COMPANY OVERVIEW - SAFETY Yates’ safety program consistently exceeds national averages for experience modification rates, lost work time, and incidence rates. Our projects vary in size and nature, including vertical and horizontal construction for private and public clients in both the industrial and commercial markets. These projects range in size from several hundred thousand dollars upward to nearly $2 billion. Yates employees unique safety practices and programs that have consistently resulted in incident rates approximately six times lower than the national average, as well as maintaining a low EMR which is currently at 0.54. Using multiple tools such as Behavioral Based Safety (BBS), Safety Task Assessments (STA’s) and Self Assessment Checklists (SAC’s), Yates Construction is committed to providing an environment that motivates employees to perform safely.

Behavioral Based Safety ProgramYates is one of the few contractors that use a formal BBS with thousands of observations performed weekly. BBS is an employee-driven program that is non-punitive. The employees of Yates have embraced and taken ownership of the BBS program, providing management with actual data about the behaviors of individuals. This program enables the employees to provide peer employees with non-threatening, non-punitive feedback, thereby modifying the safety behavior of the individual. The overall outcome of this program is a workforce that operates safely. No single group of individuals is solely responsible for safety; every employee shares this responsibility. Having a good site safety culture and providing a safe workplace for employees are two of the main factors that help to prevent accidents and to increase productivity. BBS has been widely accepted as addressing an important need as part of an organization’s total health, safety, and environmental effort. BBS programs have a proven track record of effectiveness in manufacturing, chemical plants, oil field operations, hospitals, trucking fleets, and construction.

The key principle of BBS is deceptively simple - identify the key behaviors that cause accidents and then reduce them. It involves promoting safe behavior in the workplace by using employee involvement to initially identify practices (behaviors) critical to reducing the risk of injury. When used in conjunction with and integrated into a total safety program, BBS is an effective way to involve employees, to promote teamwork, and to increase morale.

Self Assessment ChecklistThe Self Assessment Checklist is intended to provide a tool by which the individual employee can provide feedback to the Project Management on safety related concerns and observations concerning his/her work area as well as the safety process. It is also intended to be used to provide an employee a check list or guide for them to ensure that they have the proper personal protective equipment necessary for performing an assigned task given to them by the Superintendent or his/her designee. It takes into account that the individual employee may be required to perform multiple tasks during the day, hence the AM, PM, NA check off blocks. It also provides a tool to receive input about the safety process and ideas or comments on improvement.

Additional Training and Safety ProgramsYates implements and executes the following programs:

• Introduced & implemented Click Safety• Behavioral Based Safety Process (BBSP) – An employee-driven safety observation program.• Continuous Improvement Focus• 30 and 10 Hour OSHA Class• New Hire Orientation CD – English and Spanish interactive safety CD.• Weekly Safety Conference Calls and Project Toolbox Safety Meetings (Daily)• Safety and Health Manual• Sites celebrating safety milestones with dinners including employees and their families.• Media Library established – standardized safety training throughout the corporation.• OTI 500 Instructors on staff, CPR / First Aid trainers on staff, • Use of Safety Task Assessments (STA) for pre-work hazard analysis.• Self Assessment Checklist (SAC) used for individual review of safety prep for work.• Mandatory equipment operator qualification required.• Training database established and maintained.• Involved in the Construction Industry Institute “Best Practices.”

Project Specific Safety PlanYates develops a project specific safety plan for each project that includes a dedicated onsite safety team, along with a detailed project safety manual. Safety will be PRIORITY NUMBER ONE for the entire team and will be communicated and enforced through all levels of the project to include the subcontractors, suppliers, and consultants. Our goal will be “ZERO INJURIES” and we will strive to meet that goal every day.

VALUE ADDED SERVICESSelf-Perform CapabilitiesOur team’s direct self-performance construction capabilities greatly increase our ability to meet our client’s goals in terms of cost, schedule, safety and quality. Our capabilities provide our project teams with added control and flexibility in scheduling and installing the work efficiently and safely. Our personnel are experienced and well versed in the knowledge of engineering and construction means and methods, which increases our ability to direct and manage construction activities in the most efficient and cost-effective manner. Yates has significant experience and capability to perform industrial construction in all major disciplines and crafts. Our basic execution approach to any project is to evaluate the local market for qualified local resources that may be able to perform elements of the work more cost effectively. When our evaluation shows this to be true, we will engage with the local market and select the best resources to do the work. We are strategically located throughout the United States and have local knowledge of the workforce and subcontracting community. We will also utilize our knowledge of regionally based contractors for specialty construction when those capabilities are required.

