WHAT?
The new Truth in Lending Act/Real Estate Settlement Procedures Act Integrated Disclosure (TRID) rules were effective on October 3, 2015. Many lenders scrambled to master the details of the new disclosures. Construction loans were particularly difficult because of a lack of binding clarification of the requirements. But help has arrived.
On July 28, 2016, the Consumer Financial Protection Bureau (CFPB) published proposed rules to clarify the TRID rules for construction loans. Final rules were
published on July 7, 2017. The final rules are effective on October 10, 2017 and compliance is mandatory on October 1, 2018. While the revisions are available as of October 10, 2017 many of the changes will require system changes that must be completed by the mandatory compliance date.
Prior to TRID many construction loans were exempt from the old disclosure requirements; but TRID clearly expanded the scope of Regulation Z to cover most construction loans.
Initially the CFPB provided few details regarding completion of the Loan Estimate
and the Closing Disclosures for these loans. The 2017 revisions clarify many lingering forms issues. Unfortunately, the regulation still does not contain sample forms for construction loans.
WHY? The program provides an update on regulatory guidance for construction loans. Both the program and the detailed manual provided to attendees are updated for the 2017 revisions. The program explains coverage and exemption rules and provides section-by-section guidance on completing the Loan Estimate and the Closing Disclosure for the most typical construction loan options. Numerous form
samples are provided. The program provides answers for the many questions bankers have regarding the proper disclosure of construction loans.

Jack Holzknecht is the CEO of Compliance Resource, LLC. He has been delivering the word on lending compliance for 41 years. Determining an entity's ability to generate cash flow is essential whenever repayment of a loan will extend beyond one year. Cash flow analysis measures an entity's ability to generate sufficient cash to operate successfully and have excess cash to service annual debt payment requirements. Understanding how to calculate and interpret cash flow is essential for successful
financial institutions. Learn how to calculate cash flow using the Universal Cash Flow Analysis method (UCA), which determines the flow of cash into and out of a business entity. First, we'll define cash flow and identify potential sources and uses of cash. Next we'll illustrate how cash flow analysis is actually the process of converting an Accrual Basis financial statement into a Cash Basis financial
statement. We'll cover the Rules of Cash Flow when determining cash flow generation from changes in asset, liability and capital accounts on balance sheets over time. We'll culminate by using a full UCA from beginning to end. Covered Topics:

Untangling the Web of Fee Disclosures

The CFPB has created a "tangled web" while crafting regulations intended to prevent deception. This webinar will help you untangle the intricacies of numerous fee disclosure requirements.
The proper disclosure of fees on consumer loan transactions has always been
complicated, take for example the multi-page calculation of a finance charge in §1026.4. Fee disclosure has become more complicated over the past few years with the addition and revisions of rules for:
High-Cost Mortgages;
Truth in Lending Act/Real Estate Settlement Procedures Act Integrated Disclosures (TRID);
Ability to Repay/Qualified Mortgage Rules; and
Home Mortgage Disclosure Act/Regulation C.
Please note that the program materials include a list of examples of specific fees outlined in the regulation.
WHY?
Violations of any of the requirements listed above may result in: Regulatory reimbursement;Consumer lawsuits;Regulatory cures;Higher liability from the failure to meet QM standards; andCivil monetary penalties.This program provides the information needed to fully understand the rules and to avoid the liability inducing problems.
Covered Topics:
Upon completion of the program, participants understand that improper fee disclosure may result in violations. In some cases a violation of one section may result in one or more violations of other sections. It is a tangled web. For example:
A violation of the finance charge rules contained in §1026.4 may also cause a violation of the disclosure requirements in §1026.18 or §1026.38 since the finance charge is included in those disclosures;
Improper categorization of fees on the TRID disclosures contained in
§1026.37 and .38 may result in a violation of the tolerance rules contained in §1026.19;
Failure to follow the APR calculation rules contained in §1026.22 may result in:
o The incorrect APR appearing in the disclosures contained in §1026.18, §1026.32, §1026.37 or §1026.38;
o Inadvertently triggering coverage of §1026.32; o An inaccurate calculation of the rate spread disclosed on
the HMDA LAR and used to determine the applicability of the high-cost mortgage loan rules contained in §1026.32 and the higher-priced mortgage loan rules contained in §1026.35; or
o The incorrect disclosure of the HOEPA status disclosed on the HMDA LAR;
o An inaccurate determination of the higher-priced covered transaction status of a loan for purpose of determining which a transaction achieves safe harbor or presumption of compliance status for the ability to repay rules in Section 1026.43;
Failure to properly calculate the total points and fees as prescribed by the high-cost mortgage loan rules contained in §1026.32 can:
o Inadvertently trigger §1026.32 coverage; o Violate the disclosure rules contained in §1026.32; o Result in an incorrect entry on the HMDA LAR; and o Blow the Qualified Mortgage status for purposes of
§1026. 43; or
Failure to follow TRID rules contained in §1026.38 may result in the incorrect disclosure of the total of all itemized amounts that are designated borrower-paid at or before closing on HMDA LAR.

