer, super vise

and implement tasks as a chief executive

of the authority.

a) , Employ, administer and dismiss

employee of the authority;

b) Prepare strategic plan, annual action

program and budget; submit same to

the executive council and apply

same up on approval;

c) Disburse money based on theapproved budget and actionprograms of the authority;

d) Delegate the authority in the wholerelations with third parties.

2. The director-general may delegate partof his power and duties to other officialsof the authority to the extent necessaryfor the efficient performance of theauthority;

3. Prepare performance and account

reports of the authority and submit same

to the executive council.

GGeenneerraall

1. Lead a particular work process as an

owner among core work processes;

2. Perform other functions distinctively

identified by the director general;

3. Act on behalf of the director general in

his absence.

4. A work process may reorganize or entitle

to grade hereon based on the weight and

complexity of activities; based on the

responsibility and accountability as well

as the required skill;

5. Without prejudice to sub article 1 to 4 of

this article, the authority, as necessary,

may change the organization of the work

process or works of each process due to

the increase or decrease of revenues being

collected by the authority or other factors.

grade and fulfill the necessary

requirement and good code of

conduct shall be given salary and

benefit of the position;

b) The employee appointed at low

grade or appointed at high grade and

doesn’t fulfill the necessary

requirement of the position; the issue

shall be assessed in accordance with

directive to be issued for promotion

implementation,

4. No appointment, promotion, transfer or

demotion shall be allowed on any

unauthorized work position or structure

of work except the provision of the law.

probationary training shall be employed

for a period of one year term;

2. The actual competence of an employee

appointed for approbation period shall

dismiss trainee who has rigorous

employee through transparent competition.

However, without competition, a particular

vacant position may be occupied through

promotion through considering the

following conditions;

a) If there is no competitor and the

employee meets the required

qualification and discipline, and

passes the written and oral

examinations of the authority;

b) An employee shall be selected with his

high good code conduct and work result

authority and has been found fulfilling

the necessary qualification the

fulfill the required qualification is not

more than one year;

መ/ቤቱ ሠራተኛ 2ዐ የሥራ ቀናት

የዓመት ዕረፍት ፈቃድ ይሰጠዋል፡፡

3 ከአንድ ዓመት በላይ ያገለገለ ሠራተኛ

ለእያንዳንዱ ተጨማሪ ዓመት አንድ

የሥራ ቀን እየታከለበት የዓመት

የዕረፍት ፈቃድ ያገኛል፤ ሆኖም

የሚሰጠው የአንድ ዓመት የዕረፍት

ፈቃድ ከ3ዐ የሥራ ቀኖች መብለጥ

የለበትም፡፡

1 የሥራው ሁኔታ በማስገደዱ ምክንያት

የባለሥልጣኑ መሥሪያ ቤት ሠራተኛ

የዓመት ዕረፍት ፈቃዱን በበጀት ዓመቱ

ውስጥ ሊሰጠው ያልቻለ እንደሆነ

የመሥሪያ ቤቱ የበላይ ኃላፊ ለሁለት

የበጀት ዓመት ሊያስተላልፈው ይችላል፤

ሆኖም ያልተጠቀመበት የዓመት ዕረፍት

ፈቃድ በሦስተኛው በጀት ዓመት

ለሠራተኛው መሰጠት አለበት፡፡

2 በዚህ ደንብ አንቀጽ "2 ንዑስ አንቀጽ 5

yተጠቀሰው ቢኖርም፣ በዚህ አንቀጽ ንዑስ

አንቀጽ 1 መሠረት የዓመት ዕረፍት ፈቃድ

መውለጃዋ ሲደርስ እወልዳለሁ ብላ

ከገመተችበት ቀን በፊት 3ዐ ተከታታይ

ቀናት የቅድመ ወሊድ ፈቃድ፣ እንዲሁም

ከወለደችበት ቀን ጀምሮ 6ዐ ተከታታይ

ቀናት የወሊድ ፈቃድ ከክፍያ ጋር

ይሰጣታል፡፡

3 ሠራተኛዋ የወሰደችው የቅድመ ወሊድ

ፈቃድ xLöM ÃLwldች እንደሆነ

እስከምትወልድበት ቀን ድረስ ባሉት

የሥራ ቀናት የምትቆይበት እረፍት

በበጀት ዓመቱ የዓመት ዕረፍት ፈቃድ፣

ወይም በበጀት ዓመቱ የዓመት ዕረፍት

ፈቃድ የሌላት ከሆነ ከሚቀጥለው የበጀት

ዓመት የዕረፍት ፈቃዷ ይተካል፡፡

4 ሠራተኛዋ በዚህ አንቀጽ ንዑስ አንቀጽ 2የተወሰነውን የወሊድ ፈቃድ ከጨረሰችበኋላ ብትታመምና ተጨማሪ ፈቃድየሚያስፈልጋት መሆኑ በሐኪምከተረጋገጠ በዚህ ደንብ አንቀጽ "5በተደነገገው መሠረት የሕመም ፈቃድመውሰድ ትችላለች፡፡