CivilWe perform sitework clearing and grubbing, all types of excavation, underground piping, storm drainage, pile driving, marine site construction, asphalt, roads, and industrial liners. We manage large scale projects, both as Construction Manager and General Contractor, throughout the United States as well as other regions and countries. Our sitework experience includes working with the silty soils of the gulf coast to rocky soils and the heavy dense clays commonly found throughout the South. We have also performed many jobs in alluvial plains and are uniquely familiar with methods and techniques require to work with these soils to mitigate common construction problems and keep projects on schedule.

We understand deep foundation work and have much experience in many systems and options and can be of great assistance in assisting the design team with selecting the most cost effective application for these installations.

Structural Steel InstallationInstallation of structural steel is a specialty that can be performed by our own forces. Pre-installation planning is always emphasized in order to maximize the efficiency of the operation. Qualified personnel, a well-defined layout yard, verification of accurate piece marking and proper placement of the lifting equipment are all areas of concentration and are addressed in depth in our Quality Control and Assurance Procedures.

Page 18: Yates food and beverage4 15 14

Self-Perform CapabilitiesStructural Steel (continued)We successfully perform complicated installations where new multi-level steel structures are tied into existing structures, and free standing new structures as well. Planning must include preplanning for access for installation of the process equipment and coordination with each OEM.

Pipe InstallationQuality piping installation has been a major factor in the success of our company. All types and sizes of pipe have been installed in the field and we have many years of experience in piping installation in industrial plants. Carbon steel, stainless steel, and exotic metals are routinely welded in complex situations, many times under tight schedules or adverse conditions.

Our piping experience includes Ductile Iron, High Density Polyethylene (HDPE), Reinforced Concrete, Carbon Steel, Stainless Steel, PVC, Special alloys and extensive experience in underground and above ground Process and Utility installations of water, sewer, gas, hydraulics, lube oil, chemical and air systems.

Rigging and Equipment SettingWe have extensive rigging and equipment installation self-perform capabilities. Our direct hire labor forces are highly skilled in mechanical equipment installation, including:

• Clean Rooms• Baghouses• Process ductwork• Furnaces• Industrial ventilation and HVAC systems• Process piping• Pressure vessels• Columns• Tanks• Chillers• Towers• Industrial fire protection systems• Production equipment

Detailed and methodical safety planning is a critical component inherent in every segment of equipment placement, especially critical lifts. Safety precautions are always taken into consideration with regard to personnel, the equipment to be lifted, the equipment performing the lift and site conditions.

VALUE ADDED SERVICES

Page 19: Yates food and beverage4 15 14

ON TIME...WITHIN BUDGET...TO YOUR SATISFACTION

Self-Perform CapabilitiesElectricalWe provide full service electrical installation, effectively integrating it with other project activities. This approach eliminates added cost and overlap of responsibilities.

Our construction services and experience range from power and signal wiring systems for power plants to industrial and commercial lighting. Whether high, medium or low voltage systems, owner furnished or contractor furnished, we maintain the same level of precision, quality, cost effectiveness and expert progress tracking. From duct bank installation to installation of switchgear, MCC’s and DCS systems through start-up and testing, we provide skilled, knowledgeable personnel to support the entire project. Our broad experience gives us the flexibility to adapt to different manufacturers’ equipment and specifications without impact to schedule requirements or project standards.

Yates electrical and mechanical divisions self-perform the installation on many projects as well as providing installation services for several major equipment suppliers on select industrial projects.

Instrumentation and Control SystemsOur approach to instrumentation and control systems is different from most other construction companies, in that we perform the work within our electrical group. This results in more efficient integration and reduced overall cost. Using comprehensive in-house tracking systems assures quality and productivity. From the simplest pneumatic system to the most complex electronic digital control system, we have the experience and the expertise to do the job with the highest degree of accuracy and quality. Instrumentation is the brain of any industrial project, whether it’s electrical generation or manufacturing medicines in the pharmaceutical industry. Even computer chip production facilities require the brains of instrumentation, and we have successfully performed it all.

Our experience includes upgrade/conversion projects, which require knowledge of older type systems, as well as grass roots projects with highly sophisticated electronics. We have the capability to complete calibrations and startups in a “HOT” environment, allowing clients to sustain processing profits through procedures we have implemented across the country.

Pre-Engineered Metal BuildingsYates has a pre-engineered metal building division that has a long-term contract with Varco-Pruden Buildings. This allows us to provide metal buildings for large complex projects and gives us a competitive advantage in utilizing pre-engineered metal buildings. We evaluate the utilization of pre-engineered metal buildings on projects when we feel that it can provide some significant savings in both cost and schedule and offer that as a value added option.
