PRESS RELEASE – 21 February 2013

CROWN PROSECUTION SERVICE REPEATEDLY PREVENT PROSECUTION OF POLICE

There have been relatively few if any private Criminal Prosecutions of Police officers in history. Michael Doherty of JusticeNOW has commenced two such criminal prosecutions of Metropolitan Police officers, both of which the CPS have sought to take over and stop. The first prosecution relates to the serious charge of ‘Perverting the course of Justice’ for false allegations made by TRACEY MURPHY of Hillingdon Police. This matter is currently stayed in Luton Crown court pending a High court review of the attempt by the CPS to stop the prosecution continuing. In this case a Crown Court Judge has spoken of the ‘compelling inconsistencies’ in the allegations made by the police member of staff Ms Murphy. The Crown court judge had confirmed the matter ought to proceed to trial, yet still the CPS tried to intervene. The second prosecution relates to Sergeant Blackburn & Detective MacDonald for the charges of Kidnap, False imprisonment, Assault ABH, Affray & Misconduct in public office. This case is currently before Southwark Crown court. Once again, despite a QC Barrister endorsing the prosecution as having reasonable prospects of conviction, the CPS have once again sought to stop the prosecution of these police officers. They claim in the most disingenuous manner that there is insufficient evidence to achieve a realistic prospect of conviction. There is no question that the CPS are embarking on a pattern of conduct which illustrates a corrupt propensity to protect officers from scrutiny of their conduct in the criminal courts. Both cases are strong in evidential material, yet the CPS is content to abuse the powers entrusted to it and exercise them in an arbitrary and dishonest fashion.