በሕመም ምክንያት መሥራት ያልቻለ

ሕመሙ ከደረሰበት የመጀመሪያ ቀን አንስቶ

ባለው የአሥራ ሁለት ወር ጊዜ ውስጥ

የሚከፈልበት የሦስት ተከታታይ ቀናት

የሐዘን ፈቃድ ይሰጠዋል፡፡

2 ሠራተኛው በዚህ አንቀጽ ንዑስ አንቀጽ 1

ከተመለከቱት ውጭ የቅርብ ዘመድ ወይም

ወዳጅ የሞተበት እንደሆነ ደመወዝ

የሚከፈልበት የአንድ ቀን የሐዘን ፈቃድ

ይሰጠዋል፤ ሆኖም በዚህ ምክንያት የሚሰጥ

የሐዘን ፈቃድ በአንድ የበጀት ዓመት

77. Termination on Disciplinary Grounds

1. Any permanent employee shall be

terminated when adisciplinary penalty is

imposed up on him and the penalty is

not cancelled;

2. Where the disciplinary penalty is

mitigated or revoked on appeal, the

employee shall be enticed to take the

remaining unpaid salary of litigation

without interest;

3. The service of a temporary employee

shall be terminated without any

additional formality when a disciplinary

penalty is imposed on him or his

employment contract period expires.

80. የአገልግሎት የምስክር ወረቀት

ማንኛውም ሠራተኛ በማናቸውም ምክንያት

አገልግሎቱን ሲያቋርጥ ወይም l¥Ìr_

ሲጠይቅ ሲያከናውን የነበረውን የሥራ

ዓይነት፣ የአገልግሎት ዘመኑን፣ ሲከፈለው

የነበረውን ደመወዝና ከሥራ የተሰናበተበትን

ምክንያት የሚገልጽ የአገልግሎት የምስክር

ወረቀት ይሰጠዋል፡፡

78. Retirement

1. Unless an employee is retained in service

beyond the retirement age, his service

shall be terminated without any

additional formality at the last day of the

last month in which he attained the

retirement age by law;

2. The employee shall be notified of his

retirement in writing three months prior

to his retirement.

79. Special Case of Termination

1. Notwithstanding the other provision of this

regulation, the director general may, without

following the regular procedure of

disciplinary measure execution, terminate

any employee of the authority where there is

suspected corrupt and loss confidence there

of;

2. Any employee who has been terminated

from duty in accordance with sub-article

(1) of this article shall not be reinstated

by any court decision.

80. Certificate of Service

When the service of an employee is

terminated by any reason or when he

requires; he shall be provided with a

certificate of service indicating the type,

duration of his service, his salary and the

reason for the termination.

81. አገልግሎት ሲቋረጥ ስለሚፈፀምክፍያ

1 ማንኛቸውም የባለሥልጣኑ ሠራተኛ

በዚህ ደንብ አንቀጽ 77 በቅነሳ

ምክንያት ከሥራ የተሰናበተና የጡረታ

አበል የማይከፈለው ከሆነ:-

ሀ. ለመጀመሪያ አንድ ዓመት የሦስት

ወር ደመወዙ፣

ለ. በተጨማሪ ላገለገለበት እያንዳንዱ

ዓመት የወር ደመወዙ አንድ ሦስተኛ

(1/3ኛ) እየታከለ ይከፈለዋል፤ ሆኖም

የሚሰጠው ክፍያ ከሠራተኛው የxS‰

h#lT ወር ደመወዙ መብለጥ

የለበትም፡፡

2 ከአንድ ዓመት በታች ላገለገለ

የባለሥልጣኑ ሠራተኛ የሚፈፀመው

ክፍያ ከአገልግሎቱ ጋር እየተመዛዘነ

ይታሰባል፡፡

3 አግባብ ባለው የጡረታ ህግ

የተደነገገው እንደተጠበቀ ሆኖ ቋሚ

የመንግሥት ሠራተኛ በሞት

ምክንያት አገልግሎቱ ሲቋረጥ

በህይወት ሳለ ለባለሥልጣኑ በፅሑፍ

ላሳወቃቸው የትዳር ጓደኛው ወይም

በሥሩ ይተዳደሩ ለነበሩ ቤተሰቦቹ

የሦስት ወር ደመወዙ ይከፈላል፡፡

81. Severance Pay

1. Any employee of the authority who has

been retrenched under article 77 of this

regulation and is not entitled to pension

allowance shall be paid;

a) His salary of three months for the

first year of his service; and

b) One-third of his monthly salary for

each additional year of his service

provided; however, the payment

shall not exceed his salary of 12

months.

2. An employee who has served for less

than one year shall be entitled to

severance pay in proportion with his

service;

3. Without prejudice to the provisions of

the relevant pension law, where the

service of a permanent employee is

terminated due to his death, three

months salary shall be paid to his spouse

or dependent families who have been

made known to the authority in writing.