She is a frequent speaker on banking, bankruptcy and financial restructuring related topics and has served as a Chapter 7 Trustee. HMDA 2018 Challenges with Taking Applications Part II – Commercial

Are you prepared for these sweeping changes? HMDA reporters must
follow the new rules for applications when final action is taken on or after January 1, 2018. Many banks do not have a formal “application” form for commercial and agricultural loan requests. While the reporting
process may be more streamlined in the mortgage and consumer area, there will be significant changes for business purpose applications. The “dwelling secured” standard was generally adopted for closed-end
loans and lines of credit for consumers. Business or commercial loans have both the loan purpose test and the dwelling secured test. Business or commercial purpose loans and lines of credit are
reportable only if the purpose of the loan is for home purchase, home improvement, or refinance and the loan is secured by a dwelling.
What type of business purpose loans will be reported? What factors are considered in the purpose test? What if the collateral is a “mixed
use” property? Lenders must request applicants and co-applicants who are “natural persons” to identify their ethnicity, race, and sex; this requirement does not apply to a corporation, partnership, LLC, or
guarantors. Will the data collection forms you are currently using provide all the required fields for the new reporting requirements?
There are approximately 48+ “working days” from this presentation
until January 1, 2018. There are very few parts of the existing rules that will remain unchanged and there are 110 data elements in the new rule. Will you be ready for these extensive changes? Attend this session and learn more about application processing for consumer
loans under the new rules and gain valuable tips that will help your bank prepare for 2018.

Flood Insurance A web-based seminar

Program Content: The flood insurance regulations have been around since 1996, yet examiners continue to cite numerous violations and fines. Flood has been announced as one of the regulators' principal areas of concern. We've also had changes in the law, with the Biggert-Waters Flood Insurance Reform Act of 2012, that has influenced compliance efforts. The NFIP was temporarily extended through the end of this year but there are significant changes coming to the program due to severe financial issues. These changes won’t just change the economics of the program; there will be compliance changes, too. We’re not positive what those will be yet, but there are tea leaves to read.
We'll concentrate on some of the more vexing current issues in flood compliance, such as monitoring, contents coverage, and the ever-present condo problem, by talking through sample scenarios and explaining best practices in keeping your portfolio covered.

Still put a piece of paper into a sleeve and give it to the customer and call it a CD? It might be old fashioned but many institutions still handle nonnegotiable CDs much like they handled the negotiable instrument of days gone by. As we transition from the traditional Certificates that are negotiable to the signature card contract certificates of deposit, what rules apply and what do not anymore?
Let's look at the procedures which might not make sense anymore such as Loss of CD Affidavits. It might mean that you need signatures of all parties and not just the one opening the account. Old school might not work in today's legal and regulatory environment. Let's look at our CD rules, procedures and ownership issues that may need to be revamped.

During the next twenty years he would further this career and gain valuable experience in administering all areas of security for financial institutions while serving as: director of security and facilities, regional security officer, and corporate security director. His analytical thinking and thoroughness have been tremendously beneficial in writing policy and procedure, developing business continuity plans, and creating training programs. His dual careers have also provided much insight and experience into the world of fraud, embezzlement, and ethics investigations. He has honed his skills in risk assessment and mitigation, designed and implemented a fraud awareness and incentive program for tellers, and been recognized for his robbery awareness and prevention programs. Most recently, he has been involved in the pursuit of ATM skimmers and the efforts to stay one step ahead of them. He routinely collaborates with many local, state and government entities including the Department of Homeland Security, U.S. Secret Service Electronic Crimes Task
Force, and the Federal Bureau of Investigation.