82. አገልግሎትN ስለማራዘም

1 አንድ የባለሥልጣኑ ቋሚ ሠራተኛየመጦሪያ ዕድሜው ከደረሰ በኋላ በአንድጊዜ እስከ ሁለት ዓመት በጠቅላላውከአራት ዓመት ለማይበልጥ ጊዜአገልግሎቱን ማራዘም ይቻላል፡፡

2 በዚህ አንቀጽ ንዑስ አንቀጽ 1 መሠረት

የባለሥልጣኑN ሠራተኛ አገልግሎT

ማራዘም የሚÒለው፣

ሀ. በሠራተኛውትምህርት፣ ልዩ

ዕውቀትና ችሎታ ለመሥሪያ ቤቱ ሥራ

ጠቃሚ ሆኖ ሲገኝ፣

ለ. በደረጃ ዕድገት½ በዝውውር ወይም

በቅጥር ተተኪ ሠራተኛ ለማግኘት

አለመቻሉ ሲረጋገጥ፣

ሐ. ሠራተኛው ለሥራው ብቁ መሆኑ

በሕክምና ማስረጃ ሲረጋገጥ፣

መ. ሠራተኛው አልግሎቱን ለመቀጠል

ሲስማማ፣ እና

ሠ. የአገልግሎቱመራዘም ለባለሥልጣn# êÂ

ÄYÊKtR ቀርቦ ሲፈቀድ ነው፡፡

83. ቅጥር፣ የደረጃ ዕድገት፣ የደመወዝጭማሪና ሌላ ጥቅም መsረዝ የሚያስከትለው ውጤት

1 ቅጥር፣ ዕድገት፣ የደመወዝ ጭማሪ ወይም

ሌላ ጥቅም የተሰረዘበት ሠራተኛ የመሠረዙ

እርምጃ እስከተወሰደበት ጊዜ ድረስ

የተከፈለውን ደመወዝና ሌሎች ጥቅሞች

እንዲመልስ አይጠየቅም፡፡

2 የተሳሳተ ቅጥር፣ የደረጃ ዕድገት፣የደመወዝ ጭማሪ ወይም ሌላ ጥቅምእንዲሰጥ ሆን ብሎ ወይም በቸልተኝነትየፈቀደ የሥራ ኃላፊ ወይም የኮሚቴ አባልአግባብ ባለው የወንጀL ሕግ ድንጋጌመሠረት በወንጀል መቀጣቱእንደተጠበቀ ሆኖ አለአግባብ lወጣውወጪ ተጠያቂ ይሆናል፡፡

82. Extension of Service

1. The service of permanent employee may

be extended beyond his retirement age for

a period of up to two years at a time and

for a period not exceeding four years in

total;

2. The service of an employee may be

extended under sub-article (1) of this

article when:

a) His qualification, special skill and

ability is found to be essential to the

authority;

b) It is proved impossible to replace him

by another employee through

promotion, transfer or recruitment;

c) He is proved fit for the service by

medical certificate;

d) He has agreed to extend his service; and

e) The extension service is approved by

the director general of the authority.

83. Effects of Nullification of Appointment,Promotion, Salary Increment and otherBenefits.

1. An employee whose appointment. Promotion,

salary increment or other benefit has been

nullified, may not be requested to pay the

salary and other benefits he has received up to

the date of nullification;

2. An official or a member of a committeewho is intentionally or negligentlyauthorized unlawful appointment,promotion, salary increment or otherbenefits shall, without prejudice to hiscriminal liability under the relevantprovisions of the penal code, be liable forthe unjustifiable expense thereof.

84. Delegation of Power

The authority may delegate its power and

duty to its main branches and branch offices

when it finds necessary for the efficient and

effective administration of the authority.

Part Fourteen

Miscellaneous Provisions

85. Budget

1. The authority shall be administered by the

budget allocated from the regional state;

2. Without prejudice to sub-article 1 of this

article; revenue derived from donation

and other sources shall apply for the

service of the authority.

86. Book of Account

1. The authority shall keep complete and

accurate book of account;

2. Book of accounts and financial

documents of the authority shall be

audited annually by the auditor-general

of the region or by auditor assigned by

the auditor -general.

87. Other Applicable Laws

The Southern Nations Nationalities and

People’s Regional State Civil Service

Proclamation No 47/2002 shall apply on

matters not covered under this regulation and

directives to be issued thereon.

88. Inapplicable Laws

Any directive or customary practice which is

inconsistent with this regulation shall be

inapplicable on issues covered under this

regulation.

89. Repealed Laws

Regulation No 48/2006 is hereby repealed.

90. Transitory Provisions

1. Appeal cases pending prior to the coming

into force of this regulation shall be heard

in accordance with this regulation;

2. Right acquired by any employee under the

previous provisions shall not be deprived

by this regulation.

91. Power to Issue Directives

The Authority may issue directives for the

implementation of this regulation

92. Effective Date

This regulation shall enter in to force this 8th

day of September 2011.
